Roll Call.A roll call vote was taken and the following Council members were present:Don Bailey,JI.,Nick Gruber,Monica Lihs,Dan Lugar and Terry Strain. Open Forum.None. Agenda AdditionslDeletions.Delete item #14 -Library Report. Motion by Councilman Strain,seconded by Councilman Lugar,to approve the agenda deleting item #14 -Library Report.The Mayor asked for a voice vote.Motion carried 5 to O. Consent Agenda.B)Salary and Bill Presentation -$110,236.50;C)Appointment ofMPO Representative. Motion by Councilman Gruber,seconded by Councihnan Bailey the consent agenda appointing Kurt Rueckel and John Wesselmarm to be the MPO Representatives.The Mayor asked for a roll call vote:Ayes:Gruber,Bailey,Lugar,Strain and Lihs.Nays:None.Motion carried 5 to O. Licensing of Waste Haulers Ordinance 213 -2nd reading.Motion by Councilman Bailey, seconded by Councilman Lugar to have "AN ORDINANCE DELETING CHAPTER 213 OF THE MUNIClP AL CODE OF THE CITY OF WAUKEE,AND ENACTING IN LIEU THEREOF AN ORDINANCE PROVIDING FOR THE REGULATION AND LICENSING OF COMMERCIAL HAULERS OF REFUSE IN THE CITY OF WAUKEE,AND PROVIDING FOR PENALTIES FOR VIOLATIONS THEREOF",read for the 2nd time in title only.The Mayor asked for a roll call vote:Ayes:Bailey,Lugar,Lihs,Strain and Gruber.Nays:None. Motion carried 5 to O. Recycling at Apartments and Mobile Home Ordinance 213A -3rd reading.Motion by Councilman Gruber,seconded by Councilman Bailey,to have "AN ORDINANCE AMENDING CHAPTER2l3A"read for the 3rd time in title only.The Mayor asked for a roll call vote:Ayes: Gruber,Bailey and Lugar.Nays:Lihs and Strain.Motion carried 3 to 2. Motion by Councilman Gruber,seconded by Bailey,to put Ordinance #2210 "AN ORDINANCE AMENDING CHAPTER 213A OF THE MUNICIPAL CODE OF THE CITY OF WAUKEE, PROVIDING FOR THE ASSESSING OF FEES OR CHARGES FOR THE COLLECTION, PROCESSING AND MARKETING OF SOLID WASTE AND RECYCLABLE MATERIALS WITHIN THE CITY LIMITS OF THE CITY OF WAUKEE,lOW A,BY AMENDING 4 SECTION 213.A ©THEREOF TO INCLUDE MOBILE HOME PARKS WITH MULTI- F AMIL Y DWELLINGS CONTAINING FOUR (4)OR MORE UNITS HAVING A COMMERCIAL TYPE OF CONTAINER THAT MAYBE MECHANICALLY EMPTIED", put on final passage.The Mayor asked for a roll call vote:Ayes:Gruber,Bailey and Lugar. Nays:Lihs and Strain.Motion carried 3 to 2.The Mayor declared Ordinance #2210 duly adopted and put on final passage. ) Mandatory Recycling at Multifamily Dwellings and Mobile Home Parks -213B -3rd Reading.Motion by Councilman Gruber,seconded by Councilman Bailey,to have Ordinance 213B read for the 3rd time in title only.The Mayor asked for a roll call vote:Ayes:Gruber, Bailey and Lugar.Nays:Lihs and Strain.Motion carried 3 to 2. Motion by Councilman Bailey,seconded by Councilman Lugar to put Ordinance #2211 "AN ORDINANCE PROVIDING FOR MANDATING RECYCLING PROGRAMS AT MULTI- FAMILY DWELLINGS OF FOUR OR MORE UNITS AND MOBILE HOME PARKS WITHIN THE CITY OF WAUKEE AND ESTABLISHING PENAL TIES FOR VIOLATIONS BY DELETING CHAPTER 213B,WAUKEE MUNICIPAL CODE,AND ADOPTING IN LIEU THEREOF",on final passage.The Mayor asked for a roll call vote:Ayes:Bailey,Lugar and Gruber.Nays:Lihs and Strain.Motion carried 3 to 2.The Mayor declared Ordinance #2211 duly passed and adopted. Mobile Home -Resetting.The Council discussed the existing problems with some ofthe mobile homes that were not set properly within the last couple of years.The discussion mainly revolved around the preparation of the ground,setting of the homes and the issuing ofperrnits.I Motion by Councilwoman Lihs,seconded by Councilman Strain,to have the Building Inspectors order the Mobile Home Park owners to prepare the ground properly to meet the City Code and the Manufacturer's recommendation or the most restrictive.Councilwoman withdrew her motion. Motion by Councilwoman Lihs,seconded by Councilman Strain,to have The Building Inspectors inspect Lot 840 and to report to the Council at the December 18th meeting his findings to whether the ground preparations was adequate to meet the specifications of the state code;whether the setting of the mobile home was adequate to meet the specifications of the state code and if the method proposed to reset the home by the Mobile Home Park would meet the various City Codes.The Mayor asked for a roll call vote:Ayes:Lihs,Strain,Lugar,Gruber and Bailey.Nays:None.Motion carried 5 to O. The Council asked Kurt Rueckel to direct the Building Inspector to get the inspections done on the mobile homes that have been reset and report back to the Council at the December 18th meeting. Mayor's Report.I5 The Mayor would like the Board of Adjustment openings extended to the people that ran for the Council vacancies. The Mayor briefly discussed the street lighting along Warrior Lane. Gas Main Break -the bills accumulated from the gas main break will be submitted to Murphy Brothers for payment.Murphy Brothers has acknowledged responsibility for the break by letter to John Wesse1marm,Public Works Director. Street breakup in Westfield -The Public Works department have video tape of the problem areas and is in the process of making a list.This list will be submitted to V &K to get the estimated cost of the repairs. The Mayor received a letter from Deb Snyder stating she would not be able to attend the meeting in regard to the REAP Grant. Attorney's Report. A)Landfill and B)Annexation delayed until later in the meeting. C)REAP Grant -Paul Huscher,City Attorney,reported that a copy of the lease agreement has been sent to the Department of Natural Resources but has not received the lease agreement back. Library Report.Deleted. Parks Committee Report.Councilwoman Lihs reported to the Council the activities of the Parks Committee. Harma Weil -expressed her concern about the City's ability to afford all the little parks in town. Harmah thought it would be better to put the City's park money into the Centennial Park. Planning and Zoning Report.Councilman Strain presented the Council with a written report. Motion by Councilman Strain,seconded by Councilman Lugar,to approve the Planning and Zoning Commission report.The Mayor asked for a voice vote.Motion carried 5 to O. 13B -Annexation -Paul Huscher,City Attorney,updated the Council on the armexation. 13A -Landfill.Motion by Councilwoman Lihs,seconded by Councilman Bailey,to enter into closed session pursuant to the Iowa Code Section 21.51 ©"To discuss strategy with Counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation". The Mayor asked for a roll call vote:Ayes:Lihs,Bailey,Lugar,Gruber and Strain.Nays:None. 6 Motion carried 5 to O.ITheCouncilenteredclosedsessionat9:37pm. The Council came out of closed session at 9:46pm Motion to adjourn by Councilman Bailey,seconded by Councihnan Gruber at 9:47pm.Upon a voice vote the motion was passed 5 to O.
