HomeMy WebLinkAbout1996-01-22-Regular MinutesThe January 22nd,1996 Waukee City Council meeting was called to order at 7:01 pm by Mayor Donald L.Bailey,Jr.,with Toni Lestina taking minutes.IRollCall-A roll call vote was taken and the following Council members were present:Nick Gruber,Robyn S.Heath,Monica Lihs,Dan Lugar and Terry Strain. Open Forum -Mayor Bailey thanked the Waukee Rescue and city stafffor their efforts during the snow storm on January 18th. Councilman Strain informed the Mayor and Council that the City of Altoona is hiring a Building .Inspector and would consider dividing his time and salary with another city. Agenda Additions -Councilwoman Lihs would like to add Committee Assignments as 15A; and Kurt requested Attorney's Report be added as 16A. Motion by Councihnan Strain,seconded by Councilwoman Lihs,to approve the agenda with the additions.The Mayor asked for a roll call vote:Ayes:Strain,Lihs,Lugar,Heath and Gruber. The City's long range plans have this area designated for industrial use while the County's plans call for residential use. Donna Stall,Iowa Realty,explained to the Council that Lot I has already been approved by the County,but they would like to divide the property into 3 lots. Kurt Rueckel and John Kursitis explained the conflict this would have with the current comprehensive plan. Motion by Councilman Gruber,seconded by Councilman Strain,to table until the February 5th Council meeting,giving the Planning &Zoning Commission time to meet with theCounty and Council regarding this item.The Mayor asked for a roll call vote:Ayes:Gruber,Strain,Lihs, Lugar and Heath.Nays:None.Motion carried 5 to O. Licensing of Waste Haulers -3rd Reading.Kurt Rueckel explained to the Mayor and Council that Mark Currie suggested that a $1,000,000 umbrella was sufficient and it was not necessary for the City to be named as an additional named insured,unless the City had a contract with the earner. Motion by Councilman Gruber,seconded by Councihnan Lugar,to put an ordinance licensing of Waste Haulers on the third and final reading with the changes to the insurance limits.The Mayor asked for a roll call vote:Ayes:Gruber,Lugar,and Heath.Nays:Strain and Lihs.Motion carried 3 to 2.The clerk read the ordinance.Councilman Strain stated that he did not think it was fair to require different insurance limits for our waste hauler we contract with than haulers we are licensing. Motion by Councilman Gruber,seconded by Councihnan Lugar,to put Ordinance 2212 on its final passage.The Mayor asked for a roll call vote:Ayes:Gruber,Lugar and Heath.Nays: 4 Strain and Lihs.Motion carried 3 to 2. The Mayor declared Ordinance 2212 duly adopted and passed. ORDINANCE NO.2212 AN ORDINANCE DELETING CHAPTER 213 OF THE MUNICIPAL CODE OF THE CITY OF WAUKEE,AND ENACTING IN LIEU THEREOF AN ORDINANCE PROVIDING FOR THE REGULATION AND LICENSING OF COMMERCIAL HAULERS OF REFUSE IN THE CITY OF WAUKEE,AND PROVIDING FOR PENALTIES FOR VIOLATIONS THEREOF.See "ordinance book". Resetting of Mobile Homes -At the December 18th Council meeting Mayor Chedester made a verbal of veto the motion Councilman Lugar made pertaining to the resetting of mobile homes. The veto was not received in writing within 14 days and was deleted from the record.The motion carried 3 to 1. Mr.Chedester explained to the Council he had left the veto in written form on the council table. After a discussion,motion by Councilman Strain,seconded by Councilman Lugar,to direct Kurt to send all residents on the list,the December 18th letter from JBM Engineers and have the residents notify the City within 30 days how they plan to resolve the problems with their home(s).The Mayor asked for a roll call vote:Ayes:Strain,Lugar,Lihs,Heath and Gruber. Nays:None.Motion carried 5 to O. Review Outside of City Limits -The City currently has on file with the County an Ordinance which gives the City the right to review subdivisions outside the city limits,however,that ordinance refers to an old Section number of the Code ofIowa. Motion by Councilwoman Lihs,to introduce "AN ORDINANCE TO AMEND CHAPTER 303, ARTICLE II,SECTION 303.2,LAND SUBDIVISION REGULATIONS,WAUKEE MUNICIPAL CODE,BY DELETING THEREFROM "SECTION 409.14,"AND INSERTING IN LIEU THEREOF SECTION 354.9." Motion by Councilwoman Lihs,seconded by Councilman Lugar,to have the City Clerk read the ordinance for the first time.The Mayor asked for a roll call vote:Ayes:Lihs,Lugar;Heath, Strain and Gruber.Nays:None.Motion carried 5 to O. Motion by Councilwoman Lihs,seconded by Councilman Strain,to waive the second and third readings.The Mayor asked for a roll call vote:Ayes:Lihs,Strain,Gruber,Heath and Lugar. Nays:None.Motion carried 5 to O.The Mayor declared the Ordinance duly adopted and passed. 5 IUtilityReconnectionFeePolicy-the City has an average of 150 customers per month who pay after the due date.From there,an average 40 customers are physically posted with a shut-off notice.The City goes door to door and posts a disconnect notice along with a Customer Rights and Remedies letter.By 12:00 noon the following day usually all but two or three customers have paid. Motion by Councilman Gruber,seconded by Councilman Strain,to pass Resolution 96-6 stating if the customers does not pay by 12:00 noon the shut-off fee will be charged.The Mayor asked for a roll call vote:Ayes:Gruber,Strain,Heath,Lihs and Lugar.Nays:None.Motion carried 5 to O. RESOLUTION 96-6 A RESOLUTION SETTING A POLICY WHEN RECONNECTION CHARGES ARE TO BE IMPOSED WHEREAS,the City Council of the City of Waukee has established fees for the reconnection of water and gas service;and WHEREAS,customers of the City occasionally do not pay by the date due,thus receiving a shut off notice which is posted on the service location,said posting which requires payment by 12:00 noon the following day; WHEREAS,customers of the city occasionally do pay by this deadline stated in the posting; NOW THEREFORE BE IT RESOLVED,that said reconnection fees shall be charged if payment is not received by 12:00 noon on the due date,regardless of said services having been shut off or not,and if payment on the past due bill is received before the service(s)are actually shut off,the disconnection shall continue,unless and until said connection fees are paid as well. PASSED THIS TWENTY-SECOND DAY OF JANUARY,1996. ~~ ATTEST: CITY CLERK Permission To Seek Bids -Liability Insurance -Kurt Rueckel asked the Council for permission to seek bids for liability insurance.The City receives fairly good rates as a member of the Iowa Communities Assurance Pool,but every now and then it is wise to check rates. Motion by Councilman Lugar,seconded by Councilwoman Lihs,to direct Kurt to draw up 6 specifications and seek bids for liability insurance.The Mayor asked for a roll call vote:Ayes: Lugar,Lihs,Strain,Gruber and Heath.Nays:None.Motion carried 5 to O.ISolidWasteFees-Free Brush Pickup -Organic Technologies has proposed charging a fee of $0.65 per month for which they will collect brush,tree limbs,Christmas trees,cut up trees,etc for free.These would still need to be bundled,but no Organic Technologies bag would be necessary.This would cost each customer $7.80 per year,about the cost of 10 bags. The Utility Committee rejected this proposal. Motion by Councilwoman Lihs,seconded by Councilman Lugar,to reject this proposal as recommended by the Utility Committee.The Mayor asked for a roll call vote:Ayes:Lihs, Lugar,Strain,Heath and Gruber.Nays:None.Motion carried 5 to O. 1996 Street Programs -This item has been discussed on a number of occasions,the question mainly being to do these projects with special assessment or not. The main street projects to consider are 2nd Street,3rd Street intersections,5th Street North of Ashworth.Others to consider are Northview east of 4th Street,1st Street,Cherry east of 6th Street,and Manor Drive near Southfork. The City will need to have plans drawn up for some or all of these projects.In the interim the city can decide whether or not some or all of these projects should be done through special assessment. Robyn Heath,Terry Strain and John Wesselmann will schedule a meeting time to drive around the city to inspect the streets and assess the trouble areas. Table this item until the February 5th Council meeting. Mayor's Report -Mayor Bailey reported to the Council he taught three Government Classes and attended all the Committee meeting this month. Mayor Bailey appoint Karmin Wilson to the Parks Committee and appoint Monica Lihs to the Southfork Committee as Council representative. Parks Committee Report -Lihs -Councilwoman Lihs briefly review the written Parks Committee Report. Attorney's Report -Paul Huscher,City Attorney,has reviewed the Zoning Ordinances and handed out the new Subdivision Ordinance to be reviewed by the Mayor,Council and Administrator.I 7 Paul will have the changes in the platting procedures ready for review at the February Sth Council meeting. Paul would recommend a checklist for the Planning &Zoning Commission to use when recommending a plat to the Council with the following items:Grade Ordinance;Fire Hydrant placement;stop sign placement;sidewalks;street light placement;perimeter lighting,fire siren place;etc.If the checklist is used by the council it will save them a lot of time. Councilman Lugar recommended Kurt Rueckel and John Kursitis to create the new checklist. Annexation -It will be several months before a decision is handed down pertaining to the appeal. Annexation -Closed Session -Motion by Councilman Lugar,seconded by Councilwoman Heath,to enter into closed session pursuant to the Iowa Code Section 21.5 (1)(C )"To discuss strategy with Counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the govemmental body in that litigation".The Mayor asked for a roll call vote:Ayes:Lugar,Heath, Lihs,Strain and Gruber.Nays:None.Motion carried S to O. The Council entered into closed session at 9:36pm. The Council came out of closed session at IO:24pm. Motion to adjourn at 10:24pm by Councilman Gruber,seconded by Councilman Strain.Upon voice vote the motion passed S to O. Attest: 8
