HomeMy WebLinkAbout1996-03-04-Regular MinutesThe March 4,1996 Waukee City Council meeting was called to order at 7:00pm by Mayor Donald L.Bailey,Jr.,with Toni Lestina taking minutes. Roll Call.A roll call vote was taken and the following Council members were present:Nick Gruber,Robyn Heath,Monica Lihs,and Dan Lugar.Absent:Terry Strain. Open Forum. Val Bilbrey,ICAP,gave the Council written information and briefly discussed the workings of ICAP.Mark Currie will be at the March l Sth meeting to give the Council figures for insurance coverage. Phil Kausalik asked the Mayor and Council when the paving of Laurel Street would be taking place.Kurt explained from his understanding,the paving would be done as soon as the weather is above freezing and stays above freezing for several days. Agenda Additious -Approval.C)Hometown Cafe and Lounge Liquor License Renewal - delete. Motion by Councilman Gruber,seconded by Councilwoman Lihs,to approve the agenda with the deletion of 5C -Hometown Cafe Liquor License Renewal.The Mayor asked for a voice vote.Motion carried. High School Site Plan.Rich Gardner presented the High School Site Plan to the Mayor and Council explaining the different phases of development.The School District would like to have a temporary exemption from having a hard surfaced parking lot,possibly postpone the construction of the bike path,and be able to construct the school up to 50 feet in height. Motion by Councilman Lugar,seconded by Councilman Gruber,to allow the School to be constructed as proposed,but not to exceed 50 get in height,that the pedestrian path be connected to the Windfield Subdivision as the different phases of the Subdivision are completed,and to allow gravel parking instead of asphalt,if needed due if the bids come in too high,but that the parking lots be hard surfaced within five (5)years or before the High School is expanded.The Mayor asked for a roll call vote:Ayes:Lugar,Gruber,Heath and Lihs.Nays:None.Motion carried 4 to O. Rezoning of Lots 1-7 Sunrise Meadows.Motion by Councilman Gruber,seconded by Councilwoman Lihs,to have the second reading in title only.The Mayor asked for a roll call vote:Ayes:Gruber,Lihs,Heath and Lugar.Nays:None.Motion carried 4 to O. Motion by Councilman Gruber,seconded by Councilwoman Lihs,to have the third reading in title only.The Mayor asked for a roll call vote:Ayes:Gruber,Lihs,Lugar and Heath.Nays: None.Motion carried 4 to O. The Mayor declared Ordinance No.2214 duly adopted and passed. 3 I ORDINANCE NO.2214 AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE, ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY RE-ZONING AND CHANGING CERTAIN PROPERTY THEREIN FROM R-2 (ONE AND TWO FAMILY RESIDENTIAL DISTRICT)TO R-4 (ROW DWELLING AND CONDOMINIUM DWELLING DISTRICT)AND AMENDING THE OFFICIAL ZONING MAP TO SHOW RE-ZONING. BE IT ORDAINED by the Council of the City of Waukee: Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City,adopting the Official Zoning Map,is hereby amended by changing the following described real estate from R-2 (One and Two Family Residential District)to R-4 (Row Dwelling and Condominium Dwelling District);and that the Official Zoning Map be made to reflect such amendment: Lots 1-7 in the Subdivision officially know as Sunrise Meadows in the City of Waukee,Dallas County,Iowa. Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3.Severability Clause.If any section,provision or part of this ordiuance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 4.Effective Date.This ordinance shall be in effect upon its final passage, approval and publication provided by law. Passed by the City Council of the City of Waukee,this 4th day of March,1996,and approved this 4th day of March,1996. Rezoning of Westgate Townhomes.In the fall of 1994,the City rezoned the property in the northwest corner of the Westgate property for townhomes.The developers later amended the area to be rezoned but due to the transition in the administration during that time,it never was completed. Motion by Councilman Gruber to introduce "AN ORDINANCE TO AMEND CHAPTER 301, WAUKEE MUNICIPAL CODE,ZONING ORDINANCE OF THE CITY OF WAUKEE, IOWA,BY RE-ZONING AND CHANGING CERTAIN PROPERTY THEREIN FROM R-2 (ONE AND TWO FAMILY RESIDENTIAL DISTRICT)TO R-4 (ROW DWELLING AND CONDOMINIUM DWELLING DISTRICT)AND AMENDING THE OFFICIAL ZONING MAP TO SHOW RE-ZONING". 4 Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to have the ordinance read for the first time in title only.The Mayor asked for a roll call vote:Ayes:Lihs,Heath,Gruber and Lugar.Nays:None.Motion carried 4 to O.J Proposed Operating Budget -Public Hearing.Motion by Councilman Gruber,seconded by Councilman Lugar,to accept the Operating Budget and have it filed with the County.The Mayor asked for a roll call vote:Ayes:Gruber,Lugar,Lihs and Heath.Nays:None.Motion carried 4 to O. 28E Agreement -Fire District.Kurt Rueckel,Brad Curtis and the three Townships have met regarding the funding requests for fire protection and emergency medical services. Motion by Councilwoman Lihs,seconded by Councilman Lugar,to accept the 28E Agreement with Walnut Township.The Mayor asked for a roll call vote:Ayes:Lihs,Lugar,Heath and Gruber.Nays:None.Motion carried 4 to O. Motion by Councilwoman Lihs,seconded by Councilman Lugar,to accept the 28E Agreement with Boone Township.The Mayor asked for a roll call vote:Ayes:Lihs,Lugar,Heath and Gruber.Nays:None.Motion carried 4 to O.I Mobile Home Park Ordinance.The existing ordinances state that the set backs of mobile homes can not differ by more than one or two feet.Double wide homes must be set much further than the single wide homes therefore,a double wide cannot be set next to a single wide.In at least one instance there is a empty lot on one side of which there is a home set back twenty-seven feet and on the other side twenty feet,making the use of this lot impossible under the current ordinance.The current ordinance does not mention the old section of the park and what to do if a home is taken out and they want to put one the same size back in its place. Motion by Councilwoman Lihs,seconded by Councilman Lugar,to table until the March 18th meeting and have Kurt give the Council more information.The Mayor asked for a roll call vote: Ayes:Lihs,Lugar,Heath and Gruber.Nays:None.Motion carried 4 to O. Mayor's Report.The Mayor updated the Council on the following items:A)County Budget meeting at 4:30pm Tuesday,March 5th;B)Monday,March 11th,a Special Council meeting for the Street Projects;C)Centennial Park Clean-up is April 20th and the City needs volunteers;and D)Mike Lake,Business Association,is looking into organizing a Farmer's Market to be at the triangle on Saturday mornings. Planning &Zoning Report.A written report was handed out and Councilwoman Heath briefly I5 discussed the report. Library Report.The Council received a written report. Attorney's Report.Paul Huscher,City Attorney,had nothing to report. Administrator's Report. Motion by Councilwoman Lihs,seconded by Councilman Lugar,to accept the Mayor's Report; the Planning &Zoning Report;and the Administrator's Report.The Mayor asked for a roll call vote:Ayes:Lihs,Lugar,Gruber and Heath.Nays:None.Motion carried 4 to O.
