Roll Call.A roll call vote was taken and the following Council members were present:Nick Gruber,Robyn Heath,Monica Lihs,Dan Lugar and Terry Strain. Open Forum.None. Agenda Additions -Agenda Approval.Add #8A -Meadowland Townhomes and move item #17 up on the agenda. Motion by Councilwoman Lihs,seconded by Councihnan Lugar,to approve the agenda with the addition of item 8A -Meadowland Townhomes.The Mayor asked for a voice vote.Motion carried. CITIZEN OF THE YEAR.Mayor Bailey formal announced Pastor Roger Schlaefer as the Citizen of the Year.A reception in honor of Pastor Roger Schlaefer will be held at the Waukee Public Library Community Room at 7pm on Monday,April 22nd. University Trunk Sewer.Kurt Rueckel updated the Council regarding the University Truuk Sewer Project.I4 Motion by Councilman Gruber,seconded by Councilman Lugar,directing Kurt Rueckel to work with the School Board,the Developers,and Landowners on the finances of the University Trunk Sewer Project.The Mayor asked for a roll call vote:Ayes:Gruber,Lugar,Strain,Lihs,and Heath.Nays:None.Motion carried 5 to O. Hickman Trunk Sewer -Phase I Acceptance.Last fall,the City started the Hickman Trunk Sewer Project from just west of Warrior Lane to east of Alice's Road.The first phase of the project has been completed and has been inspected and approved by Veenstra &Kimm. Motion carried 5 to O. 5 RESOLUTION 96-09 RESOLUTION ACCEPTING A PORTION OF THE HICKMAN ROAD SANITARY TRUNK SEWER IN THE CITY OF WAUKEE,DALLAS COUNTY,IOWA WHEREAS,a portion of the Hickman Trunk Sanitary Sewer has been installed by private developers along Highway 6,commonly known as Hickman Road; WHEREAS,this portion of the Sewer has been inspected by the City Engineer and has been found to be acceptable to the City; WHEREAS,a 50 foot wide perpetual sanitary sewer easement has been granted to and accepted by the City of Waukee; NOW,THEREFORE,be it resolved that the following portion of the Hickman Trunk Sewer is hereby accepted by the City of Waukee on this 1st day of April,1996. Hickman Trunk Sanitary Sewer Phase II between 0+00 and 27+58.12. Fire Department Air Packs.Motion by Councilman Lugar,seconded by Councilman Strain,to give Don Henson,Fire Chief,permission to purchase 2 new air packs from Toyne's for 1 $3,390.00.Toyne's is the only dealer in Iowa.The Mayor asked for a roll call vote:Ayes: Lugar,Strain,Heath,Lihs,and Gruber.Nays:None.Motion carried 5 to O. Mobile Home Park Ordinance -Set Back and Rear Yards.A meeting with representatives of the Mobile Home Park including Stephanie Brick,Jim Colin,Jerry McFall,Tom Davis,and Richard Hanson,Dynamic Homes was held to discuss the an Ordinance involving the set back of the mobile homes and the rear yard separations. Motion by Councilman Lugar to introduce the Ordinance No.2216. Motion by Councilman Strain,seconded by Councilman Lugar,to have the first reading of the following Ordinance in title only.The Mayor asked for a roll call vote:Ayes:Strain,Lugar, Heath,and Gruber.Nays:Lihs.Motion carried 4 to 1. ORDINANCE NO. AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE, ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY AMENDING SECTION 301.15(E)(4),"R-6"MOBILE HOME,TO PROVIDE FOR MINIMUM SEPARATION OF MOBILE HOMES AND OTHER BUILDINGS AND STRUCTURES.I6 BE IT ORDAINED by the Council ofthe City of Waukee: r Section 1.Section 39 l.l6(E)(4)of Chapter 301,Waukee Municipal Code,Zoning Ordinance of the city,is hereby amended by deleting said subparagraph,and inserting in lieu thereof the following: 4.Each lot shall have a front yard not less than fifteen (15)feet in depth measured from the edge of the surfaced private street to the mobile home.Side yards shall be maintained to provide a minimum separation between mobile homes of at least ten (10)feet;and a minimum separation of at least six (6)feet shall be maintained between mobile homes and any other buildings or structures on the same or adjoining lots.Rear yard separations shall be maintained so as to provide separation of mobile homes of at least sixteen (16)feet from any gas main. Except as otherwise provided herein,measurements to the mobile homes shall be taken from the closest point between the paved portion of the street and/or the closest point of the mobile homes at ground level,provided that any overhang or extension shall extend out from the mobile home by no more than two (2)feet. The provisions of this Ordinance shall apply to any mobile home placed in a mobile home development from and after the effective date of this Ordinance. The sixteen (16)foot rear yard separation requirement shall not apply to any mobile home park developments approved and completed prior to November 1, 1993,provided that any mobile homes placed in any such developments from and after the effective date ofthis Ordinance shall have the nearest point of the mobile home at least two (2)feet from any gas main and have a rear yard separation of at least ten (10)feet. Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 4.Effective Date.This ordinance shall be in effect upon its final passage, approval and publication as provided by law. Meadowland Townhomes -Plat 1.Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to pass Resolution No.96-10 accepting the final plat of Meadowland Townhomes Plat I -a Subdivision of the City of Waukee,in Dallas County,Iowa.The Mayor asked for a roll call vote:Ayes:Lihs,Heath,Gruber,Strain,and Lugar.Nays:None.Motion carried 5 to O. 7 RESOLUTION NO.96-10 RESOLUTION ACCEPTING THE FINAL PLAT OF MEADOWLAND TOWNHOMES PLAT 1 -SUBDIVISION OF THE CITY OF WAUKEE,IN DALLAS COUNTY,IOWA WHEREAS,Downing Development,LTD.has presented the Final Plat of Meadowland Townhomes -Plat 1,and the Waukee Planning and Zoning Commission approved this Final Plat on February 27,1996;and WHEREAS,the City Council has found this subdivision to be in conformance with its comprehensive plan;and WHEREAS,the City Council has found that the final plat has met the requirements under section 354.8 of the Code ofIowa;and WHEREAS,a letter has been submitted dedicating a parcel ofland for park dedication as per the requirements of the City's Subdivision Ordinance. NOW,THEREFORE,be it resolved that the Final Plat for Meadowland Townhomes -Plat 1 is hereby approved on this first day of April,1996. EAP Contract.Carol Clift,EAP representative,explained their services to the Mayor and Council.Councilman Strain asked Carol how many times in the last year did the city employees use the EAP service?At the current time the EAP service is being utilized but the service was not used at all in the last year. Motion by Councilwoman Lihs,seconded by Councilman Strain,to table until later in meeting. The Mayor asked for a voice vote.Motion carried. Special Assessment Policy.Motion by Councilman Lugar,seconded by Councilman Gruber,to table until after the 1996 Street Projects Work Session.The Mayor asked for a roll call vote: Ayes:Lugar,Gruber,Lihs,Strain,and Heath.Nays:None.Motion carried 5 to O. Ordinance Limiting Gas with-in City Limits.Motion by Councilman Gruber to introduce an Ordinance prohibiting any other corporation,firm,person,or entity other than the City,from constructing,installing,or maintaining any gas main,yard line,consuming gas piping,etc,in the City of Waukee. Motion by Councilwoman Lihs,seconded by Councilman Gruber,to have the Clerk read the ordinance in title only.The Mayor asked for a roll call vote:Ayes:Lihs,Gruber,Heath,Strain, and Lugar.Nays:None.Motion carried 5 to O.The Ordinance is as following:I 8 i---- , Ordinance No. AN ORDINANCE TO AMEND CHAPTER 201,WAUKEE GAS BUlLDING CODE, OF THE CITY OF WAUKEE,IOWA,BY AMENDING SECTION 201.2,TO PROHIBIT CONSTRUCTION OF GAS MAINS,YARD LINES,OR CONSUMER'S GAS PIPING OR MOVEMENT OF NATURAL GAS THROUGH ANY CONDUlT BY ANY GAS DISTRIBUTION SYSTEM OR GAS COMPANY OTHER THAN THE WAUKEE MUNICIPAL GAS SYSTEM OR ITS CUSTOMERS WITHIN THE CITY LIMITS OF THE CITY OF WAUKEE,IOWA. BE IT ORDAINED by the Council of the City of Waukee: Section 1.Section 201.2 of Chapter 201,Waukee Gas Building Code of the City,is hereby amended by adding thereto the following: No person,firm,corporation,or other entity than the Waukee Municipal Gas System of the City of Waukee or its customers shall install,construct,or maintain any gas main,yard line,consumer's gas piping,or gas distribution system,or cause movement of natural gas through any conduit within the city limits of the City of Waukee,Iowa. Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Approval of Community Builder Program.Motion by Councilman Lugar,seconded by Councilwoman Lihs,to adopt Resolution No.96-11.The Mayor asked for a roll call vote:Ayes: Lugar,Lihs,Strain,Heath and Gruber.Nays:None.Motion carried 5 to O. RESOLUTION NO.96-11 A RESOLUTION ADOPTING THE COMMUNITY BUlLDER PROGRAM IN THE CITY OF WAUKEE,IOWA WHEREAS,the City Council of the City of Waukee has applied for and received RISE monies for the Alice's Road project;and 9 WHEREAS,the City has also adopted its comprehensive plan,in 1992;and WHEREAS,the comprehensive plan is considered to be part of the Community Builder Program;and WHEREAS,this Community Builder Program is on file and has been accepted by the Iowa Department of Economic Development; NOW THEREFORE BE IT RESOLVED,that the Waukee City Council hereby adopts the Community Builder program and orders the Clerk to place it on file at the office the Department of Transportation and the Department of Economic Development. PASSED THIS FIRST DAY OF APRIL,1996. Eliminating $8.00 Fee for Recycling Bins.At the last Utility Committee meeting it was voted to allow one free replacement recycling bin to the Utility Customers and to allow new residents a free bin.This issue came about due to all the bins that were lost during the winter storms. The Council took no action on this item. Request to Hire Part-Time Summer Help.In order for the Public Works Department to handle the additional work load that spring and summer bring,they will need part-time help before the start of the fiscal year.Because of the expected new development,and the mowing of grass takes up so much time,John Wessehnann is recommending that at least two individuals be hired by the first or second week in May. Motion by Councilwoman Lihs,seconded by Councilman Strain,to allow three (3)part-time employees be hired at a rate of$7.50/hr.The Mayor asked for a roll call vote:Ayes:Lihs, Strain,Lugar,Heath,and Gruber.Nays:None.Motion carried 5 to O. Mayor's Report.Set a meeting date in August for a Long Range Plans;The Community Betterment Committee will meet April 30th at City Hall;and Mayor's Meeting on April 10th, Mayor Bailey and Kurt Rueckel will be attending. Motion by Councilwoman Lihs,seconded by Councilman Strain,to accept the Mayor's report. The Mayor asked for a roll call vote.Motion carried. Planning and Zoning Report.The Council received a written report. Motion by Councilwoman Lihs,seconded by Councilman Gruber,to accept the Planning & Zoning report.The Mayor asked for a voice vote.Motion carried. 10 Parks Committee Report.The Council received a written report. Motion by Councilwoman Lihs,seconded by Councilman Gruber,to accept the Parks Committee report.The Mayor asked for a voice vote.Motion carried. Attorney's Report.Motion by Councilwoman Lihs,seconded by Councilman Gruber,to enter into closed session pursuant to the Iowa Code Section 21.51 (C)"To discuss strategy with Counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation".The Mayor asked for a roll call vote:Ayes:Lihs,Gruber,Strain,Heath,and Lugar.Nays:None.Motion carried 5 to O. The Council entered closed session at 9:40pm. The Council carne out of closed session at 9:57pm. Motion by Councilman Gruber,seconded by Councilwoman Lihs,to recess at 9:50pm. Upon a voice vote the motion passed 5 to O. The Council carne out of recess at 10:12pm. Motion by Councilman Strain,seconded by Gruber,to continue the contract with the EAP.The Mayor asked for a roll call vote:Ayes:Lugar.Nays:Strain,Gruber,Lihs,and Heath.Motion failed 1 to 4.
