Donald L.Bailey,Jr.,with Toni Lestina taking minutes.
Roll Call.A roll call vote was taken and the following Council members were present:Nick
Gruber,Dan Lugar and Terry Strain.Absent:Robyn Heath and Monica Lihs.
Open Forum.Ben Phillips asked the Mayor and Council about a clean-up day for Waukee.He
has talked with Waste Management and they will pickup the garbage if the City is interested.
The Mayor asked Kurt to talk with Waste Management and arrange a date.The Mayor would
like the date published in the Dallas County News and the newsletter.
Mike Sawyer -Mr.Sawyer inquired about the policy of the City doing as much local business as
possible.The City has no policy on the books for local vendor preference.Kurt asked Mr.
Sawyer to leave a business card.
Councilwoman Heath arrived at 7:04pm.
Agenda Additions/Approval.Delete item #16 -Request for Reimbursement of Water fees;add
item #18B -Library Report;and add item #20A -item pending litigation.
Motion by Councilwoman Heath,seconded by Councilman Strain,to approve the agenda with
the deletion of item #16 and the addition of items #18B and #20A.The Mayor asked for a voice
vote.Motion carried.
Consent Agenda -A)4/1196 and 4/15/96 Bill Presentation.Motion by Councilman Strain,
seconded by Councilman Gruber,to approve the Consent Agenda.The Mayor asked for a roll
call vote:Ayes:Strain,Gruber,Heath and Lugar.Nays:None.Motion carried 4 to O.

First Responder Unit.Several months ago the Waukee City Council gave permission for the
City to seek bids for a new First Responder vehicle.The City received bids from the following
three (3)vendors:

Motion by Councilman Gruber,seconded by Councilman Lugar,to accept the bid from Foster
Coach for $74,924.The Mayor asked for a roll call vote:Ayes:Gruber,Lugar,Strain and Heath.
Nays:None.Motion carried 4 to O.
Councilman Strain states he did not feel vendors should be allowed to alter their bids after the
bid opening.
TCI Explanation of Rate Increase.Lisa Glasco,TCI representative,explain the rate increase
that will take effect June 1,1996.
Paul Huscher,City Attorney,advised the Council they may want to review and possibly update
the franchise ordinance.
Ordinance Allowing Construction of Dwellings before Final Plat Approval.In the past,the
City has allowed homes to be built in subdivisions before final plat approval.This allows the
developer to open up their development with something to show.
Motion by Councilman Gruber to introduce the following.
Motion by Councilman Gruber,seconded by Councilman Lugar,to have the first reading ofthe
following ordinance:
ORDINANCE NO.J
AN ORDINANCE TO AMEND CHAPTER 303,WAUKEE MUNICIPAL CODE,
SUBDIVISION REGULATION ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY
AMENDING SECTION 303.43 TO ALLOW CONSTRUCTION OF NOT MORE THAN TWO
(2)PRINCIPAL RESIDENTIAL STRUCTURES,PRIOR TO APPROVAL OF FINAL PLAT,
AFTER APPROVAL OF SUBDIVISION OF LAND HAS BEEN APPLIED FOR IN
PROPERTY ZONED R-1,R-2,R-4,OR R-5,AND PRELIMINARY PLAT APPROVAL HAS
BEEN GRANTED;AND FURTHER PROVIDING THAT SAID RESIDENCE STRUCTURES
SHALL NOT BE OCCUPIED OR SOLD PRIOR TO FINAL PLAT APPROVAL.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 303.43 of chapter 303,Waukee Municipal Code,subdivision
regulations of the City,is hereby amended by adding thereto the following:
(C)After obtaining preliminary plat approval for property zoned R-I,R-2,R-4
or R-5,a subdivider may construct not more than two (2)principal
residence structures in a subdivision upon obtaining permit therefore,
provided,however,such structures shall not be occupied or sold prior to
the granting of final plat approval for the subdivision.

Section 2.Repealer.All ordinances or parts of ordinances in conflict with the
provisions ofthis ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance
shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity ofthe
ordinance as a whole or any section,provision,or part thereof not adjudged invalid or
unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
Motion by Councihnan Lugar,seconded by Gruber,to waive the second (2nd)and third (3rd)
readings.The Mayor asked for a roll call vote:Ayes:Lugar,Gruber,Strain and Heath.Nays:

Motion by Councilman Gruber,seconded by Councilwoman Heath,to put Ordinance No.2216
on its final approval.The Mayor asked for a roll call vote:Ayes:Gruber,Heath,Lugar,and
Strain.Nays:None.Motion carried 4 to O.
Developer's Agreement -Enterprise Urban Renewal Area.Last year the City entered into
the following Developer's Agreement with Downing Development:
A meeting was held March 25,1996,in the law offices of Dorsey &Whitney concerning this
matter.In attendance were:Bob Josten,Bond Attorney;Tom MeW,Ruan Securities;Kurt
Rueckel,City Administrator;and Jeff Downing,Downing Development.From the discussions
at this meeting,the city has the following options:
1.The city can issue a tax increment revenue bond to the developer in the amount of
$816,623.00.I have suggested this bond would be for 15 years at 6%interest.
This bond would count against the debt limit of the City.The interest and
principal is paid only with funds generated from the increased taxes collected
from the developed property.Ifthese fax funds are not enough to pay the hond
off in 15 years,the bond ends and the city owes nothing else to the developer.
The city regains debt capacity as the principal of the bond is paid off.
2.The city can agree with the developer rebate tax funds annually from the
development.This option requires the city and the developer to agree to a
specific dollar amount that will be repaid with tax dollars.I would suggest that
this amount be the principal amount used above,$816,623.00,plus the interest
projected from the amortization model,$509,940.00,making the total
$1,326,563.00.This tax rebate would not count against the city's debt limit.It
would require the tax increment dollars to be spent up to the full amount of the
agreement for 15 years.

Robert Josten is reconnnending that the city issue the bonds.The city's bonding capacity should
increase by $600,000 -$750,000 a year at the current rate of growth.
Motion by Councilman Strain,seconded by Councilman Lugar,to issue bonds to be paid through
TIF as reconnnended by Bob Josten.The Mayor asked for a roll call vote:Ayes:Strain,Lugar,
Heath and Gruber.Nays:None.Motion carried 4 to O.
Lots of Record.Motion by Councilman Gruber,seconded by Councilman Lugar,to set a date
for a public hearing May 6,1996.The Mayor asked for a roll call vote:Ayes:Gruber,Lugar,
Strain,and Heath.Nays:None.Motion carried 4 to O.
University Trunk Sewer.Motion by Councilman Gruber,seconded by Councilman Strain,to
have Ed Biddle,School Attorney,and Paul Huscher,City Attorney,schedule a meeting to work
on the legal aspects of the school helping the city with the finances of the University Trunk
Sewer.The Mayor asked for a roll call vote:Ayes:Gruber,Strain,Lugar,and Heath.Nays:
None.Motion carried 4 to O.
Request to Waive Fees High School.The Waukee School District has requested the City of
Waukee to waive fees associated with the new high school.
Veenstra and Kirnm has agreed to waive their fees.The Building Inspectors have agreed to
waive some of their fees and to give a reduction on the permit.The city has some fees which
could be waived such as the site plan review ($35.00),their share of the permit ($5,500 est.),and
Zoning Administrator's fee ($3,300 est.).
Motion by Councilman Strain,seconded by Councilman Lugar,to waive the Zoning
Administrator's fees for the new high school.The Mayor asked for a roll call vote:Ayes:Strain,
Lugar,and Heath.Nays:None.Abstain:Gruber.Motion carried 3 to O.
Mobile Home Park Ordinance.Motion by Councilman Gruber,seconded by Councilman
Strain,to set a Public Hearing date for May 6,1996.The Mayor asked for a roll call vote:Ayes:
Gruber,Strain,Heath,and Lugar.Nays:None.Motion carried 4 to O.
City Hall Maintenance.The City currently has a contract with a local family for the cleaning of
city hall.This contract is costing the city much more than it should and the City should look into
a way to have it done elsewhere.
The City currently is paying the family $400 a month plus $25.00 when they do windows.
A professional service will provide professional cleaners who have liability insurance gave a
quote of $200 per month.
Motion by Councilman Strain,seconded by Councilman Gruber,to authorize Kurt,City Clerk,to

make the decision of City Hall Maintenance.The Mayor asked for a roll call vote:Ayes:Strain,
Gruber,Heath,and Lugar.Nays:None.Motion carried 4 to O.
Fire Chief Vehicle.The Waukee Fire Department is asking the City Council for a vehicle to be
used for fire business.Bill Harvey explained the city would be responsible for the insurance and
gas expenses,but that they would pay for the insurance during the first year.
Motion by Councilman Lugar,seconded by Councilman Strain,to give the Fire Department
approval to look for a used vehicle and the City will accept the responsibility of the insurance
(starting next year)and gas expenses and that a policy on the vehicle use would have to be
written first.The Mayor asked for a roll call vote:Ayes:Lugar,Strain,Heath and Gruber.Nays:
None.Motion carried 4 to O.
EAP Program.The City had a contract with the "Employee Assistance Program"for EAP
services costing the City $1,050 a year.At the last meeting the Council did not vote to renew the
contract.The EAP is now willing to charge $18 per employee or $324 a year the rate given to
Polk County Businesses.There are several other programs in the area comparable to the EAP
program.
Iowa Methodist is proposing a fee of$7.00 per employee or $126.00 per year.
Motion by Councilman Lugar,seconded by Councilwoman Heath,to have the Iowa Methodist
Program presented at the May 6th Council meeting.The Mayor asked for a roll call vote:Ayes:
Lugar,Heath,Gruber and Strain.Motion carried 4 to O.
Library Report.Councilman Strain present the Mayor and Council with a written report.
Motion by Councilman Lugar,seconded by Councilwoman Heath,to accept the Library report.
The Mayor asked for a voice vote.Motion carried.
Mayor's Report.Mayor Bailey report on the following items:A)Highway 6 Project Meeting
April 22nd.John will attend;B)Talked to Senator Douglas regarding Highway 6 walkway;C)
DA.R.E.Day activities;D)Mayor Bailey and Kurt Rueckel attended the School Board Meeting
on April 9th;E)Town Forum -Senator Douglas;F)Long Range Plan meeting,August 16th &
17th;G)Citizen of the Year reception,April 22nd;H)Councilwoman Lihs is running in the
Boston Marathon today.
Administrator's Report.Kurt Rueckel requested the Council go into closed session at this
time to discuss matters which may result in litigation.
Motion by Councilman Lugar,seconded by Councilwoman Heath,to enter into closed session
21.51 (C)"To discuss strategy with Counsel in matters that are presently in litigation or where
litigation is imminent where its disclosure would be likely to prejudice or disadvantage the

position of the governmental body in that litigation".The Mayor asked for a roll call vote:Ayes:
Lugar,Heath,Gruber,and Strain.Nays:None.Motion carried to O.
The Council entered closed session at 9:51 pm.
The Council came out of closed session at 10:37pm.
Administrator's Report.
Mayor Bailey discussed with the Council a bill from the IRS.Kurt provided the Mayor and
Council with information regarding past due bill from the IRS.The Mayor felt Kurt should be
allowed to do his administrative duties and to follow up with a recommendation to the Personnel
Committee if deemed necessary.
Kurt and the Personnel Committee will meet at 5:00pm on Thursday,April 18th.
Motion by Councilman Strain,seconded by Councilman Lugar,to receive and file the letter from
Jan Blazanin dated April 12th and the information dated February 20th.The Mayor asked for a
voice vote.Motion carried,
Attorney's Report -Annexation -Closed Session.Motion by Councilman Gruber,seconded
by Councilwoman Lihs,to enter into closed session 21.51 (C)"To discuss strategy with Counsel
