The May 20,1996 Waukee City Council meeting was called to order at 7:00pm by Mayor
Donald L.Bailey,Jr.,with Toni Lestina taking minutes.
Roll Call.A roll call vote was taken and the following Council members were present:Nick
Gruber,Robyn Heath,Monica Lihs,and TelTY Strain.Absent:Dan Lugar.
Open Forum.Mayor Bailey announced that Denny Dohnage has served 6 years (maximum
term)on the Library Board and will be stepping down the 31st of May.The Council thanked
him.
Agenda Additions -Agenda Approval.Motion by Councilwoman Lihs,seconded by
Councilman Strain,to approve the agenda.The Mayor asked for a voice vote.Motion carried.
Consent Agenda -A)5/6/96 Council Minutes;B)Salary &Bill Presentation;and C)
Casey's Liquor License.
5/6/96 Council Minutes are amended as follows:
Motion by Councilwoman Lihs,seconded by Councihnan Gruber,to amend the 5/6/96 minutes
to direct Paul Huscher,City Attorney,to proceed with matters regarding the South Dallas County
Landfill by rejecting the offer and proceeding with matters.The Mayor asked for a voice vote.
Motion carried,
Motion by Councilman Gruber,seconded by Councilwoman Lihs,to approve the consent agenda
with the amendment to the 5/6/96 Council minutes.The Mayor asked for a voice vote.Motion
carried.

Mayor's Proclamation.Mayor Bailey declared May 29,1996 as National Senior Health &
Fitness Day.
PROCLAMATION
"The Benefit of Exercise is Ageless"

WHEREAS,the President of the United States has designated Mayas Older Americans
Month and National Physical Fitness and Sports Month;and
WHEREAS,it is appropriate to honor our mature citizens for their many contributions to
the viability and strength of our community;and
WHEREAS,consistent physical activity is important to the well-being of older adults and to
the quality of their lives;and
WHEREAS,all older adults can participate is activities which improve and maintain their
health;
Now,therefore,be it resolved that I do hereby proclaim,Wednesday,May 29,1996 as
NATIONAL SENIOR HEALTH &FITNESS DAY

and urge our citizens to support the efforts of local organizations which encourage older
adults to enhance their lives through fitness activities.
National Earth Day -Tree Donation -Waste Management.Waste Management has donated
a tree to be planted in a city park.Mayor Bailey suggested the tree be planted in the Windfield
Park.
Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to accept the tree from
Waste Management with great thanks and dedicate the tree to the Windfield Park.The Mayor
asked for a roll call vote:Ayes:Lihs,Heath,Strain,and Gruber.Nays:None.Motion carried 4
to O.
28E Agreement -High School-University Trunk Sewer.Motion by Councilwoman Lihs,
seconded by Councilman Gruber,to accept the 28E Agreement for the University Trunk Sewer
Project.The Mayor asked for a roll call vote:Ayes:Lihs,Gruber,Strain,and Heath.Nays:
None.Motion carried 4 to O.
Iowa Energy Bank Program.John Wesselmann has been researching the possibilities of
various energy efficiency plans for various departments.The Iowa Energy Bank provides low
interest loans for energy efficiency plans.Representatives gave a fifteen minute presentation on
the Iowa Energy Bank and how the City could get on the Internet.

The Council directed John Wesselmann to start working on energy efficiency programs for each
of the city buildings.
Permission to Seek Bids on Concrete Saw.John Wesselmann is requested permission from the
Council to seek bids for a concrete saw with greater horsepower than the current machine and a
26"cutting blade.
Motion by Councilman Gruber,seconded by Councilman Strain,to give John Wesselmann
permission to seek bids for a new concrete saw.The Mayor asked for a roll call vote:Ayes:
Gruber,Strain,Heath,and Lihs.Nays:None.Motion carried 4 to O.
Permission to Seek Bids on Public Works Building Expansion.The Public Works
Department has been strapped for office space,a map room,break room,and storage space.This
expansion would be on the north side of the current public works building.The approximate cost
would be $32,000.00 depending on bids for building and interior work.
Motion by Councilman Strain,seconded by Councilman Gruber,to seek bids for expanding the
public works building.The Mayor asked for a roll call vote.Ayes:Strain,Gruber,and Heath.

Waukee State Bank -Ordinance Allowing Temporary Commercial Structure.Motion by
Councilwoman Lihs,to introduce Ordinance No.2220.
Motion by Councilwoman Lihs,seconded by Councilman Heath,to have Ordinance No.2220
read in title on for the first time.The Mayor asked for a roll call vote:Ayes:Lihs,Heath,
Gruber,and Strain.Nays:None.Motion carried 4 to O.
Ordinance No.2220
AN ORDINANCE TO AMEND CHAPTER 303,WAUKEE MUNlCIP AL CODE,
SUBDIVISION REGULATIONS ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY
AMENDING SECTION 303.43 TO PROVIDE THAT,AFTER PRIOR COUNCIL
APPROVAL,AND SUBJECT TO OBTAINING SITE PLAN APPROVAL IN PROPERTY
ZONED c.r,C-2,C-3 OR M-l;A PROPERTY OWNER MAY CONSTRUCT OR LOCATE A
TEMPORARY COMMERCIAL STRUCTURE,PROVIDED THAT SAID TEMPORARY
COMMERCIAL STRUCTURE SHALL NOT BE OCCUPIED AFTER ONE YEAR
FOLLOWING SITE PLAN APPROVAL,AND SHALL BE REMOVED WITHIN THIRTEEN
(13)MONTHS OF SUCH APPROVAL.
BE IT ORDAINED by the Council of the City of Waukee:

Section I.Section 303.43 of Chapter 303,Waukee Municipal Code,Subdivision
I~~--i
Regulations ofthe City,is hereby amended by adding thereto the following:
(D)After prior council approval,and subject to obtaining site plan approval in
property zoned C-l,C-2,C-3 or M-l,a property owner may construct or
locate a temporary commercial structure,provided that said temporary
commercial structure shall not be occupied after one year following site
plan approval,and shall be removed within thirteen (13)months of such
approval.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the
ordinance as a whole or any section,provision,or part thereof not adjudged invalid or
unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this __day of May,1996,and
approved this __day of May,1996.

Urban Renewal Tax Increment Revenne Bond -Public Hearing.Motion by Councilman
Gruber,seconded by Councilwoman Lihs to adopt Resolution No.96-l2B -Urban Renewal Tax
Increment Revenue Bond.The Mayor asked for a roll call vote:Ayes:Gruber,Lihs,Heath,and
Strain.Nays:None.Motion carried 4 to O.
RESOLUTION NO.96-l2B
Resolution authorizing the issuance of an $816,623 Urban Renewal Tax Increment
Revenue Bond,Series 1996,pledging to The payment of the Bond funds and portions of
taxes created pursuant to the authority of Subsection 2 of Section 403.19 of the Code of

Iowa and providing for the securing of the Bond,all for urban renewal purposes of the
City of Waukee,Iowa
WHEREAS,the City of Waukee,Iowa,pursuant to and in strict compliance with all laws
applicable to the City,and in particular the provisions of chapter 403 of Code of Iowa,has
adopted an Urban Renewal Plan by resolution of the council for the enterprise Business Park
Urban Renewal Area;and
WHEREAS,this Council has adopted an Ordinance which provides for the division of
taxes levied on taxable property in the enterprise business Park Urban Renewal area and which
establishes the fund referred to in subsection 2 of Section 403.19 of the Code ofIowa (the
"Urban renewal Tax Revenue Fund"),which fund and the portion of taxes referred to in that
subsection may be irrevocably pledged by the City for the payment of the principal and interest
on bonds or notes issued under the authority of Section 403.9 of the Code to finance or refinance
in whole or in part projects in the Enterprise Business Park Urban Renewal Area;and
WHEREAS,pursuant to Sections 364.6,394.25 and 403.9 of the Code of Iowa,the City
has published a notice of the proposed action of the City Council to institute proceedings for the
issuance of an $816,623 Urban Renewal Tax Increment Revenue Bond,for the purpose of
fmancing an urban renewal project within the enterprise Business Park Urban Renewal Area,
consisting of the acquisition of streets,water,sanitary sewer and storm sewer improvements
constructed by Downing Development,Ltd,and has held a hearing thereon and has otherwise
complied with statutory requirements for the issuance of such bond;
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Waukee,
Iowa,as follows:
Section I.Pursuant to and as authorized by the Constitution and laws of the State of
Iowa,and particularly Section 403.9 ofthe Code of Iowa,there is hereby authorized to be issued
an $816,623 Urban Renewal Tax Increment Revenue Bond,Series 1996 (the "1996 Bond"),to
be dated as of the date of its delivery to Downing Development Ltd.The 1996 Bond shall bear
interest,shall be payable as to principal and interest,and shall have such other terms as are
incorporated in the form of the 1996 Bond set out in Section 2 hereof.The City reserves the
right to call and repay any principal amount of the 1996 Bond at any time,upon the city giving
notice by registered or certified mail to the Registered Holder addressed to such Registered
Holder at his registered address and placed in the mail not less than thirty (30)days prior to the
date fixed for prepayment.In the event of prepayment on a date other than an annual interest
payment date,interest shall be paid to the date of prepayment only.The 1996 Bond shall be
fully registered as to principal and interest in the name of the holder on the books of the City
Clerk of the City,such registration to be noted upon the 1996 Bond and after such registration,
payment of the principal and interest thereof shall be made only to the Registered Holder.Upon
the request in writing of such Holder personally or by his attorney in fact the 1996 Bond may be
transferred to a designated transferee.

Budget Amendment -Public Hearing.No written or oral objections were received.
Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to adopt Resolution No.96-
13 -Budget Amendment.The Mayor asked for a roll call vote:Ayes:Lihs,Heath,Strain,and

RESOLUTION NO.96-13
A RESOLUTION AMENDING THE CURRENT BUDGET FOR THE FISCAL YEAR
ENDING JUNE 30,1996 (AS AMENDED LAST ON ,1996).
Be It Resolved by the Council of the City of Waukee,Iowa:
Section 1.Following notice published May 9,1996 and the public hearing held May
20,1996,the current budget (as previously amended)is amended as set out herein and in detail
by fund type and activity that supports this resolution which was considered at that hearing:
REASON:Decrease revenues because Zoning Fees ($20,000)and Site Plan review
($5,000)were overstated,the COPS Grant was not accepted ($25,000)and the City did not
borrow funds to extend the Hickman Road Trunk Sewer ($900,000).Increase in revenues caused
by unbudgeted Library revenues from fmes,gifts,coping,etc.($2,050)and Solid Waste
Collection Fund ($92,000),underbudgeted Library grants received ($1,850),Open Access
($2,130),Dallas County Library Contribution ($1,555),Interest on Deposits ($9,000),Building
Permit fees ($20,000),and Gas Department revenues ($110,000).
Decrease expenditures because Hickman Road Trunk Sewer project was not done
($900,000).Increase in expenditures caused by unbudgeted Library expenses to postage,
supplies and miscellaneous ($7,570),Solid Waste Collection Fund ($80,000),and underbudgeted
Building Inspection costs ($15,000),Zoning Administration costs ($2,000),and Gas Department
cost of goods sold ($75,000).
Passed this 20th day of May,1996.
Mutual Aid Agreement -Police Department.The Mutual Aid Agreement is between the
Waukee and West Des Moines Police Departments.The Waukee and West Des Moines
communities are in agreement to help each other and have that agreement in writing.
Motion by Councilman Gruber,seconded by Councilwoman Heath,to accept the 28E Agreement
-Mutual Aid between Waukee and West Des Moines.The Mayor asked for a roll call vote:
Ayes:Gruber,Heath,Strain,and Lihs.Nays:None.Motion carried 4 to O.
Councilman Dan Lugar arrived at 8:21p.m.

Summer Recreation Program -YMCA.For the past few years the City of Waukee has
sponsored swimming lessons in Adel and recreational swimming in Dallas Center.The City also
had a summer recreation program which tours kids various places during the morning.
The Council directed Kurt to discuss with the YMCA a family fee and if kids from the Waukee
community could possibly work/help with the summer programs.
Motion by Councilman Lugar,seconded by Councilwoman Lihs,to accept the proposed Waukee
Extension of the YMCA programs.The Mayor asked for a roll call vote:Ayes:Lugar,Lihs,
Gruber,Heath,and Strain.Nays:None.Motion carried 5 to O.
YMCA Task Force -Appointment of Members.Dr.Stalker and Kurt Rueckel have met with
officials at the Walnut Creek YMCA several time over the past six to eight months,to talk about
possibilities and areas of cooperation between the School,the city,and the YMCA.
It was recommend to the School Board and City Council to appoint members of a task force to
help plan for the YMCA to come to Waukee,in the short and long term.
The Mayor directed the Council members to bring several names of residents to help on the
YMCA Task Force to the June 3rd Council Meeting.
Open Burning -Extension of Open Burning Period.Kurt Rueckel has received a few
requests for the extension of the open burning period.
Motion Councilman Gruber,to allow open burning during the period of June l Oth through June
22nd between the hours of7:00 a.m.and 7:00 p.m.with no Sunday burning.After further
discussion Councilman Gruber withdrew the motion.
mOT Agreement -Highway 6 Detour Paving Agreement.The City received a letter from the
IDOT regarding their offer to pay for half of the paving of Alice's Road and to do the necessary
repairs on University as part of the Highway 6 project.
Motion by Councilman Strain,seconded by Councilman Gruber,to have Mayor Bailey,Kurt
Rueckel,and John Kursitis meet with the mOT on these matters.The Mayor asked for a roll call
vote:Ayes:Strain,Gruber,Heath,Lihs,and Lugar.Nays:None.Motion carried 5 to O.
Report on Windfield Streets.Dale Sorenson,Veenstra &Kimm,explained the damage to the
streets was caused from water problems in the area.The problems should be solved with added
drainage installed and by changing the drainage of the sump pumps in the area.
Knuckles will start work in the Windfield area in the next 2 weeks.
10 IDaleSorensonandJohnKursitisensuredtheCouncilwith95%certainty that this remedy would
fix the problems that have occurred.
Motion by Councilwoman Lugar,seconded by Councilman Gruber,to accept the Windfield
Street Repair proposal.The Mayor asked for a roll call vote:Ayes:Lugar,Gruber,Lihs,and
Heath.Nays:Strain.Motion carried 4 to 1.
The Council directed Kurt to sent letters to all Windfield residents regarding the drainage of
sump pumps.
Permission To Seek Land for Annexation South of University.Part of the land south of
University,within the University Trunk Sewer service area is not within city limits.
Motion by Councilman Strain,seconded by Councilman Lugar,to give Kurt Ruecke1 permission
to contact property owners south of University (south of Centennial Park)regarding annexation.
The Mayor asked for a roll call vote:Ayes:Strain,Lugar,Lihs,Heath,and Gruber.Nays:None.
Motion carried 5 to O.
Mayor's Report.The Mayor updated the Council on the following items:a)Community
Betterment information in Wankee Taukee;B)Mayor's Meeting -shared a Citizen work order;
C)Meet with Mike Harman -Southfork Committee on May 29st;and D)the Council should
respond to information given to them regarding the Sahu Acres road.
Parks Committee Report -Councilwoman Lihs briefly reviewed the written report.
Motion by Councilman Gruber,seconded by Councilman Lugar,to accept the written report.
The Mayor asked for a voice vote.Motion carried.
Attorney's Report.Paul recommended that work continue to be done on the following
Ordinances:a)Traffic Ordinances;B)Boundary Ordinances;C)Grade Ordinances;D)
Subdivision Ordinances;and E)Zoning Ordinances.
Motion by Councilwoman Lihs,seconded by Councilman Gruber,to enter into closed session
21.51 (C )"To discuss strategy with Counsel in matters that are presently in litigation nor where
litigation is imminent where its disclosure would be likely to prejudice or disadvantage the
position of the governmental body in that litigation".The Mayor asked for a roll call vote:Ayes:
Lihs,Gruber,Strain,Heath,and Lugar.Nays:None.Motion carried 5 to O.
The Council entered closed session at 9:56 p.m.
The Council came out of closed session at 10:09 p.m.
The Council talked about whether or not to go into closed session,after a brief discussion motion
by Councilwoman Lihs,seconded by Councilman Gruber to adjourn at 10:27 p.m.Motion
carried 5 to O.
