L.Bailey,Jr.,with Toni Lestina taking minutes.
Roll Call.A roll call vote was taken and the following Council members were present:Nick
Gruber,Robyn Heath,Monica Lihs,Dan Lugar and Terry Strain.
Open Forum.
Mrs.Lause -100 Nortbview Drive -spoke to the Mayor and Council members regarding a dump
truck hauling branches unloading at the City's brush pile behind the Public Works Department.
She would like to see this stopped.
Agenda additions -Agenda Approval.Motion by Councilman Gruber,seconded by
Councilman Strain,to approve the agenda with the addition of 6A -Concrete Saw Bids and make
the following correction to the June 3,1996 minutes:"Motion by Councihnan Strain,seconded
by Councihnan Lugar,to give the City Treasurer the opportunity to submit a letter of resignation
effective July 1,1996.The Mayor asked for a roll call vote:Ayes:Strain,Lugar,Lihs and
Heath.Nays:Gruber.Motion carried 4 to 1".
Consent Agenda -6/3/96 Council Minutes and B)Salary &Bill Presentation.Motion by
Councilman Strain,seconded by Councilwoman Lihs,to approve the Consent Agenda with the
correction to the June 3,1996 Council Minutes.The Mayor asked for a roll call vote:Ayes:
Strain,Lihs,Heath,Lugar and Gruber.Nays:None.Motion carried 5 to O.

Library -Introduce New Board Members.Mayor Bailey introduced Carol Guttenfelder and
Joe Schmitt as the New Library Board Members.
Concrete Saw Bid Results.Three (3)bids were received,only 1 bid meet the bid specifications
totally.
Motion by Councilman Lugar,seconded by Councilwoman Lihs,to approve the purchase of a
concrete saw and blade from Aggregate for $7,499.00 to be taken out of next year's budget.The
Mayor asked for a roll call vote:Ayes:Lugar,Lihs,Heath,Strain,and Gruber.Nays:None.
Motion carried 5 to O.
Mosquito Spraying.Motion by Councilman Lugar,seconded by Councilman Strain,to approve
four (4)applications at $500.00 per application.Mayor Bailey asked for a roll call vote:Ayes:
Lugar,Strain,Gruber,Heath,and Lihs.Nays:None.Motion carried 5 to O.
Alice's Road Engineering.As part of the Highway 6 Project,Alice's Road will be paved and
University Avenue repaired.The City and the State will split the cost of paving Alice's Road

with the City paying for the engineering design and the State paying for the engineering
supervision.
The Council voiced their concern with the bid procedure Veenstra &Kimm has been using.
Motion by Councilman Gruber,seconded by Councihnan Strain,to have Veenstra &Kimm do
the engineering work on the Alice's Road Paving Project for $7,500.00.Mayor Bailey asked for
a roll call vote:Ayes:Gruber,Strain,Heath,Lihs,and Lugar.Nays:None.Motion carried 5 to
O.
Various Projects.Kurt Rueckel gave the Mayor and Council financial information to consider
when making their decisions on various projects that the City is considering.
IDOT -Agreement for Maintenance.Motion by Councilman Lugar,seconded by
Councilwoman Lihs,to sign the IDOT Agreement.The Mayor asked for a roll call vote:Ayes:
Lugar,Lihs,Strain,Gruber,and Heath.Nays:None.Motion carried 5 to O.
1996 Street Projects -Engineering.A Citizen voiced a concern regarding loaded grain trucks
driving down Ashworth Drive.
Motion by Councilman Gruber,seconded by Councihnan Lugar,to accept the proposal from
Veenstra &Kimm for the engineering for the following street projects:option #3 for Northview;
option #2 for 2nd Street,3rd Street,at a cost $25,300.00.The Mayor asked for a roll call vote:
Ayes:Gruber,Lugar,Heath,Lihs,and Strain.Nays:None.Motion carried 5 to O.I
Compliance Schedule -Lagoon Expansion.Kurt Rueckel updated the Council and
recommended the Council ask the DNR for a 1 year delay in coming into compliance with their
Ammonia -Nitrate regulations.
Motion by Councihnan Strain,seconded by Councilman Gruber,directed Kurt Rueckel to send a
letter asking for a delay of 1 year.The Mayor asked for a roll call vote:Ayes:Strain,Gruber,
Lugar,Heath,and Lihs.Nays:None.Motion carried 5 to O.
Resolution Authorizing Application for SRF.Motion by Councilman Lugar,seconded by
Councihnan Gruber,to pass Resolution No.96-14 authorizing Kurt Rueckel to file a SRF
application for the possible expansion of the lagoon.This would not commit the City to do the
project now,but would put the City on the waiting list.Mayor Bailey asked for a roll call vote:
Ayes:Lugar,Gruber,Lihs,Strain,and Heath.Nays:None.Motion carried 5 to O.
RESOLUTION NO.96-14
A RESOLUTION AUTHORIZING THE SUBMISSION OF AN APPLICA nON TO THE
IOWA DEPARTMENT OF NATURAL RESOURCES -STATE WATER POLLUTION

CONTROL REVOLVING FUND LOAN PROGRAM FOR WASTEWATER PROJECTS FOR
THE PURPOSE OF CONSTRUCTING IMPROVEMENTS TO THE SANITARY SEWERAGE
SYSTEM,DESIGNATING THE CITY ADMINISTRATOR AS THE AUTHORIZED
REPRESENTATIVE FOR ACTIVITIES ASSOCIATED WITH THE PROJECT AND
AUTHORIZING THE CITY ADMINISTRATOR TO EXECUTE THE LOAN APPLICATION.
WHEREAS,the City Council of the City of Waukee,Iowa has determined that it is necessary to
construct certain improvements to its sanitary sewerage system,and
WHEREAS,the State ofIowa under its State Water Pollution Control Revolving Fund Loan
Program provides for sewerage system improvements by offering low interest loans,and
WHEREAS,the City Council of the City of Waukee,Iowa is interested in submitting an
application for a low interest loan under the state program for the construction of improvements
to the sanitary sewerage system.
NOW,THEREFORE,be it resolved by the City Council of the City of Waukee,Iowa that:
1.The State Water Pollution Control Revolving Loan Fund application for the
construction of improvements to the sanitary sewerage system is approved.
2.Kurt A.Rueckel,City Administrator is hereby authorized and directed to execute
and file the application on behalf of the City of Waukee,Iowa with the State of
Iowa Department of Natural Resources;and that he is hereby authorized and
directed to furnish such information as the Department of Natural Resources may
reasonably request in connection with the application which is herein authorized
to be filed,sign all necessary documents which is herein authorized,to furnish
such assistance to the Department of Natural Resources as may be required by law
or regulations,and to receive payment.
Passed and approved this 17th day of June,1996,by the City Council of the City of Waukee,
Iowa.
Library Report.Councilman Strain distributed a written Library Report.
Motion by Councilman Lugar,seconded by Councilwoman Lihs,to accept the Library Report.
Mayor Bailey asked for a voice vote.Motion carried.
Board of Adjustment.The Council received a written Board of Adjustment Report.
Marvin Whitlock -315 Bel-Aire Drive -would like the to see the accessory building height
requirement changed from 14 feet to at least 18 feet.

Kurt Rueckel will conduct a survey with the surrounding cities regarding their height
requirement ordinances.!Mayor's Report.The Citizen Work orders are a big success;updated the Council on the
situation with Laurel Street;and July 1st the Mayor will be attending a meeting in Iowa City and
will not be able to attend the July 1st Council Meeting.
Administrator's Report.The YMCA Task Force will include only two (2)members;Greg
Fetterman -Intern -started work on June 17th and will be working a twenty hours per week;
Mobile Home Park -there are 4 residents in the park that have not complied to the regulation for
an occupancy permit.
Motion by Councihnan Gruber,seconded by Councilwoman Lihs,to send letters to the four (4)
residents of the Mobile Home Park who have not complied with the City's letter a number of
months ago to start eviction procedures.Mayor Bailey asked for a roll call vote:Ayes:Gruber,
Lihs,Strain,Lugar,and Heath.Nays:None.Motion carried 5 to O.
Attorney's Report -Annexation -Closed Session.Motion by Councilwoman Lihs,seconded
by Councilwoman Heath,to enter into closed session 21.51 (C)"To discuss strategy with
Counsel in matters that are presently in litigation or where litigation is imminent where its
disclosure would be likely to prejudice or disadvantage the position of the governmental body in
that litigation".Mayor Bailey asked for a roll call vote:Ayes:Lihs,Heath,Gruber,Strain,and
Lugar.Nays:None.Motion carried 5 to O.I
The Council entered closed session at 9:26 p.m.
The Council carne out of closed session at 10:00 p.m.
Motion to adjourn at 10:00 p.m.by Councilwoman Lihs,seconded by Councilwoman Heath.
The Mayor asked for a voice vote.Motion carried 5 to O.
