Donald L.Bailey,Jr.,with Toni Lestina taking minutes.
Roll Call.A roll call vote was taken and the following Council Members were present:Nick
Gruber,Robyn Heath,Monica Lihs,Dan Lugar,and Terry Strain.
Open Forum.
Chet Chedester -220 Waukee Avenue,spoke to the Council regarding the Farmer's Market not
conforming to Ordinance 210.
Marvin Whitlatch -315 Bel-Aire Drive,asked the Council when mosquito spraying would be
done again.
Mr.Whitlatch asked the Council what setback requirements exist when building a deck.
Agenda Additions -Agenda Approval.Motion by Councilwoman Lihs,seconded by
Councilman Lugar,to approve the agenda with the deletion of item #11 and to move item #16 to
end of the meeting in closed session.The Mayor asked for a voice vote.Motion carried 5 to O.
Consent Agenda -A)8/5/96 Council Minutes;B)Salary and Bill Presentation.Motion by
Councilman Gruber,seconded by Councilwoman Lihs,to approve the consent agenda.The
Mayor asked for a roll call vote:Ayes:Gruber,Lihs,Lugar,Heath,and Strain.Nays:None.
Motion carried 5 to O.

Homecoming Parade.Amanda Clayton and Joe Pirdle,Waukee High School Students,spoke
to the Council asking for ajoint effort of the City and School to organize a Homecoming Parade.
Motion by Councilman Gruber,seconded by Councilman Lugar,to support the homecoming
parade and possibly a bonfire after the parade.The Mayor asked for a roll call vote:Ayes:
Gruber,Lugar,Strain,Heath,and Lihs.Nays:None.Motion carried 5 to O.
Scheduling of Special Meeting to Cousider Westgate Development.Councilman Strain stated
there is a problem with the water drainage in this development and will not vote for a special
meeting for Westgate.
Mayor Bailey reported he had attended two meetings between Developer and Landowners
to resolve the drainage issue.The Developer told the Farmer he would reimburse him for
any crop damage he caused.
Motion by Councilman Gruber,seconded by Councilwoman Heath,to schedule a special
meeting for August 28th,if the items on the punch list are not completed by August 26th the
special meeting will be canceled.The Mayor asked for a roll call vote:Ayes:Gruber and Heath.
Nays:Strain,Lugar,and Lihs.Motion failed 2 to 3.
The Westgate Development will be addressed at the September 9th meeting.
Discussion of Proposed Solid Waste ordinance.Kurt Rueckel spoke to the Council regarding
the landfill charges have been increase and he will be discussing the rate increase with Waste
Management ofIowa.The ordinance will be presented at the September 9th meeting.j

mOT Agreement -Hwy 6.Kurt Rueckel voice his concerns to the Council regarding the mOT
Agreement.
Northern Natural Gas ConferencelWastewater Systems Seminar.Motion by Councilman
Strain,seconded by Councilman Lugar,to have John Wessehnann attend the Northern Natural
Gas Conference/Wastewater Systems Seminar in Minneapolis at a cost not to exceed $450.00.
The Mayor asked for a roll call vote:Ayes:Strain,Lugar,Lihs,Heath,and Gruber.Nays:None.
Motion carried 5 to O.
New Gas Odorizer &Resizing of Regulator Stations.It has been very highly recommended
that the city consider resizing the regulator statio s and also install a new odorizer at the border
station.
Motion by Councilman Lugar,seconded by Councilman Gruber,to approve a new gas odorizer
and resizing of the regulator stations,not to exceed $14,000.00.The Mayor asked for a roll call
vote:Ayes:Lugar,Gruber,Lihs,Strain,and Heath.Nays:None.Motion carried 5 to O.
Westgate Plat 1 -Gas Main Installation.The City submitted bid specifications for the
Westgate Plat 1 gas main installation.Murphy Brothers and Arby Construction declined to bid
on this job.Iowa Pipeline placed a bid for $20,589.00.
Motion by Councilman Strain,seconded by Councilman Lugar,to contract Iowa Pipeline to
install the Westgate Plat 1 gas main,with the cost not to exceed $20,589.00.The Mayor asked
for a roll call vote:Ayes:Strain.Lugar,Heath,and Gruber.Nays:Lihs.Motion carried 4 to 1.
Westgate Plat 1 /Gas Main Material Purchase.Motion by Councilman Strain,seconded by
Councilman Lugar,to approve the purchasing gas main materials for the Westgate Plat 1 gas
main installation,not to exceed $6,466.31.The Mayor asked for a roll call vote:Ayes:Strain,
Lugar,Gruber,Heath,and Lihs.Nays:None.Motion carried 5 to O.
Hiring of City Treasurer.Motion by Councilman Lugar,seconded by Councilwoman Lihs,to
accept the withdrawal by David Angelerie of his acceptance of the City's job offer for the
position of the City Treasurer.The Mayor asked for a roll call vote:Ayes:Lugar,Lihs,Gruber,
Strain,and Heath.Nays:None.Motion carried 5 to O.
Rescheduling of Council Meeting.The Development Board has scheduled the next public
hearing on the armexation petitions for September 23rd when the Council meeting was
scheduled.In order for the City to be able to attend that meeting,motion by Councilman
Gruber,seconded by Councilwoman Lihs,to reschedule the September meetings to be
September 9th and September 16th.The Mayor asked for a roll call vote:Ayes:Gruber,Lihs,
Lugar,Strain,and Heath.Nays:None.Motion carried 5 to O.
NETCOM Request to Use Right-Of-Way.NETCOM is proposing to install a fiber optic cable

to the New High School site.As part of the project the cable will come down Alice's Road from
the north to University,to the west,to the High School site.Table until the September 9th
meeting.I
Planning and Zoning Report.Motion by Councilwoman Lihs,seconded by Councilman
Gruber,to accept the Planning and Zoning report.The Mayor asked for a voice vote.Motion
carried 5 to O.
Utilities Committee Report.Motion by Councilman Gruber,seconded by Councilman Lugar,
to accept the Utilities Committee report.The Mayor asked for a voice vote.Motion carried 5 to
O.
Mayor's Report.The Mayor announced he had attended a meeting about the proposed
casino,also attended two meetings regardiug Westgate development drainage concerns,
attempting to resolve the concerns.The Mayor reported he delivered the State award to
Dowuey Printing.The Mayor reported he is in contact with citizens of Sahu Acres
attempting to connect them with the Operating Engineers Union.The Mayor read a letter
from Virginia Clark thanking the City for our prompt resolution to her citizen work order.
The Mayor announced the tax rate information is in from the rest ofthe county.The
Mayor announced he has received complaints about properties not being mowed Windfield
2 and along University Avenue.The Mayor announced the anditors will be in Sept.9th.
The Mayor announced he had rode patrol with the police department,twice the last week.
The Mayor annouuced he uominated the Easou Elementary project"Hands across the
Community"for the Lieuteuant Governors Prism Award.
Admiuistrator's Report.
Attorney's Report -A)Annexation -Closed sessiou;B)Landfill-Closed session.Motion
by Councilwoman Lihs,seconded by Councilman Strain,to enter into closed session 21.15(I )
"To evaluate the professional competency of an individual whose appointment,hiring,
performance or discharge is being considered when necessary to prevent needless and irreparable
injury to that individual's reputation at that individual requests a closed session".The Mayor
asked for a roll call vote:Ayes:Lihs,Strain,Gruber,Lugar,and Heath.Nays:None.Motion
carried 5 to O.
The Council entered into closed session at 8:49pm.
The Council came out of closed session at 9:17pm.
Open Session -City Treasurer.Motion by Councilman Strain,seconded by Councilwoman
Lihs,to have the Personnel Committee and the City Administrator review the list of applicants
and make an offer as soon as possible.The Mayor asked for a roll call vote:Ayes:Strain,Lihs,I8
Lugar,Gruber,and Heath.Nays:None.Motion carried 5 to O.
Motion to into closed session at 9:19pm by Councilwoman Lihs,seconded by Councilman Strain
to enter into closed session under section 21.51 (C)"To discuss strategy with Counsel in matters
that are presently in litigation or where litigation is imminent where its disclosure would be
likely to prejudice or disadvantage the position of the governmental body in that litigation".
Upon roll call the following members voted:Ayes:Lihs,Strain,Gruber,Heath,and Lugar.
Nays:None.Motion carried 5 to O.
The Council carne out of closed session at 9:39pm.
Motion to adjourn at 9:39pm by Councilman Gruber,seconded by Councilwoman Heath.The
Mayor asked for a roll call vote:Gruber,Heath,Lihs,Strain,and Lugar.Nays:None.Motion
carried 5 to O.
