HomeMy WebLinkAbout1996-09-16-Regular MinutesThe September 16,1996 Waukee City Council meeting was called to order at 7:00 PM by Mayor Donald L.Bailey,Jr.,with Toni Lestina taking minutes. Roll Call.A roll call vote was taken and the following Council Members were present:Nick Gruber,Robyn Heath,Monica Lihs,Dan Lugar,and Terry Strain.Absent:None. Open Forum: Jerry Husted -2783 W Avenue,representing James and Marilyn Husted -2791 W Avenue and 2787 W Avenue regarding a fence being built at 2789 W Avenue on James Husted's property. The Husted's would like the fence removed they have talked to their neighbor and she continues to built the fence on their property.No one has had the property lines surveyed.Huscher stated that if the problem is property lines it would be a civil matter the City has no jurisdiction in this matter.Can the builder of the fence use any material to construct this fence.This is not addressed in the City Fence Ordinance.The Mayor stated that the fence ordinance should be updated and defme which side of a privacy fence should be facing out and what materials can be used on a fence. The Mayor stated that the Police Chief can possibly help and for everyone in the area to keep their cool. Kurt stated he always suggest when someone is putting up a fence they should speak to their neighbors and see if they would be interested in jointly building the fence.]Julie Backsen -455 Maple -would like the reconsider to be allowed to build a garage on their property.They were turned down because of the C-l zorring of their property.lfyou have a nonconforming use you cannot change any structure without going to the Board of Adjustment Connnittee and apply for a variance.They have been living in the home for 4 years.They were under the understanding that when they were ready they could build a garage on their property. The apartments next to Julie's property is zoned R-3.Kurt suggested that Julie attend the Planning and Zoning Commission meeting on September 24th.Councihnan Lugar would like the area looked at to see if it is even local for that area to be zoned C-l.The Backseu's would like to replace the old garage with a 2 car garage.The old garage is currently falling down and bring down the value of their property.The Mayor stated a possible resolution could get the property rezoned.The rezoning process takes several months. I Setting Date for Beggar's Night.Motion by Councilman Gruber,seconded by Councilman Lugar,to set Beggar's Night for Thursday,October 31st from 6:30pm.to 8:00pm.The Mayor asked for a roll call vote:Ayes:Gruber,Lugar,Lihs,Strain,and Heath.Nays:None.Motion carried 5 to O. Ordinance Raising Monthly Garbage Fees.Add to the ordinance that the recycling bins are property of the city and will need to be turned in to the city in a clean condition or be charged $8.00 fee for the bin. Motion by Councilwoman Lihs,seconded by Councilwoman Heath to have the ordinance read for the 2nd time in title only.The Mayor asked for a roll call vote:Ayes:Lihs,Heath,Strain, Gruber,and Lugar.Nays:None.Motion carried 5 to O. Jim Phillips -wanted to know if the citizens were notified of this rate increase.Kurt stated it was published in the Waukee Taukee. Hanna Weil -stated Waste Management seems to be very sloppy,if they to drop or spill any of the trash they will not pick any of the mess up.This matter will be addressed with Waste Management.Waste Manage usually is very responsive with any problems the city has had when brought to their attention. NET com Agreement.The Mayor is strongly recommending that the City ask for 8 fibers in their cable in trade for the easement.The City could possibly have their own cable programs. The Mayor thought there would probably be at least 100 fibers in this cable. Motion by Councilman Gruber,seconded by Councilman Lugar to make all changes to the agreement and forward on to NETcom.The Mayor asked for a roll call vote:Ayes:Gruber, Lugar,Lihs,Heath,and Strain.Nays:None.Motion carried 5 to O. University Trunk Sewer -Area Included In Assessment.John Kursitis and Kurt Rueckel briefly updated the Council.The Council directed Kurt to contact all the residents in the area before any council action is taken.The best thing to do is eliminate a pumping station. Councilman Gruber would like to set a deadline for the residents in the area to hookup or pay a fee.Notices will go out to all residents in the area by the next meeting. Mayor's Report.The Mayor attend the MidAmerica meeting in Boone;and Mayor Bailey,the Fire Department and First Responders attended the Southfork parade on Sunday. Matt Austin would like to scrap and paint the five building in the park.The city will have to provide the paint.The work should be completed within the next 5 weeks.John Wesselmann would like to take to the Parks Committee meeting and invite Matt Austin to attend the meeting. Councilman Strain thought the Library might have some paint projects for Mr Austin to earn his badge for eagle scout.Motion by Councilwoman Lihs,seconded by Councilman Gruber,to 4 accept the Mayor's report.The Mayor asked for a voice vote.Motion carried. )Administrator's Report.The Auditor's are here in full force.Don't forget next Monday to get your act together for a strategy meeting.Motion by Councilman Gruber,seconded by Councilwoman Lihs,to accept the Administrator's report.The Mayor asked for a roll call vote. Motion carried. Attorney's Report - A)Annexation -Closed Session.Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to enter into closed session under section 21.51 (C)"To discuss strategy with Counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation". The Mayor asked for a roll call vote:Ayes:Lihs,Heath,Strain,Lugar,and Gruber.Nays:None. Motion carried 5 to O. The Council enter closed session at 8:52pm.
