Donald L.Bailey.Jr.
Roll Call.A roll call vote was taken and the following Council Members were present:Nick
Gruber,Robyn Heath,Monica Lihs,Dan Lugar,and Terry Strain.Absent:None.
Open Forum.No one brought up anything.
Agenda Additions -Agenda Approval.Motion by Councihnan Strain,seconded by
Councihnan Gruber,to approve the agenda as presented.The Mayor asked for a voice vote.
Motion carried 5 to O.
Consent Agenda -A)10/07/96 Council Minutes and B)Salary and Bill Presentation.
Motion by Councilman Gruber,seconded by Councihnan Strain,to approve the Consent Agenda.

fees to cover the increase of the tipping fees at North Dallas County Landfill.Motion by ;r "Vi>')I!
Councilwoman Lihs,seconded by Councihnan Strain,to have the Clerk read the Solid Waste
Ordinance for the 3rd time in title only.The Mayor asked for a roll call vote:Ayes:Lihs,Strain,
Heath,Lugar,and Gruber.Nays:None.Motion carried 5 to O.

Ordinance No.2224 IANORDINANCEAMENDINGCHAPTER213AOFTHEMUNICIPALCODEOFTHE
CITY OF WAUKEE,PROVIDING FOR THE ASSESSING OF FEES OR CHARGES FOR
THE COLLECTION,PROCESSING AND MARKETING OF SOLID WASTE AND
RECYCLABLE MATERIALS WITHIN THE CITY LIMITS OF THE CITY OF WAUKEE,
IOWA,TO INCREASE COLLECTION CHARGES,AND TO NOTE THAT THE BINS ARE
THE PROPERTY OF THE CITY OF WAUKEE.(SEE "ORDINANCE BOOK").
Motion by Councilman Lugar,seconded by Councilman Strain,to amend Section 4D read
"recycling container shall remain the property of the City of Waukee."The Mayor asked for a
roll call vote:Ayes:Lugar,Strain,Lihs,Heath,and Gruber.Nays:None.Motion carried 5 to O.
Motion by Councilman Gruber,seconded by Councilwoman Lihs,to put the Solid Waste
Ordinance on its final passage.The Mayor asked for a roll call vote:Ayes:Gruber,Lihs,Strain,
Heath,and Lugar.Nays:None.Motion carried 5 to O.
Mayor Bailey declared the Ordinance No.2224 duly adopted and passed.
Subdivision Ordinance -1st Reading.After a lengthy discussion,motion by Councilwoman
Lihs,seconded by Councilman Lugar,to accept the proposed land subdivision regulations that
were submitted by Jeff Downing and set a hearing date for Tuesday,October 29,1996 at
7:00pm.The Mayor asked for a voice vote.Motion carried 5 to O.I
Motion by Councilwoman Lihs,seconded by Councilman Lugar,to table the first reading of the
Subdivision Ordinance.The Mayor asked for a roll call vote:Ayes:Libs,Lugar,Gruber,Heath,
and Strain.Nays:None.Motion carried 5 to O.
Acceptance of City Hall Furnace Bids.Several weeks ago the furnace at city hall was
inspected and found to be unsafe.Because of the urgency of getting a new furnace the City
Administrator sought bids and had the furnace installed.Motion by Councilwoman Lihs,
seconded by Councilman Lugar,to support the Administrator's decision to accept the bid low
from Ade1 &Winterset TV and Appliance for $2,050.The Mayor asked for a roll call vote:
Ayes:Lihs,Lugar,Heath,Strain,and Gruber.Nays:None.Motion carried 5 to O.
Casino America Dallas County River Boat Gambling.Motion by Councilwoman Libs,
seconded by Councilman Lugar,to accept the Dallas County River Boat Gambling Study
Committee report.The Mayor asked for a roll call vote:Ayes:Lihs,Lugar,Strain,Gruber,and
Heath.Nays:None.Motion carried 5 to O.
University Trunk Sewer Area Update.After a lengthy discussion,the Council directed Kurt
to schedule a meeting with all the residents in the mea.I4
US Energy Services Contract.Motion by Councilwoman Lihs,seconded by Councilman
Lugar,to direct the Public Works Department to draw up specifications and seek bids for this
service.The Mayor asked for a roll call vote:Ayes:Lihs,Lugar,Strain,Heath,and Gruber.
Nays:None.Motion carried 5 to O.
Windfield Park Equipment Installation.The Public Works Department ordered and received
the equipment for Windfield Park.Motion by Councihnan Lugar,seconded by Councilman
Gruber,to hire a contractor to install the park equipment at a cost not to exceed $5,000.The
Mayor asked for a roll call vote:Ayes:Lugar,Gruber,Strain,Lihs,and Heath.Nays:None.
Motion carried 5 to O.
Mayor's Report.The Mayor reported the following:the street painting and bonfire were a big
success;Kurt and Mayor Bailey met with the Auditor's last week and a the Council will be
receiving a copy of the report next week;the Mayor will be sponsoring ajuvenile diabetes walk
in March thru the City;voiced concern regarding the mounts of dirt sitting on the shoulder ofthe
roads;the Mayor met with Chad Waller,Shelter Insurance last week;and Paul Huscher stated he
talked with the attorney with MWR Telecom and the most fiber strands they had ever given is
two.
Development Committee Report.The Council was given a written report.
Attorney's Report.Motion by Councilwoman Lihs,seconded by Councilman Strain,to enter
into closed session under section 21.51(C)"To discuss strategy with Counsel in matters that are
presently in litigation or where litigation is imminent where its disclosure would be likely to
prejudice or disadvantage the position of the governmental body in that litigation".The Mayor
asked for a roll call vote:Ayes:Lihs,Strain,Heath,Gruber,and Lugar.Nays:None.Motion
carried 5 to O.
The Council entered into closed session at 10:02pm.
The Council carne out of closed session at 10:26pm.
Motion by Councilman Gruber,seconded by Councilwoman Lihs,to appeal the Waukee/Clive
armexation decision made by the Polk County Development Board.The Mayor asked for a roll
call vote:Ayes:Gruber,Lihs,Strain,Heath,and Lugar.Nays:None.Motion carried 5 to O.
Motion by Councilman Gruber,seconded by Councilwoman Heath,to enter into closed session
