Roll Call.A roll call vote was taken and the following Council Members were present:Nick Gruber,Robyn Heath,Monica Lihs,and Dan Lugar.Absent:Terry Strain. Open Forum:None. Agenda Addltfons -Agenda Approval.Add to the agenda 19C·Closed Session 21.51G Discussion Only.Motion by Councilman Gruber,seconded by Councilwoman Lihs,to approve the Agenda.The Mayor asked for a voice vote.Carried voice vote. Motion carried 3 to 1.• McLeod USA Right-of-Way Agreement.Motion by Councilman Lugar,seconded by Councilwoman Heath,to approve the agreement with the suggested changes.The Mayor asked for a roll call vote:Ayes:Lugar,Heath,Lihs and Gruber.Nay:None.Motion carried 4 to O. Lease of Water Tower -US Cellular Corp.Tabled until 3/17/97. Solid Waste Ordinance Collection at Townhome Units.Motion by Councilman Lugar, seconded by Councilman Gruber,to send this item to the Utility Committee.The Mayor asked for a roll call vote:Ayes:Lugar,Gruber,Lihs,and Heath.Nays:None.Motion carried 4 toO. Insurance Bid Results.Rodger Howell -because ofthe publication in the paper there was sufficent events that there was a possibility of an insurance change. Kim Bilbrey -ICAP,was aware the City was seeking insurance bids. Mayor Bailey recommended that this item be table until the March 10the meeting and have Kurt bring a recommendation to the Council. Motion by Councilman Lugar,seconded by Councilwoman Lihs,to accept the Insurance Bid from ICAP.The Mayor asked for a roll call vote:Ayes:Lugar,Lihs,Gruber,and Heath.Nays. None.Motion carried 4 to O. Set A Date for a Public Hearing -Revised Zoning Ordinance.Motion by Councilman Gruber,seconded by Councilwoman Heath,to set a hearing date for March 17,1997 at 7:00pm for a Revised Zoning Ordinance and the rezoning request from Williams Turf Farm.The Mayor asked for a roll call vote:Ayes:Gruber,Heath,Lihs,and Lugar.Nays:None.Motion carried 4 to O. Permission to Seek Bids for 1997 Police Car.Motion by Councilman Lugar,seconded by Councilwoman Lihs,to give the Police Department permission to seek bids for a new police car not to exceed $21,000.The Mayor asked for a roll call vote:Ayes:Lugar,Lihs,Heath and Gruber,Nays:None.Motion carried 4 to O. Consideration of Participation in a County Wide Tire Collection Grant.Motion by Councilman Lugar,seconded by Councilwoman Lihs,to approve participation in a County Wide Tire Collection.The Mayor asked for a roll call vote.Ayes:Lugar,Lihs,Gruber and Heath. Nays:None.Motion carried 4 to O. Proposed 28E -Cable Review Services Agreement.Motion by Councilman Lugar,seconded by Councilman Gruber,to give Kurt permission to attend the join meeting to discuss the proposal.The Mayor asked for a roll call vote:Ayes:Lugar,Gruber,Lihs,and Heath.Nays: None.Motion carried 4 to O. Mayor's Report.Mayor Bailey introduced the new EMS Captain,Terry Gibson;The Juvenile Diabetes Foundation raised between $500,000 and $600,000;appoint Linda Foltz to the parks committee;the citizen work order book needs to be updated;Bob Sayre has talked with the Mayor regarding the condition of North 6th Street;~) Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to accept the Mayor's report. The Mayor asekd for a voice vote.Motion carried. Planning and Zoning Report.A written report was handed out.Motion by Councilman Lugar, seconded by Councilwoman Lihs,to accept the P &Z report.The Mayor asked for a voice vote. Motion carried. Parks Report.A written report was handed out.Motion by Councilman Lugar,seconded by Councilwoman Heath,to accept the Park Committee report.The Mayor asked for a voice vote. Motion carried. Administrator's Report.Kurt announced that Larry Ryan,Code Enforcement Officer,started work;there has been alot of interest for commercial developed along Alice's Rd and University. Motion by Councilman Lugar,seconded by Councilwoman Lihs,to accept the Administrator's report.The Mayor asked for a voice vote.Motion carried. Attorney's Report. Annexation -Closed Session.Brief is due on good friday. Landfill -Closed Session.Paul had not received anything.Motion by Councilwoman Lihs, seconded by Councilwoman Heath.I Motion by Councilman Gruber,seconded by Councilwoman Lihs,to enter into closed session 21.51 G "To avoid disclosure of specific law enforcement matters,such as current or proposed investigations,inspection or auditing techniques or schedules,which if disclosed would enable law violators to avoid detection".The Mayor asked for a roll call vote:Ayes:Gruber,Lihs, Heath and Lugar.Nays:None.Motion carried 4 to O. The Council entered into closed session at 8 :20pm. The Council came out of closed session at 9:04 pm. Motion to adjourn at 9:05 pm by Councilwoman Lihs,second by Councilman Lugar.Motion passed 4-0.
