Bailey,Jr. Roll Call.A roll call vote was taken and the following Council Members were present:Nick Gruber,Robyn Heath,Monica Lihs,Dan Lugar,and Terry Strain. Open Forum.Larry Lyon -610 Boone Drive -would like to publicly commend the Waukee Law Enforcement Officials for successfully slowing down the traffic on Boone Drive but there still is a problem with the dust.Kurt stated that a dust control application is to be applied on Tuesday,May 6th.Larry requested a speed limit sign posted south of the ball park entrance. Agenda Additions -Agenda Approval.Motion by Councilman Lugar,seconded by Councilwoman Lihs,to approve the agenda with the deletion of item #6.The Mayor asked for a voice vote.Motion carried. They have done a tremendous job.The Mayor presented the group with a certificate of Appreciation.Clark Bowden accepted the certificate for the Courtyard Crew Garden Club. Zoning Ordinance -3rd Reading.Kurt Rueckel explained several concerns regarding R-4 Town Houses and Mobile Homes Parks.Early Friday afternoon Kurt received a letter from Kathryn Barnhill representing the concerns of some mobile home park residents.Kurt recommended to pass the Zoning Ordinance and try to resolve these issues within the next month. Jeff Downing would hate to see the Council pass the Zoning Ordinance without the issues resolved. Mayor Bailey suggested to the Council to delay the passing of the Zoning Ordinance until the May 19th meeting. Councilman Strain asked if the Planning &Zoning Commission addressed Mr.Downing concerns.Councilman Strain would like to know the recommendations of the Planning and . Zoning Commission. Councilman Gruber had a problem with the Zoning Ordinance as currently written. Councilman Lugar would like to have all items of concerns addressed before any further action is taken. Councilwoman Lihs would like to have Paul Huscher's legal opinion regarding the Mobile Home Park letter. Paul Huscher will read the letter and give his legal opinion. Motion by Councilman Strain,seconded by Councilman Lugar,delay item #7 and to direct Kurt to meet with John Kursitis,Councilwoman Heath,Jeff Downing and anyone else Kurt feels would be appropriate to attend to discuss the Zoning Ordinance concerns.The Mayor asked for a roll call vote:Ayes:Strain,Lugar,Lihs,Heath,and Gruber.Nays:None.Motion carried 5 to O. Resolution Regarding Zoning Fees and Charges.Motion by Councilwoman Lihs,seconded J/ by Councilman Lugar,to approve Resolution No.97-15 setting fees for it )'.f Planning/Subdivision/Zoning and all additional cost incurred by the City of Waukee for review jf if!.fJ fees of the City Engineer and/or City Attorney;and reimbursement for publication charges when 3 warranted due to excessive costs.The Mayor asked for a roll call vote:Ayes:Lihs,Lugar, Gruber,Heath,and Strain.Nays:None.Motion carried 5 to O.) Consideration of New Sewer Lagoon Facility Plans.John Kursitis,V &K,and John Wesselmann,Public Works Director,reported to the Council regarding the Sewer Lagoon Project Treatment process to allow additional growth in the city.John Kursitis presented an updated Biolac System with a proposed cost of$I,156,OOO.00 for Phase 1 and $881,000 for Phase 2. Motion by Councilwoman Lihs,seconded by Councilman Gruber,to set a date for a public hearing June 2nd regarding the Sewer Lagoon Facility.The Mayor asked for a roll call vote: Ayes:Lihs,Gruber,Strain,Heath,and Lugar.Nays:None.Motion carried 5 to O. Impact Fees -WaterlSewer/Warning Sirens.Kurt Rueckel presented to the Council an analysis of impact fees for the Sewer Plant expansion. Councilman Lugar would like to see all citizens share the cost for Phase 2 of the sewer plan expansion.Ifthe city does not adopt impact fees the sewer rates will have to increased. Motion by Councilman Gruber,seconded by Councilwoman Lihs,to direct Kurt Rueckel to meet with area developers and have several council members attend to discuss the possible impact fees.The Mayor asked for a roll call vote:Ayes:Gruber,Lihs,Heath,Lugar,and Strain.Nays:I None.Motion carried 5 to o.J Budget Amendment -Set a Date for Public Hearing.Motion by Councilman Gruber, seconded by Councilwoman Lihs,to set a public hearing May 19th at 7:00pm for a Budget Amendment.The Mayor asked for a roll call vote:Ayes:Gruber,Lihs,Heath,Strain,and Lugar. Nays:None.Motion carried 5 to O. Gas Rebate Program.John Wesselmann presented a Gas Rebate Program to the Mayor and Council.Motion by Councilman Strain,seconded by Councilwoman Heath,to implement the Gas Rebate Program by July 1,1997.The Mayor asked for a roll call vote:Ayes:Strain,Heath, Lihs,and Gruber.Nays:Lugar.Motion carried 4 to 1. Attorney Fees for Board of Adjustments.Motion by Councilman Gruber,seconded by Councilwoman Lihs,to have the City Attorney at the Board of Adjustment hearing when requested and have Kurt review the fees to see if the city needs to increase them.The Mayor asked for a roll call vote:Ayes:Gruber,Lihs,Lugar,Strain and Heath.Nays:None.Motion carried 5 to O. Agreement for Maintenance and Repair of Primary Roads in Municipalities.Motion by Councilwoman Lihs,seconded by Councilman Gruber,to approve the agreement with Iowa Department of Transportation for maintenance and repair of primary roads in Municipalities. The Mayor asked for a roll call vote:Ayes:Lihs,Gruber,Heath,Strain,and Lugar.Nays:None. Motion carried 5 to O. Approval of NDRSWPC By-Laws.Motion by Councilman Lugar,seconded by Councilman Strain,to approve the NDRSWPC By-Laws.The Mayor asked for a roll call vote:Ayes:Lugar, Strain,Gruber,Lugar,and Lihs.Nays:None.Motion carried 5 to O. Mayor's Report.The Mayor announced the following:Rick Huscher was appointed to Judgeship effective May 29th;the city will need to fmd a new prosecuting attorney;the covered bridge project -KCCI awarded the city with the Project Mainstreet Grant;received a Thank You note from the Girls Scouts;introduced Beth Kusel as the new Dallas County News reporter; declared May 4th -10th Municipal Clerk's week;Michelle Hillman,Waste Management,send a very nice letter regarding the City Livability Awards and stating we were the only city in the Des Moines area that applied for this award. Motion by Councilwoman Lihs,seconded by Councilman Gruber,to accept the Mayor's report. The Mayor asked for a voice vote.Motion carried.
