Bailey,Jr. Roll Call.A roll call vote was taken and the following Council Members were present:Nick Gruber,Robyn Heath,Monica Lihs,Dan Lugar,and Terry Strain. Open Forum.Lyn Schafer presented the Council with a plaque received from the Project Main Street. Mayor Bailey mentioned all the work the Waukee Jaycees did obtaining the bridge from Mr. Terry who donated the bridge to the city and Mr.Bissel for moving the bridge at his own expense. Tom Davis,spoke to the Council regarding the clean-up day.Several of the residents of the Mobile Home Court felt they were treated unfairly because they were not included.Tom mentioned that the lots are inspected on a monthly basis and the court has a program in place. Zoning Ordinance -3rd Reading.Jeff Downing,Downing Development,mentioned some of his remaining concerns. Motion by Councilman Strain,seconded by Councilman Lugar,to send Zoning Ordinance back to the Planning and Zoning Commission for review and return to the Council for the third reading on June 2.The Mayor asked for a roll call vote:Ayes:Strain,Lugar,Heath,Lihs,and Gruber.Nays:None.Motion carried 5 to O. Impact Fees -Discussion Only.Motion by Councilman Lugar,seconded by Councilwoman Lihs,to delay the discussion of impact fees until the 2nd meeting in June.The Mayor asked for a ·1 roll call vote:Ayes:Lugar,Lihs,Heath,Strain,and Gruber.Nays:None.Motion carried 5 to O. North 6th Street Easements/Deeds Acquisition.Paul recommended a change to include a section showing the reason for the easement.Paul recommended to approve the easements with some minor changes. Motion by Councilman Lugar,seconded by Councilman Strain,to accept the easements.The Mayor asked for a roll call vote:Ayes:Lugar,Strain,Heath,and Gruber.Nays:Lihs.Motion carried 4 to •. Joint Fire Services Grant -Permission to Apply.Motion by Councihnan Lugar,seconded by Councihnan Strain,to delay granting permission to apply for the grant until Kurt talks with Clive.The Mayor asked for a roll call vote:Ayes:Lugar,Strain,Lihs,Heath,and Gruber.Nays: None.Motion carried 5 to O. Request To Use Proceeds from Sale of Equipment -Waukee EMS.Motion by Councilman Strain,seconded by Councilman Gruber,to allow the EMS to use the proceeds from the Sale of Equipment.The Mayor asked for a roll call vote:Ayes:Strain,Gruber,Heath and Lihs,Nays: Lugar.Motion carried 4 to 1.I 4 University Avenue Trunk Sewer Easement Acquisition.Table until item 20.b later in the meeting. Resolution Appointing Paul E.Huscher -Prosecuting Attorney.Motion by Councilman Gruber,seconded by Councilwoman Lihs,to appoint Paul E.Huscher as Prosecuting Attorney. The Mayor asked for a roll call vote:Ayes:Gruber,Lihs,heath,Strain and Lugar.Nays:None. Motion carried 5 to O. Mayor's Report.The Mayor appointed Chris Brown to serve on the Community Betterment Committee;attended the granaopening of the Waukee State Bank;last Wednesday Mayor Bailey attended a meeting with the YMCA and the School to discuss the future programs; received a letter from the Iowa League of Cities on behalf of senator Douglas. Motion by Councilman Lugar,seconded by Councilwoman Lihs,to accept the Mayor's report. The Mayor asked for a voice vote.Motion carried. Library Report.Motion by Councilman Strain,seconded by Councilwoman Lihs,to accept the Library report.The Mayor asked for a voice vote.Motion carried. Utility Report.Motion by Councilman Lugar,seconded by Councilman Gruber,to accept the Utility Committee report.The Mayor asked for a voice vote.Motion carried. Administrator's Report.Motion by Councilman Lugar,seconded by Councilwoman Lihs,to accept the Administrator's report.The Mayor asked for a voice vote.Motion carried. Treasurer's Report.Charlene briefly explained the Treasurer's report to the Council.Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to accept the Treasurer's report. The Mayor asked for a voice vote.Motion carried. Attorney's Report. Annexation -Closed Session.Motion by Councilman Gruber,seconded by Councilman Lugar, to enter into closed session 21.51 (C)to discuss strategy with counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation.The Mayor asked for a roll call vote:Ayes:Gruber,Lugar,Lihs,Heath and Strain.Nays:None.Motion carried 5 to 0 .. Council entered into closed session at 8:34pm. Landfill -Closed Session. Closed Session -21.5(C ). 5 The Council came out of closed session at 9:09pm.IMotionbyCouncilmanStrain,seconded by Councilman Lugar,to amend the easement previously approved for the University Avenue Trunk Sewer from David Conn,but increase to the dollar amount $17,000.The Mayor asked for a roll call vote:Ayes:Strain,Lugar,Lihs, Heath,and Gruber.Nays:None.Motion carried 5 to O.
