1.Bailey,Jr.
Roll Call.A roll call vote was taken and the following Council Members were present:Nick
Gruber,Robyn Heath,Monica Lihs,and Terry Strain.Absent Dan Lugar.
Open Forum.Mayor Bailey thauked Mr.Brackin and Mr.McFarland from West Des Moines
for attending the meeting.
Jim Phillips,240 Be1-Aire,felt the city should provide retro active the rebates for gas furnaces
and air conditioners.Jim feels this item should be put up for vote of the citizens of Waukee
before the city passed this.
Agenda Approval-Agenda Approval.Motion by Councilman Gruber,seconded by
Councilwoman Lihs,to approve the agenda as presented.The Mayor asked for a voice vote.
Motion carried voice vote.
Consent Agenda -A)5119/97 Council Minutes;B)Salary and Bill Presentation;and C)
Casey's -Beer Permit and Sunday Sales.Mayor Bailey had a question on the digital camera
that was purchased by the Water Department -John explained what the camera would be used
for and that it should have been taken out of several departments that will also be using the
camera.Also the bill from Electro-serv -this bill was from running the electric to the new
odorant system,and Public Works cellular phone bill-John explained they purchased extra
batteries,antennas and several leather carrying cases.
Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to approve the consent
agenda.The Mayor asked for a roll call vote:Ayes:Lihs,Heath,Strain,and Gruber.Nays:
None.Motion carried 4 to O.

cleaning up litter along University Avenue on Saturday,June 28th.
Abandonment of Alley Way -S.E.Corner of Laurel &5th Street.Motion by Councilman
Gruber,seconded by Councilwoman Lihs,to set a public hearing date for June 16th.The Mayor
asked for a roll call vote:Ayes:Gruber,Lihs,Heath,and Strain.Nays:None.Motion carried 4
to O.
University Avenue Trunk Sewer -Hardy's Update.Hardy's Construction updated the
Council on the progress ofthe University Avenue Trunk Sewer Project.
Application for the Display of Fireworks.Motion by Councilman Strain,seconded by
Councilman Gruber,to approve the permit for the display of fireworks submitted by Deb Rolek
with the exclusion of aerial fireworks,The Mayor asked for a roll call vote:Ayes:Strain,
Gruber,Heath,and Lihs.Nays:None.Motion carried 4 to O.
Motion by Councilman Gruber,seconded by Councilwoman Heath,to allow the use of roman
candles but no other aerial fireworks.The Mayor asked for a roll call vote:Ayes:Gruber,Heath,
Strain.Nays:Lihs.Motion carried 3 to I.
Zoning Ordinance -3rd Reading.Marsha Knaack does not feel the city has be acting in good
faith if the zoning ordinance is passed because Councilwoman Lihs directed Paul Huscher,City
Attorney,to contact Ms.Barnhill regarding the concerns she addressed.

Motion by Councilman Gruber,to approve the 3rd reading ofthe zoning ordinance in title only.
Motion failed for lack of a second.]
Motion by Councilman Gruber,seconded by Councilman Strain,to set a meeting when
convenient for all parties involved.The Mayor asked for a roll call vote:Ayes:Gruber,Strain,
Lihs,and Heath.Nays:None.Motion carried 4 to O.
Permission to Apply for Grant to Study Joint Fire Services.Motion by Councilman Gruber,
seconded by Councilwoman Heath,to apply for the grant with the in-kind matching would be
done by the Fire Staff and not the city staff.The Mayor asked for a roll call vote:Ayes:Gruber,
Heath.Nays:Lihs and Strain.Motion died.
This discussion is scheduled for the next Council meeting.
Triangle Park -Curb Project.Motion by Councilman Gruber,seconded by Councilman
Strain,to accept the bid from N.C.Ltd not to exceed $9,060.00 for the Triangle Park Curb
project with completion date before the 4th of July celebration.The Mayor asked for a roll call
vote:Ayes:Gruber,Strain,Heath,and Lihs.Nays:None.Motion carried 4 to O.
Wastewater Treatment Facility Study -Public Hearing.Mayor Bailey opened the Public
Hearing at 8:45pm.
Veenstra &Kimm described the proposed project which will increase the capacity of the plant to
6,000 persons and to change the treatment process to help the city meet it regulation s year
round.

Mayor Bailey asked if any written comments had been received.Mr.Rueckel had not received
any comments.
Mayor Bailey asked for any comriJ.ents from the audience.None were received.
Mayor Bailey closed the hearing.
Motion by Councilman Gruber,seconded by Councilwoman Lihs,to formally submit the
Wastewater Treatment Facility Study.The Mayor asked for a roll call vote:Ayes:Gruber,Lihs,
Strain,and Heath.Nays:None.Motion carried 4 to O.
Adoption of Preliminary Resolution -1997 Street Improvements.Motion by Councilman
Strain,seconded by Councilwoman Heath,to adopt the Preliminary Resolution No.97-19
pursuant to section 384.42 ofthe code ofIowa covering the 1997 Street improvements and
Cherry Street improvement projects.The Mayor asked for a roll call vote:Ayes:Strain,Heath,
Gruber,and Lihs.Nays:None.Motion carried 4 to O.I

Adoption of Resolution Approving and Adopting Preliminary Plans and Specifications,~1~..<J
Estimate of Cost and Plat and Schedule.Motion by Councilman Strain,seconded by
Councilwoman Heath,to adopt Resolution 97-20 approving and adopting the preliminary plans
and specifications,and plat and schedule and estimate of costs pertaining to the 1997 Street
Improvements and Cherry Street Improvement Projects including sidewalks along Cherry Street.
The Mayor asked for a roll call vote:Ayes:Strain,Heath,Lihs,Gruber.Nays:None.Motion
carried 4 to O.
Special Assessment Street Projects -Set Date for Public Hearing.Motion by Councilman
Strain,seconded by Councilwoman Heath,to set a date for a public hearing on the proposed
Resolution of Necessity on the 23th day of June,1997,at 7:00pm at the Waukee Public Library
in the City,and that the City Clerk be authorized and directed to give notice of the public hearing
by publication and mailing,as required by Section 384.50 of the Code ofIowa and that the notice
be in substantially the form set out in these proceedings.The Mayor asked for a roll call vote:
Ayes:Strain,Heath,Lihs,and Gruber.Nays:None.Motion carried 4 to o.
Alice's Road Special Assessment Consideration Revisited.Tabled.
Mayor's Report -TCI Rate Review.Motion by Councilman Strain,seconded by
Councilwoman Heath,to protest the cable installation rate increases.The Mayor asked for a roll
call vote:Ayes:Strain,Heath,Gruber,Lihs.Nays:None.Motion carried 4 to o.
The Mayor meet with Sue Stonehacker and visited her business;met with Mayor Brownell and
Kurt May 30th;warning sirens may be installed within the next year to improve our system;
North 6th Street easements have been reviewed and are ready to sign;attended the ceremony for
the swearing in of Rick Huscher to judgeship.
Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to approve the Mayor's
report.The Mayor asked for a voice vote.Motion carried.
Planning and Zoning Report.Motion by Councilwoman Lihs,seconded by Councilman
Gruber,to approve the Planning and Zoning report.The Mayor asked for a voice vote.Motion
carried.
Parks Report.Motion by Councilman Gruber,seconded by Councilwoman Heath,to approve
the Parks report.The Mayor asked for a voice vote.Motion carried.
Economic Development Report.Motion by Councilwoman Lihs,seconded by Councilwoman
Heath,to approve the Economic Development report.The Mayor asked for a voice vote.
