HomeMy WebLinkAbout1997-06-16-Regular MinutesThe June 16,1997 Waukee City Council meeting was called to order at 7:00pm by Mayor Donald L.Bailey,Jr. Roll Call.A roll call vote was taken and the following Council Members were present:Nick Gruber,Robyn Heath,Monica Lihs,Dan Lugar,and Terry Strain.Absent:None. Open Forum.Elizabeth De Witt spoke to the Council regarding the Centennial Park play equipment and that she is upset about the city removing the play equipment. Mayor Bailey explained the equipment had to be removed because of the liability factor. John Wesselmann explained that the Park Board will be talking about replacing the equipment at their next meeting. Councilman Strain announced Paul Huscher's victory regarding the Annexation Hearing. Agenda Additions -Agenda Approval.Motion by Councilman Lugar,seconded by Councilwoman Heath with the addition of item SA -Appointment of Linda Hommer to the Library Board of Trustees;and change item #17 to item SB -Shared Fire Services Grant - Permission to Apply.The Mayor asked for a voice vote.Motion carried. Shared Fire Services Grant -Permission to Apply.Motion by Councilman Gruber,seconded by Councilwoman Heath,to have the joint study and the in-kind work to be performed by the 3 volunteers and not the city staff and also solicit other surrounding conununities.The Mayor asked for a roll call vote:Ayes:Gruber,Heath,Lugar.Nays:Lihs,and Strain.Motion carried 3 to 2.I Vacating Alley -Public Hearing.Mayor Bailey open the Public Hearing at 7:25pm. The Mayor asked for any written or verbal conunents.Mr.Rueckel stated that non had been received. Mayor Bailey closed the hearing. Motion by Councilman Gruber,seconded by Councilman Lugar,to direct the City Attorney to prepare the proper paperwork to vacate the alleyway south of Laurel,north ofRR tracks just east of 6th Street.The Mayor asked for a roll call vote:Ayes:Gruber,Lugar,Heath,Lihs and Strain. Nays:None.Motion carried 5 to O. Zoning Ordinance -3rd Reading.Mr.Rueckel reconunended to pass the Zoning Ordinance as is and correct/revise any items of concern regarding the Mobile Home Park at a later date. Motion by Councilman Gruber,seconded by Councilman Lugar,to have the clerk read the ordinance in title only.The Mayor asked for a roll call vote:Ayes:Gruber,Lugar,Heath,Lihs, and Strain.Nays:None.Motion carried 5 to O. Motion by Councilman Gruber,seconded by Councilwoman Lihs,to put Ordinance No.222J;,an ordinance establishing comprehensive zoning regulations for the City of Waukee,Iowa,and providing for the administration,enforcement,and amendment thereof,in accordance with the provisions of Chapter 414,Code of Iowa,and for the repeal of Chapter 301 of the Municipal Code and all ordinances in conflict herewith,on final passage.The Mayor asked for a roll call vote:Ayes:Gruber,Lihs,Heath,Strain,and Lugar.Nays:None.Motion carried 5 to O. j Hawthorne Ridge -Preliminary Plat.Motion by Councilman Gruber,seconded by Councilwoman Heath,to approve the Preliminary Plat.The Mayor asked for a roll call vote: Ayes:Gruber,and Heath.Nays:Lihs,Strain,and Lugar.Motion failed 2 to 3. Mobile Home Park Construction Plans.Tabled until drainage issues to Broderick property are resolved.Larry Ryan informed the Council that all of the homes have a seal,and most a certificate of occupancy.He stated that this does not mean all of the homes were properly set. The only way the City can re-inspect mobile homes that have a seal is at the owner's request.Joe Brick,representing the Mobile Home Park stated that the offer to reset the homes was still on the table. ~Preliminary &Final Plat Carper's Ridge Subdivision.Motion by Councilwoman Lihs, '<,seconded by Councilman Strain,to approve Resolution No.#97-21 Carper's Ridge Subdivision~I4 Preliminary &Final Plat pending City Attorney's review of Legal documents.The Mayor asked for a roll call vote:Ayes:Lihs,Strain,Lugar,Heath,and Gruber.Nays:None.Motion carried 5 to O. Request for Deannexation -Jan Blazanin and Mike DeAnnda (Sahu Acres).Motion by Councilman Strain,seconded by Councilwoman Lihs,to decline the request from Jan Blazanin and Mike DeAnda for deannexation from the city.The Mayor asked for a roll call vote:Ayes: Strain,Lihs,Gruber,Lugar,and Heath.Nays:None.Motion carried 5 to O. Presentation "Proposed City Hall"-Concept Only.Tabled until 7/7/97. Councilman Gruber left at 9:56pm. Request to Extend Sewer Services to 142nd Street.Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to direct Kurt to write a letter to the City of Clive regarding the sewering of 142nd Street.The Mayor asked for a roll call vote:Ayes:Lihs,Heath,Lugar,and Strain.Nays:None.Motion carried 4 to O. Fire Department Request for Maps.Kurt will make all plat maps available to the Fire DepartmentlFirst Responders. First Responder -By-laws.Motion by Councilman Lugar,seconded by Councilman Strain,to approve the First Responder By-laws.The Mayor asked for a roll call vote:Ayes:Lugar,Strain, Lihs and Heath.Nays:None.Motion carried 4 to O. Solid Waste Fees.Motion Councilman Lugar,seconded by Councilman Strain,to have the 1st reading of the Solid Waste Fees in title only.The Mayor asked for a roll call vote:Ayes:Lugar, Strain,Lihs,and Heath.Nays:None.Motion carried 4 to O.This ordinance will increase the monthly fees from $8.65/month to $9.25/month,and $O.65/month to $O.80/month. Resolution of Necessity -Public Hearing Date.Motion by Councilwoman Lihs,seconded by '17-;/''''- Councilman Lugar,to set a date for a public hearing on the proposed Resolution of Necessity on 7th of July,1997,at 7:00pm at the Waukee Public Library and that the City Clerk be authorized and directed to give notice of the public hearing by publication and mailing,as required by Section 384.50 of the Code oflowa.The Mayor asked for a roll call vote:Ayes:Lihs,Lugar, Heath,Strain.Nays:None.Motion carried 4 to O. Special Assessment -Alice's Road.Discussion only. Contract for Fireworks.Motion by Councilwoman Lihs,seconded by Councilman Lugar,to accept the Fireworks contract.The Mayor asked for a roll call vote:Ayes:Lihs,Lugar,Strain, and Heath.Nays:None.Motion carried 4 to O. 5 Connection Fees -Discussion Only.Kurt briefed the Council and Mayor on the report from Veenstra and Kimm. Motion by Councilwoman Lihs,seconded by Councilman Strain,to direct Kurt to proceed with the connection fees and bring to the next Council meeting.The Mayor asked for a roll call vote: Ayes:Lihs,Strain,Heath.Nays:Lugar.Motion carried 3 to 1. Award Meter Reading Contract.Motion by Councilman Lugar,seconded by Councilwoman Lihs,to award the meter reading contract to Van Wert with a 30 -60 day termination clause.The Mayor asked for a roll call vote:Ayes:Lugar,Lihs,Heath,and Strain.Nays:None.Motion carried 4 to O. North 6th Street EasementslDeeds Acquisition.Kurt has not received all the signed easements/deeds back from the property owners. Mayor's Report.Mayor Bailey announced that Fareway will be coming to Waukee;the Women's Club spoke very highly of Kurt Rueckel for speaking at their meeting;discussed the problem with sidewalks on the south end of Third Street; Motion by Councilwoman Lihs,seconded by Councilman Lugar,to accept the Mayor's report. The Mayor asked for a voice vote.Motion carried. Library Report.Motion by Councilman Lugar,seconded Councilwoman Lihs,to accept the Library report.The Mayor asked for a voice vote.Motion carried.1 Utility Report.Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to accept the Utility report.The Mayor asked for a voice vote.Motion carried. Administrator's Report.Motion by Councilwoman Lihs,seconded by Councilwoman Heath, to accept the Administrator's report.The Mayor asked for a voice vote.Motion carried. Treasurer's Report.Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to accept the Treasurer's report.The Mayor asked for a voice vote.Motion carried. Attorney's Report.Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to discuss strategy with counsel in matters that are presently in litigation or where litigation is prejudice or disadvantage the position of the governmental body in that litigation.The Mayor asked for a roll call vote:Ayes:Lihs,Heath,Strain,Lugar.Nays:None.Motion carried 4 to O. The Council entered into closed session at 10:57.
