HomeMy WebLinkAbout1997-07-21-Regular MinutesThe July 21,1997 Waukee City Council meeting was called to order at 7:00pm by Mayor Donald L.Bailey,Jr. Roll Call.A roll call vote was taken and the following Council Members were present:Nick Gruber,Monica Lihs,and Terry Strain.Absent:Robyn Heath and Dan Lugar. Open Forum.The Mayor dedicated a framed print of the Covered Bridge taken by Marvin Terry.Mayor Bailey stated this is to be a symbolic remindered to build a community with the City staff,neighbors,and neighboring communities. Agenda Additions -Agenda Approval.Motion by Councilman Gruber,seconded by Councilwoman Lihs,to approve the agenda with the addition of item 9A -Jeff Downing presentation of a conceptual drawing of a building to be used for City Hall and Waukee School Administrative Offices.The Mayor asked for a roll call vote:Ayes:Gruber,Lihs,and Strain. Nays:None.Motion carried 3 to O. Consent Agenda -A)7/7/97 and 7/14/97 Council Minutes;B)Salary and Bill Presentation. Motion by Councilwoman Lihs,seconded Councilman Strain,to approve the Consent Agenda with the addition of the 3 following bills:R.D.McKinney Plumbing $884.93;Rota Rotor $117.50;and Smith's Sewer Service $55.00.The Mayor asked for a roll call vote:Ayes:Lihs, Strain,Gruber.Nays:None.Motion carried 3 to O. Councilman Strain stated that when the performance bond has expired on projects there is a point in time when the property owners have to assume responsibility for repairs. Motion by Councilman Gruber,seconded by Councilwoman Lihs,to approve the 10/3/97 Homecoming Parade at I :30pm,route will be determined later.The Mayor asked for a roll call 3 vote:Ayes:Gruber,Lihs,and Strain.Nays:None.Motion carried 3 to O. /\) Welcome Wagon Recognition Week July 21st -25th -Proclamation.Mayor Bailey read and signed a Welcome Wagon Proclamation,proclaiming the week of July 21st through July 25th, 1997 as Welcome Wagon Recognition Week. Resolution Amending Comprehensive Plan -Enterprise Business Park.Motion by Councilwoman Lihs,seconded by Councilman Strain,to pass Resolution #97-27 amending the City of Waukee Comprehensive Plan.The Mayor asked for a roIl calI vote:Ayes:Lihs, Strain and Gruber.Nays:None.Motion carried 3 to O. Public Hearing -Rezoning Property From A-1 to C-1 Enterprise Business Park (Future Expansion)-1st Reading.Mayor Bailey announced that now was the time and place for a public hearing in regard to an Ordinance Rezoning Property from A-I to C-I for the Enterprise Business Park for future expansion. There being no written or oral comments against the Ordinance,motion by Councilman Strain, seconded by Councilwoman Lihs,to have the Clerk read the Ordinance for the first time in title only.The Mayor asked for a roIl call vote:Ayes:Strain,Lihs,and Gruber.Nays:None.Motion carried 3 to O. Ordinance Raising Monthly Solid Waste Fees -3rd Reading.Motion by Councilwoman Lihs,seconded by Councilman Strain,to have the Clerk read the Ordinance for the third time in title only.The Mayor asked for a roIl calI vote:Ayes:Lihs,Strain,and Gruber.Nays:None. Ordinance No.2227 An Ordinance amending Chapter 213A of the Municipal Code of the City of Waukee, providing for the assessing of fees or charges for the collection,processing and marketing of solid waste and recyclable materials within the city limits of the City of Waukee,Iowa,by deleting Section 4 thereof and inserting a new Section 4 to increase coIlection charges for single family residences from $8.65 to $9.25 per month;to increase coIlection charges for a dwelling of two or three units from $8.65 to $9.25 per month;and to increase coIlection charges for multi- family dweIlings containing four or more units having a commercial type of container that may be mechanically emptied,and any mobile home park from $0.65 to $0.80 per unit per month,on its final passage.(SEE ORDINANCE BOOK). Connection Fees.A lengthy discussion took place regarding an in-depth report prepared by Veenstra and Kimm on possible connection fees for the City's water supply and wastewater 4 ) ) treatment facility.Council concluded to have the preparer of the report attend a Council meeting for further answers and discussion. Subdivision Ordinance Revision -lst Reading.Motion by Councilwoman Lihs,seconded by Councilman Gruber,to set the date of August 4,1997 for a public hearing for the first reading of a Subdivision Ordinance Revision.The Mayor asked for a roll call vote:Ayes:Lihs,Gruber,and Strain.Nays:None.Motion carried 3 to O. Contract for Engineering Design -Wastewater Treatment Facility.Veenstra &Kimm presented an agreement for engineering services for the City of Waukee Wastewater Treatment Facility improvements. Motion by Councilwoman Lihs,seconded by Councilman Strain,to accept the agreement with the stipulation that engineering design costs do not exceed the amount of$105,000.00.The Mayor asked for a roll call vote:Ayes:Lihs,Strain,and Gruber.Nays:None.Motion carried 3 to O. Resolution In Support ofthe "State and Local Government Empowerment Act".Motion by Councilman Strain,seconded by Councilwoman Lihs,to receive and table a Resolution in support of the "State and Local Government Empowerment Act".The Mayor asked for a roll call vote:Ayes:Strain,Lihs,and Gruber.Nays:None.Motion carried 3 to O. Repiping of Well By The Cemetery.City Public Works Director,John Wesse1mann,reported that the wall casing of the well located by the Waukee Cemetery was in poor condition.The cost to replace the casing would be approximately $6,000.00. Motion by Councilman Gruber,seconded by Councilman Strain,to have the necessary repairs made and not to exceed $6,000.00.The Mayor asked for a roll call vote:Ayes:Gruber,Strain, and Lihs.Nays:None.Motion carried 3 to O. Trading of Backhoe.City Public Works Director,John Wesselmann,reported that it is time to consider the two year trade program with the Case dealer for a hackhoe trade in the amount of $7,500.00. Motion by Councilman Gruber,seconded by Councilman Strain,to utilize the trade program with Contractor's Machinery for a new backhoe in the amount of $7,500.00.The Mayor asked for a roll call vote:Ayes:Gruber,Strain,and Lihs.Nays:None.Motion carried 3 to O. Resolution Setting Compensation for the Fire Chief and First Responder Captain.Motion by Councilman Strain,seconded by Councilwoman Lihs,to adopt Resolution No.97-28, approving compensation for the Waukee Fire Chief and First Responder Captain in the amount of$IOO.OO per month (each)beginning July 1,1997 and continuing until authorized by City Council.The Mayor asked for a roll call vote:Ayes:Strain,Lihs,and Gruber.Nays:None. 5 Motion carried 3 to O. Resolution Approving the 1997-98 Wage Scale and The Placement of Employees in the Appropriate Grades and Steps.A resolution approving the 1997-98 Wage Scale and placing the Employees in their Appropriate Steps was presented and discussed by the Council. J Motion by Councilwoman Lihs,seconded by Councilman Strain,for the Personnel Committee to review the Resolution No.97-29 approving the 1997-98 wage scale to July 1,1997.The Mayor asked for a roll call vote:Ayes:Lihs,Strain,and Gruber.Nays:None.Motion carried 3 to O. Mayor's Report.The Mayor thanked all parties involved in the 4th of July celebration, Community Betterment Committee,Councilwoman Lihs,Councilwoman Heath,Waukee Jaycees,First Responders,Fire Department,City Staff,Waukee Methodist Church,and Waukee Christian Church;Community Betterment Committee possibly needs to be the Community Betterment Association with representation of one person from all service groups;the Mayor will attend W.R.A.meeting;and discussed a letter from a utility customer with a disputed utility bill. City Administrator Ruecke1 commented that the City is investigating it. Motion by Councilwoman Lihs,seconded by Councilman Strain,to approve the Mayor's Report. The Mayor asked for a voice vote.Motion carried. Library Report.Motion by Councilwoman Lihs,seconded by Councilman Strain,to approve the Library Report.The Mayor asked for a voice vote.Motion carried.) Attorney's Report.Motion by Councilwoman Lihs,seconded by Councilman Gruber,to enter into closed session 21.51 (C)to discuss strategy with counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation.The Mayor asked for a roll call vote:Ayes:Lihs,Gruber,and Strain.Nays:None.Motion carried 3 to O. Council entered closed session at 9:25pm. Councel came out of closed session at 9:50pm. 6 ) ) Paul Huscher stated that he has written the letter of settlement to the landfill but has not received a response.
