Donald L.Bailey,Jr.
Roll Call.A roll call vote was taken and the following Council Members were present:Nick
Gruber,Monica Lihs,and Robyn Heath.Absent:Terry Strain.
Open Forum.
Mary Barry,Lot 839.The agenda item addressing the setting of her mobile home was deleted
from the agenda before the meeting and she would like to know when it would be on again.She
is trying to take out a permit to build a deck and can not until the resetting issue is resolved.
Marsha Knaack -mobile home park resident-this issue should not be put on hold until the law
suite is settled.The law suite should not effect this issue at all.
Mayor Bailey read a petition from the residents of Candleridge regarding the weeding on a
vacant lot on Laurel.
Agenda Additions -Agenda Approval.Motion by Councilman Gruber,seconded by
Councilwoman Lihs,to approve the agenda with the addition of 15A -Administrator's Report.
The Mayor asked for a voice vote.Motion carried.

Fall Festival-Permission To Hold -Block Off Streets.Jay Hoskinson,Business Association,
spoke to the Council requesting permission to have the Fall Festival with the tent and street
blocking the same as in past years,to use the City's generator,to hang banners,and to have the
flashing arrow sign on Highway 6.
Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to approve the plans for the
Fall Festival as requested.The Mayor asked for a roll call vote:Ayes:Lihs,Heath,and Gruber.
Nays:None.Motion carried 3 to O.
Fall Festival Parade Route.The parade route will start on North Warrior Lane to Ashworth,
west on Ashworth to 4th St,south on Fourth Street to 6th Street,north to the Co-op.Motion by
Councilwoman Lihs,seconded by Councilwoman Heath,to approve the Fall Festival Parade
Route.The Mayor asked for a roll call vote:Ayes:Lihs,Heath,and Gruber.Nays:None.
Motion carried 3 to O.
Library Preliminary Agreement for Future Library Site.Brad Mills,Library Board,spoke
to the Council explaining the plans for a future Library site on the south east comer of Warrior
Lane and Ashworth Drive.The Mayor and Council gave their blessing on the proposed location.
Public Hearing -Ordiuance Amending Zoning Ordinance To Reduce Required Parking
Lot Buffer from Residential Districts with Existing 30 foot Buffers.The City Council of the
City of Waukee,Iowa,met at the City Hall,in Waukee,Iowa,at 7:30 o'clock p.m.,on August
18,1997,pursuant to the published notice.The meeting was called to order,the Mayor presided

and the roll being called,the following named Council Members were present and absent:
Present:Nick Gruber,Monica Lihs,and Robyn Heath.Absent:Terry Strain.
Upon investigation,it was found that no persons had appeared and filed objections to the
proposed Ordinance amending 301.27 (A).
Motion by Councilman Gruber,seconded by Councilwoman Lihs,that the hearing be closed.
The Mayor put the question on the motion and the roll being called,the following named Council
Members voted:Ayes:Gruber,Lihs,and Heath.Nays:None.Motion carried 3 to O.
Motion by Councilman Gruber,introduced an ordinance to amend Chapter 301,Waukee
Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,by deleting Section 301.27 (A)
2 in its entirety and substituting in lieu thereoflanguage decreasing the required buffer between
parking lots and residential districts with existing 30 foot perimeter buffer zoning from 25 feet to
10 feet.
Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to read the ordinance in title
only for the first time.The Mayor asked for a roll call vote:Ayes:Lihs,Heath,and Gruber.
Nays:None.Motion carried 3 to O.
Motion by Councilman Gruber,seconded by Councilwoman Heath,to suspense of the 2nd and

The Mayor declared Ordinance No.2229 duly passage and adopted.
ORDINANCE NO.2229
AN ORDINANCE TO AMEND CHAPTER 301 ,WAUKEE MUNICIPAL CODE,
ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY DELETING
SECTION 301.27 (A)2 IN ITS ENTIRETY AND SUBSTITUTING IN LIEU
THEREOF LANGUAGE DECREASING THE REQUIRED BUFFER BETWEEN
PARKING LOTS AND RESIDENTIAL DISTRICTS WITH EXISTING 30 FOOT
PERIMETER BUFFER ZONES FROM 25 FEET TO 10 FEET.
Subdivision Ordinance Revision -2nd Reading.Motion by Councilwoman Lihs,seconded by
Councilwoman Heath,to amend the Subdivision Ordinance to have the time of collection of
connection fees to be when the building permits are issued and add the definition of subdivision

Agreement for Engineering Inspection Services -1997 Street and Cherry Street
Improvements.Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to enter
into the agreement for engineering inspection services for the 1997 Street and Cherry Street
improvements.The Mayor asked for a roll call vote:Ayes:Lihs,Heath,and Gruber.Nays:
None.Motion carried 3 to O.
Lowering Speed Limit -Warrior Lane (Hwy 6 to Ashworth).Motion by Councilman
Gruber,seconded by Councilwoman Lihs,to direct the City Attorney to draw up the ordinance to
lower the speed limit along Warrior Lane from Sunrise Drive to Ashworth.The Mayor asked for
a roll call vote:Ayes:Gruber,Lihs,and Heath.Nays:None.Motion carried 3 to O.
McCleod USA Agreement To Run Wire Through Portion of City Limits.Motion by
Councilman Gruber,seconded by Councilwoman Lihs,to enter into an Agreement with
McCleod USA with the changes noted and striking the limitations.The Mayor asked for a roll
call vote:Ayes:Gruber,Lihs,and Heath.Nays:none.Motion carried 3 to O.
Mayor's Report.The Mayor reported the following:Northview will be started on Aug 19th;
Cherry Street shouldbe completed this week;Dallas County will be providing ambulance service
on August 25th and will be located at the Police Department;received a letter from Terry and
Ann McAtee stating they will be moving and resigning from committees;received a call from
Gertrude Petersen she would like to organize the boy scouts to clean up between the hardware
and cafe;attended the Peachtree block party;and presented the article printed regarding Waukee
the most livable community,based on a Business Record poll.
Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to approve the Mayor's
report.The Mayor asked for a voice vote.Motion carried.
Planning and Zoning Report.Motion by Councilwoman Lihs,seconded by Councilman
Gruber,to approve the Planning and Zoning Report.The Mayor asked for a voice vote.Motion
carried.
Administrator's Report.Kurt announce he had received 4 letters of interest for the vacant
council seat -Jay Oxenford,Marvin Berger,Larry Lyon,and Jeff Downing.
Motion by Councilman Gruber,seconded by Councilwoman Heath,to schedule a special
meeting on August 25th to meet individually with the citizens interested in filling the vacant
council seat for 10-15 minutes each.The Mayor asked for a roll call vote:Ayes:Gruber,Heath,
and Lihs.Nays:None.Motion carried 3 to O.
Administrator's Report.Kurt announced the Auditor's are currently here and will be for 3 to 4
weeks;the first layer of asphalt has been put down on Cherry Street today;Northview will be
started tomorrow;and Boone Drive was completed today and will be opened shortly after school
starts next week.

Yard Waste Collection -the Council agreed with the recommendation to leave the yard waste
collection on the 2nd and 4th Mondays of each month,to be reviewed again in the fall when the
leaves start to change color.
Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to accept the
Administrator's report.The Mayor asked for a voice vote.Motion carried.
Attorney's Report.Annexation application-Clive has asked for a extension of time from the
Supreme Court.
Landfill -closed session.Motion by Councilwoman Lihs,seconded by Councilwoman Heath,
to enter into closed session 21.5(1)(C)to discuss strategy with counsel in matters that are
presently in litigation or where litigation is imminent where its disclosure would be likely to
prejudice or disadvantage the position of the governmental body in that litigation.The Mayor
asked for a roll call vote:Ayes:Lihs,Heath,and Gruber.Nays:None.Motion carried 3 to O.
