Donald L.Bailey,Jr.
Roll Call.A roll call vote was taken and the following Council Members were present:Nick
Gruber,Robyn Heath,Monica Lihs,and Terry Strain.
Open Forum.JeffVens -Southfork Parade -Sept 14th Southfork Picnic -Motion by
Councilwoman Lihs,seconded by Councilman Gruber,to approve the request for a Southfork
Parade on September 14th at 4:00pm.The Mayor asked for a voice vote.Motion carried.
Marge Lause -100 Northview Drive -inquired if anything had been done to the person or
persons responsible for the vandalism to the concrete work on Northview Drive.
Jim Barry -660 Little Walnut Creek Drive -spoke regarding the issue of Little Walnut Creek
Drive.This issue will be addressed as soon as the North 6th Street issue has been fmaled.The
City is still waiting for 2 residents along North 6th Street to sign the easement.
The Mayor directed Kurt to send letters to all the property owners along North 6th Street.
Jane Blazanin -600 Little Walnut Creek Drive -Jim Coons has provided rock for North 6th
Street to upgrade the conditions of the road.
Jane Blazanin -600 Little Walnut Creek Drive -would like a copy of the statement Terry Strain
made at the July 7th Council Meeting.
Mike DeAnda -600 Little Walnut Creek Drive -would like to know if a meeting with several
Council Members and all the residents of Sahu acres will be taking place within the next 2
weeks.The Mayor stated the meeting will take place within the next 30 days.
Mayor Bailey spoke regarding the Northview sidewalks.There are several properties the
sidewalk will be redone.If there are any other property owners that are unhappy with the
sidewalk please make Kurt at City Hall aware.
University Trunk Sewer is currently behind schedule.The estimated completion date is October
5th.
Agenda Additions -Agenda Approval.Delete item 8 and lOA from the agenda.Motion by
Councilman Gruber,seconded by Councilman Strain,to approve the agenda with the deletion of
items 8 -Consideration of Preliminary Packet for Color Converting,Inc.and lOa -Public
Hearing -Vacating of 5th Street (Ashworth -Maple).The Mayor asked for a voice vote.Motion
carried.

Appointment to Fill Council Vacancy.Tom Davis -Lot 833 MWMHC-would like to see the
appointed person be a running candidate to see how they would handle the position.
Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to appoint Mary White to
the vacant City Council seat.The Mayor asked for a roll call vote:Ayes:Lihs,Heath,Strain,and
Gruber.Nays:None.Motion carried 4 to O.
City Clerk Kurt Rueckel gave the oath of office to Ms.White.Councilwoman White took her
Council seat.
Rezoning Request Boone Drive -Set Public Hearing Date.Motion by Councilwoman Lihs,
seconded by Councilwoman Heath,to set a public hearing for the Rezoning of Boone Drive on
October 6,1997.The Mayor asked for a roll call vote:Ayes:Lihs,Heath,Strain,Gruber,and
White.Nays:None.Motion carried 5 to O.
Petition for Voluntary Annexation -South of University Avenue.Motion by Councilwoman
Lihs,seconded by Councilwoman White,to set a public hearing date for October 6,1997 to
consider the Petition for Voluntary Annexation south of University Avenue.The Mayor asked
for a roll call vote:Ayes:Lihs,White,Heath,Gruber,and Strain.Nays:None.Motion carried 5
to O.
Consideration of Providing Sewer Service 142nd Avenue.Kurt stated that Clive has not
provided a complete cost estimate.Their estimate is $1,035.00 per unit and $800.00 per acre,
there may be additional costs but Clive will not take the time now to figure those costs,as the
property is in Waukee ..
Change Orders 1 &2 1997 Street Projects.Motion by Councilwoman Lihs,seconded by
Councilman Gruber,to approve change orders 1 &2 -1997 Street Projects -change order #1
reduces the amount ofthe project by $21,176.51 by basing the asphalt from a tonnage basis to a
square yard basis;change order #2 -is to remove the trees,bushes,and the stone sign at the east
end of North view Drive.This will increase the project cost by $2,975.The Mayor asked for a
roll call vote:Ayes:Lihs,Gruber,Strain,White,and Heath.Nays:None.Motion carried 5 to O.
Discussion on Policy Requiring the Repair of Existing Sidewalks and Installation of New
Sidewalks -Community Wide.Marvin Whitlock stated there are water shut off valves sticking
out of the sidewalks and could easily hurt citizens that are walking.
Jim Phillips stated the sidewalks in the business district are in need of repair.

It is the Cities responsibility from the water main to the shut off valve and the homeowners
responsibility from the shut off valve to their homes.
Kurt stated there are several sidewalks in need of replace as soon as possible.
Councilman Strain would like the Code Compliance Officer to bring them a list of sidewalks in
need of repair.
Resolution Supporting Court Proceedings Protecting Cities ROW.Motion by
Councilwoman Lihs,seconded by Councilwoman Heath,to pass Resolution NO.97-31.The
Mayor asked for a roll call vote:Ayes:Lihs,Heath,White,Strain,and Gruber.Nays:None.
Motion carried 5 to O.This Resolution supports the City's participation in having the League of
Cities enter into legal proceeding to protect Cities ROW.
Subdivision Ordinance -3rd Reading -Final Passage.Motion by Councilman Gruber,
seconded by Councilman Strain,to have the 3rd reading in title only.The Mayor asked for a roll
call vote:Ayes:Gruber,Strain,White Heath,and Lihs.Nays:None.Motion carried 5 to O.

AN ORDINANCE ESTABLISHING COMPREHENSIVE LAND SUBDIVISION
REGULATIONS FOR THE CITY OF WAUKEE,IOWA,AND PROVIDING FOR THE
ADMINISTRATION,ENFORCEMENT,AND AMENDMENT THEREOF,AND FOR THE
REPEAL OF CHAPTER 303 OF THE MUNICIPAL CODE AND ALL ORDINANCES IN
CONFLICT THEREWITH.
University Avenue Easement -Schwartz.Motion by Councilman Gruber,seconded by
Councilwoman Heath,to approve the University Avenue Easement Agreement with Mr.
Schwartz.The Mayor asked for a roll call vote:Ayes:Gruber,Heath,White,Lihs,and Strain.
Nays:None.Motion carried 5 to O.The estimated cost of this agreement is $2,275.
Public Works/Code Compliance Building -Permission to Seek Bids.Councilman
Strain would like to focus on the shell of the building and use modular walls for the interior
walls.
Councilman Gruber feels that it would be a must to have a locker room with a shower.
Councilwoman Lihs voiced her concern with the needs of many other departments in the City for
more space and upgraded facilities.

Mayor Bailey would like to form a building committee and bring information back to the
Council.Councilman Gruber and Councilwoman White were put on the committee.
University Avenue Railroad Crossing -Change in Scope.Motion by Councilman Gruber,
seconded by Councilwoman Heath,to allow Public Works Director to implement the railroad
crossing replacement and also add the additional amount of concrete beyond the 15ft the state is
willing to pay for.The Mayor asked for a roll call vote:Ayes:Gruber,Heath,Lihs,Strain,and
White.Nays:None.Motion carried 5 to O.
Training Request for Employees -Public Works.Motion by Councilman Gruber,seconded
by Councilwoman Lihs,to allow the Public Works Director to schedule the Public Works
Employees for training classes.The Mayor asked for a roll call vote:Ayes:Gruber,Lihs,White,
Heath,Strain.Nays:None.Motion carried 5 to O.
Consideration of Wage Increase -City Clerk!Administrator.Motion by Councilman Gruber,
seconded by Councilwoman Lihs,to give the City Clerk!Administrator a 10%salary increase,
retroactive to July 1,1997.The Mayor asked for a roll call vote:Ayes:Gruber,Lihs,Strain,
Heath,White.Nays:None.Motion carried 5 to O.
Mayor's Report.Mayor Bailey spoke on the following items:Vote at the School Board
Election September 9th;residents along Waco Place would like to know what is planned for their
area;Tom Tovrea,Parks Comm;Larry Lyons,Development Committee;Council Round table;
Hands Across the Community enter the City;speed limit reduction on Alice's Road and Warrior
Lane on next agenda;teaching 2 Government Classes last week.
Motion by Councilwoman Lihs to accept the Mayor's report,second by Councilwoman White.
The Mayor asked for a voice vote.Motion carried 5-0.
Utility Report.Motion by Councilman Gruber,second by Councilwoman Lihs to approve the
report.The Mayor asked for a voice vote.Motion carried 5-0.
Planning and Zoning Report.Motion by Councilman Gruber,seconded by Councilwoman
Lihs to approve the Planing and Zoning Report.The Mayor asked for a voice vote.Motion
carried 5-0.
Councilwoman Lihs spoke regarding complaints she has received from residents concerning
properties on Locust Street.
Attorney's Report Motion by Councilwoman Lihs,seconded by Councilman Gruber,to enter
into closed session 21.5 (1)C to discuss strategy with counsel in matters that are presently in
litigation or where litigation is imminent where its disclosure would be likely to prejudice or
disadvantage the position of the governmental body in that litigation.The Mayor asked for a roll
call vote:Ayes:Lihs,Gruber,White,Heath,and Strain.Nays:None.Motion carried 5 to O.

jAdjournment.Motion to adjourn at 10:05 PM by Councilman Gruber second by
