Bailey,Jr. Roll Call.A roll call vote was taken and the following Council Members were present:Nick Gruber,Monica Lihs,and Mary White.Absent:Robyn Heath. Open Forum.Mrs.DeWitt expressed her concern with the condition of the sod at Cherry Street. Veenstra &Kimm stated that it is the contractor's responsibility to take care of the sad.If the sod dies,the contractor is responsible to replace the sod. Kurt is to send a letter clarifying to the residents that the contractor is responsible to care for the sod. Motion carried 4 to O. Set a Date for a Public Hearing -Sale of City Property to IDOT.Motion by Councilwoman Lihs,seconded by Councilman Gruber,to set a public hearing date for October 20,1997 at 7:00pm to sell city property to IDOT.The Mayor asked for a roll call vote:Ayes:Lihs,Gruber, White and Strain.Nays:None.Motion carried 4 to O. Set a Date for a Public Hearing -Rezoning of Property from A-I to R-3 and R-4.Motion by Councilman Gruber,seconded by Councilwoman White,to set a public hearing date for October 20,1997 at 7:00p.m.to rezone property known as the Allen property -South of Westgate and North of the railroad tracks from A-I to R-3 and R-4.The Mayor asked for a roll call vote: Ayes:Gruber,White,Lihs,and Strain.Nays:None.Motion carried 4 to O. Public Hearing -Annexation of Property to Waukee -SE Corner of University Avenue and Ashworth Drive.The public hearing was called to order at 7:25pm,the Mayor presided and the roll being called,the following named Council Members were present and absent:Nick Gruber, Monica Lihs,Terry Strain,and Mary White.Absent:Robyn Heath. The Mayor announced this was the time and place set for the public hearing to consider annexation of the property at the SE corner of University Avenue and Ashworth Drive to the City of Waukee. Upon investigation,it was found that no persons had appeared and filed objections to the proposed annexation of property to Waukee.There were no written or oral comments received. 4 City Attorney Paul Huscher stated that one of the property owners is his client. Motion by Councilwoman Lihs,seconded by Councilman Strain,to approve Resolution 97-34 approving the Voluntary Annexation of the City of Waukee and directed the City Attorney to forward the paperwork to the City Development Board.The Mayor asked for a roll call vote: Ayes:Lihs,Strain,Gruber and White.Nays:None.Motion carried 4 to O. Resolution Approving Intergovernmental Agreement with the City of Clive for Routine Maintenance of Certain Paved Roads.Motion by Councilman Gruber,seconded by Councilman Strain,to approve Resolution No.97-35 approving Intergovernmental Agreement with the City of Waukee for routine maintenance of certain paved streets.The Mayor asked for a roll call vote:Ayes:Gruber,Strain,White,and Lihs.Nays:None.Motion carried 4 to O. Resolution Approving Hawthorne Ridge Final Plat 1.Motion by Councilwoman Lihs, seconded by Councilman Gruber,to approve Resolution 97-36 accepting the final plat of Hawthorne Ridge Plat I -a subdivision of the City of Waukee,in Dallas County,Iowa.The Mayor asked for a roll call vote:Ayes:Lihs,Gruber,Strain.Nays:None.Abstain:White. Motion carried 3 to O. Resolution Providing for the Issuance of Warrants in Connection with The Construction of the City's 1997 Street Improvements and Cherry Street Improvements Project.Motion by Councilman Gruber,seconded by Lihs,to approve Resolution No.97-37 providing for the ) Issuance of Warrants in connection with the construction of the City's 1997 Street Improvements .). and Cherry Street Improvements Project.The Mayor asked for a roll call vote:Ayes:Gruber, Lihs,White and Strain.Nays:None.Motion carried 4 to O. Ordinance Rezoning Property from A-I to R-I -Boone Drive.The Mayor asked if any written or oral comments were received.None were received. Motion by Councilman Gruber,seconded by Councilwoman White,to have the Clerk read the ordinance for the first time in title only.The Mayor asked for a roll call vote:Ayes:Gruber, White,Lihs,and Strain.Nays:None.Motion carried 4 to O. Ordinance Increasing Mayor and City Council's Compensation.Motion by Councilman Strain,seconded by Councilwoman Lihs,to have the Ordinance read for the first time in title only.The ordinance will increase the compensation of the Mayor from $250.00 per month to $400.00 per month,the Mayor Pro-Tem from $55.00 per month to $110.00 per month,and the council from $50.00 per month to $100.00 per month.Kurt Rueckel stated there is money in the budget to cover the increase.The Mayor asked for a roll call vote:Ayes:Strain,Lihs,White, Gruber.Nays:None.Motion carried 4 to O. 5 )JPermissiontoPurchaseNewShedforCentennialPark.Table until the October 20th meeting. Mayor's Report.Received a letter regarding the speed limit on North l Oth Street;Cherry Street first Council meeting in November;move signage in the school areas;Big Thanks for the Homecoming Festivities;complaint from Al Scholes regarding the trimming ofthe evergreen trees;David Conn believes his pond is leaking caused from the construction work with the University Trunk Sewer project;Dev Comm meeting October 8th;Sahu Acres road meeting October 9th;received a letter from the DNR regarding the Sewer Lagoon Project;construction for Laurel and Fareway has begun;Jim Phillips is interested in serving on the Board of Adjustment;meet the candidate night is October 21st at the Library;received letter for the Hands Across the Community Prism Award. Motion by Councilwoman Lihs,seconded by Councilwoman White,to approve the Mayor's Report.The Mayor asked for a voice vote.Motion carried. Administrator's Report.Motion by Councilwoman Lihs,seconded by Councilman Gruber,to approve the Administrator's Report.The Mayor asked for a voice vote.Motion carried. Planning and Zoning Report.Motion by Councilman Gruber,seconded by Councilwoman White,to approve the Planning and Zoning Report.The Mayor asked for a voice vote.Motion carried, Attorney's Report -Annexation (Closed Session);Landfill (Closed Session);and Personnel Matters (Closed Session).City Attorney Paul Huscher briefly updated the Council on the Annexation situation;the Landfill Case has been decided upon and is closed. Motion by Councilwoman Lihs,seconded by Councilman Gruber,to accept the Attorneys report. The Mayor asked for a voice vote.Carried voice vote. Motion by Councilwoman Lihs,seconded by Councilman Strain,to enter into closed session 21.51 (I)to evaluate the professional competency of an individual whose appointment,hiring, performance or discharge is being considered when necessary to prevent needless and irreparable injury to that individual's reputation and that individual requests a closed session.The Mayor asked for a roll call vote:Ayes:Lihs,Strain,White,and Gruber.Nays:None.Motion carried 4 to O.
