HomeMy WebLinkAbout1997-10-20-Regular MinutesThe October 20,1997 Waukee City Council meeting was called to order at 7:02pm by Mayor Donald L.Bailey,JI. Roll Call.A roll call vote was taken and the following Council Members were present:Nick Gruber,Robyn Heath,Monica Lihs,Terry Strain,and Mary White.Absent:None. Open Forum. Marge Lause -100 Northview Drive -asked for a update on sidewalks and crosswalks on Ashworth Drive and the five-way stop.Mayor Bailey stated that is being studied. Marge asked about the speed limit being lowered for the safety of the children arriving and leaving the school walking. Councilman Strain suggested a flashing sign with the speed limit being lowered during school hours.Councihnan Strain suggested this issue to be taken to the School Board. Mayor Bailey stated that as soon as the study is completed it will be presented to the Council. Councilwoman Lihs received a call from a resident regarding the cars speeding on Ashworth between the five-way stop and the 4-way stop at 4th and Ashworth. Agenda Additions -Agenda Approval.Add 17A -Aflac Contract/Documents.Motion by Councilwoman Heath,seconded by Councilwoman Lihs,to approve the agenda with the addition of 17A -AFLAC -Contracts/Documents.The Mayor asked for a voice vote.Motion carried. Consent Agenda -A)10/6/97 Council Minutes;and B)Salary and Bill Presentation. Councilwoman White would like Kurt's statement regarding money for the increase of Council Payment would be in the budget added to the minutes and itemize the Administrator's Report. Ordinance Changing Zoning of Lot I -Seven Pine From A-I to R-l.Motion by Councilwoman Lihs,seconded by Councilman Strain,to have the 2nd reading of ordinance to amend Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa, by Re-Zoning and Changing Certain Property therein from A-I (Agricultural District)to R-l (Single Family Residential District)and Amending the Official Zoning Map to Show Re-Zoning in title only.The Mayor asked for a roll call vote:Ayes:Lihs,Strain,White,Heath,and Gruber. Nays:None.Motion carried 5 to O. Resolution Approving Westgate Plat 2.Brad Cooper,Civil Engineers Design,discussed the plans for development in Westgate Plat 2. Paul Huscher,City Attorney,had 2 major concerns I)the Treasurer's Certificates on the wrong form and the property description was not attached;and 2)in the easement stipulation there is only one prevision that grantor will not change the easement area or the grade.Paul is more concerned with the property owner not changing the easement area or the grade.He would like language put in concerning the property owners. Motion by Councilman Strain,seconded by Councilwoman Heath,to approve Resolution 97-39 with the corrections to the Treasurer's Certificate,The Mayor asked for a roll call vote:Ayes: Strain,Heath,Lihs,Gruber,and White.Nays:None.Motion carried 5 to O. 3 Ordinance Increasing the Compensation of Mayor and Council.No written comments received. Motion by Councilman Strain,seconded by Councilwoman Lihs,to have the 2nd reading of the ordinance in title only.The Mayor asked for a roll call vote:Strain,Lihs,Heath,Gruber,and White.Nays:None.Motion carried 5 to O. Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to waive the 3rd reading and put on final passage.The Mayor asked for a roll call vote:Lihs,Heath,Strain,Gruber,and White.Nays:None.Motion carried 5 to O. Ordinance No.2232 AN ORDINANCE AMENDING CHAPTER 110 -SECTION 110.1 AND 110.2 INCREASING THE MONTHLY COMPENSATION OF CITY COUNCIL PERSONS,THE MAYOR,AND THE MAYOR PRO-TEM. BE IT ORDAINED by the City Council of Waukee,Iowa. Section I.Section 110.1 is hereby amended by deleting $50.00 from the first line thereof,and inserting in lieu thereof"$IOO.OO",and by deleting from the second line "$55.00" and inserting "$110.00"in lieu thereof;such changes to be effective after the next regular election for the office of each council person and so that the section reads as follows: 110.1 Councilmen.The salary of each council person shall be $100 per month, however,any council person serving as mayor pro tern shall be paid $I I a for each month in which he or she remains in office. Section 2.Section 110.2 is hereby amended by deleting "$250.00"and inserting in lieu thereof"$400.00";such change to be effective after the next regular election for the office of the Mayor and so that the section reads as follows: 110.2 Mayor.The Mayor shall receive a monthly salary of $400/month. Section 3.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. 4 Section 5.Effective Date.This ordinance shall be in effect upon its final passage, approval and publication as provided by law. Resolution Increasing the Gas Connection Fees.Motion by Councilman Strain,seconded by Councilwoman Heath,to approve Resolution 97-40 increasing the Gas Connection Fees to $375.00.The Mayor asked for a roll call vote:Ayes:Strain,Heath,White,Gruber and Lihs. Nays:None.Motion carried 5 to O. The Mobile Home Park would like all the gas services installed this fall and are willing to pay the added cost to have the work contracted out.The price estimate per lot would be $404.13 for the contractor doing the main work to put the gas services in. Public Hearing -Resolution Deeding City Property to mOT. The Mayor opened the hearing at 8:04p.m. Mayor Bailey asked if any written or oral commends were received.None were received. The Mayor closed the meeting. Motion by Councilman Gruber,seconded by Councilwoman White,to approve Resolution 97-41 approve the Quit Claim Deed.The Mayor asked for a roll call vote.Ayes:Gruber,White,Lihs, Strain,and Heath.Nays:None.Motion carried 5 to O. Approval of Bids to Abandon Downtown Well.Motion by Councilman Strain,seconded by Councilman Gruber,to approve the bid from J &R Drilling Services,Inc.Not to exceed $6,540.00.The Mayor asked for a roll call vote:Ayes:Strain,Gruber,Heath,Lihs,and White. Nays:None.Motion carried 5 to O. Approval of Utilities Policies.Motion by Councilman Strain,seconded by Councilman Gruber,to approve the Utilities Billing Polices.The Mayor asked for a roll call vote:Ayes: Strain,Gruber,Heath,Lihs,and White.Nays:None.Motion carried 5 to O. Consideration of City Ad Advertisement.Motion by Councilman Gruber,seconded by Councilman Strain,to approve the City ED Advertisement.The Mayor asked for a roll call vote: Ayes:Gruber,Strain,Heath,Lihs,and White.Nays:None.Motion carried 5 to O. Appointment to Board of Adjustments.JeffMcCoige -term up;Margaret Stone -resigned. Names submitted to fill the position on the Board of Adjustments were Bob Ellis,Jim Phillips, 5 and Herb Perry. Motion by Councilman Gruber,seconded by Councilwoman Heath,to appoint Bob Ellis to complete a 2 year term and Jim Phillips to a 5 year term on the Board of Adjustments Committee affective November 11,1997.The Mayor asked for a roll call vote:Ayes:Gruber, Heath,White,Strain,and Lihs.Nays:None.Motion carried 5 to O. Appointment to Planning and Zoning Commission.Mark Schoeberl and Jeff McCoige are interested in serving on the Planning and Zoning Commission. Motion by Councilman Gruber,seconded by Councilwoman White,to reappoint Frank Hoifeldt to the Planning &Zoning Commission to a five year term,The Mayor asked for a roll call vote: Ayes:Gruber,White,Lihs,Heath,and Strain.Nays:None.Motion carried 5 to O. Motion by Councilwoman Heath,seconded by Councilwoman White,to appoint Jeff McCoige to the Planning &Zoning Commission for a five year term.The Mayor asked for a roll call vote: Ayes:Heath,White,Strain,Lihs,and Gruber.Nays:None.Motion carried 5 to O. Discussion of Park Restrooms/Storage Building.John Wesselmann discussed the estimates to construction a building for Park Restrooms/Storage Building. Mayor's Report.Jeff Downing and Dan McGowan made copies of the award the City of Waukee received -Best of Des Moines 1997;Fareway still is planning to build but has been delayed until spring;Gilcrest!J ewett would like to start building next summer;Meet the candidates is scheduled for Tuesday,October 21,1997 at the City Library. Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to accept the Mayor's report.The Mayor asked for a voice vote.Motion carried Administrator's Report.Kurt updated the Council on the Northview Street project;University Trunk Sewer Project has been moving along smoothly and will be completed in the next few weeks;Toni is helping to straighten his files;the auditors will be back on November 3rd. Motion by Councilwoman Lihs,seconded by Councilwoman Heath,to accept Administrator's Report.The Mayor asked for a voice vote.Motion carried.
