Donald L.Bailey,Jr.
Oath of Office -Donald Bailey,Mayor;Nicholas Gruber,City Council;Marvin Berger,City
Council;and William Peard,City Council,were swom in by Kurt A.Rueckel,City Clerk.
Roll Call.The Mayor asked for a roll call vote and the following Council members were
present:Marvin Berger,Nick Gruber,Robyn Heath,Larry Lyon,and Bill Peard.
Open Forum.Mrs.De Witt,550 5th Street,she is concerned with Waukee's winter road
conditions.
Mayor Bailey stated that the winter road conditions are currently being addressed and will
improve in the very near future.
Agenda Additions -Agenda Approval.Motion by Councihnan Lyons,seconded by
Councilman Berger,to approve the agenda.The Mayor asked for a voice vote.Motion carried.

Audit Presentation.Mr.Nielson from the State Auditor's Office presented the 1996/1997 fiscal
year audit to the Mayor and Council.
Motion by Councilman Lyon,seconded by Councilwoman Heath,to accept the 1996-97 Aunual
Audit.The Mayor asked for a roll call vote:Ayes:Lyon,Heath,Berger,Gruber,Peard.Nays:
None.Motion carried 5 to O.

Property Maintenance Ordinance -3rd Reading.
John Thorne asked what is consider "hard surface".The intended meaning of the word
unsurfaced as used in the recently passed Property Maintenance Ordinance #2234 would be any
surface not covered with inorganic material normally used in the surfacing of roadways such as
crushed limestone,gravel,asphalt or concrete.
Ed Slauson -how long would a resident have to comply if given notice.There would be
reminders in the Waukee Taukee and then courtesy letters sent.
Chet Chedester -did not find a procedure in the ordinance stating the length of time that would
be considered reasonable.Paul Huscher explained that 20 days is considered a reasonable time
span for personal service.
Mayor Bailey stated this Ordinance was recommended by the City staff.
Sandra Klein -why is it anyone else business what a resident does with their property.
Larry Lyon state that he is for the property ordinance because there are property owners
(landlords)that do not live in the area to oversee the condition of their property.
Steven Blaumenthal stated that the surrounding properties making improvements has increased
his property value $30,000 in three years.
Marvin Whitlock -315 Bel-Aire Drive feels the cities needs these ordinances to protect the
citizens against home owners that do not maintain their property.
Joe Guisinger does not feel the city is big enough for an ordinance like this.
Fred Hinds -745 Cherry Street,is in favor of the ordinance.He will continue to be a good
neighbor and be a good citizen.
Motion by Councilman Lyon,seconded by Councilwoman Heath,to have the Property
Maintenance Ordinance read for the 3rd time in title only.The Mayor asked for a roll call vote:

Motion by Councilman Gruber,seconded by Councilman Lyon,to put on Ordinance No.2234 "
AN ORDINANCE DELETING CHAPTERS 401 AND 403 OF THE MUNICIPAL CODE OF
THE CITY OF WAUKEE,AND ENACTING IN LIEU THEREOF AN ORDINANCE
PROVIDING FOR THE MAINTENANCE OF PROPERTY IN THE CITY OF WAUKEE,
AND PROVIDING FOR PENAL TIES FOR VIOLA nONS THEREOF"on its fmal passage.
The Mayor asked for a roll call vote:Ayes:Gruber,Lyon,Berger,Peard and Heath.Nays:None.

Ordinance Creating a "Level B"Road Classification -3rd Reading.Motion by Councilman (~)
Gruber,seconded by Councilwoman Heath,to have the ordinance creating a "Level B"road I
classification read for the 3rd time in title only.The Mayor asked for a roll call vote:Ayes:~
Gruber,Heath,Peard,and Lyon.Nays:Berger.Motion carried 4 to I.
Motion by Councilman Gruber,seconded by Councilwoman Heath,to put Ordinance No.2235
"AN ORDINANCE ESTABLISHING A CLASS OF ROADS IN THE CITY OF WAUKEE
CLASSIFIED AS "LEVEL B".ROADS,AND SETTING OUT CRITERIA FOR SERVICE OF
SUCH ROADS",on its fmal passage.The Mayor asked for a roll call vote:Ayes:Gruber,
Heath,Peard,and Lyon.Nays:Berger.Motion carried 4 to 1.
Ordinance Restricting Parking on Northview Between Warrior Lane and 4th Street -2nd
Reading.
Marvin Whitlock is in support of this ordinance for the safety of the children in the
neighborhood.TIle city council worked with the residents in regard to not widening Northview
but the residents would give up the parking on the street ifNorthview was not widened.
Mike Lause -100 Northview -everyone will be traveling at higher speeds if there is no parking.
Motion by Councilman Lyon,seconded by Councilman Peard,to have the Ordinance restricting
parking on Northview between Warrior Land and 4th Street from 6:00am to 6:00pm,Monday
thru Friday read for second time in title only.The Mayor asked for a roll call vote:Ayes:Lyon,
Peard,Heath Berger,and Gruber.Nays:None.Motion carried 5 to O.

Schlaefer/Songbird Park Easement.Motion by Councilman Lyon,seconded by
Councilwoman Heath,to give Kurt permission to talk with the surrounding property owners
regarding an easement for assess to Songbird Park.The Mayor asked for a roll call vote:Ayes:

Abandonment of Alleys -Wearmouth.Tabled until 1119/98 Council meeting.
Update on N.6th Street (Acquisition of Easement).Kurt Rueckel and Paul Huscher updated
the Council on the acquisition of easement on N.6th Street.
John Wesselmann,Approving of New Job Description,and Granting Permission for City
Administrator to Being Hiring Process.Motion by Councilman Gruber,seconded by
Councilman Berger,to pass Resolution No.98-01 the City Administrator permission to begin the
hiring process of a Director of Public Works as described in the Job Description at pay grade 10,
and to bring back a recommendation for City Council approval.The Mayor asked for a roll call
vote:Ayes:Gruber,Berger,Heath,Peard and Lyon.Nays:None.Motion carried 5 to O.

Ordinance Creating Board of Appeals -lst Reading.Motion by Councilman Gruber,to
introduce the ordinance creating a Waukee Municipal Code Appeals Board providing for
appointment by the Mayor,subject to Council approval,designating the qualifications,number,
quorum,terms,residence,and powers.
Motion by Councilman Gruber,seconded by Councilman Peard,to have the Ordinance read for

Ordinance Restricting Parking on Third Street from 185 Third Street to Kaylin Drive.
Tabled until the January 19th Council meeting.
Resolution Increasing the Per Capita Annual Fees of the North Dallas Solid Waste
Regional Planning Commission from $0.50 to $0.85.Motion by Councilman Gruber,
seconded by Councilwoman Heath,to approve Resolution No.98-05 increasing the Per Capita
Atmual Fees of the North Dallas Solid Waste Regional Planning Commission from $0.50 to
$0.85.The Mayor asked for a roll call vote:Ayes:Gruber,Heath,Berger,Peard,and Lyon.
Nays:None,Motion carried 5 to O.

Citizen of the Year Rules.Motion by Councilwoman Heath,seconded by Councilman Gruber,
to approve the City of the Year Rules.The Mayor asked for a voice vote.Motion carried.
Mayor's Report.The Mayor received a call from Guy Blair regarding address numbers on his
building;will be attending a cookie munch off;met with Dream Catchers (housing for adults
with disabilities);and requested the P &Z have a joint meeting with the Parks Committee.
Motion by Councilwoman Heath,seconded Councilman Gruber,to accept the Mayor's report.
The Mayor asked for a voice vote.Motion carried.
Administrator's Report.Motion by Councilman Berger,seconded by Councilman Lyon,to
accept the Administrator's Report.The Mayor asked for a voice vote.Motion carried.
Attorney's Report.Aunexation Appeal is still pending.
Motion by Councilman Lyon,seconded by Councihnan Berger,to accept the Attorney's Report.
The Mayor asked for a voice vote.Motion carried.
