Donald L.Bailey,Jr.
Roll Call.The Mayor asked for a roll call vote and the following Council members were present:
Marvin Berger,Nick Gruber,Robyn Heath,Larry Lyon,and Bill Peard.
Open Forum.None.
Agenda Additions -Agenda Approval.Motion by Councilman Berger,seconded by
Councilman Lyon,to approve the agenda with the deletion of#11 -Extension of University Truuk
Sewer Warrants.The Mayor asked for a voice vote.Motion carried.
Consent Agenda -A)1/5/98 Council Minutes;and B)Salary and Bill Presentation.Motion
by Councilman Gruber,seconded by Councilman Lyon,to approve consent agenda.The Mayor

Cure DeTour -Tim Salivan.On May 16th the CURE DeTour -diabetic bike ride and celebration
would like to use the City Triangle.The bike ride would start at 8 :OOamand the band will play
from I to 4.The Waukee Jaycees will be participating in the bike ride and celebration.
Motion by Councilman Gruber,second Councilman Peard,to approve the use of the City Triangle
for the CURE DeTOUR Bike Ride and Celebration.The Mayor asked for a roll call vote:Ayes:
Gruber,Peard,Berger,Heath,and Lyon.Nays:None.Motion carried 5 to O.
Ordinance Rezoning of Vaughn Property -Public Hearing.The City Council of the City of
Waukee,Iowa,met at the City Hall,in Waukee,Iowa,at 7:05 o'clock p.m.,on January 19,1998.
The meeting was called to order,the Mayor presided and the roll being called,the following named
Council Members were present and absent:Present:Gruber,Berger,Heath,Peard,and Lyon.
Absent:None.
The Mayor aunounced this was the time and place set for the hearing to rezone the Vaughn
Property,
Upon investigation,it was found that no persons had appeared and filed objections to the proposed
rezoning of the Vaughn Property.
The Mayor closed the public hearing at 7:17 o'clock p.m.
Councihnan Lyon to introduce the Ordinance Rezoning the Vaughn Property.
Motion by Councilman Gruber,seconded by Councilman Peard,to have the clerk read the
Ordinance to amend Chapter 310,Waukee Municipal Code,Zoning Ordinance of the City of
Waukee,Iowa,by rezoning and changing certain property therein from A-I (Agricultural District)
to R-3 (Multi-Family Residential)and from A-I (Agricultural District)to R-4 (ROW Dwelling and

Condominium Dwelling District)and amending the Official Zoning Map to show rezoning,for the /')
rust time in title only.The Mayor asked for a roll call vote:Ayes:Gruber,Peard,Lyon Berger,;
and Heath.Nays:None.Motion carried 5 to O.;
Ordinance Changing the Zoning of Property from A-l to R-5(R-2).The City Council ofthe
City of Waukee,Iowa,met at the City Hall,in Waukee,Iowa,at 7:20 o'clock p.m.,on January 19,
1998.The meeting was called to order,the Mayor presided and the roll being called,the following
named Council Members were present and absent:Present:Gruber,Berger,Heath,Peard,and
Lyon.
The Mayor announced this was the time and place set for the hearing to rezone the Williams Turf
Farm Property.
Upon investigation,it was found that no persons had appeared and filed objections to the proposed
rezoning of the Williams TurfFann Property.
The Mayor closed the public hearing at 7:44 o'clock p.m.
The property owners of Williams Turf Farm at the northeast corner of Alice's Road and University
Avenue have requested the rezoning of this property from A-I to R-5 (R-2).The Planning and
Zoning Committee recommended approval of this plan at their December 16th meeting.The
rezoning of this property is in conformance with the City's Comprehensive plan as amended.

Councilman Lyon introduced the ordinance.
Motion by Councihnan Berger,seconded by Councilwoman Heath to have the clerk read the
ordinance to amend Chapter 301,Waukee Municipal Code,Zoning Ordinance ofthe City of
Waukee,Iowa,by rezoning and changing certain property therein from A-I (Agricultural District)
to R-2 (One and Two Family Residential),and R-5 (PUD)and amending the official zoning map
to show re-zoning,for the first time in title only.This rezoning is conditioned upon:the ROW
being provided as indicated int he conceptual;and that the width of the pavement on Olson Drive
be provided,in general,as described in the conceptual plans when the property is actually
developed.The Mayor asked for a roll call vote:Ayes:Berger.Heath.Gruber,Peard,and Lyon.
Nays:None.Motion carried 5 to O.
Resolution Creating "Level B"Roads in the City of Waukee.Motion by Councilman Gruber,
seconded by Councilman Lyon,to pass Resolution No.98-06 creating "Level B"roads in the City
of Waukee -Little Walnut Creek Drive,Sahu Acres;Walnut Lane,Sahu Acres;N.Sixth Street,
Waukee Industrial Park;275th Street COUli,Dallas County;284th Lane,Dallas County.The
Mayor asked for a roll call vote:Ayes:Gruber.Lyon,Heath,and Peard.Nays:Berger.Motion
carried 4 to I.
Ordinance Restricting Parking on Northview between Warrior Lane and 4th Street -3rd
Reading.

Marvin Whitlock would a prevision made for parking on 1st,2nd,and 3rd Street if parking is
going to be allowed on Northview Dr.
Mel Mendenhall -reminded the Council tbat the property maintenance ordinance will also affect
the restricted or no parking ordinance.
Motion by Councihnan Gruber,seconded by Councilman Peard,to have the clerk read the
Ordinance to amend Sections 502.4 (I)and 502.4 (1),Waukee Municipal Code,deleting said
sections in their entirety and inserting in lieu of Sections 502.4 (I)and 502.4 (1)as follows to
prohibit parking of vehicles on tbe north side of North view Drive from Fourth Street to Warrior
Lane between the hours of 6:00 o'clock a.m.and 6:00 o'clock p.m.Monday through Friday;and to
prohibit parking on the south side of Northview Drive at any time,for tbe third time in title only.
The Mayor asked for a roll call vote:Ayes:Gruber,Peard,Berger,Heath,and Lyon.Nays:None.
Motion carried 5 to O.
Motion by Councihnan Gruber,seconded by Councilwoman Heath,to put Ordinance No.2235 on
final passage.The Mayor asked for a roll call vote:Ayes:Gruber,Heath,Peard,Lyon,and
Berger.Nays:None.Motion carried 5 to O.
The Mayor declared Ordinance No.2235 passed and approved.
Resolution Extending the Warrants for University Avenue Trunk Sewer.Deleted.
28E Agreement by and between Dallas County and Waukee -Road Maintenance.The City
of Waukee has a 28E agreement with Dallas County.28E refers to a specific Chapter in the Code
ofIowa,which deals with one governmental entity spending money for purposes which do not go
directly to serve its citizens,in exchange for services provided by another governmental entity
services that do.
Motion by Councilman Berger,seconded by Councilman Lyon,to approve the 28E Agreement
between Dallas County and Waukee for the maintenance of certain roads.The Mayor asked for a
roll call vote:Ayes:Berger,Lyon,Peard,Heath,and Gruber.Nays:None.Motion carried 5 to O.
Revised Agreement Establishing the Des Moines Area MPO.Motion by Councilman Gruber,
seconded by Councilman Berger,to approve the revised agreement establishing the Des Moines
Area MPO.The Mayor asked for a roll call vote:Ayes:Gruber,Berger,Heath.Peard,and Lyon.
Nays:None.Motion carried 5 to O.
Permission to Seek Bids -Solid Waste Collection.Motion by Councihnan Peard,seconded by
Councilman Lyon,to extend tbe Solid Waste Collection contract with Waste Management for I
year.The Mayor asked for a roll call vote:Ayes:Peard,Lyon,heath,Berger,Gruber.Nays:
None.Motion carried 5 to O.
Permission to purchase used Dump Truck -Road Use Fund.Motion by Councilman Lyon,

seconded by Councilman Peard,to the purchase a used dump truck from 0 'Hall oren not to exceed /l
$11,500 and a stainless steel salt spreader not to exceed $2,817.The Mayor asked for a roll call )
vote:Ayes:Lyon,Peard,Heath,Gruber,and Berger.Nays:None.Motion carried 5 to O.)
Resolution setting a $5.00 fee for the Posting of Disconnect Notices.Motion by Councilman
Gruber,seconded by Councilman Berger,to pass Resolution #98-07 setting a $5.00 fee for the
!•posting of disconnect notices.The Mayor asked for a roll call vote:Ayes:Gruber,Berger,Heath,
Peard,and Lyon.Nays:None.Motion carried 5 to O.
University Avenue Trunk Sewer -Update.Dale Sorenson -V &K gave a brief update to the
Mayor and City CounciL
Sewer Service -142nd Avenue -Permissiou to talk with Property Owners to Sign Petition
and Waivers.This sewer extension would entail another lift station and a force main.The
estimated cost would be $275,000 and would serve at least 65.25 acres.The approximate
assessment would be $4,169.
Motion by Councilman Lyon,seconded by Councilman Pcard,to give Kurt permission to talk with
property owners involved to sign petition and waivers.The Mayor asked for a roll call vote:Ayes:
Lyon,Peard,Heath,Berger,and Gruber.Nays:None.Motion carried 5 to O.
Mayor's Report.The Budget Committee met several times and have made progress;maybe
adding a police person,city hall person,and public works person;budget committee will meet
again on January 27th;Cure DeTOUR;Walk for a Cure on March 7th;Saturday attended the Cook
munch off for the Girl Scout cookie sales;Bill Peard will be assign to Board of Adjustment;
Council round table appoint Bill Peard;the Betterment committee will be combined with the Parks
Committee and make it Parks and Recreation Committee;Theresa Walling,CEO of us West,
talked to the Utility committee regarding fiber optics;the contact has been signed and delivered for
the capping of the well;
