Donald L.Bailey,Jr.
Roll Call.The Mayor asked for a roll call vote and the following Council Members were present:
Nick Gruber,Marvin Berger,Don Bailey,Jr.,Robyn Heath,Bill Peard and Larry Lyon.Absent:
None.
Open Forum.None.
Agenda Additions -Agenda Approval.Item #11 moved to #5c,items #22 and #23 deleted.
Motion by Councilman Lyon,seconded by Peard,to approve agenda as revised.The Mayor
asked for a voice vote.Motion carried.
Consent Agenda -A)2/23/98 Council Minutes;B)Salary and Bill Presentation.Motion by
Councilman Gruber,seconded by Councilman Berger,to approve the consent agenda.The Mayor

University Avenue Access Control Plan.Motion by Councilman Gruber,seconded by
Councilman Peard,to approve request for University Avenue Access Control Plan with the
addition of a sixth access point to account for a pre-existing private drive.The Mayor asked for
roll call vote:Ayes:Berger,Lyon,Heath,Peard,Gruber.Nays:None.Motion carried 5 to O.
Ordinance No.2238 Rezoning Indigo Ridge from A-I to R-2.Motion by Councilman Berger,
seconded by Councilwoman Heath,have the ordinance read for the 2nd time in title only.The
Mayor asked for a roIl call vote:Ayes:Gruber,Berger,Heath,Peard,and Lyon.Nays:None.

"AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNlCIP AL CODE,ZONING
ORDINANCE OF THE CITY OF WAUKEE,lOW A,BY RE-ZONING AND CHANGING
CERTAIN PROPERTY THEREIN FROM A-I (AGRICULTURAL DISTRICT)TO R-2 (ONE
AND TWO FAMILY RESIDENTIAL DISTRICT)AND AMENDING THE OFFICIAL
ZONING MAP TO SHOW RE-ZONING"upon its frnal passage and adoption.Mayor asked for
roll call vote:Ayes:Gruber,Heath,Lyon,Peard,and Berger.Nays:None.Motion carried 5 to

OFFICIAL ZONING MAP TO SHOW RE-ZONING"upon its final passage and adoption.The

Motion carried 5 to o.Whereupon,the Mayor declared Ordinance No.2239 duly adopted and

Ordinance Rezoning Ross Property (SE corner of Ashworth Dr and University Avenue)
From A-I to C-I,R-2,R-3 and R-4 -2nd Reading.Motion by CouncilmanPeard,seconded
by Councilwoman Heath,to extend the C-1 and R-4 area currently proposed for rezoning.The
Mayor asked for a roll call vote:Ayes:Gruber,Berger,Heath,Peard,and Lyon.Nays:None.

Ordinance Adopting 1994 Building Codes -2nd Reading.Motion by Councilman Peard,
seconded by Councilman Lyon,to have the clerk read the ordinance for the 2nd time in title only.

Repair of Damage Caused by Hardy's Construction on University Avenue.Dale Sorenson
reported to the Mayor and Council on damage and repair that has occurred to University Ave.

Addendum Extending Contract Completion Date -Wastewater Treatment Facility
Improvements.Motion by Councilman Lyon,seconded by Councilman Peard,to extend the
contract to allow for 365 days until completion date on Wastewater Treatment Facility.The
Mayor asked for a roll call vote:Ayes:Gruber,Lyon,Peard,Heath,and Berger.Nays:None.
Motion carried 5 to O.
Acceptance of bid on 8-inch Sanitary Sewer to University Avenue Trunk Sewer.Motion by
Councilman Gruber,seconded by Councilman Lyon,to accept Hardy's change order with
conditions (30 days completion,no change to language formally agreed too,etc.)if agreement is
not reached then accept McAninch Corporation bid for $35,500.00 for construction of8-inch
sanitary sewer to University Avenue Trunk Sewer.The Mayor asked for a roll call vote:Ayes:
Gruber,Lyon,Peard,Heath,and Berger.Nays:None.Motion carried 5 to o.
Silt Fence at Southfork-Update by V &K.Dale Sorenson of Veenstra &Kimm gave update
on work completed.
Mayor's Report.Attended County Land Use meeting on Thursday,February 26;Will be
attending Mayor's meeting March 11;Larry Ryan injured back and will be temporally gone;
Reminded Council upcoming of Cure DeTour.
Motion by Councilwoman Heath,seconded by Councilman Berger,to approve the Mayor's
report.The Mayor asked for a voice vote.Motion carried.
Councilman Lyon reminded Council and Staff of new School Board/City Council member
rotation.
Attorney's Report.Motion by Councilman Lyon,seconded by Councilman Peard,to approve
the Attorney's report.The Mayor asked for a voice vote.Motion carried.
