HomeMy WebLinkAbout1998-04-06-Regular MinutesThe April 6,1998 Waukee City Council meeting was called to order at 7:00pm by Mayor Donald L.Bailey,Jr. Roll Call.The Mayor asked for a roll call vote and the following Council Members were present: Nick Gruber,Marvin Berger,Robyn Heath,Bill Peard and Larry Lyon.Absent:None. Open Forum.Jay Oxenford,commended Officer White,and Waukee Fire Department for their quick response to a recent fire at the Midwest Mobil Home Court. Jay Oxenford,advised council of the desire of many residents to restart Waukee baseball.Asked council to considered this before making any changes at Centennial Park. Mayor read letter ofnornination naming Helen Lockwood citizen of the year. Agenda Additions -Agenda Approval.Motion by Councilman Berger,seconded by Councilman Lyon,to approve agenda.The Mayor asked for a voice vote.Motion carried. Sahu Acres -Acceptance of Easement or Right-Of-Way.Motion by Councilman Gruber, seconded by Councilman Lyon,to accept easement on Little Walnut Creek when all legal matters have been settled.The Mayor asked for roll call vote:Ayes:Lyon,Peard,Berger,Heath,Gruber. Motion by Councilman Gruber,seconded by Councilman Lyon,to approve Resolution No.98-06 designating North Little Walnut Creek Drive,North Walnut Creek Lane,2751h Street Court,and 284'h Lane "Level B"roads in the City of Waukee.The Mayor asked for roll call vote:Ayes: Lyon,Peard,Berger,Heath,Gruber.Nays:None.Motion carried 5 to O. Motion by Councilman Gruber,seconded by Councilman Lyon,to amend Resolution 98-06 to read "that the Waukee City Council does hereby designate the following roads as "Level B" Roads-such designation shall not be effective until this Resolution and any Deeds transferring title of said Roads to the City (if applicable),are filed with the Dallas County Recorder's Office".The Mayor asked for roll call vote:Ayes:Lyon,Peard,Berger,Heath,Gruber.Nays:None.Motion carried 5 to O. Wearmouth Alley -Status Report.No Action.Table until the April 20,1998 Council meeting. 3 Songbird Park -Public Access Easement.Motion by Councilman Lyon,seconded by Councilman Gruber,to pass Resolution 98-12 a resolution stating the City of Waukee's iutention to abandon the pedestrian access easement to Song Bird Park,through lots 17 and 18 of Corene Acres Plat II.The Mayor asked for roll call vote:Ayes:Lyon,Peard,Berger,Heath,Gruber. Nays:None.Motion carried 5 to O. '), ) It is the iutention of the Waukee City Council to abandon the easement through lots 17 and 18 of Corene Acres at such time the bike path easement is obtained. Permission to Purchase Water Meters.Motion by Councilman Peard,seconded by Councilman Gruber,to allow the water department to purchase 200 5/8 x 3/4 meters and 100 one iuch meters from Waterpro for a price not to exceed $26,528.00.The Mayor asked for a roll call vote:Ayes: Gruber,Berger,Heath,Peard,and Lyon.Nays:None.Motion carried 5 to O. Permission to Pnrchase Hardware and Software.Motion by Councilman Berger,seconded by Councilman Peard,to purchase of new hardware and software from CMS,of Ames,Iowa for a total of$16,961 plus traiuiug not to exceed $4,000.The Mayor asked for a roll call vote:Ayes: Gruber,Berger,Heath,Peard,and Lyon.Nays:None.Motion carried 5 to O. Ordinance No.2244 Establishing Code of Appeals Board -1"Reading.Motion by Councilman Gruber,seconded by Councilman Lyon,to have the ordinance read for the I st time iu title only.The Mayor asked for a roll call vote:Ayes:Gruber,Lyon,Peard,Heath,and Berger. ORDINANCE NO.2244 AN ORDINANCE TO CREATE A WAUKEE MUNICIPAL CODE APPEALS BOARD PROVIDING FOR APPOINTMENT BY THE MAYOR,SUBJECT TO COUNCIL APPROVAL,DESIGNATING THE QUALIFICATIONS.NUMBER.QUORUM,TERMS,RESIDENCE,AND POWERS. Section 403.1.Purpose.The purpose of this ordinance is to establish an Appeal Board to hear appeals as provided in the Waukee Municipal Code (including adopted national codes). Section 403.2.Board of Appeals.The Board of Appeals shall mean the Municipal Code Appeals Board.The Board shall be appointed by the Mayor, subject to Council approval.The Board shall consist of seven membersr six of which shall be individuals knowledgeable by training and/or education in the construction industry or the fire service and one member shall be a citizen appointed at large.Members of the Board shall be appointed for a term of five years,except when the Board shall first be created two members shall be appointed for a term of five years!two members for a term of four years,one member for a term of three yearsl one member for a term of two yearSI one member for a term of one year.All terms shall expire on June 30 of the 4 /',appropriate year.A quorum shall consist of four members.All members of the Board shall reside in the City.The Board shall adopt rules of procedure for conducting its business. Section 403.3.Conduct of Business.The Board shall conduct all business at a public hearing unless otherwise exempted by State or municipal law.The Board shall hear and decide appeals of orders,decisions,or determinations of the Code Compliance Officer relative to applicable city codes and ordinances.The Code Compliance Officer shall be an ex-officio member of and secretary to said board but shall have no vote on any matter before the board.The Board shall render all decisions and findings in writing to the appellant with a duplicate copy to the code compliance officer. There shall be assessed at the time of the filing of an appeal a $100.00 filing fee to cover administrative costs and publication costs. Board of Appeals Appointments.Motion by Councilman Gruber,seconded by Councilman Lyon,to approve the Mayor's appointment of the following individuals to the Board of Appeals: Clint Robinson -Fire Department,for a term of 5 years;Darin Felt -Electrical,for a term of 5 years;Jerry Crow -General Contractor/Carpenter for a term of 4 years;Steve Downing -General Contractor for a term of 4 years;Don Dorrian Jr.-Heating and Air -conditioning for a term of 3 years;Bob McKinney -Plumbing for a period of 2 years;and Steven Blumenthal-Citizen at Large for a term of one year,with terms expiring said years from June 30,1998. Ordinance to replace Section 502 (Parking Ordinance)of the City Code -1st Reading. \Motion by Councilman Berger,seconded by Councilman Peard,to have the Clerk read the ordinance for the 1"time in title only.The Mayor asked for a roll call vote:Ayes:Gruber, Berger,Heath,Peard,and Lyon.Nays:None.Motion carried 5 to O.(Complete copy of this ordinance is available at Waukee City Ha1l41O-6th Street Waukee,IA -between 8:00AM & 5:00PM Monday -Friday) Acceptance of Bids -Wastewater Facility Improvements. Motion by Councilman Peard,seconded Lyon to pass Resolution No.98-13 awarding contract for wastewater treatment facility improvement project to Rice Lake Contracting (Deerwood,MN, in the amount of$2,214,000)contingent uponDNR approval.The Mayor asked for a roll call vote:Ayes:Lyon,Gruber,Berger,Heath and Peard.Nays:None.Motion carried 5 to O. Whereupon,the Mayor declared the bid accepted. Contract for 4th of July Band.Motion by Councilwoman Heath,seconded by Councilman Lyon,to approve the contract for a amount not to exceed $800.00 for the Subdivisions to play at the 4th of July festivities.The Mayor asked for a roll call vote:Ayes:Gruber,Lyon,Peard, Heath,and Berger.Nays:None.Motion carried 5 to O. Mayor's Report. The Mayor brought attention to the need to have the ditch repaired along University Ave.at Southfork;the Parks Committee is looking into a possible grant to assist with renovations;end loader damaged several curbs in town that need repair;construction company doing work next to 5 Waukee State Bank has not returned landscape to original condition;Development Committee to f) meet April 22,1998 at 7:OOPM;streets around town need repair;Council will be meeting April l 13,1998 for a work session;park shelter bids are be sought;the hiring process for summer help) has started;Mayor meet with Rep.Ed Fallon;Mayor was a respect speaker and handed out awards,also attended event at Waukee Elementary for funds being raised for new playground equipment. Motion by Councilwoman Heath,seconded by Councilman Peard,to approve the Mayor's report. The Mayor asked for a voice vote.Motion carried. Administrator's report.Motion by Councilman Peard,seconded by Councilman Lyon,to approve the Administrator's report.The Mayor asked for a voice vote.Motion carried. Planning and Zoning.Motion by Councilman Lyon,seconded by Councilman Peard,to approve the Planning and Zoning Committee report.The Mayor asked for a voice vote.Motion carried. Parks Report.Motion by Councilman Gruber,seconded by Councilman Lyon,to approve the Parks Committee report.The Mayor asked for a voice vote.Motion carried. Utility Report.Motion by Councilwoman Heath,seconded by Councilman Lyon,to approve the Parks Committee report.The Mayor asked for a voice vote.Motion carried. The Council discussed the culvert on 6th Street south ofthe Police Station,the status of the Director of Public Works search,and the drainage at the properties on Ashland Court.
