Donald L.Bailey,JI.
Roll Call.The Mayor asked for a roll call vote and the following Council Members were present:
Nick Gruber,Marvin Berger,Robyn Heath,Bill Peard and Larry Lyon.Absent:None.
Open Forum.Waukee Jaycees played video of the unveiling ofamonument donated in memory
of the Oklahoma City bombing victims,in Oklahoma City,Oklahoma.Mayor and Council
thanked the Waukee Jaycees for representing Waukee and Iowa so well.
Agenda Additions -Agenda Approval.Motion by Councilman Lyon,seconded by
Councilman Gruber,to approve agenda as amended.The Mayor asked for a voice vote.Motion

County Auditor's Office show that the City does not have possession of the Wearmouth Alley.
Ordinance No.2245 Establishing a 25 MPH speed limit on Ashworth Drive when lights are
flashing.Motion by Councilman Lyon,seconded by Councilman Peard,to have the Clerk read
the ordinance for the 1"time in title only.The Mayor asked for a roll call vote:Ayes:Lyon,
Peard,Gruber,Berger and Heath.Nays:None.Motion carried 5 to 0.
Motion by Councilman Gruber,seconded by Councilman Peard,to waive the 2nd and 3'd readings.

ORDINANCE NO.2245 AN ORDINANCE TO PROVIDE FOR THE LOWERING OF THE
MAXIMUM SPEED LIMIT FROM 35 MPH TO 25 MPH ON ASHWORTH ROAD
BETWEEN WARRIOR LANE AND UNIVERSITY WlIEN VARIABLE DISPLAY SPEED
SIGNS ARE POSTED AND BEACONS ARE IN OPERATION.
The maximum speed limit with the variable display speed limit signs and beacons in operation
shall be 25 mph.The maximum speed limit with variable display speed limit signs and beacons
not activated shall be 35 mph.The hours of operation shall be established by the Waukee Police
Department.

Resolution No.98-14 Forgiving Loan From Gas Fund to the General Fund.Motion by

a $195,000 advance from Gas Fund to the General Fund.The Mayor asked for a roll call vote:
Ayes:Berger,Heath,Lyon,Peard,and Gruber.Nays:None.Motion carried 5 to 0.
Resolution No.98-15 to Lock in Gas Prices for Winter.Motion by Councilman Peard,
seconded by Councilman Gruber,to pass Resolution No 98-15 authorizing U.S.Energy to lock
in prices and volumes for November,December,and January of 98/99 and 99/2000.The Mayor
asked for a roll call vote:Ayes:Peard,Gruber,Berger,Heath,and Lyon.Nays:None.Motion

ORDINANCE NO.2246 AN ORDINANCE TO AMEND CHAPTER'S 203 AND 204,WAUKEE
MUNIClP AL CODE,WATER RATES AND PROVISIONS FOR SEWER RENTAL,DECREASING
THE MINIMUM USAGE FROM 2000 TO 1000 GALLONS,AND PLACING IN LIEU TIlEREOF

THE FOLLOWING RATE OF BilLING ADmSTMENTS.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section's 203.2 and 204.5 of Chapter's 203 and 204,Waukee Municipal Code,
are hereby deleted in their entirety,and the following is placed in lieu thereof:
1.Section 203.2
Water Rates.Water shall be furnished at the following monthly rates per
meter within the city limits:
A rninimum monthly bill of $8.60 shall be charged for zero to 1,000 gallons
of metered water usage per month.
Water usage in excess of the minimum (1,000 gallons)will be charged at a rate
of $6.40 per 1,000 gallons per month.
All users outside city limits of Waukee will be charged $17.20 per month
minimum and 150%of the above designated rates per meter:
Water will not be furnished outside the limits of Waukee without consent of
Des Moines Water Works.
II.Section 204.5
Rate of Rent and Manner of Payment.The rate of rent shall be:
A minimum monthly sewer bill of$5.16 shall be charged for zero to 1,000
gallons of water usage per month.
Water usage in excess of the minimum (1,000 gallons)will incur a waste water
charge of$3.84 per 1,000 gallons per month.
The rent shall be paid under the water bill at the time payment of the water bill
is due and under the same conditions beginning with the next payment after
connection to the sewer system is made.
(Ordinance No.2246 becomes legal and binding upon publication.)
Permission to Purchase Defibrillator.Motion by Councilman Gruber,seconded by Councilman
Berger to have the Rescue Department proceed with the purchase of a defibrillator for $6,000,
from Zoll Medical Corporation,32 Second Avenue,Burlington,MA.The Mayor asked for a roll
call vote:Ayes:Lyon,Gruber,Berger,Heath and Peard.Nays:None.Motion carried 5 to O.
Whereupon,the Mayor declared the bid accepted.

Resolution to Approve MFO Planning Work Program and FY 1999 Assessment.Motion by
Councilman Berger,seconded by Councihnan Peard,to pass Resolution No 98-16.approving the
Des Moines Area Metropolitan Organization Unified Planning Work Program and Budget for
FYE 1999.The Mayor asked for a roll call vote:Ayes:Berger,Peard,Gruber,Lyon,and Heath.
Nays:None.Motion carried 5 to O.
Resolution Setting Water Meter Hook-Up Charges.Motion by Councilman Gruber,seconded
by Councilman Berger,to pass Resolution No 98-17 approving the water meter cost and charge
to builders for installation on new construction.The Mayor asked for a roll call vote:Ayes:
Gruber,Berger,Lyon,Peard and Heath.Nays:None.Motion carried 5 to 0,
mOT Preconstruction Agreement for City's Portion of Sec.2 of U.S.6 Reconstruction.

Preconstruction Agreement for Highway-6 referred to as Agreement No.98-3-152.The Mayor

Ordinance to replace Section 502 (Parking Ordinance)of the City Code -2nd Reading.

Councilwoman Heath,to have the debris run through a chipper at a cost not to exceed $5,000.

Mayor's Report.Mayor attended DARE graduation April 4 and Des Moines Register ground
breaking;Citizen of the Year Award Presentation Mentioned;Mayor meeting with Des Moines
Chamber of Commerce members;yards on Bel-Aire being restored;Damage done to yards along
University needs to be repaired;Waukee Elementary would like the use of City dump trucks to
move dirt;Mayor encouraged School ICity cooperation.

session at 9:45pm under 21.51 (I)to evaluate the professional competency of an individual whose
appointment,hiring,performance or discharge is being considered when necessary to prevent
needless and irreparable injury to that individual's reputation and that individual requests a closed
session.The Mayor asked for a voice vote.Motion carried.
