Open Forum.None. Agenda Additions -Agenda Approval.Motion by Councilman Berger,seconded by Councilman Gruber,to approve the agenda as amended,deleting item #9 Approval of preliminary plat -Booth property.The Mayor asked for a voice vote.Motion carried. Consent Agenda -A)6/1/98 &6/8/98 Council Minutes;B)Salary and Bill Presentation;C) Cigarette Permit Renewal-The Bank,Skippy's,Krause Gentle Corp.,DBA Kum &Go, and Casey's General Store;D)Jaycees 4th of July Liquor License.Motion by Councilman Gruber,seconded by Councilman Peard,to approve the consent agenda.The Mayor asked for a roll call vote:Ayes:Gruber,Peard,Lyon,Heath,and Berger.Nays:None.Motion carried 5 to O. Motion by Councilman Gruber,seconded by Councilman Lyon to go in closed session at 7:00 p.m.pursuant to section 21.5.!,to evaluate the professional competency of an individual whose appointment,hiring,performance or discharge is being considered when necessary to prevent needless and irreparable injury to that individual's reputation and that individual requests a closed session.The Mayor asked for a role call vote:Ayes:Gruber,Lyon,Heath,Berger,Peard. Nays:None.Motion carried. Council came out of closed session at 7:30 p.m. Council Discussed City/School cooperation A.Linda Mack addressed City Council.Gave detailed overview,concerning status of the library project. B.Discussion of28E Agreement for proposed library. Motion by Councilman Gruber,Seconded by Councilman Berger to go into closed session at 8:34 pursuant to 21.5.J,to discuss the purchase of particular real estate only where premature disclosure could be reasonably expected to increase the price the governmental body would have to pay for that property.The Mayor asked for a roll call vote:Ayes:Gruber,Berger,Heath,Peard and Lyon.Nays:None.Motion carried 5 to O. Resolution No.98-21.Motion by Councihnan Gruber,seconded by Councilman Peard,to allow local churches to use Triangle Park for "Singspirations"each Saturday in August from 6:30PM- 8:30PM.The Mayor asked for a roll call vote:Ayes:Gruber,Peard,Heath,Berger and Lyon. Nays:None.Motion carried 5 to O. Approval of Change Orders 2nd Street Improvements.Motion by Councilman Gruber, seconded by Councilman Berger,to proceed with item #3-the removal and replacement of pavement beyond the construction limits to improve drainage at the intersection;and item #4-use additional asphalt tonnage at Second and Northview to shape the intersection for drainage.The Mayor asked for a roll call vote:Ayes:Gruber,Berger,Lyon,Peard and Heath.Nays:None. Motion carried 5 to O. Approval of Proposed Resolution of Necessity -Eastern Area Pump Station. MINUTES OF MEETING FOR HEARING ON RESOLUTION OF NECESSITY. A meeting of the Council of the City of Waukee,Iowa,was held at the City Hall,in the City,at 7:00 o'clock p.m.,on June 15,1998.The Mayor presided and the roll was called, showing members present and absent,as follows: Present:Gruber,Berger,Bailey,Heath,Peard,Lyon. Absent:None. The Mayor announced that this was the time and place set for hearing upon the proposed resolution of necessity covering the Eastern Area Pump Station Project.All written objections heretofore filed and all written or oral objections filed or made during the hearing were considered by the Council. Written objections were filed by the following: None. Oral objections were made by the following: None. The Mayor then declared that a motion would be in order for the adoption of Resolution of Necessity. It was moved by Council Member Gruber and seconded by Council Member Lyon that the Resolution of Necessity for the Eastern Area Pump Station,be adopted in the form herein after ) r) set out. After due consideration thereof by Council the Mayor put the question upon the motion and the roll being called,the following named Council Members voted: Ayes:Gruber,Lyon,Berger,Heath,Peard. Nays:None. Whereupon,the Mayor declared the said motion duly carried and the Resolution of Necessity finally adopted. RESOLUTION NO.98-22 Final Resolution of Necessity WHEREAS,this Council has adopted a preliminary resolution in accordance with Section 384.42 ofthe Code ofIowa,covering the Eastern Area Pump Station Project (the "Project");and WHEREAS,pursuant hereto,the Project Engineers have prepared preliminary plans and specifications,an estimated total cost of the work and a plat and schedule,including the valuation of each lot as determined by this Council,and the same have been duly adopted and are now on file with the City Clerk; NOW,THEREFORE,It Is Resolved by the City Council of the City of Waukee,Iowa: Section 1.It is hereby found and determined to be necessary and for the best interest of the City and its inhabitants to proceed with the Project,and to assess the cost or a portion thereof to the property benefitted thereby. Section 2.The Project shall constitute a single improvement and shall consist generally of the complete construction of a 0.26 mgd sewage pumping station located north in the service area, and a 6-inch force main extending westerly approximately 3,550 linear feet to an existing manhole of a gravity sewer. SERVICE AREA An area in Section 36,Township 79 North,Range 26 West of the 5th Principal Meridian,Dallas County,Iowa,more particularly described as follows: Beginning at the southwest comer of the Southeast Quarter of the Southeast Quarter (SE 1/4 SE 1/4)of said Section 36;thence north along the west line of the Southeast Quarter of the Southeast Quarter (SE 1/4 SE 1/4)and the Northeast Quarter of the Southeast Quarter (NE 1/4 SE 1/4)of said Section 36 to the northwest corner of the Northeast Quarter of the Southeast Quarter (NE 1/4 SE 1/4)of said Section 36;thence east along the north line of the Southeast Quarter (SE 114)of said Section 36 to the northeast corner of the Southeast Quarter (SE 1/4)of said Section 36;thence south along the east line of the Southeast Quarter (SE 114)of said Section 36 to the southeast corner of the north three hundred thirty (330) feet ofthe East Half of the Southeast Quarter of the Southeast Quarter (E Y2SE 1/4 SE 114) of said Section 36;thence west along the south line of the north three hundred thirty (330) feet of the East Half of the Southeast Quarter of the Southeast Quarter (E Y2SE 114 SE 114) of said Section 36 to a point on the west line of said East Half (E Y2);thence south along the west line of the East Half of the Southeast Quarter of the Southeast Quarter (E Y2SE 114 SE 114)of said Section 36 to the northwest corner of the south three hundred twenty-six (326) feet of the East Half of the Southeast Quarter of the Southeast Quarter (E Y2 SE 114 SE 1/4) of said Section 36;thence east along the north line of said south three hundred twenty-six (326)feet of the East Half of the Southeast Quarter of the Southeast Quarter (E Y2SE 114 SE 114)to the northeast corner of the west four hundred (400)feet ofthe south three hundred twenty-six feet of the East Half of the Southeast Quarter of the Southeast Quarter (E Y2SE 114 SE 1/4)of said Section 36;thence south along the east line of the west four hundred (400)feet of the south three hundred twenty-six (326)feet of the East Half of the Southeast Quarter of the Southeast Quarter (E Y2SE 114 SE 114)of said Section 36 to a point on the south line of the Southeast Quarter (SE 1/4)of said Section 36;thence west along the south line of the Southeast Quarter (SE 1/4)of said Section 36 to the point of beginning,except for public rights-of-way and streets,containing 65.19 acres. It is considered that the following described property will be benefitted by the Project and should be specially assessed: An area in Section 36,Township 79 North,Range 26 West of the 5th Principal Meridian, Dallas County,Iowa,more particularly described as follows: The West Three-Quarters of the West Half of the Southeast Quarter of the Southeast Quarter (W 3/4 W Y2SE 114 SE 114)of said Section 36,including 14.25 acres,more or less. Section 4.Unless a property owner files objections with the City Clerk at the time of the hearing on this resolution of necessity,the property owner shall be deemed to have waived all objections pertaining to the regularity of the proceedings and the legality of using the special assessment procedure. Section 5.All resolution,parts of resolutions,or actions of the Council in conflict herewith are hereby repealed,to the extent of such conflict. Passed and approved the 15th day of June,1998. Resolution Ordering Preparation of Detailed Plans,Specifications,Notice of Hearing,Notice of Bidders,and Form of Contract. It was moved by Council Member Berger and seconded by Council Member Gruber that the City 'J I, ), ) ( ) Clerk be directed to file certified copies of the Resolution of Necessity and Preliminary Plat and Schedule of Assessments with the County Treasurer of Dallas County and that the resolution hereinafter set out ordering the preparation of the detailed plans and specifications and the preparation of the notice of hearing and notice to bidders and form of contract covering the Eastern Area Pump Station be adopted. Whereupon,the Mayor put the question upon the motion,and the roll being called,the following named Council Members voted: Ayes:Berger,Gruber,Heath,Peard,Lyon. Nays:None.
