L.Bailey,Jr.
Roll Call.The Mayor asked for a roll call vote and the following Council Members were present:
Marvin Berger,Nick Gruber,Larry Lyon.Absent:Robyn Heath,Bill Peard.
Open Forum.John Wilson,160 3rd St.,concerned by the lack of parking along 3rd Street;Jay
Oxenford,MWMH Lot 866,concerned about the lack of sidewalks along Ashworth and
University;Julia Slaybaugh,15 Bel-Aire Dr.,asked about the time frame for the repair of'Bel-Aire
Drive.
Agenda Additions -Agenda Approval.Motion by Councilman Gruber,seconded by
Councilman Berger,to approve the agenda.The Mayor asked for a roll call to approve the

Councilman Gruber,seconded by Councilman Lyon,to set date of September 14,1998 for a
public hearing to amendment the City budget for purchase and installment of warning sirens;and
to have notice to bidders published for warning sirens.The Mayor asked for a roll call vote:Ayes:

Waukee Business Association to Run Fall Festival Raffle in City's Name.Motion by
Councilman Gruber,seconded by Councilman Berger,to approve raffle for the fall festival to be
run by the Waukee Business Association under City name.The Mayor asked for a roll call vote:
Ayes:Gruber,Berger,Lyon.Nays:None.Motion carried 3 to O.
Approval of Contract for Services -Craig Butterfield.Motion by Councilman Gruber,
seconded by Councilman Berger,to have Craig Butterfield provide consulting services,reporting
directly to Mayor Donald L.Bailey and Kurt Rueckel,with services to be reviewed at the October
5,1998 City Council meeting.The Mayor asked for a roll call vote:Ayes:Gruber,Berger,Lyon.

Ordinance Adding Metal Fabricators to the Permitted Uses in M-l District.Motion by
Councilman Gruber,seconded by Councilman Lyon,to set September 14,1998 as the date for a
public hearing on an ordinance adding metal fabricators to the permitted uses in M-l districts.The
Mayor asked for a roll call vote:Ayes:Gruber,Lyon,Berger.Nays:None.Motion carried 3 to O.
Public Hearing on Waste Water Proceedings for State Revolving Loan Fund.
Resolution No.98-41 Motion by Councilman Lyon,seconded by Councilman Berger,
determining to enter into a loan and disbursement agreement(s).Mayor asked for a roll call vote:

and approving Loan and disbursement Agreements and providing for the issuance and securing
the payment of $455,748 Sewer Revenue Bonds,Series 1998A at 4.23%,$945,252 Sewer
Revenue Bonds,Series 1998B at 4.23%,and $1,178,000 Sewer revenue Bonds,Series 1998C at
3.62%.Mayor asked for a roll call vote:Ayes:Berger,Lyon,Gruber.Nays:None.Motion

Rezoning CrowlEngelen Property.Motion by Councilman Gruber,seconded by Councilman
Berger,to have the City Clerk have the first reading of the ordioance to amend chapter 301,
Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,By re-zoning and
changing certain property therein from A-I (Agricultural District)to R-1 (Single Family
Residential District),in title only.The Mayor asked for a roll call vote:Ayes:Gruber,Berger,

Rezoning of 207 Ashworth.Motion by Councilman Gruber,seconded by Councilman Berger,to
have the City Clerk have the first reading of the ordioance to amend chapter 301,Waukee
Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,by re-zoning and changing
certain property therein from R-2 (One-and Two-Family Residential District)to R-3 (Multi-
Family Residential District),in title only.The Mayor asked for a roll call vote:Ayes:Gruber,

Rezoning Country Club Woods 5.Motion by Councilman Gruber,seconded by Councilman
Berger,to have the City Clerk have the first readiog of the ordinance to amend chapter 301,
Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,by re-zoning and
changing certain property therein from R -5 (A -1)(Planned Unit D evel opment District)to R-1
(Single Family Residential District),in title only.Mayor asked for a roll call vote:Ayes:Gruber,

Hawthorne Ridge Change Street Names.Motion by Councilman Gruber,seconded by
Councilman Berger,to approve Resolution No.98-43 changing Hawthorne Ridge Street Names.

Final Plat Approval -Hawthorne Ridge Plat 3.Motion by Councilman Gruber,seconded by
Councilman Berger,to approve Resolution No.98-44 the final plat for Hawthorne Ridge Plat 3,
contiogent on approval by the City's Engioeers and Attorney.The Mayor asked for a roll call

Approval of Construction Plans -Parkview Crossing.Motion by Councilman Gruber,
seconded by Councilman Berger,to approve construction plans for Park View Crossing,as
recommended by Veenstra and Kimm,subject to storm computations being agreed to and

Resolution Allocation Possible Local Option Sales Tax Revenue,pending an Affirmative in
the November Election.Motion by Councilman Berger,seconded by Councilman Lyon,to
approve a resolution for allocation of local option sales tax,pending an affirmative vote in the
November election.The Mayor asked for a roll call vote:Ayes:Berger,Lyon.Nays:Gruber.
Motion failed 2 to 1.
Resolution Establishing Cash Balances and Reserves.Motion by Councilman Gruber,
seconded by Councilman Lyon,to table a resolution establishing the goals and policies for
maintaining fiscal cash balances for cash flow purposes and future capital needs in various city
funds,and agree to address the issue at the October 13,1998 special council session.The Mayor

Approval of Water Distribution System Plan.Motion by Councihnan Lyon,seconded by
Councihnan Gruber,to accept study and place it on file.The Mayor asked for a roll call vote:

Engmeering Agreement for Inspection Services.Motion by Councihnan Gruber,seconded by
Councihnan Berger,to approve the August 12,1998 Inspection Agreement from Veenstra and
Kimm to inspect the 500,000 storage tank and give a written report(s)to:l)describe its present
structural and coating condition and note recommended improvements;2)analyze foundation;
and 3)note and how water would be supplied while the tank is out of operation.The Mayor

Ordinance No.2250 Decreasing Water Rates.Councihnan Gruber introduced an Ordinance to
decrease the water rates.Motion by Councilman Berger,seconded by Councilman Lyon,to waive
the 1st and 2nd reading of have an ordinance to amend chapter 203 of the Waukee Municipal
Code,Water rates,by lowering the rate from $6.40/1000 gallons to $5.75/1000 gallons.The
Mayor asked for a roll call vote:Ayes:Lyon,Berger,Gruber.Nays:None.Motion carried 3 to
O.
Motion by Councihnan Gruber,seconded by Councilman Lyon,to have the City Clerk read an
ordinance to amend chapter 203 of the Waukee Municipal Code,Water rates,by lowering the
rate from $6.4011000 gallons to $5.9511000 gallons,for the 3rd time in title only and place
Ordinance No,2250 on final passage.The Mayor asked for a roll call vote:Ayes:Gruber,Lyon,

ORDINANCE NO.2250
AN ORDINANCE TO AMEND CHAPTER 203 OF THE WAUKEE MUNICIPAL CODE,
WATER RATES,BY LOWERING THE RATE FROM $6.40/1000 GALLONS TO
$5.90/1000 GALLONS
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section's 203.2 of Chapter 203,Waukee Municipal Code,is hereby deleted)
in its entirety,and the following is placed in lieu thereof:)

1.Section 203.2
Water Rates.Water shall be furnished at the following monthly rates per meter
within the city limits:
A minimum monthly bill of $7.95 shall be charged for zero to 1,000
gallons of metered water usage per month.
Water usage in excess of the minimum (1,000 gallons)will be
charged at arate of$5.90 per 1,000 gallons per month.
All users outside city limits of Waukee will be charged $12.00 for zero to 1,000
gallons of metered water usage per month,and $8.63 per 1,000 gallons per month
in excess of the first 1,000 gallons.
Water will not be furnished outside the limits of Waukee without consent of Des
Moines Water Works.
Ordinance 2250 becomes official upon publication and will be reflected in customers September
Utility billing statement.)

Site Plan Ordinance.Motion by Councilman Lyon,seconded by Councilman Berger,to table
the third reading of the Revised Site Plan Ordinance until the September 14,1998 City Council
meeting.The Mayor asked for a roll call vote:Ayes:Lyon,Berger,Gruber.Nays:None.Motion
carried 3 to o.
Mayor's Report.Mayor mentioned that most of the work has been complete on the restrooms at
Centennial Park,the contractor is awaiting deliver of a new water fountain to complete the
project;Rail Road crossing on University Ave.being looked into;Mayor read a letter from
Barbara E.Bouley,Manager of Public Policy for US West Communications,stating that the call
volume to Altoona,Ankeny,Dallas Center,Earlham,Granger,Indianola,Norwalk,Panora,Van
Meter,Winterset and Woodward was insufficient (according to US West)to justify expanding
local calling area to include the afore mentioned cities.
The Mayor asked for a motion.Motion by Councilman Gruber,seconded Councilman Lyon,to
have staff draft a waiver ofthe utility rule,and to have the City Administrator speak with officials
from the cities of West Des Moines,Clive,and Urbandale about the matter.The Mayor asked for

Administrator's Report.City Administrator,Kurt Rueckel provided brief report on status of
several projects.
Library Report.Councilman Marvin Berger provided the Council with brief report to
supplement written report provided.
Utility Committee Report.Councilman Nick Gruber,provided the Council with a summary of
the Utilities Committee's recent and on going work.
Park's Report.Mayor Don Bailey provide update.
Planning &Zoning Report.Councilman Larry Lyon provide a brief summation of Planning &
Zoning to supplement the written report provided to the Council.
Attorney's Report.City Attorney,Paul Rusher provided information on the possibility of28E
agreements that may be to the benefit to the City;and answered hypothetical question concerning
the liability of City.
Adjournment.Motion by Councilman Lyon,seconded by Councilman Berger,to adjourn the
