HomeMy WebLinkAbout1998-09-14-Regular MinutesThe September 14,1998 Waukee Council meeting was called to order at 7:00 p.m.by Mayor Donald L.Bailey,Jr. ) ) ) Roll Call.The Mayor asked for a roll call vote and the following Council Members were present: Marvin Berger,Nick Gruber,Don Bailey,Robyn Heath,Bill Peard,Larry Lyon.Absent:None. Open Forum.JeffVens,540 Southfork Dr.,Asked for Council approval of September 20,1998 parade to be held in Southfork.The individual Council members informed Mr.Vens that the parade had their unanimous support,and did not require an official voice vote. Jay Oxenford,MWMH Lot 866,Asked City Council to require sidewalks to be installed along the School properties abutting Ashworth and University.Mr.Oxenford expressed serious concern about the safety of students and others walking to and from the High School,Middle School and Sporting events. Lisa Forret,475 Waukee Ave.,Expressed her desire to have the Council consider placing a stop sign at the pedestrian crossing between the High School and Middle School on Ashworth. Public Hearing -Amendment FY Ending 1999 Budget.Motion by Councilman Gruber, seconded by Councilman Berger,to pass Resolution No.98-45 amending the FYE 1999 Budget increasing the expenditures in the Community Protection Program by $100,000 -proceeds to come from the sale of bonds,such an amendment being made to purchase a warning siren system. The Mayor asked for a roll call vote:Ayes:Gruber,Berger,Heath,Peard,Lyon.Nays:None. Motion carried 5 to O. Acceptance of Warning Siren Bids.Motion by Councilwoman Heath,seconded by Councilman Peard,to have Fesler representative address Council at the September 28,1998 City Council meeting and answer question concerning the two different systems they bid.The Mayor asked for a roll call vote:Ayes:Heath,Peard,Lyon,Berger,Gruber.Nays:None.Motion carried 5 to O. Request to Set Fireworks -775 Walnut Ridge Drive.Motion by Councilwoman Heath, seconded by Councilman Lyon,to permit a fireworks display by Dennis &Debbie Rolek,at 775 Walnut Ridge Dr,on 9/12/98,9/13/98 and 9/19/98,between the hours of 12:00pm and lO:OOpm. ORDINANCE NO.2251 AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE,ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY AMENDING SECTION 301.22,"M-l"LIGHT INDUSTRIAL DISTRICT,TO ADD METAL FABRICATORS MEETING CERTAIN RESTRICTIONS TO THE PERMITTED USES IN M-l DISTRICTS. BE IT ORDAINED by the Council of the City of Waukee: Section 1.Section 301.22 A of Chapter 301,Waukee Municipal Code,Zoning Ordinance of the city,is hereby amended by adding Section 11 which shall read as follows: 301.22 A "Light Metal Fabrication Facility"-fabrication of metal using modern technology,such as lasers and computer numerically controlled equipment,and in which there is no heavy type of processing such as punch presses,stamping,shearing,casting,forging,01'iron workers. Within 30 feet ofthe structure containing such facility,noise shall not, at any time,exceed 65 decibels. ) J Ordinance No.2251 is made legal and binding upon publication. ORDINANCE NO.2252 SITE PLAN REQUIREMENTS CITY OF WAUKEE,IOWA AN ORDINANCE TO AMEND CHAPTER 304 IN ITS ENTIRETY AND INSERTING IN LIEU THEREOF THE FOLLOWING ESTABLISHING PROCEDURES FOR THE DEVELOPMENT,SUBMISSION AND APPROVAL OF A SITE PLAN;FOR THE SUBMISSION OF SUCH SITE PLAN TO THE PLANNING AND ZONING COMMISSION FOR ITS RECOMMENDATION AND CITY COUNCIL APPROVAL; AND FURTHER ESTABLISHJNG PENALTIES FOR ANY VIOLATION OF SAID ORDINANCE.~ ) Changes in the Site Plan Ordinance are primarily confined to the engineering,landscaping,and architectural requirements and language.A complete copy of the Site Plan Ordinance is available at Waukee City Hall,410 6th Street,Monday through Friday,between the hours of8:00 a.m.and 5:00 p.m.Publication of the summary of contents makes this ordinance legal and binding within Waukee cooperate limits. Conditional Grant of Waiver of Plat Approval for Hunter Hills Plat 1.Motion by Councilman Lyon,seconded by Councilwoman Heath,to waive city subdivision requirements subject to developers compliance with the following city concerns:1)the right of way for the private street would be widened to 60',2)the bulb of the cul-de-sac would be increased to a radius of 60', 3)an overland flowage easement would be established according to city engineer's recommendation ..The Mayor asked for a roll call vote:Ayes:Lyon,Heath,Peard,Gruber,Berger. Preconstruction Agreement Highway 6.Motion by Counci1man Lyon,seconded by Councilman Peard,to enter into agreements 98-3-166 at a cost of$44,501 and 98-3-209 at a cost of$152,170. Approval of Conditional Side Walk Waiver for Westview Church.Motion by Councilwoman Heath,seconded by Councilman Lyon,to waive sidewalk requirements with the proposed bonds and triggers 1)development of the end lots of the adjacent property,2)the year 2002,or 3)request by the city;and such bonds as are necessary to cover the current landscape requirements.The Mayor asked for a roll call vote:Ayes:Heath,Lyon,Peard,Gruber,Berger.Nays:None.Motion carried 5 to O.
