Donald L.Bailey,Jr.
Roll Call.The Mayor asked for a roll call vote and the following Council Members were present:
Nick Gruber,Don Bailey,Robyn Heath,Bill Peard,Larry Lyon.Absent:Marvin Berger.
Resolution Approving Final Costs and Amount to be Assesses for 1997 Street
Improvements and Cherry Street Improvements.The Clerk presented the certificate of
completion and final estimate of cost of the Project Engineers for the construction of the 1997
Street Improvements and Cherry Street Improvements Project,said certificate showing the
contract between the City and contractor or contractors fully performed in accordance with the
plans and specifications and the orders of the Council and settiog out the costs thereof and
recommending the acceptance of the construction of the 1997 Street Improvements and Cherry
Street Improvements Project by the Council for purposes of making payment to the contractor.
The certificate of completion and cost estimate having been duly examined by the Council.
Council Member Gruber iotroduced a motion,second by Council Member Lyon to pass
Resolution No.98-52 accepting the work covering the 1997 Street Improvements and Cherry
Street Improvements Project,determining costs,ordering payment to the contractor and directing
preparation of final assessment plat and schedule.

Accepting work coveriog the 1997 Street Improvements and Cherry Street Improvements
Project,determining costs,ordering payment to the contractor and directing preparation
of the final assessment plat and schedule;
WHEREAS,the Project Engineers have duly filed a certificate in accordance with Section
384.58 of the Code ofIowa showing that they have inspected completed work for the 1997 Street
Improvements and Cherry Street Improvements Project (the "Project")and that the same has
been performed in compliance with the terms of the contract and showing the total cost thereof;
NOW,THEREFORE,It Is Resolved by the City Council of the City of Waukee,Iowa,as
follows:
Section 1.It is hereby found and determined that the work of constructing the Project
has been duly and fully completed by the contractor in accordance with the terms of the contract,
and the same is hereby accepted and approved.
Section 2.It is hereby found and determined that the total cost of said Project is in the
total amount of $776,332.72,of which the sum of$193,807.06 shall be assessed against private
property within the assessable district.
Section 3.Except for the amount beiog retained by the City pursuant to Chapter 573
of the Code ofIowa,which shall be paid to the contractor not less than 30 days after the )
acceptance of the work,the amount due the contractor is hereby ordered paid either through the j
issuance of an anticipatory warrant or warrants,in accordance with Section 384.57 of the Code of )
Iowa,or from available funds from which payment for the work may be made.
Section 4.The Project Engineers are hereby instructed to prepare the final schedule of
assessments,as provided in Section 384.59 of the Code ofIowa.
Section 5.All resolutions or parts of resolutions in conflict herewith be and the same
are hereby repealed,to the extent of such conflict.

Adjournment.Motion by Councilwoman Heath,seconded by Councilman Peard,to adjourn the
meeting at 7:29 p.m.The Mayor asked for a roll call vote:Ayes:Heath,Peard,Gruber,Lyon.
