Absent:Larry Lyon. Open Forum.Mayor,Donald L.Bailey,Jr.read a letter from Joan Heskett,225 Northview Dr.indicating that she was resigning from the Planning &Zoning Commission.The Mayor and the Council thanked Joan Heskett for her outstanding service to the community.Joan Heskett served as a member of the P&Z Commission for over 15 years. Consider Establishing Park Board.Park's Committee Members Chuck Underwood, Wayne Johnson and Councilman Bill Peard addressed the City Council and each gave a summary of the benefits of changing the status ofthe Park's Committee. ORDINANCE NO.2260 AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT,POWERS AND DUTIES OF A PARK.AND RECREATION BOARD BE IT ORDAINED by the Council of the City of Waukee: Section 1.PURPOSE.The purpose of this ordinance is to create a park and recreation board to plan,develop and conduct community-wide recreational and leisure facilities and activities which are designed to strengthen family and community relationships thereby enhancing the quality of life in the Waukee community, Section 2.BOARD CREATED;APPOINTED;TERMS:There shall be a Park and Recreation Board for the City consisting of a Chairperson and nine (9)citizens oflegal age whose members shall be appointed by the Mayor subject to the approval of the City council for three (3)year overlapping terms ending on December 31 of each year.Members named upon the enactment of this chapter shall hold office for such terms as the Mayor shall designate with the approval of the City Council.The terms of not more than three (3)members shall expire in anyone year. I) Section 3.OFFICERS;TERM;COMPENSATION:Officers of the Board shall consist of a Chairperson,Vice Chairperson and Secretary. A. B. c. D. Chairperson.The Chairperson shall be a member of the City Council appointed by the Mayor subject to the approval of the City Council.The Chairperson shall be an ex-efficio member of the Board and have no voting privileges except in the case of a tie vote of the members present. Vice Chairperson and Secretary.At its first meeting in January of each year,the Board shall elect one of its members as Vice Chairman and one as Secretary. Tenure of Office,The tenure of an officer,including the Chairperson,shall be for a period of one year.An Officer may be elected for succeeding year. Compensation.Members shall serve without compensation.A member may receive actual expenses incurred in conducting business for the Board and may apply for reimbursement when attending seminars or conventions authorized by the Board.Such expenses must be approved prior to their being incurred.I !) Section 4. A. B. C. D. E. F. POWERS AND DUTIES.The Board Shall: Development.Seek the development of a broad variety of programs,areas,facilities and services to meet community needs and demands. Planning.Establish,maintain and update plans for parks and recreation facilities,consistent with the overall City comprehensive Plan. Administrative Powers.Exercise,subject to City Council approval,all administrative powers in the adoption of policies, rules and regulations pertaining to the use and control of all parks, recreational program or activity. Rates and Charges.Subject to City Council approval,establish fees,rates and charges for the use of a City park,pleasure ground or other recreational facility,or for participation in a recreational program or activity. Leasing to Organizations.Have authority to lease,under reasonable rules and requirements and subj ect to City Council approval,a particular park or portion thereof,as follows: 1).For a period not in excess often (10)days to charitable, fraternal and patriotic organizations for the purpose of permitting such organizations to conduct celebrations, anniversaries and entertainment. 2).For a period not to exceed six (6)months,as the board shall deem proper,for the purpose of permitting the playing of amateur or professional athletic games. Budget.Submit a recommended budget for consideration by the City Council for inclusion in the annual budget. Section 5.MEETINGS:Meetings of the Board shall be held at least monthly with additional meetings or committee meetings held as deemed advisable by the Board.All Board and committee meetings shall be held in full compliance with the Iowa Open Meetings Law and minutes thereof filed with Board Secretary and City Clerk. Section 6.REPORTS:The Board shall file a written armual report with the City Council and may make such other reports to the City Council as it deems advisable or as may be requested by the City Council.The City shall provide monthly financial reports pertaining to Board activities to each member of the Board. Section 7.APPEAL:Any person aggrieved by a decision of the Board may file an appeal with the Council within Thirty (30)days of the action appealed from. Section 8.BOARD DISCONTINUED:The Council may discontinue the Board by adopting a resolution proposing the action,and publishing notice as provided in section 362.3 of the Iowa Code,of the resolution and of a date,time and place of a public hearing on the proposal,and may discontinue the Board by ordinance or amendment not sooner than thirty days following the hearing. Section 9.REPEALER:All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 10.SEVERABILITY CLAUSE:If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 11.EFFECTIVE DATE:This ordinance shall be in effect upon its final passage,approval and publication as provided by law. ORDINANCE NO.2261 AN ORDINANCE AMENDING SECTION 502.10,WAUKEE MUNIClPAL CODE,BY ADDING SECTION 502.10(R)TO PROHIBIT PARKING ON PORTIONS OF THE STREET RlGHT-OF-WAY OUTSIDE THE TRAVELED PORTION OF THE STREET,EXCEPT AS MAY BE SPECIFICALLY PERMITTED AND INDICATED BY APPROPRIATE SIGNS PURSUANT TO DULY ENACTED AND PUBLISHED ORDINANCES. Section 1.Purpose.The purpose of this ordinance IS to amend section 502.10 prohibit parking 2 by adding section 502.10 (R)as follows: §502.10 (R).Prohibited Parking 011 portions of Street Right-of-Way Outside the Traveled Portions of the Street.No parking is permitted on portions of the street right-of-way outside the traveled portion of the street,except as may be specifically \ ) J.J permitted and indicated by appropriate signs pursuant to duly enacted and published ordinances. Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. ORDINANCE NO.2262 AN ORDINANCE TO REQUIRE ALL RAILWAY COMPANIES TO CONSTRUCT AND REP AIR ALL STREET IMPROVEMENTS BETWEEN THE RAILS OF THEIR TRACKS,AND ONE FOOT OUTSIDE,AT THIE OWN EXPENSE,UNLESS BY ORDINANCE THE RAILWAY IS REQUIRED TO IMPROVE OTHER PORTIONS OF THE STREET,IN WHICH CASE,THE RAILWAY SHALL CONSTRUCT AND REPAIR THE IMPROVEMENT SO SPECIFJED BY ORDINANCE,AND THE IMPROVEMENT OR REPAIR MUST BE OF THE MATERIAL AND CHARACTER ORDERED BY THE CITY,AND MUST BE DONE AT THE TIME THE REMAINDER OF THE IMPROVEMENT IS CONSTRUCTED OR REPAIRED.VIOLATION OF THIS ORDINANCE IS A MISDEMEANOR. BE IT ORDAINED by the Council of the City of Waukee:) ) )Section 1.Construction and Repair Required of All Railway Companies. All railway companies shall construct and repair all street improvements between the rails of their tracks,and one foot outside,at their own expense,unless by separate ordinance the railway is required to improve other portions of the street,and in that case the railway shall construct and repair the improvement of that part of the street specified by the ordinance,and the improvement or repair must be of the material and character ordered by the city,and must be done at the time the remainder of the improvements is constructed or repaired. Section 2.Rails to be Laid as Required,and Grade to be Maintained. When an improvement is made,the company shall lay rail as required by the council,and shall then keep up to grade that part of the improvement they are required to construct or maintain. Section 3.Failure or Refusal by Railway.If a railway fails or refuses to comply with the order of the council to construct or repair an improvement,the work may be done by the city and the expense shall then be assessed upon the property of the railway company,for collection in the same manner as a property tax.A tax assessed under this section shall also be a debt due from the railway,and may be collected in an action at law in the same manner as other debts. Section 4.Improvements Defined.As used in this Ordinance,the term "improvements"shall include:street surface,curb,gutter,and sidewalks. Section 5. misdemeanor. Misdemeaner,Each violation of this ordinance shall constitute a Section 6.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Permission to Buy Snow Plow Blade.Motion by Councihnan Peard,second by Councilman Berger,to accept low bid for purchase of a pickup mounted snow plow from Hawkeye Truck Equipment for an amount not to exceed $3,500.The Mayor asked for a roll call vote:Ayes:Peard,Berger,Gruber,Heath,Lyon.Nays:None.Motion carried 5 to O. Soil Report -Ashworth Drive Improvement.Motion by Councilman Peard,second by Councilman Lyon,to receive and file soil report,and acknowledge a higher degree of future soil settlement and pavement cracking in lieu of incurring additional expense at this time.
