Members were present:Nick Gruber,Marvin Berger and Robyn Heath.Absent:Mayor
Donald L.Bailey,Bill Peard,Larry Lyon.
The April 8,1999 Waukee City Council meeting was called to order at 6:35 p.m.by
Mayor Pro-tern Robyn Heath.
Bob Hays,City Administrator gave a brief summary concerning the budget protest;what
to expect;and the responsibilities as concerns staff and the City Council.
Closed Session as per 21.5c.Motion by Councilman Gruber,second by Councilwoman
Heath to enter into closed session as per section 21.5c of the Code ofIowa "To discuss
strategy with counsel in matters that are presently in litigation or where litigation is
imminent where its disclosure would be likely to prejudice or disadvantage the position
of the governmental body in that litigation,"at 6:40 p.m.The Mayor Pro-tern asked for a
roll call vote:Ayes:Gruber,Heath,and Berger.Nays:None.Motion carried 3 to o.
Council Member Arrives.Councilman Bill Peard arrived at 6:43 p.rn.
Out of Closed Session.Motion by Councilwoman Heath,second by Councilman Gruber
to come out of closed session at 8:35 a.m.The Mayor Pro-tern asked for a roll call vote:
Ayes:Heath,Gruber,Peard,and Berger.Nays:None.Motion carried 4 to o.
Adjournment.Motion to adjourn by Councilman Gruber,second by Councilman Peard
at 8:36 p.m.The Mayor Pro-tern asked for a roll call vote:Ayes:Gruber,Peard,Heath
