HomeMy WebLinkAbout1999-04-27-Special MinutesThe April 27,1999 Special Council Meeting was call to order at 7:03p.m.by Mayor Donald L.Bailey,Jr. /) I )Roll Call.The Mayor asked for a roll call vote and the following Council Members were present:Nick Gruber,Robyn Heath,Bill Peard,Marvin Berger,and Larry Lyon. Open Forum.None Agenda Additions -Agenda Approval.Motion by Councilman Gruber,seconded Councilman Peard,to approve the agenda.The Mayor asked for a voice vote.Motion carried. Ordinance -Defining Position of City Administrator/Clerk.Motion by Councilman Lyon,seconded by Councilman Berger,to have the ordinance amend Chapter 108.6,by deleting Section 108.6,providing for duties and powers of the clerk,Waukee Municipal Code,and inserting in lieu thereof Section 108.6 to provide for creation of the position of City Administrator/Clerk;and provide for the appointment,compensation,duties, residence,and responsibilities of the City Administrator/Clerk,read for the first time in title only.The Mayor asked for a roll call vote:Ayes:Lyon,Berger,Heath,Peard, Gruber.Nays:None.Motion carried 5 to O. Motion by Gruber,to suspend the 2nd and 3rd reading of the Ordinance defining the position of the City Administrator/Clerk.Motion failed for lack of a second. Jim Phillips,240 Bel-Aire Dr,asked the Council why are they making all the changes now.How will the new Administrator be able to walk in to this position being new and try to perform all these dues?It would be impossible. Terry Strain,765 Walnut Ridge Drive,voiced concerns regarding the five council members stating this ordinance will be no different than before.He would like to know what the differences are with this new ordinance from the old ordinance.Larry Lyon stated the differences with this ordinance would allow the new administrator to come in and manage the city with out micro management.This should be discussed at the regular council meeting with proper notification to the public. Jim Phillips,240 Bel-Aire Dr,how can you hired a man and give him all the power when you don't know what he is like. Jay Oxenford,866 Collins Drive,we are paying this man a lot of money to do this job and there should have been more notice to the citizens regarding a special meeting updating these ordinances.He does not disagree with what the council is doing but he does disagree with the way they are doing it. Terry Strain stated the citizens feel the council is trying to change the form of government with out going to a vote for the citizens to decide.Terry Strain feels the Council has not handled this issue in an open manor.1J Councilwoman Heath stated the Council knew they wanted these Ordinances updated in January but with the budget appeal they did not have time until now to do this.It is not her goal to change the form of government.She would like to have the Administrator/Clerk duties defined in written ordinance form. Ordinance -Defining Powers &Duties of Mayor.Motion by Councilman Gruber, seconded by Councilwoman Heath,to have the ordinance to amend Chapter 107.2,by deleting Section 107.2,creation of appointive Officers,Waukee Municipal Code,and inserting in lieu thereof Section 107.2 to provide that Appointive Officers of the City of Waukee,shaIl be City Administrator/Clerk,Police Chief,Attorney and Fire Chief,read for the first time in title only.The Mayor asked for a roll call vote:Ayes:Gruber,Heath, Lyon,Peard,and Berger.Nays:None.Motion carried 5 to o. Motion Councilman Gruber,seconded by Councilman Lyon,to have the ordinance defining the position of the City Administrator/Clerk read in title only.The Mayor asked for a roll calI vote:Ayes:Gruber,Lyon,Heath,Berger,and Peard.Nays:None.Motion carried 5 to o. Ordinance -Providing for the Appointment 7 Qualification of Municipal Officers. Motion by Councilman Gruber,seconded by Councilwoman Heath,to have the ordinance to amend Chapter 108,Section 108.5A,by deleting Section 108.5A,providing for duties and powers of the Mayor,Waukee Municipal Code,and inserting in lieu thereof Section 108.5A to provide that the Mayor shall have supervisory duties except for such duties which have been delegated by law to the City Administrator/Clerk;and providing that the Mayor shall have the power to examine all functions of the Municipal Departments,their records,and to call for special reports from department heads at any time,read for the first time in title only.The Mayor asked for a roll call vote:Ayes:Gruber,Heath,Berger, Peard,and Lyon.Nays:None.Motion carried 5 to o. The Mayor announced he will be making changes on the personnel committee and gave the council members a letter stating the changes. Adjournment.Motion by Councilman Gruber,seconded by Couocilwoman Heath,to adjourn the meeting at 8:07pm.The Mayor asked for a voice vote.Motion carried 4 to 1.
