Agenda Additions -Agenda Approval.Motion by Councilman Peard,seconded
Councilman Gruber,to move item #8 after item #22,and approve the agenda.The Mayor

Delinquent Utility Accounts.Per request of the Mark Arentsen,City Administrator the
City Council referred the matter hack to him for his review before placing said item on
the May 17,1999 City Council Agenda.
Swearing in of New City Administrator.Mayor,Donald L.Bailey,Jr.administered the
oath of office for Mark J.Arentsen as the new City Administrator for the City of Waukee
and offered the Mayor's and City Council's congratulations.
Council Member Arrives.Councilman Larry Lyon arrived at 7:10.
Waukee United Methodist Church -Permission to Utilize City Facilities.Motion by
Councilman Peard,second by Councilman Lyon,to allow Waukee United Methodist Church
use the old Fire Station for Sunday School Classes,with details of such arrangements and l

requirements to be worked out with City Staff.The Mayor asked for a roll call vote:Ayes:
Peard,Lyon,Gruber and Berger.Nays:None.Motion carried 4 to O.
Ordinance -Defining Position of City Administrator/Clerk.Motion by Councilman
Gruber,seconded by Councilman Lyon,to have the City Clerk read the ordinance for the
second time in title only.The Mayor asked for a roll call vote:Ayes:Gruber,Lyon,
Berger and Peard.Nays:None.Motion carried 4 to O.
Ordinance -Providing for the Appointment &Qualification of Municipal Officers.
Motion by Councilman Gruber,seconded by Councilman Berger,to have the City Clerk
read the ordinance for the second time in title only.The Mayor asked for a roll call vote:
Ayes:Gruber,Berger,Peard and Lyon.Nays:None.Motion carried 4 to O.
Ordinance -Defining Powers &Duties of Mayor.Motion by Councilman Lyon,
seconded by Councilman Berger,to have the City Clerk read the ordinance for the second
time in title only.The Mayor asked for a roll call vote:Ayes:Lyon,Berger,Peard and
Gruber.Nays:None.Motion carried 4 to O.
Ordinance to Allow for the Erection of Monument Identification Signs.Motion by
Councilman Berger,seconded by Councilman Lyon,to have the City Clerk read the
ordinance for the first time (subject to revisions)in title only.The Mayor asked for a roll
call vote:Ayes:Berger,Lyon,Gruber and Peard.Nays:None.Motion carried 4 to O.
Address Building Inspection Issues.Mayor Donald L.Bailey,Jr.and the City Council
asked that the matter be referred to the City Administrator.
Ordinance No.2279 to Rezone Munn Property from A-l to C-4.Motion by
Councilman Gruber,seconded by Councilman Berger,to have the City Clerk read the
ordinance for the third time in title only,with rezoning conditional to the site plan already
presented to staff,with rezoning to revert to A-I zoning if said structure is not
constructed as submitted.The Mayor asked for a roll call vote:Ayes:Gruber,Berger,
Peard and Lyon.Nays:None.Motion carried 4 to O.
Motion by Councilman Gruber,second by Councilman Lyon,to place the ordinance on

ORDINANCE NO.2279
AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL
CODE,ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY
CONDITIONALLY RE-ZONING AND CHANGING CERTAIN PROPERTY
THEREIN FROM A-I (AGRICULTURAL DISTRICT)TO C-4 (OFFICE PARK
COMMERCIAL)AND AMENDING THE OFFICIAL ZONING MAP TO SHOW
SAID RE-ZONING.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning
Ordinance of the City,adopting the Official Zoning Map,is hereby amended by changing
the following described real estate from A-I (Agricultural District)to C-4 (Office Park
Commercial District)and that the Official Zoning Map be made to reflect such
amendment:
THE EAST 300 FEET OF THE WEST 400 FEET OF THE
SOUTH 326 FEET OF THE EAST 'h OF THE SE Yt,
SECTION 36,TOWNSHIP 79 NORTH,RANGE 26

Section 2 Conditional Rezoning.Said Plat is rezoned from A-I
(Agricultural District)to C-4 (Office Park Commercial District)upon the condition that
construction be in accordance with the architectural rendering and site plan presented to
the City Council and staff prior to approval of the rezoning,with rezoning to revert to A-
I zoning if said structure is not constructed as submitted.
Section 3.Repealer.All ordinances or parts of ordinances in conflict with
the
provisions of this ordinance are hereby repealed.
Section 4.Severability Clause.If any section,provision or part of this
ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect
the validity of the ordinance as a whole or any section,provision,or part thereof not
adjudged invalid or unconstitutional.
Section 5.Effective Date.This ordinance shall be in effect upon its final
passage,approval and publication as provided by law.

ORDINANCE NO.2280
AN ORDINANCE AMENDING SECTION 502.5,WAUKEE MUNICIPAL
CODE,BY DELETING SAID SECTION AND PLACING IN LIEU THEREOF
SECTION 502.5 AS REVISED TO INCLUDE PROHIBITION OF PARKING ON
BOTH SIDES OF LAUREL STREET EAST OF FOURTH STREET.
Section 1.Purpose.The purpose of this ordinance is to prohibit parking on
Laurel Street east of Warrior lane so as to provide for safe passage along said public
right-of-way.
Section 2.This ordinance shall provide for the deletion of Section 502.5 and
placing in lieu thereof the follow:
§502.5 No parking is permitted at any time on either side of the following east-
west streets:
Ashworth Drive:
see §502.8
Cherry Street
Corene Avenue:
from First Street Place to Christopher Avenue
Laurel Street:
east of Fourth Street
Locust Street
see §502.8.
University Avenue
Section 3.Repealer.All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.

Temporary Directional Signs.Motion by Councilman Peard,second by Councilman
Gruber,to authorize city staff to work with the business community in the placement of
appropriate directional signs as provided by city ordinance.The Mayor asked for a roll

Resolution No.99-46.Windfield Development Performance Bond.Motion by
Councilman Gruber,second by Councilman Peard,to adopt Resolution No.99-46
entitled "Resolution releasing performance bond -Windfield Development II,L.C."The
Mayor asked for a roll call vote:Ayes:Gruber,Peard and Berger.Nays:None.Motion
carried 3 to O.
Resolution No.99-47.Ashworth Drive Change Order No.1.Motion by Councilman
Gruber,second by Councilman Peard to adopt Resolution entitled "A Resolution
approving change order no.1 to the contract with Correl Contractor,Inc.for the
Ashworth Drive pavement improvement project increasing the contract in the amount of
$908.80."The Mayor asked for a roll call vote:Ayes:Gruber,Peard and Berger.Nays:

Resolution No.99-48.Approval of Final Plat Parkview Crossing.Motion by
Councihnan Gruber,second by Councihnan Peard,to adopt a Resolution entitled
"Resolution accepting the Final Plat ofParlcview Crossing Residential R-4,R-3,R-2,and
Commercial C-1 Plat 1 a Subdivision of the City of Waukee,In Dallas County Iowa"
with the stipulation that all comments made by Veenstra &Kimm be addressed and all
fees be paid.The Mayor asked for a roll call vote:Ayes:Gruber,Peard and Berger.Nays:

Resolution No.99-49.Naming of Rosenkranz Drive.Mayor,Donald L.Bailey,Jr.,
requested a motion be made to name the southern most,east to west street in Parkview
Crossing to be named Rosenkranz Drive in honor of the former Mayor of the City of
Waukee,Floyd W.Rosenkranz.Motion by Councihnan Gruber,second by Councilman
Peard,to name the southern most,east to west street in Parkview Crossing to be named
Rosenkranz Drive in honor of the former Mayor of the City of Wankee,Floyd W.
Rosenkranz.The Mayor asked for a roll call vote:Ayes:Gruber,Peard and Berger.Nays:

Mayor's Millennium Celebration.Motion by Councilman Peard,second Councihnan
Berger,to support the Mayor's Millennium Celebration with a contribution of $1,000,

Mayor's Report.Mayor,Donald L.Bailey,Jr.,thanked the City Council Members for
attending the Citizen of the Year Reception for Hannah Weil.
School Board Recognition Week Proclaimed.The Mayor Proclaimed the Week of May
9th -May IStll ,1999 School Board Recognition Week.
Setting time for Board of Adjustment Meeting.The BOA will meet May 10,1999 at
6:30 p.m.at Waukee City Hall.
Setting time for Council Work Session.The City Council will meet for a special work
session May 10,1999 at 7:30 p.m.at Waukee City Hall.
Administrator's Report.Mark Arentsen,City Administrator,gave a brief report;Bob
Hays,outgoing Interim City Administrator gave an additional sunnnary of events.
Planning &Zoning Report.Councilman Nick Gruber gave a brief report on the last
P&Z Meeting.
Library Board.Councilman Berger and members of the Library Board gave a summary
of events in connection with the Library's fund raising and projected construction.
