Bailey,Jr. Roll Call.Mayor Bailey asked for a roll call vote and the following Council members were present:Nick Gruber,Marvin Berger,Bill Peard,Robyn S.Heath,and Larry Lyon. Open Fornm.Jay Oxenford -spoke to the Mayor and Council in regard to the mowing of the weeds north of the Middle School and south of the Mobile Home Park. Motion by Councilman Lyons,motion died for lack of a second. Resolution No.99-62 -Discussion of Boone Drive Sidewalks and Streetlights.With the presence of the Elementary School on Boone Drive and the rapid increase in development on and around Boone Drive the safety of foot traffic has become a concern. to facilitate a safe environment for children and other pedestrian traffic,sidewalks and streetlights need to be installed along Boone Drive. Motion by Councihnan Peard,seconded by Councihnan Gruber,to approve the placement of streetlights on Boone Drive.The Mayor asked for a roll call vote:Ayes: Peard,Gruber,Berger,Heath.Nays:None.Abstain:Lyon.Motion carried 4 to O.The residents will be invited to a meeting June 30,1999. Resolution No.99-63 -Public Hearing ou Lease of Data Equipment for City Hall LAN.Requests for proposals were submitted to four vendors for phone and date systems for the new City Hall and Public Safety Building.After reviewing the proposals submitted,staff has selected Convergent Communications to provide phone and data systems for the new facilities. 1 ) ) Mayor Bailey announced this is the time and place for the Public Hearing on the lease of Hardware and Software for City Hall.There were no written objections or oral objections. After due consideration and discussion,Councilman Berger,introduced the "Resolution approving a Lease-Purchase Agreement for Data Hardware and Software for the new City Hall and Public Safety Building,seconded by Councilman Peard.The Mayor asked for a roll call vote:Berger,Peard,Heath,Lyon,and Gruber.Nays:None.Motion carried 5 to O. Resolution No.99-64 -Change Order No.2 (Wastewater Treatment Facility).A number of items have required change or modification in the construction of the Wastewater Treatment Facility.With the changes listed in this resolution the combine Change Orders (No.1 &No.2)represent a decrease in the total contract amount of $521.00.Veestra &Kimm have reviewed said changes and are recommending approval. Motion by Councilwoman Heath,seconded by Councilman Lyon,to adopt "A resolution approving Change Order No.2 to the contract with Rice Lake Contracting Corp.,for the wastewater treatment facility improvements increasing the contract in the amount of $30,484.00."The Mayor asked for a roll call vote:Ayes:Heath,Lyon,Peard,Berger, Gruber.Nays:None.Motion carried 5 to O. ) l) Resolution No.99-65 -Approving Partial Pay Estimate No.11 (Wastewater Treatment Facility).This is the final partial pay estimate for the Wastewater Treatment Facility.The payment represents completion of 100%of the project less the 5% retainage. Veenstra &Kimm has forwarded a punch list to Rice Lake Contractors Corp.for the remaining few items.If the punch list is not completed within 31 days all or a portion of the retainage maybe withheld.Veenstra &Kimm is reconnnending approval of Partial Pay Estimate No.11 in the amount of$84,423.31. Motion by Councihnan Berger,seconded by Councilwoman Heath,to adopt "Resolution approving Partial Pay Estimate No.11 (final)for the Wastewater Treatment Facility Improvements State Revolving Fund Project No.CS 19211501."The Mayor asked for a roll call vote:Ayes:Berger,Heath,Gruber,Lyon,and Peard,Nays:None.Motion carried 5 to O. Resolution No.99-66 -Wage and Salary Adjustment for 1999/2000.The wage and salary adjustments for 1999/2000 needs to be adopted in the form of a resolution for them to go into effect for the pay period ending July 15,1999.The increases reflect a 3.5% cost of living adjustment to the wage scale table. Additionally,a review of job descriptions and a wage survey will be completed by October 1,1999.This report will contain recommendations for salary adjustments commensurate with responsibilities and comparable wages for jobs in the Metro area. Motion by Council man Peard,seconded by Councilman Lyon,to adopt "Resolution to approve the FY199912000 Wage and Salary Adjustment."The Mayor asked for a roll call vote:Ayes:Peard,Lyon,Heath,Berger,and Gruber.Nays:None.Motion carried 5 to O. Resolution No.99-67 -Setting New Policy for Compensation of Accumulated Sick Leave -Per Resignation of Employment and Spelling out Grade and Step Policy. Motion by Councilman Gruber,seconded by Berger,to adopt "Resolution setting new police for Compensation of Accumulated Sick Leave and Spelling out Grade and Step Policy".The Mayor asked for a roll call vote:Aye:Gruber,Berger,Heath,Peard,Lyon. Nays:None.Motion carried 5 to O. Discussion of Possible Construction Noise Ordinance.After a lengthy discussion,the Council took no action. Ordinance No.2298 -Failure to Assist Police Officer.This is an addition to the City's Criminal Ordinance.This particular Ordinance reflects the State Code's requirement to provide assistance to an Officer ofthe Law. Motion by Councilman Peard,seconded by Councilman Gruber,to have the ordinance read for the first time in title only.The Mayor asked for a roll call vote:Ayes:Peard, Gruber,Berger,and Lyon.Nays:Heath.Motion carried 4 to 1. ORDINANCE NO.2298 AN ORDINANCE DEFINING THE CRIME OF REFUSING TO ASSIST OFFICER AND PROVIDING THE PUNISHMENT THEREFOR BE IT ORDAINED by the Council of the City of Waukee: §620.1 Refusing to Assist Officer.Any person who is requested or ordered by any mistrate or peace officer to render the magistrate or officer assistance in making or attempting to make an arrest,or to prevent the commission of a criminal act,shall render assistance as required.A person who,unreasonably and without lawful cause,refuses or neglects to render assistance when so requested is guilty of a violation of this section. §620.2 Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. §620.3 Severability Clause.If any section,provlSlon or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. §620A Effective Date.This ordinance shall be in effect upon its fmal passage,approval,and publication as provided by law. ORDINANCE NO.2299 AN ORDINANCE TO PROVIDE FOR PERMIT APPLICATION,LOCATION PLAN,CONSTRUCTION AND INSPECTION OF INSTALLATIONS OF TELECOMMUNICATIONS,CABLE TV,TELPHONE,ELECTRIC,AND DRAINAGE TILE IN THE CITY OF WAUKEE,IOWA BE IT ORDAINED by the Council of the City of Waukee that Chapter 225 of the Waukee Municipal Code is hereby adopted as follows: Section 1.Form of Permit:1 IJ UTILITY PERMIT APPLICATION CITY OF WAUKEE Application No._ Date _ This is a Utility Permit Application for all utility installations including telecommunications,cable TV,telephone,electric,drainage tile.The applicant agrees to comply with the attached UTILITY PERMIT REQUIREMENTS. Compliance shall be determined by the sole discretion of the City as deemed necessary to promote public health,safety and the general welfare.These requirements shall apply unless waived in writing by the City prior to installation. A.Location Plan.An applicant shall file a completed location plan as an attachment to this Utility Permit Application.The location plan shall set forth the location of the proposed line on the road system or along lot lines and include a description of the proposed installation.Applicant is responsible for all surveys necessary to establish location of easements and rights-of-way. B.Notice of Work.At least five (5)complete working days prior to the proposed installation,an applicant shall file in triplicate with the City a completed Utility Permit Application stating the approximate date,location and nature of the proposed installation. Additionally,at least two (2)complete working days prior to the actual work,the applicant shall notify the City of the intent to begin work. )I C.Inspection.The City of Waukee shall provide an inspector during the installation of all lines to review compliance with this Utility Permit.The inspector shall have the right,during reasonable hours and after showing proper identification,to enter any installation site in the discharge of the inspector's official duties,and to make any inspection or test that is reasonably necessary to protect the public health,safety and welfare.The applicant shall pay the actual costs for inspection of the project. D.Issuance.Upon approval of the application,the Utility Permit will be issued by the City.The permit fee will be $25.00. E.Remittance of Fees.The applicant shall pay the actual costs directly attributable to the installation inspection conducted by the City.Payment shall be made within thirty (30)days after completion of the installation.Payments not made in such time shall be subject to reasonable interest charges. F.Requirements.The installation inspector shall review compliance with the following requirements: 1.Construction signing shall comply with the Manual on Uniform Traffic Control Devices. ) ) ) 2.A permanent warning tape shall be placed one (1)foot above all underground utility lines. 3.All tile line locations shall be marked with references located in the R.O.W.line. 4.No underground utility lines shall cross over a crossroad drainage structure. 5.Residents along the utility route shall have uninterrupted access to the public roads.An all-weather access shall be maintained for residents adjacent to the project. 6.Ajoint assessment of the road surfacing shall be made by the applicant and the City both before and after construction.After construction,granular surfacing shall be added to an existing granular roadway,drive or parking area by the applicant to restore the surfacing to its original condition.After surfacing \ ) has been applied,the road surface shall be reviewed by the City once the road has been saturated,to determine if additional surfacing on the roadway by the applicant is necessary. 7.All damaged areas within the R.O.W.shall be repaired and restored to at least its former condition by the applicant or the cost of any repair work caused to be performed by the City will be assessed against the applicant.Portland cement concrete patches shall be I"thicker than the removed portland cement concrete surfacing.Asphaltic cement concrete patches shall be I"thicker than the removed asphaltic cement concrete surfacing. 8.Areas disturbed during construction which present an erosion problem shall be solved by the applicant in a manner approved by the City. 9.All trenches,excavations,and utilities that are knifed shall be properly tamped. I O.Cable,pipe line,and tile line crossing paved roads shall be constructed as follows:Utilities designated by the City which cross under the roadway shall be placed in casings so that the pipe may be removed for repair without disturbing the sub grade.The casing shall be adequate strength,and of sufficient length to extend 2 feet beyond each edge of the surfaced roadway.On paved roads,cable casings may be placed through the sub-grade by jacking,or by boring a hole just large enough to take the line.All open excavations near pavement shall be of sufficient distance from pavement to prevent soil collapses resulting in undermining of pavement. 11.On roads not paved,an open trench may,upon approval of the City,be dug and the cable,pipeline,or tile line placed therein, and the trench backfilled over the line.All backfilling of tunnels and trenches shall be thoroughly compacted in layers of 6"or less in depth.Backfilling of trenches within the R.O.W. shall be tamped sufficiently to avoid settlement.All work shall be one in a workmanlike manner,and the gronnd left in a neat condition,satisfactory to the City in charge. 12.All overhead utilities shall be placed at a distance of two (2) feet inside the R.O.W.line unless specifically approved otherwise by the City. 13.All work shall conform to the minimum Des Moines /) Metropolitan Design Standards Manual,City of Waukee lStandardSpecifications,and criteria set forth herein. G.Non-Conforming Work.The City may halt the installation at any time ifthe applicant's work does not meet the requirements set forth in this Utility Permit. H.Emergency Work.In emergency situations,work may be initiated by an applicant without first obtaining a Utility Permit.However, a Utility Permit must be obtained within fourteen (14)days initiation of the work.All emergency work shall be done in conformity with the provisions of this ordinance and shall be inspected for :full compliance. 1.Violation of Ordinance.Violation of any of the provisions of this Chapter shall be a simple misdemeanor punishable with a civil penalty of $100 for each violation.Each day that a violation occurs or is permitted to exist by the applicant constitutes a separate offense. J.Hold Harmless.The utility compauy shall save this City harmless of any damages resulting from the applicant's operations.A copy )of a certificate of insurance naming this City as an additional JinsuredforthepermitworkshallbefiledintheCityClerk's office prior to installation.The minimum limits of liability under the insurance policy shall be $1,000,000. K.Performance Bond.The contractor or applicant shall have on file with the City a performance bond for restoration of areas within the R.O.W.and on utility easements.This bond shall a minimum of $2000 and may be of greater value depending on the scope of the project.Bond to be held for 60 days after date of completion. L.Permit Required.No applicant shall install any lines unless such applicant has obtained a Utility Permit from City and has agreed in writing that said installation will comply with all ordinances and requirements of the City for such work.Applicants agree to hold the City free from liability for all damage to applicant's property which occurs proximately as a result of the applicant's failure to comply with said ordinances or requirements. M.Relocation.The applicant shall,at any time subsequent to installation of utility lines,at the applicant's own expense,relocate ~or remove such lines as may become necessary to conform to new grades,alignment or widening ofR.O.W.resulting from ) ) maintenance or construction operations for highway improvements. Section 3.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4.Severability Clause.If any section,provision or part ofthis ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutinal. Section 5.Effective Date.This ordinance shall be in effect upon its fmal passage,approval and publication as provided by law. ORDINANCE NO.2300 AN ORDINANCE SETTING RESPONSIBILITIES FOR CITY OFFICERS AND THE FINANCES AND RECORDS OF THE CITY Section 1.Purpose.The purpose of this ordinance is to create procedures for financial accounting,to regulate the retention and destruction of records,and to regulate purchases. Section 2.This ordinance shall provide for the deletion of Section 111 and placing in lieu thereof the following: §111.1.Purpose.The purpose of this ordinance is to create procedures for financial accounting,to regulate the retention and destruction of records,and to regulate purchases. ) t §111.2.Fees.All fees collected for any purpose by any municipal officer shall be deposited with the city treasury through the office of the finance officer.If any said fees are due to an officer,they shall be paid to him by wan-ant/check drawn by the finance officer upon the filing of adequate reports relating thereto as required by law, ordinance or council directive. §111.3.Records,Retention.The clerk shall,upon order of the council, destroy all records and papers other than the minutes of the council proceedings, ordinances and instrwnents having to do with real estate or bond issues,when such records are more than ten (10)years old,in accordance with law.Time-keeping records may be destroyed after two (2)years,and election records as provided by state law.The clerk shall prepare a resolution for council action each year listing the records to be destroyed. §111.4.Petty Cash Fund.The finance officer shall be custodian of a petty cash fund not to exceed $200.00 for the payment of small claims for minor purchases,collect-on-delivery transportation charges,and small fees customarily paid at the time of rendering a service for which payments the clerk shall obtain some form of receipt or bill acknowledged as paid by the vendor or his agent.At such time as the petty cash fund is approaching depletion the finance officer shall draw a wan-ant/check for replenishment in the amount of the accumulated expenditures and said wan-ant and supporting detail shall be submitted to the council as a claim in the usual manner for claims and charged to the proper funds and accounts.It shall not be used for salary payments or other personal services or personal expenses. ) ) ) [July 11,1994 -2183] §111.5.Purchasing Quotations.All purchase over ($500.00)shall be made after securing quotations.Quotations shall be sought from at least two (2),and if possible,three (3)vendors.If an item is a proprietary product this provision shall be waived,but every effort shall be made to avoid specifications with proprietary items exclusively.Once a quotation is taken on an item,unless in a fluid market,no new quotations need to be sought for re-orders unless more than one year has elapsed since the last quotations were received from the several possible vendors.Major supply contracts,such as for gasoline,fuel oil,etc.,shall be reviewed annually.Department heads shall be guided by this regulation on requisitions submitted with quotations. §111.6.Bidding-Major Contracts.Contracts for consulting services,for such services as water main,sewer and sanitary work,street and utility construction by contract and large equipment shall be placed before the council if amounting to $5,000 or more,except for emergencies endangering the public heath or safety.Major items involving a departure from budgetary provisions,or items not otherwise authorized by t ) council,shall likewise be put before council for policy decision and letting where required. §l11.7.Purchasing-Orders.All purchases of services supplies and equipment shall be made only after issuance of a purchase order,and no invoice shall be accepted unless authorized by such an order.Purchases not exceeding two thousand dollars ($2,000.00)may be made by the Administrator/Clerk or those officials authorized by the Administrator/Clerk,but only on issuance of a spot purchase order in writing signed by the authorized officer.A copy of such spot purchase order must be delivered to the finance officer within twenty-four (24)hours,weekends and holidays excepted. All other purchase shall be valid only if a purchase order has been given in writing and signed by the Administrator/clerk.Purchases from petty cash and continuing purchases from vendors awarded extended contracts by bid award shall be excepted. [May 4,1992 -2154] §111.8.Authorizations to Expend.The finance officer shall determine whether a purchase order may be issued by checking the availability of an appropriation sufficient to pay for such a purchase,and whether the purchase,if a major item,has been authorized by the budget or other council approval.The finance officer shall draw a warrant/check only upon an invoice received or progress billing for public improvement, supported by a purchase order and a signed receipt indicating the materials have been delivered of the quality,and in the quantities indicated,or the services have been performed satisfactorily to the extent billed,and only if an appropriation is available.No purchase shall be authorized unless there is an appropriation available or the council amends the appropriations,or transfer of appropriation is made in accordance with power delegated by council and within the limits set by law and the council. §l11.9.Accounting.The finance officer shall set up and maintain books of original entry to provide a chronological record of cash received and disbursed through all receipts given and warrant/checks written,which receipts and warrant/checks shall be prenumbered,in accordance with modem,accepted methods,and the requirements of the state.The finance officer shall keep a general ledger controlling all cash transactions, budgetary accounts and recording fund balances. §111.10.Budget Accounts.The finance officer shall set up such individual accounts to record receipts by source and expenditures by purpose as will provide adequate information and control for budgetary purposes as planned and approved by council.Each individual account shall be maintained within its proper funds as required by council order or state law and shall be so kept that receipts can be immediately and directly compared with specific estimates and expenditures can be related to the appropriation which authorized it.No expenditure shall be posted except to the appropriation for the function and purpose for which the expense was incurred. §111.11 Contingency Accounts.Whenever the council shall have budgeted for a contingency account the finance officer shall set it up in the accounting records but said officer shall not charge any claim to a contingency account.Said contingency accounts may be drawn upon only by council resolution directing a transfer to a specific purpose account within its proper funds and then only upon compelling evidence of an unexpected and unforeseeable need or emergency. Section 3.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 5.Effective Date.This ordinance shall be in effect upon its fmal passage,approval and publication as provided by law. ORDINANCE NO.2301 AN ORDINANCE AMENDING SECTION 212.2,WAUKEE MUNICIPAL CODE,BY DELETING SAID SECTION AND PLACING IN LIEU THEREOF SECTION 212.2 AS REVISED TO EXTENDING OPEN BURNING IN THE SPRING FROM APRIL 15TH THROUGH MAY 15TH AND IN THE FALL FROM OCTOBER 15TH THROUGH NOVEMBER 30TH• Section 1.Pnrpose.The purpose of this ordinance is to extend the time for bunting organic debris in the spring and fall.I ) Section 2.This ordinance shall provide for the deletion of Section 212.2 and placing in lieu thereof the follow: §212.2 Open Burning Prohibited.No person shall kindle or maintain any bonfire or refuse fire,or burn inorganic material,any paper or similar combustible debris,including plants,leaves or vegetable matter,or authorize any such fire to be kindled or maintained on any private land within the boundaries of the City of Waukee, except for the burning of plant and vegetable matter originating on the premises owned or leased by such person,between the hours of 7:00 A.M.to 7:00 P.M.,April 15th through May 15th,excluding Sundays;and between the hours of 7:00 A.M.to 7:00 P.M.,October 15th through November 30t\excluding Sundays,with said fires being extinguished and not smoldering by the 7:00 P.M.deadline;and except the following: A.Fire Places and Grills.This ordinance shall not apply to indoor or outdoor fireplaces or barbecue grills used solely for entertainment purposes or the preparation of food for human consumption. B.Organic Fire in Agricultural Areas.This ordinance shall not apply to organic fires in agricultural areas zoned A-I as long as there are no fires within 1,000 feet of any land zoned other than A-1. C.Variance.Open burning of materials not exempted herein upon application to and a variance granted by the City Administrator,after consultation with the Fire Chief of the City of Waukee.Each application for a variance shall contain the following: 1.The name,address and telephone number of the person submitting the application or,if such person is a legal entity,the name and address of the individual authorized to accept service or process on its behalf and the narne of the person in charge of the premises where such open burning is to be conducted. 2.The type of business or activity involved. 3.The nature of the materials to be burned in the open including the type,quantity,and method of iguition and estimate of the time required to complete the open burning is to be conducted. 4.The exact location of the proposed open burning site. 5.The reason(s)for considering that compliance with the prohibition of open burning will produce serious hardship without equal or greater benefits to the public,and the reason why no other reasonable method or disposal can be used without resulting in a hazard to health or property. 6.The signature of the person making the application,following the affmnation that all statements are true and correct. D.Bonfires.A person may kindle or maintain a bonfire or authorize such fire to be kindled or maintained,if such person firsts obtains a permit or the authorization from the Fire Chief of the City of Waukee,or his authorized agent,if the following conditions are met: 1.Such person is an authorized city employee operating under the authority of the city to conduct such a fire;and lor ) ) ) 2.The purpose of the fire is the instruction of public employees in the methods of fire fighting;and/or 3.The purpose of the fire is to instruct employees in the methods of fire fighting on private property used for industrial purpose; and/or 4.The purpose of the fire is for public gatherings under legitimate sponsorship of civil,fraternal,religious,education,or similar organization. 5.Only organic materials are used,proper safety precautions are used,and the fire is well controlled.
