Bailey,Jr.IRollCall.The Mayor asked for a roll call vote and the following Council members were present:Nick
Gruber,Marvin Berger,Robyn Heath,Bill Peard,and Larry Lyons.
Open Fornm.Councilman Lyon requested the Monday,October 18'1999 City Council meeting be moved
to Tuesday,October 19,1999.
Motion by Councilman Lyon,seconded by Councilwoman Heath,to reschedule the Monday,October 18,
1999 council meeting to Tuesday,October 19,1999.The Mayor asked for a roll call vote:Ayes:Lyon,
Heath,Peard,Berger,and Gruber.Nays:None.Motion carried 5 to O.
Agenda Additions -Agenda Approval.Motion by Councilman Peard,seconded by Councilman Lyon,to
approve the agenda with the deletion of items #34 -Closed Session Per Section 21.51 "to evaluate the
professional competency of an individual whose appointment,hiring,performance or discharge is to be
considered when necessary to prevent needless and irreparable injury to that individual's reputation and
that individual requests a closed session";and #35 -Resolution Adopting Assistant City Administrator's
Job Description and Salary Adjustment.The Mayor asked for a voice vote.Motion carried 5 to O.

Design Alliance Architect to Discuss Starns of New Pnblic Safety Bnilding.Jerry Purdy,gave a brief
update on the new Public Safety Building.
Resolution No.99·115 Approving Change Order No.1 for the Public Safety Building.Design
Alliance,Inc.is requesting approval of a change order for the Public Safety Building in the amount of
$3,383.50.This change order includes:
I.South curb cut -$516.00
2.Door Hardware Revision -$514.00
3.Brick Allowance -$1,497.00
4.Thick Approach Excavation -$1,711.00
5.Additional Approach -$1,115.50
6.Curb cut along V Avenue per John Gibson's reqnest -$1,024.00

Resolution No.99-116 Approving Partial Pay Estimate No.9 for the Public Safety Building.Tbe base
contract for the construction of the new Public Safety Building in the amount of $2,413,000.00 was
awarded to the Denis Della Vedova firm last October.IThearchitectshavereviewedthispayrequestandrecommenditbeapprovedintheamountof$301 ,464.45
for work completed through September 25,1999.The balance of the contract to finish.inclnding retainage
is $437,811.70.
Motion by Councilman Berger,seconded by Councilman Gruber,to adopt Resolution No.99-116 entitled
"Resolution Approving Partial Pay Estimate No.9 to Denis Della Vedova for the Waukee Public Safety
Building".The Mayor asked for a roll call vote:Ayes:Berger,Gruber,Peard,Lyon and Heath.Nays:
None.Motion carried 5 to O.
Discussion About Utilization of Office Space at City Hall.A request was made to allow the City Council
the opportunity to discuss the utilization of office space at City Hall.
Resolution No.99-117 Approving Adoption of Utility Easement from Gilcrest Jewett Lumber
Company.This utility Easement from Gilcrest Jewett Lumber Company will allow an additional 15 feet
for repairing,replacing,enlarging,inspecting and maintaining a Gas Main together with all necessary
structures and appurtenances thereto,under,over,on,through,across and within the Easement Area.
Motion by Councilman Peard,seconded by Councilman Lyon,to adopt Resolution No.99-117 approving
adoption of Utility Easement from GilcrestJewett Lumber Company".The Mayor asked for a roll call
vote:Ayes:Peard,Lyon,Gruber,Berger and Heath.Nays:None.Motion carried 5 to 0
Resolution No.99-118 •Public Hearing Taking Action to Enter into a Loan Agreement for Sewer
Bonds and Consideration of Letter of Intent with Ruan Securities.Mayor Bailey opened the Public
Hearing at 7 :37pm.No oral or written comment had been received.

the Loan Agreement.
Mayor Bailey closed the Public Hearing at 7 :49pm.
Motion by Councilman Peard,seconded by Councilman Berger,to approve Resolution No.99-118 "Taking
action to enter into a Loan Agreement"in an amount not to exceed $810,000 with the escrow being
unconditional.The Mayor asked for a roll call vote:Ayes:Peard,Berger,Gruber,Heath and Lyon.Nays:
None.Motion carried 5 to O.
Resolution No.99-119 -Public Hearing Taking Action to Enter into a Loan Agreement for Water
Bonds and Consideration of Letter of Intent with Ruau Securities.Mayor Bailey opened the Public
Hearing at 7:50pm.No oral or written comments were received.

action to enter into a Loan Agreement"in an amount not to exceed $670,000 with the escrow being

actual ordinance.Paul Huscher has now completed the ordinance requested for said rate change.

FURNISHED USERS BY THE MUNICIPAL GASWORKS DISTRIBUTION SYSTEM OF THE CITY OF
WAUKEE,IOWA,BY DELETING SAID CHAPTER AND INSERTING IN LIEU THEREOF AMENDED
GAS RATES,INCREASES,AND MANNER OF PROVISION OF SERVICES.
BE IT ORDAINED BY THE COUNCIL OF TIIE CITY 01'WAUKEE AS POLLOWS:
Section I.Chapter 202,Waukee Municipal Code is hereby amended by deleting said chapter
and inserting in lieu thereof the following:
Section 2.Monthly Rates.The following monthly rates to be charged for gas furnished the
users thereof within the corporate limits of the City of Waukee shall be and are established as follows:
A.Rate Schednle No.1·Small Volnme (Firm)This rate is
applicable to all fnm natural gas service normally supplied
through one meter as a single point of delivery for all residential
and industrial customers that consume 1000 therms (lOOccf)or
less per month:
Service Charge per Meter $8.75
Non-gas Commodity Charge per therm $0.175

Purchased Gas Calculation (pGC)-shall be calculated each
month by dividing the total quantity of therms delivered to the
city into the total dollars spent to have natural gas delivered to
the City Town Border Stations (TBS)1
The above rate shall be subject to the monthly Sales Volume
Adjustment (SVA).The SVA shall adjust the Non-Gas
Commodity Charge for monthly volume variations.
B.Rate Schedule No.2 -Large Volume (Firm)This rate is
applicable to all firm natural gas service normally supplied
through one meter as a single point of delivery for all residential
commercial and industrial customers that consume 1000 therms
(lOOcc!)or less per month:
Service Charge per Meter $17.50
Non-gas Commodity Charge per thenn $0.130
Purchased Gas Calculation (pGC)-shall be calculated each
month by dividing the total quantity of therms delivered to the
city into the total dollars spent to have natural gas delivered to

The above rate shall be subject to the monthly Sales Volume

C.Rate Schedule No.3 -Interruptible Commercial This rate is
applicable to any customer for non-domestic purposes where all
service is taken through a single meter at one location,and where
the average daily consumption is equal to or greater than 1000
thems per day.The customer must be able to curtail the use of
natural gas within 4 hours of notification.
Service Charge per Meter $50.00
Non-gas Commodity Charge per therm $0.05
Purchased Gas Calculation (POC)-shall be calculated each
mouth by dividing the total quantity of therms delivered to the
city into the total dollars speut to have natural gas delivered to
the City Town Border Stations (TBS)
The above rate shall be subject to the monthly Sales Volume
Adjustment (SVA).The SVA shall adjust the Non-Gas
Commodity Charge for monthly volume variations.
Failure .to Curtail Penalty -The City shall assess the following penalty
charges,in addition to the priced,for failure to curtail natural gas
consumption within 4 hours of notifications:
Non-Critical Day'-$8.75 per therm consumed after the notification
period.
•As called by Northern Natural Gas.ICriticalDay*-$5.60 per therm consumed after the notification period.

Late Payment Charge-A late payment charge of 1.5%shall be added to
the past due amount if the bill is not paid by the due date.
Minimum Charge ~The minimum charge is the service charge plus the
commodity charge for all the therms used.
Section 2.Rate Increase.Any rate increases after November I,1999,which are made by the
supplier of natural gas to the Waukee Municipal Gasworks Distribution System shall be passed on to the
consumer additional to the above rates,and shall be reflected in a subsection of the Gas Bill sent to said
consumer.
Section 3.DisconnectionJReconnection Policy The DisconnectionIReconnection Policy shall
be set by resolution of the City Council of the City of Waukee,and shall remain in full force and effect until
amended by the Council.
Section 4.Installation of Gas Meter Extensions.
§202.3.Installation of Gas Meter Extensions.When in the opinion of the City Clerk,a meter is
inaccessible to the reader because of location,prohibited entry due to animals or barriers,or any other
reason,the City Clerk may cause to be installed a gas meter extension and shall charge the cost of said gas
meter extension and the installation thereof to the user.

§202.4 Payment.Gas payments shall be governed by the Waukee Municipal Utilities
Gas Tariff,as the same may,from time to time,be amended,on file with the Iowa State Commerce
Commission.

§202.5 Enforcement.The City Conncil may,by resolution,establish rules for the
termination of gas service to any customer who has become delinquent and fails to remedy said
delinquency after reasonable notice.
§202.6.Amendments.The said City may from time to time,by ordinance,change and readjust
the foregoing rates to be charged for gas where it is deemed advisable in the judgment of the City Council,
with approval of outstanding bondholders of record.
§202.7.Compnlsory Meter Check.Every meter shall be removed from service at least once
each 10 years and thoroughly tested for accuracy.Any meter found inaccurate beyond a tolerance of two
(2%)percent shall not be returned to service until properly adjusted.
§202.8.Fees,Charges and Expenses.The City Council shall,by resolution,establish a
schedule of fees,charges and expenses for the extension or installation of gas service lines by the City of
Waukee.The schedule of fees,charges and expenses shall be posted in the office of the administrative
official,and may be altered or amended only by a resolution of the City Council.
§202.9.Waiving of Installation and hook-np fees.Installation or hook-up fees may be waived
for non-profit organizations or other charitable purposes when deemed acceptable by the city council.
Section 5.Repealer.All ordinances or parts of ordinances in conflict with the provisions of
this ordinance are hereby repealed.

Section 6.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole
or any section,provision,or part thereof not adjudged invalid or unconstitutional.ISection7.Effective Date.This ordinance sball be in effect upon its final passage,approval
and publication as provided by law.

miles per hour.
2.The speed limit on Ashworth Drive between the east line of Warrior Lane and

3.The speed limit on Boone Drive from a distance of 1875 feet north of the
centerline of University Avenue to the north line of University Avenue in the
City of Waukee,Iowa is 35 miles per hour.

cityunless all passengers of said vehicle are inside said vehicle in the place intended for
their accommodation.No person shall ride on the running board of a motor vehicle or in
any other place not customarily used for carrying passengers.No person riding upon any
bicycle,coaster,roller skates,sled,skis,skateboard or toy vehicle upon a roadway.This
section shall not apply to emergency vehicles.

October 19,1998 -Ordinance No.2258 IU.Only those sections above which are listed as simple misdemeanors by the Code of Iowa,
shall be enforced as violations of the Waukee Municipal Code.If the punishment for
violation of such section under the Code of Iowa,shall be different from that provided by the
Waukee Municipal Code for a simple misdemeanor,the punishment set out in the Code of
Iowa shall prevail.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this
ordinance are hereby repealed.

Ordinance No.2305 Amending 1994 Uniform Fire Code.A year ago,the City of Waukee adopted the
1994 Uniform Fire Code but did not adopt the amendments to go along with it.By adopting the
amendments,the City will have the same fire code as the other western suburbs.
The City of Waukee currently has a 45,000 sq.ft.commercial building under construction,and our current
fire code does not mandate a sprinkler system for this struction.If the same building were to be built in
Clive,the building would have been sprinkled at 6,000 sq.ft.

Section 1.Purpose.The purpose of this ordinance is to provide more uniformity with the
surrounding communities as concerns sprinkling of structures and to provide for the safety of the general
public.

This ordinance shall provide for the addition to Chapter 803 by adding thereto
§803.Amendments To The Uniform Fh'e Code Of 1994.

The Uniform Fire Code is amended and changed in the following respects:
Amend Section 105.2.2 Expiration to read as follows:A fee for permits required hy this ordinance shall he
paid to the City of Waukee and permits shall be valid for one year nnless otherwise noted on the permit.
Add Section 105.2.2.1 Duplicate Permits.Wheu evidence is shown that a building permit and fee has been
secured for any listed permit the Fire Code,it may suffice and duplicate fees may be waived.
Amend Section 105.8 Permit Required to read as follows:A permit shall be obtained [TOmthe Chief of the
Waukee Voluntary Fire Department prior to engaging in the following activities operations,practices or
functions:

oil-burning equipment.
4.To remove Class I or Class II liquids from an underground storage tank used for fueling motor
vehicles by any means other than the approved,stationary on-site pumps normally used for
dispensing purposes.

dispensing stations,refineries,distilleries and similar facilities where flammable and combustible

Amend Section 7802.2 Seizure of Fireworks to read as follows:The Chief is authorized to seize,take,
remove or cause to be removed at the expense of the owner all stocks of illegal fireworks (not State
approved),offered or exposed for sale,stored and held to be in violation of this section.
Amend Section 7802.3 Prohibition to read as follows:It shall be unlawful for any person to possess,store,
offer for sale,sell at retail,or use or explode any fireworks within the corporate limits of the City of
Waukee,Iowa.
Exception:1.The use of fireworks for display is allowed as set forth in Section 7802.4.
Amend Section 7802.4.3 Bond For Display to read as follows:The applicant shall,at the time he or she
makes his or her application for a permit,attach thereto a bond or certificate of Insurance naming the

Ordinance No.2306 Amending Site Plan to Allow for Utility Exemption on Construction Time Limit.
MidAmerican Energy is petitioning the City Council to change the City's Site Plan Ordinance to allow for
more flexibility in the window of time they would need to construct a substation after the Site Plan has
been approved.]The Planning and Zoning Commission has recommended that the Ordinance be worded to allow for an
exemption for utilities.
This ordinance should allow for a justifiable exemption while prohibiting an open ended time frame for
general construction,thus preventing the possibility of untimely delays and nonconforming usage as
development occurs in the surrounding areas of a previously approved site plan.

Section 1.Purpose.The purpose of this ordinance is to allow for a reasonable
exemption in the time it is necessary for construction to begin on a utility service
structure after site plan approval by the City Council.
BE IT ORDAINED by the City Council of the City of Waukee,Section 304.9
Waukee Municipal Code Validity of Approval is deleted and the following is substituted
in lieu thereof:
§304.9
B.
Validity Of Approval.
A.A site plan shall become effective upon certification of approval by
the City Council.
The City Council approval of any site plan required by this article
shall remain valid for one (l)year allowing one (1)year extension
with approval of City Council upon recommendation of the
Commission after the date of approval,after which time the site
plan shall be deemed null and void if the development has not been
established or actual construction commenced.For the purpose of
this article "actual construction"shall mean that the permanent
placement of construction materials has started and is proceeding
without undue delay.Preparation of plans,securing financial
arrangements,issuance of building permits,letting of contracts,
grading of property,or stockpiling of materials on the site shall not
constitute actual construction.
c.Exemption:At the time of site plan approval the City Council may
grant an exemption on the time construction must begin after their
approval is given for a utility service structure.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with
the provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provlSlon or part of this

R-l.The Planning and Zoning Commission is recommending the rezoning of 750 NW 142"d St.from A-I
to R-l.The development plans for this proposed location include high-end neo-classical homes in a price
range above the surrounding subdivisions.The developer's idea is appeal to a different yet compatible
market at the higher-end of the income scale.

Resolution No.99-122 -Requiring Installation of a Sidewalk 0 n Eastern Side of Warrior Lane.The
City Council conditionally waived the construction of sidewalks on the west side of Warrior Lane on
November 21,1994.A subsequent motion was made to approve the final plat of Windfield Plat 3 on
November 21,1994 subject to "the developer installing sidewalkslbike trail along the full length of the plat
boundary",
The developer has submitted the final plat for Windfield II for approval at the October 19,1999 City
Council Meeting.Planning and Zoning approved the final plat at their September 28,1999 meeting with
the condition that an agreement be reached on the sidewalks along Warrior Lane.
Veenstra &K1nun have verified that there is room for a sidewalk up to 6 ft wide.City staff is
recommending the sidewalk be constructed at a width of 6-ft.This size sidewalk will accommodate the
additional foot traffic resulting from the existence of only a single sidewalk along Warrior Lane.]

Report on Interlata and Intra!ata Long Distance Phone Savings for the City of Waukee.Per the
request of Mark Arentsen,City Administrator,the City of Waukee phone usage for interlata and intralata
long distance was analyzed by Joshua Smith,Economic Development Director.After a careful review of
interlata and intralata rates of other companies,the City has put all phone numbers utilized by City
Departments with one carrier -Iowa Automobile Dealers Association (IADA),and MCI/WorldCom
reseller of long distance.The City's rate for all calls,regardless of lata,or time of call will be .0925 per
minute,billed on six second increments.The City had been paying rates varying from .10 per minute to .50
per minute on several telephone numbers.The City is also canceling calling cards through US West and
AT &T,and will have calling cards issued iu October from IADA with rates of .0925 per minutes,and a
.40 connectivity fee.The previous calling cards were charging up to .95 per minutes.The City also
requested a pic restriction or pic "freeze"for all telephone lines to prevent slamming/cramming.
