Bailey,Jr. Roll Call.Mayor Bailey asked for a roll call vote and the following Council Members were present:Nick Gruber,Marvin Berger,Robyn S.Heath,and Larry Lyon.Absent:Bill Peard. Open Forum.Jay Oxenford -866 Collins Drive-would like sidewalks placed both sides of Warrior Lane because a little boy was hurt on Friday trying to avoid being hit by a car coming home from school. Bill Meyer -320 Melrose -41'2 years ago sidewalks were planned on the West side of Warrior Lane. Jeff Warmouth -180 Kaylin Drive -would like to see a 6ft sidewalk on both sides of Warrior Lane. Tom McNulty -would like to see sidewalks installed throughout town. Jim Phillips -240 Bel-Aire -feels the City finds money for everything else and would like to know why the city can't find money to install sidewalks. Wayne Johnson -320 Parkview,would like the City to check into using parkland dedication fees for the 6ft bike trail/sidewalk along Warrior Lane. Nick Gruber,Jay Oxenford,Wayne Johnson and John Gibson will meet to discnss the sidewalks along Warrior Lane and bring their recommendation to the Council at the November 15th meeting. Kim Morris -75 Bel-Aire -voiced her opinion against open burning.Kim would like to see the burning time shortened to 2 weeks. Agenda Additions -Agenda Approval. Tyrone Theil presented the City of Waukee with a cost analysis of what our rates currently are with US West and what projected cost and savings would be by transferring City phone service to McLeod USA. Tyrone will also be giving a presentation to Waukee Business owners and residents regarding comparable services and prices. I Cost Analysis of Veenstra &Kimm Engineering Services for Fiscal Year 1998-1999. Total cost paid by the City for Veenstra &Kimm engineering services for FY1998/1999 was $243,177.60. After the developer refunds were received,the total cost to the City was $191,445.78. Resolntion No.99-135 -Approving Hawthorne Ridge Townhomes Final Plat. Veenstra &Kimm,Inc have reviewed the progress on Hawthorne Ridge Townhomes in regard to approval of the Final Plat and have noted several items on the punch list not completed.These items will be covered with performance bonds.All legal documentations have been provided. Motion by Councilman Lyon,seconded by Councihnan Berger,to adopt Resolution 99-135 accepting the final plat of Hawthorne Ridge Townhomes Residential R-5 a subdivision of the City of Waukee,in Dallas County,Iowa subject to the compliance by providing the necessary bonds (no building permits will be issued until all the required platting procedures are completed.The Mayor asked for a roll call vote:Ayes: Lyon,Berger,and Gruber.Nays:Heath.Motion carried 3 to I. Resolution No.99-136 -Approving Windfield II Plat 1 Identification Sigu. Regency Builders would like approval to erect a development identification sign (i.e.monument sign)in Windfield II Plat I.This sign would be located within the Windfield Drive median at the entrance of Windfield II Plat I.Provisions for this type of monument sign is made in Section 301.8K(5)of the Waukee Municipal Code.The proposed sign would be a mirror image of the current monument sign located within Windfield I.IStaffandtheCityEngineershavebothreviewedtheproposedmonumentsignandrecommendapproval provided that the developer provides for maintenance of the sign. Motion Councilman Lyon,seconded by Councilwoman Heath,to adopt Resolution No.99-136 approving Windfield II Plat I Identification Sign.The Mayor asked for a roll call vote:Ayes:Lyon,Heath,Berger, and Gruber.Nays:None.Motion carried 4 to O. Resolution No.99-137 -Approving Windficld II Plat 1 Final Plat. Following the City Council meeting on October 19"',1999 staff resolved the two issues of concern the delayed the approval of Windfield II Plat I Final Plat.The issue regarding the sidewalks outside of the plat proper will be assessed for construction.The second concern was the drainage issue per review by Veenstra &Kirnm the drainage concern on or around the plat in consideration can be handled as part of the sidewalk assessment and construction. Motion by Councilman Gruber,seconded by Councihnan Lyon,to adopt Resolution No.99-137 accepting the final plat of Wind field II Plat I Residential R-I a subdivision of the City of Waukee,in Dallas County, Iowa.The Mayor asked for a roll call vote:Ayes:Gruber,Lyon,Berger,and Heath.Nays:None.Motion carried 4 to O. Resolution No.99-138 -Approving Partial Pay Estimate #10 for Waukee Pnblic Safety Building. The base contract for the construction of the new Public Safety Building in the amount of $2,413,000.00 was awarded to the Denis Della Vedova fiTID.The architects have reviewed the pay request and recommend it be approved in the amount of $249,798.70 for work completed through October 25,1999. Ordinance No.2308 •to Amend Snbdivision Ordinance to Provide for Limitations on Building on Snbdivided Land Witbin the City of Waukee. This Ordinance sets limitations on building on certain subdivided lots based on Federal,State and Local laws.Limitations by lack of available disposal system,lack of service by utility companies,unstable soils. old coal mines,waterways and floodways,wetlands,groundwater,environmental limitation.or other natural or man-made features which,known or unknown,to the City Building Inspector may cause a health or safety concern for the potential occupants of the lot. Motion by Councilwoman Heath,seconded by Councilman Berger,to have the third reading of an "Ordinance Amending Subdivision Ordinance to Provide for Limitations on Building on Subdivided Land Within the City of Waukee"in title only.The Mayor asked for a roll call vote:Ayes:Heath,Berger,and Gruber.Nays:Lyon.Motion carried 3 to I. Motion by Councilwoman Heath,seconded by Councilman Berger,to place an "Ordinance Amending Subdivision Ordinance to Provide for Limitations on Building on Subdivided Land Within the City of Waukee"on final passage.The Mayor asked for a roll call vote:Ayes:Heath,Berger,and Gruber.Nays: Lyon.Motion carried 3 to I. The Mayor declared Ordinance No.2308 duly passed and adopted. ORDINANCE NO.2308 AN ORDINANCE TO AMEND CHAPTER 303.11,BY ADDING THERETO SECTION 303.11B PROVIDING THAT DUE TO LIMITATIONS AS TO A TRACT OF LAND IN A SUBDIVISION,BUILDING MAY NOT BE PERMITED ON SAID TRACT;AND PROVIDING FOR A COPY OF THIS ORDINANCE TO BE INCLUDED WITHIN EACH SUBDIVISION PLAT BE IT ENACTED BY THE COUNCIL OF THE CITY OF WAUKEE,IOWA AS FOLLOWS: Section 1.Amendment to Chapter 303.11,Waukee Municipal Code. Chapter 303.11,Waukee Municipal Code,is hereby amended by adding thereto Section 303.11B as follows: ••-~">- Section 2.Limitations on Building on Subdivided Land Within the City of Waukee.Subdivisions of land within the City of Waukee may allow multiple ownership of parcels of land (lots)within a larger tract of land originally under single ownership.Each lot has limitations of use and some lots may not be suitable for erection of dwellings or ancillary buildings.Notwithstanding compliance with all local zoning requirements and City ordinances,each lot is subject to limitations of use by Federal, State and local laws -limitations by lack of available central wastewater collection system or suitable on site individual disposal system,lack of service by utility companies, unstable soils,old coal mines,waterways and floodways,wetlands,groundwater, environmental limitations,or other natural or man-made features which,known or unknown,to the City Building Inspector may cause a health or safety concern for the potential occupants of the lot.Individuals who purchase a lot within a subdivision,or a 7 partial lot caused by the division of a lot within a subdivision assume all risk in determining the suitability of the use of such lot for building purposes.A copy of this ordinance shall be included in each plat for which approval is requested in the City of Waukee.I Section 3.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4.Severability.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 5.Effective Date.This ordinance shall be in effect upon its final passage,approval and publication as provided by law. Ordinance to Amend Subdivision Ordinance to Provide for the Prohibition of Bnildiug on a Tract of Gronnd Less than a Whole Lot. This Ordinance prohibits building on a lot that is less than a whole lot or building a structure that reqnires but is not serviceable by sewer on such a lot.IMotionbyCouncilmanGruber,seconded by Councilman Lyon,to table this item.The Mayor asked for a roll call vote:Ayes:Gruber,Lyon,Heath,and Berger.Nays:None.Motion carried 4 to O. Resolution No.99-139 -Adopting a Joint Services 28E Agreement with Clive Providing for Snow,Ice and Striping Responsibilities on Alice's Road,142M Street and Woodcrest Drive. This is a new 28E Agreement with Clive outlining snow and ice removal,striping responsibilities for Alice's Road and 142"d Street.Under the terms of this agreement the City of Waukee will be responsible for snow and ice removal on Alice's Road.The City of Clive will be responsible for snow and ice removal on 142n'Street and Woodcrest Drive.Additionally,Clive will paint pavement markings on Alice's Road and 142n'Street. Motion by Councihnan Gruber,seconded by Councilwoman Heath,to adopt Resolution No.99·139 entering the City of Waukee into a 28E Agreement with the City of Clive for the purpose of snow and ice removal,and striping of Alice's Road and 142"'Street.The Mayor asked for a roll call vote:Ayes:Gruber, Heath,Berger,and Lyon.Nays:None.Motion carried 4 to O. Discussion of Purchase of Street Sweeper. After looking for over a year,the Public Works Department found a used street sweeper for the City.It is a used 1996 Elgin Sweeper from Ames that has 1200 hours and 2900 miles.The price is $53,000 with several lease options.John Gibson suggests $20,000 dowu payment on July 15,2000 and annual payments of$7,939.87 for 5 years. Motion by Councilman Berger,seconded by Councilman Gruber,to purchase the 1996 Elgin Street Sweeper from Elliott Equipment for $53,000 with a $20,000 down payment due on July 15,2000 and to secure financing for the balance for 5 years not to exceed $7,939.87 each year.The Mayor asked for a roll call vote:Ayes:Berger,Gruber,Heath,and Lyon.Nays:None.Motion carried 4 to O.I 8 Resolution No.99-140·Authorizing the Advertising for and the Hiring of a Part-time Meter ReaderfUtility Laborer. On October 18,1999 Robert Beuter a f Bermex Contract Services notified John Gibson,Public Works Director,that they would not be signing the Meter Reader Contract due to some personnel problems.If you remember Bermex was the only bidder,so this leaves the City without a meter reading services.The most viable solution to the problem is to hire a part-time meter reader until July 1,2000 at which time the job would become full-time.$19,000 was budgeted for this year with $13,234.60 remaining.This job would be classified meter reader/utility worker.Funding for the full-time position would be shared equally by the utilities.This position would read meters 5 -7 days per month and be available to work with other departments the remaining days.
