4.Open Forum: Pastor Tim Rude and Pastor Bruce Crane with Walnut Creek Community Church stood up to introduce themselves and invite anyone interested to come to their church services held at Eason Elementary School at 9:00 am on Sundays. Mayor Bailey read a Proclamation for School Board recognition week: PROCLAMATION School Board Recognition Week 2000 WHEREAS,An excellent public education system is vital to the quality of life for all our citizens;AND, WHEREAS,The approximately 2,350 Iowa school board,area education agency board and community college board members represent a tremendous resource as local decision makers,responding to the needs of their communities and regions based on varying local conditions and serving as the voice of their communities;AND, 5 WHEREAS,School boards are leaders for leaming,continually put students first,and strive for improvement and progress in education to ensure that Iowa students are prepared for the future;AND, WHEREAS,School board governance provides shared vision,structure,accountability and advocacy for the community's educational system,keeping before the public the need of all students to become participating and productive citizens,and promoting the importance of public education for a free nation,its people,its economy,and its continued leadership in the world;AND, WHEREAS,The men and women elected by the people as members of school boards deserve recognition and thanks for countless hours of voluntary public service to education in Iowa, NOW,THEREFORE,I Mayor Donald Lee Bailey,Jr.,mayor of the City of Waukee,do hereby proclaim May 14-20,2000,as School Board Recognition Week in Iowa and call its significance to the attention of all our citizens. ~Donald L.Bailey,Jr.,ayor ATTEST: Mark J.Arentsen,City Administrator/Clerk Mayor Bailey read a letter from a concerned citizen regarding a delinquency they had received,but they had not received a utility bill prior to that from the City.John Gibson stated there had been a problem this last month with citizens receiving their utility bills, and he will send out a letter of apology. 5.Agenda Approval:Motion by Councilman Gruber,second by Councilman Peard to "Approve the Agenda as Proposed". 6.Motion:To Consider Park Board Recommendation for Improvements to Centennial Park. Councilman Johnson and Matt Carlisle presented the agenda item and gave a brief explanation of the park improvements,and would like to see that the park improvements go to the next Comprehensive Plan Committee meeting.Dr.Stalker explained that the 6 money for the improvements will come from grants and donations,and by sharing the uses both for the school and adult recreation the grants are more easily obtained.Dr. Stalker also explained that the practice fields for school athletics would be located on the school property allowing the citizens to utilize the park,Motion by Councilman Johnson, second by Councilman Watts to "Approve the Park Board Recommendation for Improvements to Centennial Park to be forwarded to the Comprehensive Plan Committee".Ayes:Johnson,Watts,Peard Berger,and Gruber.Nays:None.Motion carried 5-0. 7.Resolution:Approving the Purchase of CRAFCO Crack Sealer Motion by Councilman Watts,second by Councilman Berger to "Approve the Resolution for the Purchase of CRAFCO Crack Sealer".Ayes:Watts,Berger,Gruber,Johnson, Peard.Nays:None.Motion carried 5-0. RESOLUTION NO.00-47 A RESOLUTION APPROVING THE PURCHACE OF A CRAFCO SUPER SHOT 60 CRACK SEALER WHEREAS,the City Council of the City of Waukee is determined to extend the useful life of the streets in the City of Waukee; AND WHEREAS,in keeping with this policy the City Council has instructed the Public Works to seal cracks on a regular basis; NOW,THEREFORE,BE IT RESOLVED the City Council of the City of Waukee approves the purchase of a CRAFCO Super Shot 60 Crack Sealer in the amount of $17,600 with the down payment of $10,000 due at delivery of the crack sealer and the balance of $7,600 due on the 15th of July,2000. PASSED AND APROVED this 1st day of May,2000. The Public Works Department is in need of establishing a Laborer I Position,this position would float from the various areas and help where necessary within the department.This position will be funded through the savings realized by contracting the utility billing to Des Moines Water Works.Motion by Councilman Berger,second by Councilman Peard to "Approve establishing a Utility Laborer I position for the Public Works Department".Ayes:Berger,Peard,Gruber,Johnson,and Watts.Nays:None. Motion carried 5-0. 9.ReceivelFile:Discussion of Proposed Budget Amendment. Kathy Horner briefly explained the budget amendment proposed.Mayor Bailey requested a copy of the breakdown in Policy Administration.Councilman Johnson asked if the TIP Revenue scheduled to payout or does it belong to the City.Kathy explained that the City Collected more than had been budgeted.The Public Hearing date is set for May 15,2000,and the publication will be in May 5,2000 Dallas County News.Motion by Councilman Berger,second by Councilman Johnson to "receive the report".Ayes: Berger,Johnson,Gruber,Watts,and Peard.Nays:None.Motion carried 5-0. 10.ReceivelFile:Discussion of Closed Refuse Containers. City Staff has received complaints of garbage blowing around the City on days of trash pickup.Residents have asked the City to consider making citizens use closed refuse containers when setting garbage out for trash pickup.Mayor Bailey asked that John Gibson write and article in the Waukee Taukee to ask that the citizens either bring their garbage out the morning of pickup,or use closed containers for their trash.Motion by Councilman Peard,second by Councilman Berger to "Have John Gibson write a gentle reminder in the Waukee Taukee for the citizens to use consideration to others when displaying their garbage for garbage pickup".Ayes:Peard,Berger,Watts,Gruber,and Johnson.Nays:None.Motion carried 5-0. 11.ReceivelFile:Discussion of Dallas County Development Code of Ethics. 8 Motion by Councilman Watts,second by Councilman Johnson to "Approve the Dallas County Development Code of Ethics".Ayes:Watts,Johnson,Berger,Gruber,and Peard.Nays:None.Motion carried 5-0. 12.Receive/Pile:Discussion about the Waukee City Flag Motion by Councilman Gruber,second by Councilman Peard to "Approve the new logo be placed on the City flag as well as the metal signs on the edge of town".Ayes:Gruber, Peard,Johnson,Watts,and Berger.Nays:None.Motion carried 5-0 13.Public Hearing:Rezoning of 4L Acres from A-I to R-l. Mayor Bailey opened the Public Hearing and asked for oral or written comments.No written comments were received.Mr.Danials,1915 Hawthorne Ridge Dr.,supports the rezoning,but was concerned with the business on the location.Paul Huscher explained Home Occupation and gave a case comparison.Mr.Lyon can store contractors equipment that he uses,but cannot fabricate in his accessory building.There was significant discussion on the location of the sewer easement that would service this property.It was decided that the Engineers and staff would research and resolve the sewer issue before Mr.Lyon would receive a building permit.Mayor Bailey closed the Public Hearing. 14.Public Heming:Rezoning of Parkview Crosing Lot 59 from R-3 to R-4. Mayor Bailey opened the Public Hearing and asked for oral or written comments.None were received.Mayor Bailey closed the Public Hearing. 15.Resolution:Approving Rezoning of 4L Acres from A-I to R-l. Motion by Councilman Peard,second by Councilman Gruber to "Approve the Resolution for Rezoning 4L Acres from A-I to R-l contingent on the sewer issue being resolved prior to the building permit being issued".Ayes:Peard,Gruber,Johnson,Berger,and Watts.Nays:None.Motion carried 5-0. RESOLUTION 00-48 Approving Rezoning of 4L Acres from A-I to R-I WHEREAS,the rezoning of 4L Acres was approved by the Waukee Planning &Zoning Committee on March 28,2000;AND, WHEREAS,the Code Compliance Office has found this request to be in compliance with City Ordinances. Gary Reed with Kirkham Michael and Jamie Myers the owner of the property presented the Site Plan for Brenton Bank.Gary started by thanking the staff for their help and speed with the site plan.Motion by Councilman Johnson,second by Councilman Peard to "Approve the Brenton Bank Site Plan with a temporary hatch out area on the south side for tum around,and that sidewalks be installed along Carefree Lane when development begins on the north side of Highway 6".Ayes:Johnson,Peard,Gruber, Berger,and Watts.Nays:None.Motion carried 5-0. RESOLUTION 00-50 Approving Brenton Bank Site Plan WHEREAS,Planning &Zoning on April 17,2000 approved the Brenton Bank Site Plan;AND, WHEREAS,the Code Compliance Office has found this request to be in compliance with City Ordinances;AND, WHEREAS,Brenton Bank has been an excellent corporate citizen of the City of Waukee and Dallas County for over seventy (70)years. 11 NOW,THEREFORE BE IT RESOLVED,by the City of Waukee City Council in session this 1$1day of May 2000,that it hereby approves the Brenton Bank Site Plan. Johns Gibson presented the Addendum ITto the Standard Specifications for Public Improvements in the City of Waukee,all the concerns have been addressed and the connnittee consisting of Councilman Watts,Councilman Gruber,Mikelis Briedis and John Gibson,recommends the approval of the Adendum IT.Motion by Councilman Berger,second by Councilman Watts to "Approve the Resolution Adopting the Addendum IT to the Standard Specifications for Public Improvements in the City of Waukee".Ayes:Berger,Watts,Gruber,Johnson,and Peard.Nays:None.Motion carried 5-0. RESOLUTION NO.00-51 A RESOLUTION ADOPTING ADDENDUM II TO THE STANDARD SPECIFICATIONS FOR PUBLIC IMPROVEMENTS IN THE CITY OF WAUKEE,IOWA 12 WHEREAS,the City Council of the City of Waukee has determined that certain minimum standards of construction for public improvements are needed and desirable to insure quality controls; AND WHEREAS,on November 6,1995 the City Council passed a resolution adopting the Standard Specifications for Public Improvements for the City of Waukee,Iowa; AND WHEREAS,there was an Addendum No.1 to the Standard Specifications on May 22,1996; AND WHEREAS,the City of Waukee desires to be in accordance with the standards of the industry and continue to comply with sound engineering principles; NOW,THEREFORE,BE IT RESOLVED that the City Council ofthe City of Waukee adopts Addendum II to the Standard Specifications for Public Improvements in the City of Waukee,Iowa. Atlantic Bottling Company has requested to add on to their existing facility locate at the SE corner of Highway 6 and Alice's Road.The use of this additional space would be for 13 office functions and warehousing.Mayor Bailey thanked Atlantic Bottling for their citizen support in our community.Motion by Councilman Watts,second by Councilman Berger to "Approve the Site Plan for Atlantic Bottling Company".Ayes:Watts,Berger, Peard,Johnson,and Gruber.Nays:None.Motion carried 5-0. RESOLUTION 00-52 APPROVING SITE PLAN FOR ATLANTIC BOTTLING COMPANY WHEREAS,Atlantic Bottling Company is a highly valued City of Waukee business, AND, WHEREAS,Atlantic Bottling has proposed plans to add 17 ,000sq.ft.to their existing building,AND, WHEREAS,the Planning &Zoning Commission reviewed the plans submitted for the expansion at its April 25,2000 meeting,AND, WHEREAS,the Plans were found to be acceptable provided that a landscaping plan for the project is submitted at the time the plans are reviewed by the City Council,AND, WHEREAS,said landscaping plan has been submitted, NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this I"day of May,2000 that it hereby approves the site plan submitted by Atlantic Bottling with the provision that the landscaping plan presented is also completed. City Attorney:Paul Huscher reported that he will be attending the League of Iowa Cities Seminar regarding impact fees on May 4,2000.He will be finishing the Contract for the Meter Reading. Director of Public Works:John Gibson reported that R-22 would not be completed for another 4-6 weeks,May 6,2000 is the City wide garage sale,May 13,2000 is the City wide clean-up,and the Scouts will be re-roofing the enclosed shelter house on the weekend of May 20,2000. Mayor:Mayor Bailey reported that the building permit numbers were up,housing was up 25%from last year,and commercial was up 10%from last year,there is no t in the street name Rosenkranz,and the City of Waukee is in support of the possibility of a passenger rail service through Waukee.If any of the Councilpersons were interested Mayor Bailey has the information on the passenger rail service. Council:Councilman Johnson reported that the Easter Egg Hunt was a big success and they had nearly 600 people present.Councilman Peard had nothing to report.
