Ayes:Gruber,Peard,Watts,Berger,and Johnson.Nays:None.Motion carried 5-0. 6.Recei vefFile:Cleaning at Community Center ]A letter from Adeline Downey was received,where she asks the city to takeover the cleaning of rest rooms at the Community Center.There are a number of volunteers and a cleaning company that have offered their services . for the Community Center.Motion by Councilman Peard,second by Councilman Gruber to "Approve the Cleaning at Community Center".Ayes: Johnson,Peard,Gruber,Berger,Watts.Nays:None.Motion carried 5-0. 7.ReceivelFile:Portable Stop Sign at WaniorlWindfield Intersection E-mail from Kurt Steinke was received with a request to put a portahle stop sign in the middle of the intersection at WarriorlWindfield.Mr.Steinke showed a tape with vehicles not stopping at the current stop sign.Mr.Steinke and other members expressed a concern for the safety of children and citizens. Because the sign is hard to see it might increase accident rate.Motion by Councilman Johnson,second by Councilman Peard to request "More Law Enforcement Particularly During School Hours".Ayes:Johnson,Peard, Watts,Gruber,Berger.Nays:None.Motion carried 5-0. 8.Public Hearing:FY 2000 Budget Amendment. Mayor Pro-Tern Johnson opened the Public Hearing and asked for oral or written comments.Comments were received from Mary White.Ms.White talked about the revenue increases and decreases,finances,expenditures that occurred during the fiscal year.The total amount of money to be amended is $1.5 million.The money is coming from the fiscal year which ends on June 30,2000.Councilman Johnson closed the Public Hearing. 9.Resolution:Approving FY 2000 Budget Amendment. 6 Motion by Councilman Berger,second by Councilman Gruber to "Approve the FY Budget Amendment".Ayes:Berger,Gruber,Peard,Watts,Johnson. Nays:None.Motion carried 5-0. RESOLUTION 00-56 APPROVING FY 2000 BUDGET AMENDMENT WHEREAS,the City of Waukee is required to file its annnal budget amendment no later than May 31 of each year,AND, WHEREAS,the proposed amendment was published in the Dallas County News on May 4,2000,AND, WHEREAS,copies of the proposed amendment were distributed at the May 1 City Council meeting for review by the Mayor,Council and general public, NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this 15'h day of May,2000 that it hereby adopts the City of Waukee FY 2000 Budget Amendment as published in the Dallas County News on May 4,2000. Mayor Pro-Tern Johnson opened the Public Hearing and asked for oral or Written comments.No written comments were received.A request was made for combining the R2 (One and Two Family Residential)and R3 (Multi-Family Residential)zoning.Specifically,the bigger blocks along L.A. Grant Parkway to be R3 zoning and the interior R2 zoning.One of the projects proposed will be a 44 unit complex for the elderly with some maintenance assistance.Councilman Johnson closed the Public Hearing. II.Resolution:Approving Rezoning of Parkview Crossing Plat 2. 7 Motion by Councilman Berger,second by Councilman Walts to "Approve the Resolution to Rezone the Parkview Crossing Plat 2".Ayes:Berger, Walts,Peard,Gruber,Johnson.Nays:None.Motion carried 5-0.I RESOLUTION 00-57 APPROVING REZONING OF PARKVIEW CROSSING PLAT 2 WHEREAS,the 37.5 acre parcel immediately south of Parkview Crossing on General Grant Parkway formerly known as the Florence Booth property was annexed to the City of Waukee in April of 2000, AND, WHEREAS,a request to rezone this property to R3 multi-family along General Grant Parkway and R2 single family to the east of the R3 area was approved by the Planning and Zoning Commission at its April 25,2000 meeting,AND, WHEREAS,the City has received no objections to this rezoning request, NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this 15th day of May,2000 that it hereby approves the rezoning request as recommended by the Planning and Zoning Commission. Nays:None.Motion carried 5-0.J 8 RESOLUTION 00-58 APPROVING PURCHASE OF PROPERTY FROM BAER AGRICULTURAL SUPPLY WHEREAS,North 6"'Street in the City of Waukee does not currently connect to Highway 6,AND, WHEREAS,an improved access to Highway 6 is needed for those businesses located on North 6"'Street, AND, WHEREAS,the Iowa Department of Transportation has agreed to install a radius intersection at its expense for the North 6"'Street connection,AND, WHEREAS,street right of way needs to be acquired in order to construct the intersection,AND, WHEREAS,City staff have negotiated a potential purchase of the .23 acre right of way ueeded from Baer Agricultural Supply for a price of $40,075.20 or $4.00 per square foot,AND, WHEREAS,acquisition of similar property was made by the Iowa Department of Transportation for an average of $4.55 per square foot,AND, WHEREAS,funding for this acquisition is available in the FY 200 I City budget and the FY 2000 budget amendment, NOW THEREFORE BE IT RESOLVED by the City of Waukee City Couucil in session this 15"'day of May,2000 that it hereby approves the purchase of .23 acres from Baer Agricultural Supply for the price of $40,075.20 with said property to be used for the north 6"'Street right of way. RESOLUTION 00-59 9 APPROVING THE ENGINEERING PROPOSAL FOR DESIGN OF NORTH 6TH STREET RIGHT OF WAY IWHEREAS;the Iowa Department of Transportation has agreed to fund and install the North 6th Street approach off of Highway 6;AND WHEREAS;the City of Wankee has agreed to design and the preparation of the plans and specifications; AND WHEREAS;the City desires to retain the Engineers to provide engineering design; NOW,THEREFORE BE IT RESOLVED,the City of Waukee City Council on the 15th day of May 2000,approves the Engineering Proposal for Design of North 6th Street Right of Way for the amonnt of $6000. Public Works Director John Gibson stated that raising the existing tower 20 Feet will likely occur in the Spring of 200 I.Demolition of the old tower and Pressure tank could occur by the end of this year.Motion by Councilman Watts,second by Councilman Peard to "Approve the Resolution for engineering Contract for Water Tower Rehabilitation and Demolition:'.Ayes: Watts,Peard,Berger,Gruber,Johnson.Nays:None.Motion carried 5-0. RESOLUTION 00·60 APPROVING THE PROFESSIONAL ENGINEERING SERVICES AGREEMENT BETWEEN THE CITY OF WAUKEE AND VEENSTRA &KIMM,INC FOR WATER SYSTEM IMPROVEMENTS I 10 WHEREAS;the City is now considering the construction of the improvement to the water system as set forth in the November 6,1998 report entitled Water System lmprovements,500,000 Gallon Elevated Storage Tank;AND, WHEREAS;the City desires to proceed with the design and preparation of the plans and specifications; AND, WHEREAS;the City desires to retain the Engineers to provide engineering design and construction serves on the Project; NOW,THEREFORE BE IT RESOLVED,the City of Waukee City Council on the 15th of May 2000, approves the agreement between the City of Waukee and Veenstra &Kimm,Inc for the Water System Improvements. The Des Moines Water Works has asked for a waiver that would allow Water Works to use the City of Waukee software for billing.The waiver would give Des Moines perntission to use the software withont paying the software company a separate fee for it.CMS has been contacted with the proposal and has been notified abont the position of the City of Waukee on this issne. motion by Conncilman Gruber,second by Councilman Watts to ''Request the Authority to Obtain Waiver from Computer Management Systems for Contract Use of Utility Billing Software for Des Moines Water Works". Ayes:Gruber,Watts,Peard,Berger,Johnson.Nays:None.Motion carried 5-0. 17.Motion:Consider Request to Extend Centerntial Park Hours. 11 Brent Merkley reqnested the nse of the Centennial Park for a 24 hour Softball tournament.He was under the impression that the school had given its permission for it,but apparently the school was not informed about the event being a 24 hour event.Motion by Councihnan Gruber,second by Councilman Peard to "Consider Extending the Centennial Park Hours".Ayes: None.Nays:Gruber,Peard,Berger,Walts,Johnson.Motion failed 0-5. I 18.Resolution:Approving Purchase of OSHA Approved Storage Tank. Motion by Councilman Berger,second by Councilman Peard to "Approve The Purchase of a 2000 Gallon OSHA Storage Tank".Ayes:Berger, Peard,Watts,Gruber,Johnson.Nays:None.Motion carried 5-0. RESOLUTION 00-61 Approving the Pnrchase of a 2000-gallon Storage Tank from the Farmers Co-operative Elevator Company for the amount of $3000. Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. 13 Section 3.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.I Section 4.Effective Date.This ordinance shall be in effect upon its final passage,approval and publication as provided by law. Director of Community Development:Joshua Smith reported that at the last Community Development Meeting,Steve Blumenthal was designated to coordinate the downtown redevelopment program.Steve will be attending the Introductory Main Street Iowa Applications Workshop on behalf of the City at Grinnell. 22.Closed Session:The City decided against going into Closed Session and the City Council discussed potential gas rates if gas service was extended to Ortonville,Iowa. 23.Adjournment:Mayor Pro-Tern Wayne Johnson asked for a voice vote for adjournment.All were in favor.The Waukee City Council meeting adjourned at 8:36PM.
