Minutes from the Regular Waukee City Council Meeting on June 19,2000
1.C all to Order:The Waukee City Council meeting was called to order at
7:02pm by Mayor Bailey.
2.Roll Call:Mayor Bailey asked for roll call.Present:Gruber,Berger,
Bailey,Watts,Peard,Johnson.Absent:None.
3.Open Forum:Mayor Bailey received a letter from Waukee resident
Charles Zimmerman concerning sidewalks north ofHwy 6
on Warrior Lane.
4.Consent Agenda:Pay Roll,Bill List,Minutes from May 2,2000 meeting and
June 5,2000 meeting.Cigarette Permits for Casey's (both
stores),Kum &Go,and Fareway.Beer permit for the
Waukee Jaycee's for July 4 and July 29,liquor license for
the Wine House.Motion by Councilman Gruber and
second by Councilman Berger to,"Approve the consent
agenda as is"Ayes:Johnson,Peard,Watts,Gruber,Berger.

Joshua Smith pointed out that item #12 should be a
Resolution rather than a motion and that item #14 should be

Presentation by AT&T on Status of Cable Services in
Waukee
Mike Giampetro,General Manager of AT&T Cable,
informed the Council that they had experienced delays due
to fiber shortages and as such the project would likely not
be completed until the end of the year.The project is
nearly a one million dollar effort to upgrade Waukee's lines
to 860 Mhz capability.Mayor Bailey expressed extreme
displeasure with AT&T's efforts and hopes that a different
company offers services soon.Councilman Peard
requested a town meeting to explain the timeframe for the
upgrade.Motion by Councilman Gruber and second by
Councilman Watts to ReceivelFile.Ayes:Gruber,Watts,

Presentation Update on Census Information Regarding
Waukee
This presentation on the census will be moved to the July
10,2000 meeting because no census representative was
available.Motion by Councilman Gruber and second by
Councilman Watts to Receive/File.Ayes:Gruber,Watts,
Berger,Peard,Johnson.Nays:None.Motion Carded 5-0.
Discussion of Urbandale Annexation Moratorium
Agreement between the City of Waukee and the City of
Urbandale
Joshua Smith explained the proposal and its merits,The
Council had several suggestions for staff to take care of.
Among the issues raised were changing the agreement to

allow Waukee to annex to approximately 'h mile north of
Meredith Drive to promote an even border,adding a no de-
annexation clause,deciding upon a western end point,
talking to property owners in the area and talking to
Urbandale about sewer connection possibilities.This issue
will appear on the July 10 agenda as a resolution.Motion
and second to ReceivelFile made by Councilmen Berger
and Peard.Ayes:Berger,Peard,Johnson,Gruber,Watts.
Nays:None.Motion carried 5-0.

9.Resolution Approving Sewer Services for 4L Acres
This item was tabled until Mr.Lyons can ensure a
reasonable cost for running the line.
RESOLUTION NO.
APPROVING SEWER SERVICE FOR 4L ACRES
WHEREAS,Larry Lyon has expressed interest in installing a sewer line extension from
the existing line to his property,AND
JWHEREAS,Mr.Lyon has agreed to pay the entire cost of the project and,when
completed,dedicate the sewer line to the City,AND,
WHEREAS,Mr.Lyon has also agreed to use eight (8)inch line to facilitate others
ability to hook on at a later date and has offered a permanent easement to the City of
Waukee for this same purpose,
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in
session this 19th day of June,2000 that it hereby endorses Mr.Lyon's proposal.

10.Resolution 00-64 Adopting Official Zoning Map for City of Waukee
A map showing an up to date representation of all zoning in
the City of Waukee was presented.The staff is satisfied
with the accuracy of the map and P&Z also approved it.
Motion was made by Councilman Gruber and seconded by
Councilman Peard to approve the new zoning map as
presented.Ayes:Gruber,Peard,Johnson,Berger,Watts.
Nays:None.Motion carried 5-0.
RESOLUTION 00-64
RESOLUTION ADOPTING OFFICIAL ZONING MAP FOR THE CITY OF
WAUKEE
WHEREAS,the City of Waukee has recently annexed and rezoned a number of
properties;and
WHEREAS,the City of Waukee needed to update the official zoning map for the City;
and
WHEREAS,the Planning &Zoning Commission has approved the updated official
zoning map of the City of Waukee at the June 12,2000 P &Z Meeting;and
NOW,THEREFORE,be it resolved that the City Council of Waukee has adopted by
Resolution the updated zoning map for the City of Waukee this 19th day of June 2000.

RESOLUTION TO SET PUBLIC HEARING DATE OF JULY 10,2000 FOR

WHEREAS,Knapp Properties has requested a rezoning of this parcel so that they may
proceed with commercial and light industrial development;and
WHEREAS,the Planning and Zoning Commission approved of this request at the June
12,2000 meeting;and
JWHEREAS,the City Council has found the rezoning to be in accordance with the ideals
of the comprehensive plan;and
NOW,THEREFORE,be it resolved that the public healing over the rezoning of Noyce
Fann from A-I to C-l/M-l is hereby set for July 10,2000 this 19th day ofJune 2000.

12.Resolution 00-66:Approving Site Plan for Parkview Crossing Lot 59 I

Rick Ross was present to show the lot layout for the project
and give the Council an idea of what the elevations will
look like.Council directed staff to investigate the
possibility of requiring sprinklers in the buildings.Motion
by Councilman Watts and second by Councilman Peard to
approve the site plan.Ayes:Watts,Peard,Johnson,
Gruber,Berger.Nays:None.Motion carried 5-0.
RESOLUTION'
RESOLUTION APPROVING THE SITE PLAN FOR PARKVIEW CROSSING
LOT 59
WHEREAS,the owner's representative,Rick Ross,has presented the site plan showing
the proposed layout of the buildings and the proposed elevations of the buildings;and
WHEREAS,the Planning and Zoning Commission has approved of this site plan at its
June 12,2000 meeting;and
WHEREAS,the City Council has found this site plan to be in conformance with its
comprehensive plan;and
NOW,THEREFORE,be it resolved that the site plan for Parkview Crossing Lot 59,is
hereby accepted this 5th day of June 2000.

13.Resolution 00,<.~:Approving Concept Plan for Centennial Park and Directing

Development of a 28E Agreement with the Waukee School
District.,1
Councilman Johnson spoke in support of the proposal
saying that it is more than adequate for its intended
purpose.The agreement will provide for fair distribution of
responsibilities and benefits for each party involved.Dr.
Veronica Stalker,Superintendent of Waukee Schools,also
spoke in favor of the agreement.Concern was raised about
the time frame of the projects,especially the closing of
Ashworth Road.Ashworth Road cannot be closed until
both University and Warrior Lane are paved and connected.
Motioned by Councilman Peard and seconded by
Councilman Johnson to approve the concept plan and
pursuit of the 28E.Ayes:Peard,Johnson,Gruber,Berger,
Watts.Nays:None.Motion carried 5-0.
RESOLUTION NO.00-b~
APPROVING CONCEPT PLAN FOR CENTENNIAL PARK &DIRECTING
DEVELOPMENT OF A 28E AGREEMENTWITH THE WAUKEE SCHOOL
DISTRICT 1
WHEREAS,the Waukee School District has approached the Waukee Park Board and
proposed revisions to the current configuration of Centennial Park,AND
WHEREAS,the City of Waukee Park Board has reviewed and recommended the
revisions proposed by the School District,AND,
WHEREAS,the Comprehensive Plan Steering Committee has also reviewed the
proposed changes and is in support of the reconstruction project,
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in
session this 19th day of June,2000 that it hereby endorses the Concept Plan for the
proposed revisions to Centennial Park and directs that a 28E agreement between the
School District and City be drafted to outline the responsibilities of the City and School
District relative to the construction and maintenance associated with the proposed
revisions to Centennial Parle.

Employee Handbook
This resolution was dropped from the agenda at the
beginning of the meeting.
15.Ordinance:Amending Fire Code Ordinance -Group U Buildings
This ordinance went through the first reading on June 5,
2000.Motioned and seconded by Councilmen Gruber and
Watts to have the second reading.Ayes:Gruber,Watts,
Peard,Johnson,Berger.Nays:None.Motion carried 5-0.
ORDINANCE NO.
AN ORDINANCE TO AMEND §803 UNlFORM FlRE CODE AND THE
UNlFORM FlRE CODE STANDARDS ADOPTED BY REFERENCE AND MADE A
PART OF THE WAUKEE MUNICIPAL CODE,BY DELETING §6105.3,AND
INSERTING IN LIEU THEREOF "THE USE OF LISTED PORTABLE UNVENTED
OIL-BURINING HEATING APPLIANCES SHALL BE LIMITED TO
SUPPLEMENTAL HEATING IN GROUP U OCCUPANCIES ONLY."
Section 1.§803 Uniform Fire code and the Uniform Fire Code Standards
adopted by reference and made a part of the Waukee Municipal Code,is hereby
amended by deleting §6105.3,and inserting in lieu thereof the following:
§6105.3 Location.The use of listed portable unvented oil-burning heating

Section 2.Repealer.In any case where the provisions of this ordinance,
the Uniform Fire Code,or other ordinances of the City of Waukee,shall be found to be in
conflict,and in which statutes of the State of Iowa do not control,the provision which

establishes the higher standard for the promotion and protection of the safety of persons
and property shall prevail.
Section 3.Severability Clause.If any section,provision or part of this
ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect
the validity of the ordinance as a whole or any section,provision,or part thereof not
adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its
final passage,approval and publication as provided by law.

Earth Movers,Inc.has nearly finished the project and so
John Gibson and Mik Briedis recommended making the
first payment.The City's portion is $28,715.65.Total
project cost is $60,454 which is being split 50/50 between
the City of Waukee and St.Boniface Church.Councilman
Gruber motioned for adoption and Councilman Berger
seconded.Ayes:Gruber,Berger,Watts,Peard,Johnson.

WHEREAS,the City of Waukee awarded the contract for the public improvements
known as the University Water Main Extension Phase II on April 17,2000 to Earth
Movers Inc.in the amount of $60,454.00;and
WHEREAS,the contractor has prepared and filed a CONTRACTOR'S APPLICATION
FOR PAYMENT NO.1;and
WHEREAS,project engineers,Veenstra and Kim,have reviewed and recommended
approval of said application for payment;and
NOW,THEREFORE,be it resolved that Pay Application No.1 in the amount of
$57,431.30 be hereby approved and payment authorized on this 19th day of June 2000.

17.Reports:
City Administrator:Mark Arentsen reported that he would be meeting with Dalias Co.
to provide information about the Ortonville Utility Project.The ambulance issue is
progressing as well,the City is currently waiting for the County to respond.The Waukee
Taukee will be done by the Des Moines Water Works and will appear in the water bill.
Fireperson interviews are Saturday morning June 24,there is a special Council meeting at
5pm on July 3,and the latest plat books are not well done and most will be given back.
Director of Public Works:John Gibson said that R22 was scheduled to be completed
by June 23 or soon after.He is also expecting bids soon for the raising of the water
tower.July 4th preparation is in full swing.
Director of Community Development:Joshua Smith talked about annexation and the
upcoming (July 13)meeting with the City Development Board.He has spoken with Greg
Ganske and other parties about the new interchange and there will be a Hickman sewer
meeting on June 22.

City Council:Marvin Berger was again thankful for recent public works projects.
Nicholas Gruber asked for support for Ed Butler as Board of Supervisors candidate.
Mayor:Mayor Bailey reminded everyone that 4th of July shirts are
available for $10.The Mayor asked about a letter he received regarding a collection for
work done at the Fire Station.He also brought up a recent vote regarding Councilman
Watt's vote on the Des Moines Partnership that was misrepresented at the last meeting
and reminded the Council to stay focused.
