1.Call to Order:The Waukee City Council meeting was called to order at
7:08pm by Mayor Bailey.
2.Roll Call:Mayor Bailey asked for roll call.Present:Gruber,Berger,
Bailey,Johnson.Absent:Watts,Peard.Councilman
Peard arrived at 7:25pm.
3.Consent Agenda:Pay Roll,Bill List,Minutes from June 19,June 26,and
July 3,2000 meetings,renewing the liquor license and
Sunday sales permit of The Bank.Motion by Councilman
Johnson and second by Councilman Berger to,"Approve
the consent agenda with the pay roll,bill list (subject to
changes in headings),and minutes (subject to changes on
the 4L Acres resolution to reflect its being tabled)"Ayes:
Johnson,Berger,Gruber.Nays:None.

progress in Waukee.Hickory Tech will begin the process
of overbuilding Waukee's network in the fall of 2000;the

system will be one of the best in the state and will be
capable of providing local and long distance phone service,
Internet access (high speed),and cable television.Motion

Chris Nolte informed the Council on the progress that the
census has made in Waukee.He said that the effort was

As a result of Kathy Homer's resignation,the effort to fill

www.govtjobs.com.The position has a listed salary
between $45,000 and $55,000.Motion made to Receive/

Bill Huston,Waukee's gas consultant from US Energy,
addressed the Council about the recent rising fuel prices.
Mr.Huston showed how the prices of gas had risen
consistently and rapidly every month since January.He
mentioned that the City would be justified to look at
purchasing futures contracts to hedge against further price
increases.City Attorney,Paul Huscher,expressed doubts
about the legality of this practice,Motion made by
Councilman Peard to receive/file,seconded by Councilman

10.Receive /File:Proposed Schedule for Demolition and Disposal of Old
Water Tower and Storage Tanks.
Director of Public Works John Gibson has been working
with Dale Sorensen of V &K to obtain bids for demolition
of the water tower and storage tank.John reported that the
bids should be in,and one accepted,by August 7,2000.
The demolition would be complete approximately 60 days
later.

look through the San Jose ordinance to decide if it can be
translated to a new ordinance for Waukee.Motion by

Clarifying that A-2 and AR are One Ordinance,and the
Exact Wording of that Ordinance
City staff would like to clarify that there is only one

issue.The size of their developments allows for 69 units
and they wished to be allowed 72.The Planning and
Zoning Commission did not pass this earlier in the night so
Mr.Ross was merely informing the Council of the
situation.He will need to go before the Zoning Board of
Adjustment to state his case.The development will likely
be changed to a PUD so the 72 units can be built.Motion
by Councilman Peard and second by Councilman Johnson

16.Resolution:Parkview Crossing Plat 2 Preliminary
'IPlanningandZoningapprovedthisplatpriortotheCouncil
meeting contingent upon the developer paying for a 31 '
extension of L.A.Grant Pkwy.Rick Ross was present to
discuss the Plat with Council.He did not believe the 31'
road requirement was justified practically despite the
ordinance language.Because the other side of the road is
County land,the developer may be forced to pay for the
entirety of any road where other developments can
typically split costs with neighbors.Ross offered to pay for
15.5 ft of the road.City Staff and Mik Breidis of V &K
stated that a 24-foot road would be sufficient however
contrary to ordinance.Councilman Gruber made a motion
to approve the plat with the developer paying for the
entirety of a 24-foot road.Councilman Berger seconded.

The City of Waukee filed an involuntary petition to annex
this land in 1995.The property owners filed a voluntary
petition with the City of Clive.In order to strengthen the

Huscher recommend letting this piece be annexed into

have the staff make a statement regarding the creation of

26.Resolution:Approving Westgate Plat IV
Gary Cooper from Kirkham Michael was on hand to
present construction drawings for Westgate Plat IV.The
plans are mostly identical to the previously submitted plats.
Public Works Director John Gibson mentioned that one of
the street names might need to be changed to promote
better coordination with other city streets.Councilman
Berger motioned and Councilman Gruber seconded the
motion to approve the construction drawings for Westgate
Plat IV.Ayes:Berger,Gruber,Peard,Johnson.

Approving Westgate Plat IV Construction Drawings
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized
municipal corporation;and
1WHEREAS,Civil Engineering Consultants has submitted construction drawings for
approval on Westgate Plat IV;and
WHEREAS,the City Council approves of the drawings,subject to satisfaction of those
items listed on Veenstra and Kimm's comment letter
WHEREAS,tbe developer has agreed to change any street names as may be deemed
necessary to promote continuity with other Waukee streets.
NOW,THEREFORE BE IT RESOLVED that the City Council of Waukee does
hereby declare by resolution that the construction drawings for Westgate Plat IV are
approved,subject to above conditions.

27.Resolution:Approving Waukee Motors Site Plan
Gary Schroeder represented Waukee Motors.Planning and
Zoning had passed the site plan earlier in the night with two
contingencies.First,an overland flowage and an alley
straightening easement must be agreed upon and second
Mr.Schroeder must come back for approval when he
decides to erect a sign.Councilman Gruber motioned and
Councilman Berger seconded for approval of the Waukee
Motors site plan subject to the aforementioned
contingencies.Ayes:Gruber,Berger,Peard,Johnson.

RESOLUTION 00-100
Approving Waukee Motors Site Plan
WHEREAS,The Planning &Zoning Commission has approved the plat;AND,
WHEREAS,The City Council has approved this plat subject to the satisfaction of items
listed on the letter from Veenstra and Kim dated July 6,2000;AND,
WHEREAS,The City Council more specifically requires that a surface water flowage
easement be added as well as an alley straightening easement.
NOW,THEREFORE BE IT RESOLVED,by the City of Waukee City Council in
session this l Oth day of July 2000,that it hereby approves the Waukee Motors Site Plan.

28.Resolution:Approving Wage Increases for Employees
City Administrator Mark Arentsen made a proposal to
Council that City supervisors be able to make pay raise
decisions on their employees as long as the amounts are
within the budget.This issue was brought about because of
the Fiscal Year End on June 30.Mayor Bailey inquired
about the nature of the raise system and whether there were
and merit based measures or reviews being used.Arentsen
replied that although every supervisor handled the issue
differently,essentially a merit based raise system is already
in effect.Councilmen Peard and Johnson motioned and
seconded for approval of Arentsen's wage proposal.Ayes:
Peard,Johnson,Gruber,Berger.Nays:None.Motion
carried 4-0.

Approving Wage Increases for Employees
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized
municipal corporation;and
WHEREAS,the City Council recognizes the ability of City supervisory staff to evaluate
and compensate Waukee's employees;and
WHEREAS,the raises given by the supervisory staff fall within the existing City of
Waukee budget.

29.Resolution:Accepting Seal Coating Bids
Seal coating has been chosen as the best method of
extending the life of the deteriorating streets in Waukee.
This method will extend the useful life of these streets 4 to
7 years.The Public Works Department will do a citywide
street evaluation to determine which streets will receive the
seal coating.The estimated cost is $20,000 to $25,000.
Blacktop Service Company has submitted the most
reasonable bid.Motion by Councilman Gruber and second
by Councilman Berger to approve the resolution.Ayes:

RESOLUTION ACCEPTING BLACKTOP SERVICE COMPANY OF
HUMBOLDT,IOWA'S BID FOR STREET PATCHING AND SEAL COATING.
WHEREAS,the City of Waukee having requested a submittal of bids on June 15,2000
at 12:00 noon for street patching and seal coating;and
WHEREAS,Blacktop Service Company of Humboldt,Iowa having submitted a bid of
$67.50 per ton for installation of A.C.C.Patch Material,$0.79 per square yard of single
seal and $1.54 per square yard of double seal;and
WHEREAS,the City Staff having found Blacktop Service Company to be in compliance
with the specifications and having the proper insurance;and
NOW,THEREFORE BE IT RESOLVED,that the City of Waukee accepts the bid of
Blacktop Service Company on this 10th day of July 2000.

30.Resolution:Accepting Sewer Cleaning Bids
Staff has decided to begin cleaning and inspecting all of
Waukee's sewer lines continually on a five year rotation,
thus each year 1/5th of the lines will be serviced.Staff
recommends awarding the bid to Hydro-Clean of Ankeny.
The cost will be about $12,500 to $17,500 annually.
Councilman Gruber made the motion to approve the
resolution awarding the sewer cleaning contract to Hydro-
Clean,Councilman Peard seconded.Ayes:Gruber,Peard,

RESOLUTION ACCEPTING HYDRO-KLEAN OF ANKENY,IOWA'S BID FOR
SANITARY SEWER INSPECTION AND CLEANING.
WHEREAS,the City of Waukee having request a submittal of bids on June 15,2000 at
12:00 noon for the purpose of Sanitary Sewer Inspection and Cleaning;and
WHEREAS,Hydro-Klean of Ankeny,Iowa having submitted a bid of $0.35 per lineal
foot for cleaning,$0.58 per lineal foot for inspection,$0.48 per lineal foot for root cutting
and $200 lump sum each for mobilization;and
WHEREAS,the City Staff having found Hydro-Klean to be in compliance with the
specifications and having the proper insurance;
NOW,THEREFORE BE IT RESOLVED,that the City of Waukee accepts the bid of
Hydro-Klean on this 10th day of July 2000.

31.Ordinance:Amending Fire Code Ordinance -Group U Buildings
This ordinance has gone through the first and second
reading and is ready for the third and final passage.Motion
made by Councilman Berger to have third reading in title
only,seconded by Councilman Johnson.Mark Arentsen
made third reading.Motion by Councilman Berger and
second by Councilman Gruber to put ordinance on final
passage.Mayor Bailey declared the ordinance passed and
duly adopted.

AN ORDINANCE TO AMEND §803 UNIFORM FIRE CODE AND THE UNIFORM
FIRE CODE STANDARDS ADOPTED BY REFERENCE AND MADE A PART OF
THE WAUKEE MUNICIPAL CODE,BY DELETING §6105.3,AND INSERTING IN
LIEU THEREOF "THE USE OF LISTED PORTABLE UNVENTED OIL-BURINlNG
HEATING APPLIANCES SHALL BE LIMITED TO SUPPLEMENTAL HEATING IN
GROUP U OCCUPANCIES ONLY."
Section 1.§803 Uniform Fire code and the Uniform Fire Code Standards
adopted by reference and made a part of the Waukee Municipal Code,is hereby
amended by deleting §6105.3,and inserting in lieu thereof the following:
§6105.3 Location.The use of listed portable unvented oil-burning
heating appliances shall be limited to supplemental heating in Group U Occupancies
only.
Section 2.Repealer.In any case where the provisions of this ordinance,
the Uniform Fire Code,or other ordinances of the City of Waukee,shall be found to be in
conflict,and in which statutes of the State of Iowa do not control,the provision which
establishes the higher standard for the promotion and protection of the safety of persons
and property shall prevail.
Section 3.Severability Clause.If any section,provision or part of this
ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect
the validity of the ordinance as a whole or any section,provision,or part thereof not
adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its
final passage,approval and publication as provided by law.

32.City Administrator:Mark Arentsen reports that meetings with Monarch
Manufacturing about the gas line extensions went well.The City Development Board
Meeting will be Thursday,July 13,2000.He will be taking vacation starting next week.
There will be a comprehensive plan meeting on July 31 st,and Fourth of July button and
T-shirt sales went very well.

37.Waukee City Council Members:Councilman Peard commended the City
staff for their work on the 4th celebration.Councilman Berger expressed his excitement
about the success of the Farmer's Market.Councihnan Gruber was pleased with the
fireworks display and wants to allow more money for next years display.
38.Mayor:Mayor Bailey thanked all the participants in the 4th of July
festivities,and commended Joshua Smith for his work on the voluntary annexation
petitions.He also thanked those who have signed annexation petitions.The Mayor
expressed sadness over the loss of one of Waukee's citizens,Mable Loschen.He showed
some of the thank you cards he had received from the YMCA group that used the park
shelter house.The Mayor mentioned his meeting with the Dallas County Board of
Supervisors over the gas line to Ortonville.He introduced everyone to Nancy Bishop
from the Dallas County News.She will be covering Waukee for the paper.Mayor
Bailey informed everyone that the Christian Church would be celebrating the 10th
anniversary of their building on August 20 at 1O:30AM,and that Waukee had tumed up
on David Letterman a couple weeks ago.Lastly,he received a message of thanks from
David White of 3rd and Christopher for the Public Works Departments recent efforts after
a storm.
