The Waukee City Council meeting was called to order at
7:02 pm by Mayor Bailey.
Mayor Bailey asked for roll call.Present:Gruber,Berger,
Bailey,Watts,Peard,Johnson.Absent:None.
Payroll,Bill List,minutes from May 9,July 10,2000 City
Council meetings,and approving the cigarette license for
Skippy's Pub.Motion by councilman Gruber and second
by Councilman Johnson to,"Approve the consent agenda
with the pay roll,biIllist (subject to changes in headings),

Item number 7 was moved to the August 7'h agenda.Items
13 and 14 were moved to the July 31't agenda.Motion by
Councilman Berger and second by Councilman Gruber to
approve the agenda with the stated changes.Ayes:Berger,
Gruber,Watts,Peard,Johnson.Nays:None.Motion
carried 5-0.
Mary White,670 Boone Drive,asked when the Council
Agenda would again appear on the Waukee website.Jeff
Voorhees,3156 Ute Ave,and Rick Ross spoke in favor of
City support for a variety of senior and tax credit
development options.
Waukee Library Foundation Report
Judy Phipps,president of the Waukee Library Foundation
spoke on behalf of the Library and its current condition and
fund raising progress.She reported that the last several
weeks and months have been record setting in terms of new
users and the number of books being checked out.Judy
also unveiled the most recent totals for the fund raising.
The month of July has seen $7,386 in donations,raising the
grand total to $78,673.Another $141,863 has been
pledged,bringing the overall number to $220,537.Motion
by Councilman Berger to receive/file,seconded by
Councilman Peard.Ayes:Berger,Peard,Johnson,Gruber,
Watts.Nays:None.Motion Carried 5-0.
Information for the Fall Festival
This item was moved to August 7'h.
Discuss Possible Resolution Supporting Jim Conlin's Tax
Credit Apartment Housing
Kris Saddoris was here to speak on behalf of Jim Conlin.
She spoke about the type of project and assured the Council
that the effort would be of high quality.The 1%assistance
that is required by the Iowa Finance Authority can be
provided by the City in a number of ways and need not be a
one-time cash contribution.Saddoris said that rents would

likely be in the $375 to $600 range and that the project r-Iwouldremainanaffordablehousingfacilityforatleast15
years.The project would likely be for $3 to $4 million.
Mary White,670 Boone Drive,wondered what effect the
tax abatements would have on this project and Jim Phillips,
240 Bel Air,said that he did not feel this project should get
tax abatement because they have money available to them.
Councilmen Watts and Johnson made a motion and a
second to receive/file this information and the resolution of
support may appear on the next agenda.Ayes:Watts,
Johnson,Gruber,Berger,Peard.Nays:None.Motion
carried 5-0.
9.Receive /File:Discuss Policy Decision for Tax Increment Finance District
for Noyce (Knapp)Farm
Bob Josten from Dorsey and Whitney spoke to the Council
about possibilities for Urban Renewal Districts.His advice
was to set up as large a district as was reasonable so as to
promote flexibility for future use.He also stated that next
years Legislature was likely to either change the
requirements for the Renewal Districts or disallow them
completely.The City Attorney,Paul Huscher,pointed out Ithatanydevelopmentinthedistrictwouldbeaffordeda
TIP,and as such care should be taken when creating the
boundaries.Motion made by Councilman Gruber to
receive/file,seconded by Councilman Peard.Ayes:
Gruber,Peard,Johnson,Berger,Watts.Nays:None.
Motion carried 5-0.
10.Receive /File:Discussion of Waukee's Current Park Ordinance
Wayne Johnson had given Paul Huscher a park policy to
review at the last Council meeting.Paul said that he had
not been able to fully review the San Jose policy.He
suggested biting a consultant to help the City create an
ordinance based upon San Jose's.The Council asked that
Paul speak to someone and come back with a cost estimate
for the consulting service.Motion by Councilman Peard
and second by Councilman Johnson to receive/file.Ayes:
Peard,Johnson,Gruber,Berger,Watts.Nays:None.
Motion carried 5-0.
11.Receive /File:Gas Fund Report -Current Reserves &Forecasted
)Expenditures and Revenues
Charlene Wilson prepared a report detailing the projections
and current status of the gas fund for CounciL John Gibson
and Joshua Smith answered questions for the Council and
the Mayor.John told the Council that historically the fund
increased by about $100,000 per year.Councilman Berger
made a motion to receive/file.The motion was seconded
by Councilman Watts.Ayes:Berger,Watts,Peard,
Johnson,Gruber.Nays:None.Motion carried 5-0.
12.Resolution:a)Approving Pre-annexation Agreement with West
Central Auto Auction
Approving Pre-annexation Agreement with Frank
and Melba Scaglione
b)
Frank Scaglione owns about 118 acres of property at the
intersection of 1-80 and Ute Avenue.This property is very
important for the City of Waukee.Scaglione will annex,
but only with a pre-annexation agreement in place.The
only guarantee he needs that is beyond what the City has
given to others is that utilities will be extended.The
agreement called for them to be complete in 30 months.
Several Council members and the Mayor were concerned
about the lack of reciprocity in the agreement.They said
that extending utilities is not a problem as long as there are
guaranteed users.The Council directed Joshua Smith to
rework the agreement to include wording to this effect.
Councilman Peard made a motion to table this item until
the pre-annexation agreement is changed.This motion was
seconded by Councilman Watts.Ayes:Peard,Watts,
Gruber,Berger,Johnson.Nays:None.Motion carried 5-0.
13 &14.These resolutions have been pushed back until the July 31
meeting
15.Resolution:Authorizing Employment of Jody Gunderson as Director of
Community Development and Approving Jody's
Compensation Package
City Administrator,Mark Arentsen,upon speaking
individually with several of the Councilmen,has decided to
offer the Director of Community Development position to
Jody Gunderson.Joshua Smith,the current Director,will
be shifted into the Deputy City Administrator position.The
specifics of the decision and the compensation package
were voiced.Mayor Bailey expressed concern over the
decision,he said that he had not been involved and that he
felt proper procedure should have been to have a public
meeting discussing the candidate.It was mentioned by
several others that the City Council meeting should suffice
for that discussion time.Ed Butler,130 Kaylin Dr,
wondered if the previous discussions violated the Public
Meetings Act.Mary White,670 Boone Drive,said that the
Mayor needs to have input into what this position and other
positions should be doing.She also asked why the change
had not been budgeted.Joshua Smith replied that this
position was going to be included in the next budget cycle
but J ody Gunderson was pursued once it became clear that
he was available because it was in the best interests of the
City.Councilman Watts mentioned that there are too many
Chiefs and no Indians.Councilman Johnson was also
concerned about the staffing situation at City Hall and
directed staff to Rut discussion of that issue on the agenda
for the August 7'meeting.He feels that the City would
benefit from outsourcing more tasks.The Mayor believes
the problems in City Hall to be the responsibility of
Administrator Mark Arentsen.Councilman Berger and
Councilman Peard pointed out that Arentsen has been
working on a plan to remedy some of the problems.
Councilman Berger then made a motion to approve the
hiring and compensation package of Jody Gunderson.The
motion was seconded by Councilman Peard.Ayes:Berger,
Peard,Johnson,Gruber,Watts.Nays:None.Motion

RESOLUTION AUTHORIZING THE EMPLOYMENT AND COMPENSATION
PACKAGE OF JODY GUNDERSON AS DIRECTOR OF COMMUNITY
DEVELOPMENT
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized
municipal corporation;and
WHEREAS,the City staff has been experiencing a dramatic increase in their workload;
and
WHEREAS,the City of Waukee's success depends upon the efficiency and productivity
of City Hall;and
WHEREAS,Jody Gunderson is available for hire and has outstanding credentials,
qualifying him for the position of Director of Community Development.I

NOW,THEREFORE BE IT RESOLVED that the City Council of Waukee does
hereby declare by resolution that it approves the hiring and compensation package of
Jody Gunderson as Waukee's Director of Community Development.

16.Resolution:Indicating the City Council's Interest in Participating in
Concept Study being Performed by Des Moines
Metropolitan Wastewater Reclamation Authority
The WRA is beginning to plan for future growth in the area
and Waukee has a chance to participate in a study at no
cost.Waukee has an opportunity to be served by the WRA
then over the next several years.Councilmen Gruber and
Berger motioned and seconded to approve this resolution.
Ayes:Gruber,Berger,Watts,Peard,Johnson.Nays:None.

RESOLUTION 00-105
RESOLUTION INDICATING THE CITY COUNCIL'S INTEREST IN TAKING
PART IN THE STUDY BEING CONDUCTED BY THE DES MOINES METRO
WASTEWATER RECLAMATION AUTHORITY IWHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized
municipal corporation;and
WHEREAS,the Des Moines Metro Wastewater Reclamation Authority has offered to
allow Waukee to take part in a concept study concerning the future of the WRA;and
WHEREAS,the City of Waukee would benefit by being a part of the WRA in the future;
and
WHEREAS,the City of Waukee will incur no cost for taking part in the study.
NOW,THEREFORE BE IT RESOLVED that the City Council of Waukee does
hereby declare by resolution that it approves of the City of Waukee taking part in the
study being conducted by the Des Moines Metro Wastewater Reclamation Authority.

17.Director of Public Works:
John Gibson reported that tower demolition bids would be ready by August 7.
The Mid American connect on 182nd will be ready on the 28th.They are in the process of
prioritizing seal coating,and sewer cleaning should be done in 2 to 3 weeks.
18.Director of Community Development:
Joshua Smith has talked with the Iowa League of Cities about putting a link to
Waukee's website on theirs.West Des Moines has expressed interest in drafting a new
annexation moratorium agreement.Qwest has said that if the City Council passes a
resolution they will look into allowing calls from Waukee to Ankeny to be considered
local calls.Joshua would like to set up a meeting with the Mayor and Kyle Krause the
President of the Des Moines Menace.The Menace are looking for a place to put a new
facility.He mentioned that he would be meeting with Paul Coates from ISU about
creating an internship program where the student would get class credit and the City
would incur no cost.He said that the present interns had worked out very well and this

concerning 6 ft sidewalks.The developer pays for the first 4 feet and the City pays for
any extra that is desired.
19.City Attorney:
Paul Huscher reported that he has been working on the Broderick sewer extension
and creating a plan for dealing with unpaid traffic tickets.He also mentioned that the
Council might want to look into more City owned utilities such as phone or cable.
20.Planning and Zoning:
Nick Gruber said that P&Z meets tomorrow (July 25,2000)and that the sign
ordinance would be up for approval.
Park and Rec Board:
Wayne Johnson reported that he had attended the Farmer's Market and that it was
still growing.He had also received a small donation in the name of Georgia Hammonds.
He also mentioned that the City might want to consider a policy to reduce light pollution.
21.Waukee City Council:None
22.Mayor:
Donald Bailey expressed sadness over the passing of John Llewellyn.He said
that he would like the minutes regarding the employee wage increases to include specific
numbers.The Mayor received a letter of thanks from the Methodist church for using the
Community Center.He said he had received a letter from Mayor Daniels regarding the
Mayors Millennium Ball.He also shared a couple of letters from the County Attorney
concerning the ambulance issue and the gas service to Ortonville.The County Attorney
pushed for cooperation.Mayor Bailey reminded everyone that the Comprehensive Plan
Meeting had been moved from July 31 to August 17.
23.Adjournment:Councilmen Berger and Gruber motioned and seconded for
