HomeMy WebLinkAbout2000-07-31-Special MinutesCity of Waukee Minutes from the Special Waukee City Council Meeting of July 31,2000 1.Call to Order:The Special Meeting of the Waukee City Council Meeting was called to order at 5:33pm by Mayor Donald L.Bailey,Jr. 2.Roll Call:Mayor Bailey requested roll call-Councilmen Nick Gruber, Marvin Berger and Mike Watts were present.Councilmen Wayne Johnson and Bill Peard were absent. 3.Agenda Addition/Agenda Approval: 4.Open Forum: 5.Recei vefFile:Discussing Waukee Tax Increment Financing Policy and discuss the boundary for an additional Urban Renewal Area Mayor Bailey expressed concern about the costs and benefits of creating large urban renewal districts.He pointed out that there was additional language in the City's TIP policy that was not present when the resolution was adopted.Councilman Berger and Joshua Smith both pointed out that within the overall urban renewal area,separate TIP arrangements could still be made.Motion was made by Councilman Gruber and seconded by Councilman Watts to table the discussion until the next meeting.Ayes: Gruber,Berger,Watts.Nays:None.Motion carried 3-0. 6.Resolution:Urging the Iowa Public Utilities Commission to include Ankeny within Waukee's local calling area By targeting this request to Ankeny rather than numerous locations the chances of success are greater.Council directed Joshua Smith to include Dallas Center in the request.Motion by Councilman Gruber and second by Councilman Watts to pass the resolution subject to the addition of Dallas Center.Ayes:Gruber,Watts,Berger. RESOLUTION 00-106 RESOLUTION URGING THE IOWA UTILITIES COMMISSION TO INCLUDE ANKENY AND DALLAS CENTER IN WAUKEE'S LOCAL CALLING AREA WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized municipal corporation;and WHEREAS,Ankeny to Waukee is not a long distance call;and 1 WHEREAS,Waukee to Ankeny is a long distance call;and IWHEREAS,the citizens of Waukee would like to be able to call both Ankeny and Dallas Center without long distance charges;and NOW,THEREFORE BE IT RESOLVED that the City Council of Waukee,that we support and approve a resolution urging the Iowa Public Utilities Commission to include Ankeny and Dallas Center in Waukee's local calling area. RESOLUTION 00·107 IRESOLUTIONOFSUPPORTSUPPORTINGCONLINPROPERTIES,INC.TAX 2 CREDIT APARTMENT PROJECT WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized municipal corporation;and WHEREAS,this housing project will contain 24 units;and WHEREAS,the units will be targeted towards families;and WHEREAS,the project will be new construction;and WHEREAS,the Sponsor has requested local assistance through a tax-exempt entity;and NOW,THEREFORE BE IT RESOLVED that the City Council of Waukee,that we support and approve the development of the aforesaid housing in our community,subject to city ordinances and the building permit process.This resolution is effective until December 31,2000.In the event that any of the characteristics mentioned above should change prior to the issuance of a building permit,this resolution is null and void. RESOLUTION 00-110 PRELIMINARY RESOLUTION PURSUANT TO SECTION 384.42 OF THE IOWA CODE COVERING THE HICKMAN ROAD PUMP STATION AND SEWER EXTENSION PROJECT 1 WHEREAS,it is deemed advisable that certain public improvements be constructed in the City of Waukee,Iowa (the "City"),in accordance with the provisions of Chapter 384 of the Code of Iowa,and that a portion of the cost be assessed to the property benefited thereby;and WHEREAS,the City has arranged for engineering services with Veenstra &Kimm,Inc., in connection with the said improvement; NOW,THEREFORE,It Is Resolved by the City Council of the City of Waukee,Iowa, as follows: Section 1.The following sanitary sewer improvements shall be constructed as a single improvement and such improvements shall be located with terminal points as follows: DESCRIPTION OF IMPROVEMENTS Construction will include a 1.1 mgd pumping station,approximately 2,100 linear feet of 12-inch diameter force main,1,730 linear feet of 8-inch diameter gravity flow sanitary sewer,1,870 linear feet of lO-inch diameter gravity flow sanitary sewer,420 linear feet ) 6 of 8-inch diameter gravity flow sanitary sewer augured in place,manholes,granular access road,surface restoration and miscellaneous associated work. LOCATION OF ASESSABLE WORK The proposed 1.1 mgd pumping station will be located approximately 275 feet west and 150 feet south of the northeast corner of the southwest quarter of the southwest quarter of Section 26,Township 79 North,Range 26 West. An 8-inch diameter gravity flow sanitary sewer will begin at the west side of Alice's Road approximately 500 feet north of the northeast corner of the southeast quarter of the southeast quarter of Section 27,Township 79 north,Range 26 West.The gravity sewer will extend southerly along the west side of Alice's Road;thence easterly along the north line of the southwest quarter of the southwest quarter of Section 26,Township 79 North, Range 26 West and discharge into the proposed 1.1 mgd pumping station. Another lO-inch diameter gravity flow sanitary sewer will begin at the south side of U.S. highway 6 approximately 1,700 feet east of Alice's Road.The gravity sewer will extend northerly across U.S.highway 6;thence westerly along the north right-of-way line of U.S.Highway 6 to the southeast corner of the southwest quarter of the southwest quarter of Section 26,Township 79 north,Range 26;thence northerly along the east line of the southwest quarter of the southwest quarter of said Section 26 and discharge into the proposed 1.1 mgd pumping station. A 12-inch diameter sanitary force main will begin at the proposed 1.1 mgd pumping station and extend easterly to the east line of the southwest quarter of the southwest quarter of Section 26,Township 79 North,Range 26;thence southerly along the east line of the southwest quarter of the southwest quarter of said Section 26 to the north side of U.S.Highway 6;thence westerly along the north side of U.S.Highway 6 and discharge into the existing 12-inch diameter gravity sewer located approximately 365 feet east of Alice's Road. It is considered that the property within the following described boundaries will be specially benefited by this improvement and should be specially assessed: An area in Section 26,27 and 35 of Township 79 North,Range 26 West of the 5th Principal Meridian located in the City of Waukee,Dallas County,Iowa,more particularly described as follows: Zone 1 Beginning at the center of Section 27,Township 79 North,Range 26 West;thence easterly two thousand seventy-nine and four tenths (2,079.4)feet along the east-west centerline of said Section 27;thence southerly four hundred sixty (460)feet;thence easterly five hundred sixty (560)feet to the east line of said Section 27;thence southerly along the east line of said Section 27 to a point four hundred ninety and five tenths 7 (490.5)feet south of the northeast comer of the southeast quarter of the southeast quarter of said Section 27;thence westerly to a point four hundred ninety and five tenths (490.5) feet south of the northwest comer of the southeast quarter of the southeast quarter of said Section 27;thence northerly to a point seven hundred ninety-seven (797)feet south of the northeast comer of the northwest quarter of the southeast quarter of said Section 27; thence westerly to a point seven hundred ninety-seven (797)feet south of the northwest comer of the northwest quarter of the southeast quarter of said Section 27;thence northerly seven hundred ninety-seven (797)feet to the point of beginning;except for highway right-of-way,streets and roads. Section 2.The Project Engineers are hereby ordered to prepare preliminary plans and specifications,an estimated total cost of the work and a plat and schedule and to file the same with the City Clerk and shall include in the estimated cost a default fund item of not to exceed 10%of the amount to be assessed against specially benefited property. 1 Section 3 The improvement shall be known as the "Hickman Road Pump Station and Sewer Extension Project,"and shall be so referred to in all subsequent proceedings. Section 4.All resolutions,parts of resolutions,or actions of the Council in conflict herewith are hereby repealed,to the extent of such conflict. Passed and approved July 31,2000. RESOLUTION 00-111 RESOLUTION APPROVING AND ADOPTING PRELIMINARY PLANS AND SPECIFICATIONS,ESTIMATE OF COST AND PLAT AND SCHEDULE WHEREAS,the Council has adopted a preliminary resolution pursuant to Section 384.42 of the Code of Iowa,covering the Hickman Road Pump Station and Sewer Extension Project (the "Project");and WHEREAS,in accordance with such preliminary resolution,the Project Engineers have prepared preliminary plans and specifications,an estimated cost of the work and a plat and schedule,and have filed the same the City Clerk;and WIillREAS,this Council has determined the valuation of each lot proposed to be assessed for the Project and such valuations are now shown on the schedule,and this Council deems it advisable that the said preliminary plans and specifications,estimated cost of the Project and plat and schedule should be approved; NOW,THEREFORE,It Is Resolved by the City Council of the City of Waukee,Iowa: Section 1. approved. The Preliminary plans and specifications referred to in the preamble hereof are hereby Section 2.The plat,schedule and the valuations as shown thereon and estimate of cost are hereby ratified and approved. Section 3.This Council proposes to proceed with the Project and proposed resolution of necessity shall be prepared and hearing held thereon in accordance with the provisions of Sections 384.49,384.50 and 384.51 of the Code of Iowa. 9 Section 4.All resolutions,parts of resolutions,or actions of the council in conflict herewith are hereby repealed.I Passed and approved Jnly 31,2000. RESOLUTION 112 RESOLUTION OF NECESSITY WHEREAS,this Council has adopted a preliminary resolution in accordance with Section 384.42 of the Code of Iowa,covering the Hickman Road Pump Station and Sewer Extension Project (the "Project");and WHEREAS,pursuant thereto,the Project Engineers have prepared preliminary plans and specifications,an estimated total cost of the work and a plat and schedule,including tbe valuation of each lot as determined by this Council,and the same have been duly adopted and are now on file with the City Clerk; NOW,THEREFORE,It Is Resolved by the City Council of the City of Waukee,Iowa: Section 1.It is hereby found and determined to be necessary and for the best interest of the City and its inhabitants to proceed with the Project,and to assess a portion of the cost to the property benefited thereby. 1 10 Section2.The Project shall constitute a single improvement and shall consist generally of the construction of a 1.1 mgd pumping station,12-inch diameter force main, 8-inch and to-inch diameter gravity flow sanitary sewers and miscellaneous associated work in the following locations within the Ctiy: LOCATION OF ASSESSABLE WORK The proposed 1.1 mgd pumping station will be located approximately 275 feet west and 150 feet south of the northeast corner of the southwest quarter of the southwest quarter of Section 26,Township 79 North,Range 26 West. Section 4.The Council will meet at 7:00 o'clock p.m.on the 28th day of August, 2000,at the Waukee City Hall,in the City,at which time and place it will hear the property owners subject to the proposed assessment or assessments and interested parties for or against the Project,its cost,the assessment thereof or the boundaries of the properties to be assessed. Section 5.Unless a property owner files objections with the City Clerk at the time of the hearing on this resolution of necessity,the property owner shall be deemed to have waived all objections pertaining to the regularity of the proceedings and the legality of using the special assessment procedure. RESOLUTION 00-113 RESOLUTION ASSENTING TO THE ANNEXATION OF FRY PROPERTY TO THE CITY OF WAUKEE,IOWA WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized municipal corporation;and WHEREAS,there has been presented to the Waukee City Council of said City an Application for Annexation,as required by Section 368.7,Code ofIowa,as amended,executed by Thomas Fry the owner of the real estate to be annexed;and WHEREAS,said real estate lying adjacent to the existing City Limits of the City of Waukee, Iowa;and WHEREAS,the City of Waukee desires to annex said territory upon the Application heretofore presented;and WHEREAS,the City of Waukee bestows upon the annexed property an imposition of taxes as provided in Section 368.11,subsection 13 of the Iowa Code. 13 NOW,THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa as follows: 1.That the Application for Annexation of the Thomas Fry Property as described in Exhibit "A"attached hereto is hereby approved. 2.That upon acknowledgement by the City Development Board of the Clerk's filing of the map and this Resolution on the 31st day of July 2000 this territory shall thereafter be and become a part of the City of Waukee. 3.That the City Clerk of Waukee shall forthwith cause this Resolution and the map exhibit attached hereto be filed with the City Development Board and other filings as required by Section 368.7,Code ofIowa,as amended.
