2)Roll Call:Mayor Pro Tern Johnson asked for Roll Call.Present:Councilman
Gruber,Councilman Watts and Councilman Peard.Absent:Mayor

3)Agenda Addition!Approval:Councilman Gruber made a motion to approve the agenda.
Councilman Watts seconded the motion.Ayes:Gruber,Watts,
Johnson,Peard.Nays:None.Motion carried 4-0.
4)Consent Agenda:The Bill List and Payroll were not available for approval.Motion by
Councilmen Gruber and second by Watts to approve the August 7
ntinutes.Ayes:Gruber,Watts,Johnson,Peard.Nays:None.Motion
carried 4-0.

Open Forum:No one came forward to speak during the open forum.
Resolution:Considering signing a 28E Agreement with the City of West Des
Moines -RE:Annexation Moratorium Agreement
Mayor Bailey and Mayor Meyer as well as staff from each community
have recently been discussing a new moratorium annexation agreement.The latest proposal from West
Des Moines would use 1-80 to R-16 as the borderline.As in the current agreement,Waukee could not
annex south of this line.Councilman Gruber made a motion to approve of the proposal,Watts seconded.
Ayes:None.Nays:Gruber,Watts,Johnson,Peard.Motion defeated 4-0.
RESOLUTION 00-130 1
RESOLUTION ASSENTING TO THE SIGNING A 28E AGREEMENT WITH WEST DES
MOINES FOR THE PURPOSE OF CREATING AN ANNEXATION MORATORIUM
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized municipal corporation;
and
WHEREAS,The City of West Des Moines is in close competition with the City of Waukee for
developable laud;and
WHEREAS,both communities would like to work together to fairly divide unincorporated land near each
city's existing border;and
WHEREAS,the City of West Des Moines has proposed that 1-80 to R-22 act as an annexation moratorium
boundary.
NOW,THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa does affirm
its desire to create a 28E agreement with the City of West Des Moines for the purpose of creating an
annexation moratorium.

7)Resolution:Approving contribution for the Start It Up Mayors'Ball and New
Year's Eve Celebration
Mayor Bailey received a letter from Des Moines Mayor Preston
Daniels requesting a donation for the Downtown Community Alliance.Daniels was seeking a repeat
donation of $1000,Mayor Bailey feels that $500 is more appropriate.Councilman Gruber said that he
could not endorse any donation because of the way the organization and the City of Des Moines has treated
Waukee in the past.He did say,however,that he supports the Mayor and thinks he should go to the
Mayors'Ball.Councilman Peard suggested that $250 would send the message that Gruber was seeking
without tying Mayor Bailey's hands.City Administrator Mark Arentsen advised the Council to stick with
the Mayor's proposal and approve the $500.Councilmen Peard and Watts motioned and seconded to
approve the $500 donation to the Downtown Community Alliance.Ayes:Peard,Watts,Johnson.Nays:
Gruber.Motion carried 3-1.
RESOLUTION 00-131
RESOLUTION APPROVING DONATION TO THE DOWNTOWN COMMUNITY ALLIANCE
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized municipal corporation;
and
WHEREAS,Mayor Bailey has agreed to donate $500 to the Downtown Community Alliance;and
WHEREAS,This donation allows the Mayor to attend the Mayors'New Years Eve Ball and shows
support for the Metro Area.The donation would come from the Mayor and Council Miscellaneous portion
of the Budget under #010.810.42.6900.
NOW,THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa does
approve the $500 donation to the Downtown Community Alliance.

8)Resolution:Consider $1000 appropriation for consultant to review park fee
ordinance
Paul Huscher has talked to Prof.Nicholas,an expert in park fees and
dedications about helping Waukee to create an ordinance that complies with Iowa law.Nicholas will
charge $1000 for his time.Councilman Peard stated that this is a very reasonable price and motioned to
approve the payment.Councilman Gruber seconded.Ayes:Peard,Gruber,Johnson,Watts.Nays:None.

RESOLUTION 00-132
RESOLUTION APPROVING A $1000 APPROPRIATION FOR CONSULTANT REVIEW OF
PARK FEE ORDINANCE
WHEREAS,the City of Waukee,Dallas Connty,State of Iowa,is a duly organized municipal corporation;

WHEREAS,Prof.Nicholas is an expert in the field of park fees and dedications and is recommended by
City Attorney Paul Huscher ;and
WHEREAS,he has offered to help Waukee draft a Park Fee Ordinance for a $1000 consulting fee;and
WHEREAS,this ordinance needs to be in place soon so that Waukee can continue to grow in an efficient
manner.
NOW,THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa does
approve the $1000 appropriation for consulting work on the Park Fee Ordinance.

9)ReceivelFile:Discnss establishing multiple polling locations for elections
Carol Bayer spoke with Mark Arentsen recently about establishing new
precincts in Waukee for the purpose of creating new polling locations.The County will make the official
changes but Waukee can submit a report that will be considered.This report will need to be complete by
May and the changes will be in place by October.Discussion followed about the present situation and
overcrowding during elections.Councilman Gruber motioned to receive file,Watts seconded.Ayes:
Gruber,Watts,Peard,Johnson.Nays:None.Motion carried 4-0.
10)Resolution:Consider Pre-annexation Agreement between the City of Waukee and
Stephen and Janet Loots (Victory Glass property,3260 Ute Ave.)
This property is key to Waukee's annexation efforts.The owners will
not annex without some assurances from the City.The agreement allows the Loots to avoid assessments
until they need Waukee services.The agreement was changed several times during the discussion.
Councilman Watts asked that something be inserted to handle the effects of inflation on the per acre costs.
Based upon questions from Mik Briedis,the following changes were made.The end of item four should
read"...submitted to the City by Owner or their successors in interest or until a connection is made,"Item
five should read "...any UTILITY improvements ..."in the first line.Motion by Councilman Watts and
Seconded by Councilman Peard to approve the agreement subject to the mentioned changes.Ayes:Watts,
Peard,Gruber,Johnson.Nays:None.Motion carried 4-0.
RESOLUTION 00-133
RESOLUTION APPROVING THE PRE·ANNEXA TION AGREEMENT WITH STEPHEN AND
JANET LOOTS
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized municipal corporation;
and
WHEREAS,the Loots have agreed to annex into the City,provided arrangements are made regarding
assessments and use of water and sewer;and
WHEREAS,the Pre-annexation agreement covers all the issues required by the Loots';and
WHEREAS,this property must be anuexed into Waukee before other larger areas can be anuexed.
NOW,THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa does
approve the pre-annexation agreement between the City of Waukee and Stephen and Janet Loots.

II)ReceiveIFile:Information concerning a possible annexation moratorium between
Waukee and Urbandale
Waukee staff has been working with Veenstra and Kimm to create a
border for an annexation agreement with Urbandale,It has been decided that the best border would be to
extend the existing northern border to the west to R-16,This border is Y,mile north of Meredith Drive,
The letter discussed during the meeting was incorrect,saying that the border was I mile north of Meredith,
Motion and second by Councilmen Peard and Gruber to receive file,Ayes:Peard,Gruber,Johnson,Watts,
Nays:None,Motion carried 4-0,
12)Resolution:Approving title change and compensation package for Joshua Smith
)Joshua Smith has moved into the Deputy City Administrator position
because this position more accurately reflects the tasks Smith performs,His salary will be equal to the
Police Chief and Director of Public Works as of July 1,2001.A $3000 bonus is also payable on July 1.
Jim Phillips,!!!!!!!!Bel Aire,asked why there was no probationary period for Smith,Councilman Peard
answered that since this was a promotion and not a new hire,that none was necessary.Mary White,
!!!!!!!!!1!,asked how much of an increase this salary would be from the previous person in this position.
City Administrator Arentsen answered that Smith's salary would be higher but not significantly when the
previous employees overtime is included,Smith will not be eligible for overtime pay,Motion by
Councilman Watts to approve the title change and compensation package,Second by Councilman Gruber.

RESOLUTION 00-134
RESOLUTION APPROVING THE TITLE CHANGE AND COMPENSATION PACKAGE FOR
JOSHUA SMITH
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized municipal corporation;
and
WHEREAS,Joshua Smith has taken the position of Deputy City Administrator to allow for the hiring of
Jody Gunderson as the Director of Community Development;and
WHEREAS,this position more accurately reflects Smith's value and expertise to the City;and I

WHEREAS,this position carries with it a higher salary than his previous position.Salary will be equal to
that of the Police Chief and Public Works Director effective 7/112001.A $3,000 bonus is also payable on
7/1/2001.
NOW,THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa does
approve the title change and compensation package of Joshua Smith,Deputy City Administrator.

13)Ordinance:Amend Water Rate Ordinance
The Council and Utility Committee have already agreed to lower the
water rates from $5.90 to $5.40 per thousand gallons.This change was budgeted for.This will bring the
ordinance in line with the July lSI change.Councilman Gruber introduced the ordinance,Motion and
second by Councilmen Peard and Gruber to have the first reading in title only.Ayes:Peard,Gruber,Watts,
Jolroson.Nays:None.Motion carried 4-0.Motion and second by Gruber and Peard to waive second and
third readings.Ayes:Peard,Gruber,Watts,Johnson.Nays:None.Motion carried 4-0.Motion and

ORDINANCE NO.2324
AN ORDINANCE TO AMEND SECTION 203.2,PROVIDING FOR WATER RATES
TO BE CHARGED BY THE WATER WORKS OPERATED BY THE CITY OF WAUKEE,
IOWA,BY AMENDING RATES CHARGED FOR WATER USAGE IN EXCESS OF THE
MINIMUM (1,000 GALLONS)TO LOWER SAID RATES FROM $5.90 PER 1,000
GALLONS TO $5.40 PER 1,000 GALLONS
Section 1.Amendment.Section 203.3,Waukee Municipal Code is hereby
amended by deleting from the second subparagraph thereof,"5.90 per 1,000 gallons per month,"
and inserting in lieu thereof,"5.40 per 1,000 gallons per month."so that Section 203.2 shall read:
203.2.Water Rates.Water shall be fumished at the following monthly rates per meter
within the city limits:

A minimum monthly bill of $7.95 shall be charged for zero to 1,000 gallons of metered
water usage per month.IWaterusageinexcessoftheminimum(1,000 gallons)will be charged at a rate of $5.40
per 1,000 gallons per month.
All users outside the city limits of Waukee will be charged $12.00 for zero to 1,000
gallons of metered water usage per month,and $8.63 per 1,000 gallons per month in
excess of the first 1,000 gallons.
Water will not be furnished outside of the limits of Waukee without consent of Des
Moines Water Works.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance
shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the
ordinance as a whole or any section,provision,or part thereof not adjudged invalid or
unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon it final passage,
approval and publication as provided by law.

14)Resolution:Permission to purchase Salt Storage Shed
The DNR reqnires all salt storage sheds be enclosed.$25,000 has been
budgeted for this item and the estimated cost is $24,000.The shed will be 42'by 40'with 8"walls aud two
bays.Motion by Councilman Peard to approve the salt storage facility,second by Councilman Watts.

RESOLUTION 00-135
Approving the Purchase of a Salt Storage Facility From American Shelters for the Amonnt of
$24,000.
WHEREAS,the City of Waukee desiring to be in compliance with the Department of Natural Resources
mandate applicable to salt storage;AND I

WHEREAS,the City is in need of a salt storage facility;AND
WHEREAS,American Shelters of 105 Market Street,Audubon,Iowa has quoted the City a 42 foot by 40
foot covered structure with 8 inch wide,8 foot high walls,2bays with an 8foot center wall,6 inch concrete
floor,6 inch by 30 foot by 42 foot approach,and 216 foot openings with rolling doors;
NOW,THEREFORE BE IT RESOLVED,that the City of Waukee in session this 21"day of August
2000,hereby approves the purchase of a salt storage facility from American Shelters for the Amount of
$24,000.

IS)Resolution:Permission to purchase a skid-steer loader
The workload of the Public Works departments is has begun to strain
curreut available eqnipment.The addition of a skid steer loader will save time and labor for the
department.The Gas Department has $40,000 budgeted for this item and the cost will be $36,514.
Councilman Watts questioned the necessity of the enclosed cab and AlC.John Gibson stated that since the
unit also had heat,these features allowed it to be used more often all year.Motion by Councilman Gruber
and Second by Councilman Johnson to approve the purchase.Ayes:Gruber,Johnson,Peard.Nays:Watts.
Motion carried 3-1.
RESOLUTION 00-136
Approving the Purchase of a Skid-Steer Loader From Capital City Equipment Company for the
Amount of $36,514.
WHEREAS,the City of Waukee desires to purchase a skid-steer loader for the Public Works Department;
AND
WHEREAS,on August 16,2000 the City let bids for a 74 horsepower skit-steer loader;AND
WHEREAS,Capital City Equipment Company of Des Moines,Iowa was low bidder at $36,514;
NOW,THEREFORE BE IT RESOLVED,that the City of Waukee in session this 21"day of August
2000,hereby approves the purchase of a Bobcat Skid-Steer Loader from Capital City Equipment Company
in the amount of $36,514.

A regular meeting of the City Council of the City of Waukee,Iowa,was held at 70'c1ock p.m.on
August 21,2000,at the Waukee City Hall,230 Highway 6,Waukee,Iowa.The Mayor presided and the roll
was called,showing members present and absent,as follows:

The Mayor announced that the Council had previously on the 31 st day of July,2000 set this time
and place for hearing on the proposed Resolution of Necessity covering the Hickman Road Pump Station 1
and Sewer Extension Project,but due to the problem with the timing it was in the best interest of the City to
reschedule the date for hearing.
Council Member Gruber introduced and moved the adoption of the resolution next hereinafter set
out,and seconded by Council Member Johnson.Whereupon,the Mayor put the question upon the motion
and the roll being called,the following named Council Members voted:

17.Reports:
A)Park and Rec Chairman:Councilman Wayne Johnson gave thanks to those who participated in
the recent Comprehensive Planning meeting.
B)Planning and Zoning:Councilman Nick Gruber announced that the next Planning and Zoning
meeting wonld be Tnesday August 24.1

C)City Attorney:Paul Hilscher expressed sadness over the passing of Tom McNulte.
D)Director of Public Works:John Gibson said that bids had heen let for pump equipment for the
Hickman Station.AJso Waukee sigus would be installed soon.
City Administrator:Mark Arentsen introduced Jody Gunderson to the Council and crowd
again and mentioned that Jody's salary would be coming from the budgeted amount for the Finance
Director since Waukee had been unable to hire a qualified individual for this position.Arentsen said that
he would be taking on the fiuauce duties.He let the Council know that Ben Phillips had requested
information regarding the minimum charges on utility bills.Arentsen said that there would be Council
meetings on 8-28 and 9-5 regarding annexation of the Broderick property.
Waukee City Council:Councilman Gruber wondered when Highway 6 was expected to
reopen.It was stated that the completion date is November l.
Councilman Peard offered condolences to the family of Tom McNulte
and requested the City send flowers to the family.He also thanked intern Chad Weaver for his service to
Waukee over the course of the summer.
