1)CALL TO ORDER:The August 28,2000 Waukee City Council Meeting was called to order at
7:00pm
2)ROLL CALL:Roll was taken and the following council members were present:Gruber,
Berger,Watts,Peard and Johnson.Mayor Donald L.Bailey,Jr.was also
present.
3)AGENDA ADDITION/AGENDA APPROVAL:Joshua Smith requested that Resolution #14 be
removed from this agenda.Motion by Gruber,second by Johnson to
approve the agenda addition/agenda approval with the aforementioned
change.
4)CONSENT AGENDA:The consent agenda had the following items on it:
a.APPROVAL OF THE AUGUST 17,2000 CITY COUNCIL MINUTES
b.APPROVAL OF THE AUGUST 21,2000 CITY COUNCIL MINUTES
c.APPROVAL OF THE BILL LIST AND PAYROLL
Mayor Bailey had a question regarding a Sprint PCS cell phone bill that
was attributed to John Gibson.John stated that he did not have a Sprint
PCS phone.Mayor Bailey requested that Mark Arentsen give a report to
himself and the council later that week regarding the cell phone bill.
Motion by Berger,second by Watts to approve the consent agenda.
Ayes:Berger,Watts,Gruber,Peard &Johnson.Nays:None.Motion
carried 5-0.

Mayor Bailey asked if anyone would like to address anything not already
on the agenda.There were no comments from the crowd.

Bailey opened the Public Hearing on the Hickman Trunk Sewer and
Pumping Station Special Assessment process.The Mayor asked if any
written comments had been submitted to the City of Waukee.Arentsen ,I
replied that there had been no written comments.The Mayor then asked if
there were any oral comments regarding the special assessment.Evan
Oster,a representative of Knapp Properties (an area that was being
specially assessed)said that Knapp Properties supported the special
assessment.With no further comments,the Mayor asked for a motion to
close the Public Healing.Motion was made by Gruber with a second from
Johnson to close the Public Healing.Ayes:Gruber,Johnson,Berger,
Watts,and Peard.Nays:None.Motion passed 5-0.
a.Amending Resolution of Necessity for Hickman Trunk Sewer
and Pumping Station Project:The City of Waukee did not act on
this item because there was no need to amend this resolution.
b.Approving Resolution of Necessity for Hickman Trunk Sewer
and Pumping Station Project:A motion was made by Gruber
and a second by Watts to approve this resolution.Ayes:Gruber,
Watts,Berger,Johnson,and Peard.Nays:None.Motion carried

Amending Waukee Sign Ordinance 301.8(5):This ordinance was
introduced by Gruber,Motion by Peard,second by Watts to have the first
reading in title only of this ordinance.Ayes:Peard,Watts,Berger,

Amending Waukee Sign Ordinance 301.8(L):This ordinance was listed
twice,thus it was not acted on as item 13.
Approving Valley Paper Site Plan.This item was removed from the
agenda at the request of the developer.
Approving McDonald's/Amoco Site Plan.The McDonald's/Amoco site
plan was presented to the Waukee City Council by Jim Hileman.Mr.
Hileman stated that McDonald's was excited about coming to Waukee.
He also stated that he had talked with Joshua Smith about using brick
versus split-face block on the wainscoting portion of the building,and that
he was agreeable to do that.Jody Gunderson showed the Waukee City
Council Videotape he had taken of the McDonald's in Centerville,Iowa.
This McDonald's is very similar to the McDonald's that will be built in
Waukee.Councilman Gruber expressed his desire for McDonald's to use
white versus yellow roof lights.Mr.Hileman said that this decision was
made by the owner/operator.Motion by Peard,second by Johnson to
approve the McDonald's/Amoco site plan.Ayes:Peard,Johnson,Gruber,
and Berger.Councilman Watts abstained from voting due to his work
relationship with Jim Staudenmaier,owner of the Amoco portion of the
building.Motion was approved 4-0,with one abstention.
RESOLUTION 00-143
RESOLUTION APPROVING McDONALD'S/AMOCO SITE PLAN
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized municipal corporation;and
WHEREAS,McDonald's/Amoco has submitted a site plan to the Waukee Planning &Zoning Commission;and
WHEREAS,the Waukee Planning &Zoning Commission approved said site plan;and
WHEREAS,the City of Waukee believes that this business will be a good corporate citizen.
NOW,THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa that said site plan is approved.
Passed by tbe City Council of the City of Waukee,Iowa,and approved the 28th of August,2000.

16)RESOLUTION:Approving Sanitary Sewer Easement with Wright Tree Service,Inc.
Mark Arentsen described why the City needed a sewer easement on this property.Mayor Bailey asked
City Engineer Mikelis Briedis if this price was reasonable.Mik stated that it was a good deal for the
City,not only because of price,but because it will facilitate development in the general area.Motion by
Gruber,second by Watts to approve this resolution.Ayes:Gruber,Watts,Berger,Johnson,and Peard.
Nays:None.Motion carried 5-0.
RESOLUTION 00-144
RESOLUTION APPROVING SANITARY SEWER EASEMENT WITH WRIGHT TREE SERVICE,INC.
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized municipal corporation;and
WHEREAS,the City needs an easement for sewer north of Hickman Road;and
WHEREAS,this easement will facilitate development.
NOW,THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa does approve the sanitary
sewer easement with Wright Tree Service,Inc.
Passed by the City Council of the City of Waukee,Iowa,and approved the 28th of August,2000.

Steakhouse)and Offering A Five Year Incremental Tax Abatement
Schedule Pursuant to 427B.3 of the Code of Iowa.
The City of Waukee received a voluntary petition for annexation from GFA Steaks,L.L.c.Motion by

RESOLUTION ASSENTING TO THE VOLUNTARY ANNEXATION OF THE GFA STEAKS,LLC PROPERTY
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly orgauized municipal corporation;and
WHEREAS,there has been presented to the Waukee City Council of said City an Application for Annexation,as required
by Section 368.7,Code of Iowa,as ameuded,executed by GFA Steaks,LLC,the owners of the real estate to be annexed;and
WHEREAS,said real estate lying adjacent to the existing City Limits of the City of Waukee,Iowa;and
WHEREAS,the City of Waukee desires to annex said territory upon the Application heretofore presented.
NOW,THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa as follows:
I.That the Application for Annexation of the GFA Property,LLC as described in Exhibit "A"attached hereto
is hereby approved.
2.That upon acknowledgement by the City Development Board of the Clerk's filing of the map and this
Resolution on the 28'h of Augost,2000 this territory shall thereafter be and become a part of the City of
Waukee.
3.That the City Clerk of Waukee shall forthwith cause this Resolution and the map exbibit attached hereto be
filed with the City Development Board and other filings as required by Section 368.7,Code of Iowa,as
amended.
Passed by the City Council of the City of Waukee,Iowa,and approved the 28'"of August,2000.
