Minutes from the Regular Waukee City Council Meeting of September 11,2000
1.Call to Order:The Regular Meeting of the Waukee City Council Meeting was
called to order at 7:04pm by Mayor Donald L.Bailey,Jr.
2.Roll Call:Mayor Bailey requested roll call-Councilmen Nick Gruber,
Marvin Berger,Mike Watts,Wayne Johnson and Bill Peard were present.
3.Agenda Addition/Agenda Approval:Joshua asked City Attorney Paul Huscher
if he had a chance to review Janet Felt's request forthe city to waive the right
to review plat for Mrs.Felt's property.Paul indicated he had spoken to her
attorney and was familiar with the situation.Motion by Gruber,second by
Watts to approve the agenda as it was presented.Ayes:Gruber,Watts,
Berger,Peard and Johnson.Motion carried 5-0.
4.Consent Agenda:
a.Approval of the August 28,2000 City Council minutes:Mayor Bailey
asked why there were no reports for these minutes.He requested that the
8-28-00 minutes be approved at the 9-11-00 council meeting.(After
review of the 8-28-00 Council Meeting,there were no reports because
there were no reports on the 8-28-00 agenda).
b.Approval of the Bill List and Payroll:Payroll was $50,080.23;City bills
$119,123.55;bond sinking funds $54,004.69 -Total for approval:
$223,208.47.Motion by Gruber,second by Watts.Ayes:Gruber,Watts,
Berger,Peard and Johnson.Motion carried 5-0.

5.Open Forum:Joe Schmitt stated that he was pleased with John Gibson
monitoring the traffic at the intersection of Highway 6 &Alice's Road.John
stated that he was in agreement with Mr.Schmitt that a traffic light was
needed at that intersection;however,John noted that the Iowa Department of
Transportation (IDOT)has commented that a traffic light (for now)will not be
installed at that location in the near future.Mayor Bailey directed staff to
write a letter to the mOT asking for a traffic light at that intersection.
6.RESOLUTION:Waiving Right to Review Plat for Janet Felt -Mrs.Felt,a
long-time resident of Waukee,requested that the City of Waukee,pursuant to
354.9(2),Code of Iowa,waive the light to review her subdivision.The
subdivision plat lies outside the boundaries of the City of Waukee,Iowa.
After a careful review by City Attorney Paul Huscher,he concurred and
recommended that the City Council waive the light to review plat for Janet
Felt.The motion was made by Gruber,and seconded by Johnson.Ayes:
Gruber,Johnson,Watts,Peard and Berger.Motion approved 5-0.
7.RESOLUTION:Approving an Annexation Moratorium Agreement between
the City of Waukee and the City of West Des Moines.The City of West Des
Moines requested that the City of Waukee sign an annexation moratorium
agreement with them for the next ten (10)years.The West Des Moines plan
would allow Waukee to annex properties south of Interstate 80,west of R-22,
and north of 340th Trail.Joshua is asking the city staff to reconsider and ask
for property on the East Side of R-22.Motion by Gruber,second by Peard on
approving a draft annexation moratorium agreement between the City of
Waukee and the City of West Des Moines.Ayes:Gruber,Peard,Johnson,
Watts and Berger,Motion carried 5-0.
RESOLUTION 00-148
RESOLUTION ANNEXATION MORATORIUM AGREEMENT BETWEEN THE CITY OF
WAUKEE AND THE CITY OF WEST DES MOINES
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized municipal corporation;
and
WHEREAS,the City of West Des Moines is a good municipal neighhor to the east and south of Waukee;
and
WHEREAS,the City of Waukee feels that agreeing to an annexation moratorium agreement will help both
communities in their capital improvement planning process;and

WHEREAS,the City of Waukee believes this action is an appropriate gesture for future goodwill between
both communities.
NOW,THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa that said
agreement is approved.
Passed by the City Council of the City of Waukee,Iowa,and approved the II rh of September 2000.

8.RECEIVEIFILE:Status of Sidewalks at Waukee State Bank.Waukee State
Bank does not have a sidewalk on their Warrior Lane side.Paul and John
have reviewed the easement that was granted.John and Paul stated they are
going to review the easement further.Mayor Bailey asked when this item will
be placed on the agenda again,because he would like the sidewalks to be
installed before winter.John said this item will be back on the agenda the first
City Council meeting in October.Mark stated that Waukee State Bank has
agreed to install a 6'sidewalk whenever the city asked them to do so.Motion
by Berger,second by Gruber to receive/file this information,Ayes:Berger,
Gruber,Johnson,Peard and Watts.Motion carried 5-0.
9.PUBLIC HEARING:Hickman Road Pumping Station and Sewer Extension.
There were no written or oral comments regarding this agenda item.The
Mayor closed the public healing.
10.RESOLUTION:Awarding Contract for Hickman Road Pumping Station and
Sewer Extension.Forrest Aldrich (Veenstra &Kimm engineer)and John
Gibson stated that KRI Company of Ames was the low bidder at the amount
of $477,142.25.Forrest said they have worked with KRI before and thought
they did a good job.Motion by Watts,second by Peard to approve awarding a
contract to KRI of Ames,Iowa.Ayes:Watts,Peard,Johnson,Gruber and
Berger.Motion carried 5-0.

RESOLUTION A WARDING THE CONTRACT FOR THE mCKMAN
PUMPING STATION AND SEWER EXTENSION TO KRI COMPANY
WHEREAS,THE city of Waukee desiring to construct a Pumping Station and Sewer
Extension at the Hickman Road location for future development;AND
WHEREAS,the City on September 6,2000 let bids for the Pumping Station and Sewer
Extension;AND
WHEREAS,KRI Company was the apparent low bidder at the bid amount of
$447,142.25;
NOW,THEREFORE BE IT RESOLVED,that the City Council of Waukee,Iowa do
hereby award the contract for the Hickman Pumping Station and Sewer Extension to KRI
Company of Ames,Iowa for the amount of $447,142.25 on this nth day of September
2000.

11.MOTION:Authorizing City Staff to Write a Letter to the Valley Shopper
Warning Them of Future Fines for Not Placing their Shopper by Residents'
Front Door.Mayor Bailey said that he has received complaints from residents
who have received the Valley Shopper in their yard and/or street versus their
front door step.The Mayor asked Paul if we could write a litter ordinance
regarding these issues.Paul stated that we could.Mayor Bailey directed City

Staff to write a letter to the Valley Shopper to notify them that we are in the
process of creating a litter ordinance that will address publications being
recklessly delivered to city residents.Peard requested staff to carbon copy
any letter to all publications,including the Des Moines Register and Waukee
Today.Henry Winkler from Valley Shopper stated he was willing to sit down
and discuss issues regarding his publication.Motion was made by Peard,and
seconded by Watts to write a letter to the Valley Shopper warning them of
future fines for not placing their shopper by residents'front door.Ayes:
Peard,Watts,Berger,Gruber and Johnson.Motion passed.
12.ORDINANCE:Amending Waukee Sign Ordinance 301.8(L).Motion by
Gruber,second by Peard to have the second reading in title only.Ayes:

17.RESOLUTION:Approving Valley Paper Site Plan.Valley Paper requested
approval of their site plan to construct a new 50,000 square foot
retail/distribution facility in Waukee.The building they want to construct will
have an approximate valuation of $2,000,000 and will have a brick exterior on
two sides.Motion by Peard,second by Watts to approve Valley Paper site
plan.Ayes:Peard,Watts,Berger,Gruber and Johnson.Motion carried 5-0.
RESOLUTION 00-150
RESOLUTION APPROVING VALLEY PAPER SITE PLAN
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized municipal corporation;
and
WHEREAS,Valley Paper has submitted a site plan to the Waukee Planning &Zoning Commission;and

WHEREAS,the Waukee Planning &Zoning Commission approved said site plan;and
WHEREAS,the City of Wankee believes this business will be a good corporate citizen;and
NOW,THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa that said site
plan is approved.

18.RESOLUTION:Approving Voluntary Petition for Annexation for Phil
Broderick's Property-Gov't Lots 1,2 &3-Section 5 Boone Township.Phil
Broderick,a long-time Waukee resident has requested to annex approximately
140 acres into the City of Waukee.Motion by Gruber,second by Berger to
approve this resolution.Motion by Gruber,second by Berger to approve
voluntary petition for Broderick's property.Ayes:Gruber,Berger,Watts,
Johnson and Peard,Motion carried 5-0.

RESOLUTION ASSENTING TO THE VOLUNTARY ANNEXATION OF PHIL BRODERICK'S
PROPERTY
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a dnly organized mnnicipal corporation;
and
WHEREAS,there has been presented to the Waukee City Council of said City an Application for
Annexation,as required by Section 368.7,Code of Iowa,as amended,executed by Phillip Broderick,the
owner of the real estate to be annexed;and
WHEREAS,said real estate lying adjacent to the existing City Limits of the City of Waukee,Iowa;and
WHEREAS,the City of Waukee desires to annex said territory upon the Application heretofore presented;
and

NOW,THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa as follows:
I.That the Applicatiou for Annexation of the GFA Property,LLC as described in Exbibit
"A"attached hereto is hereby approved.
2.That upon acknowledgement by the City Development Board of the Clerk's filing of the
map and this Resolution on the 28th of August,2000 this territory shall thereafter be and
become a part of the City of Waukee.
3.That the City Clerk of Waukee shall forthwith cause this Resolution and the map exhibit
attached hereto be filed with the City Development Board and other filings as required by
Section 368.7,Code ofIowa,as amended.

19.RESOLUTION:Approving Hickman Road Lift Station Equipment from
Pollution Control Systems.John Gibson requested that to keep the Hickman
Trunk Sewer and Pumping Station moving forward,we had quotations
submitted for pumps and control equipment.V &K reviewed the quotes and
recommend purchasing the equipment from Pollution Control Systems,with
staff concurring.Motion by Gruber,second by Watts to approve buying the
pumps and control equipment from Pollution Control Systems.Ayes:Gruber,
Watts,Johnson,Berger and Peard,Motion carried 5-0.
RESOLUTION 00-152
RESOLUTION APPROVING THE PURCHASE OF THE PUMPS AND
CONTROL EQUIPMENT FOR THE HICKMAN ROAD PUMPING STATION
FROM POLLUTION CONTROL SYSTEMS
WHEREAS,the City of Waukee desiring to construct a Pumping Station at the Hickman
Road location for the purpose of future development in the area;AND

WHEREAS,due to the amount time needed for the ordering and delivery of lift station
equipment;AND
WHEREAS,the City of Waukee desiring to complete the Hickman Pumping Station and
Sewer Extension by the late fall of 2000 has requested quotes for the equipment needed
for completion on time;AND
WHEREAS,the quotes were received on August 11,2000 with Pollution Control
Systems having the apparent low quotation of $38,315;
NOW,THEREFORE BE IT RESOLVED,that the City council of Waukee,Iowa does
hereby approve the purchase of the equipment quoted by Pollution Control Systems in
the amount of $38,315 on the 11th day of September 2000.

20.MOTION:Declaring October 30,2000 as Beggar's Night.At the request of
Chief Phillips,City Staff recommended that Beggar's Night be held on
Monday,October 30,2000 from 6p.m.to 8p.m.Motion was made by Watts,
and seconded by Peard.Ayes:Watts,Peard,Johnson,Gruber and Berger.
Motion carried 5-0.
21.PUBLIC HEARING:For 500,000 Gallon Storage Modification.Mayor
Bailey called the Public Heming for the 500,000 Gallon Storage Modification.
The Mayor asked if there were any written or oral comments.There were
none,so Mayor Bailey closed the public hearing.
22.RESOLUTION:Awarding Contract for 500,000 Gallon Storage Tank
Modification and Coating.After reviewing the situation with City Attomey
Paul Huscher,Forrest (V &K),and John Gibson,the Mayor asked for this item
to be tabled for lack of information on the insurance coverage.Mayor Bailey

asked John Gibson to provide more information regarding insurance whenever
this item is presented again.
RESOLUTION 00-153
RESOLUTION A WARDING THE CONTRACT FOR THE 500,000 GALLON
ELEVATED STORAGE TANK MODIFICATION AND COATING TO
DIVERSIFIED COATING LTD
WHEREAS,the City of Waukee desiring to raise the water pressure in certain parts of
the City has let bids for the modifications and coating of the 500,000 gallon elevated
storage tank;AND
WHEREAS,Diversified Coating Ltd.of O'Fallon,lllinois was the apparent low bidder
with a bid of $491,350 for modifications and coatings;

WHEREAS,the Waukee Comprehensive Plan Committee requested that citizens form a committee to
negotiate a 28E agreement with the Waukee School District;and
WHEREAS,Mayor Bailey deems Marilea Morris,Steve Hobbs,Linda Foltz,Greg Breuer,Renee Herr,

24.RESOLUTION:Approving Economic Development Fair-Play Agreement.
At the urging of Mayor Bailey and Director of Community Development J ody
Gunderson,this resolution was asked to be tabled.Motion by Gruber,second
by Watts to have this resolution tabled.
25.MOTION:Approving Job Description and Salary Range for City Treasurer
Position.Mark submitted a job description and salary range for the City
Treasurer that is being advertised for.The salary range being considered is
$35,000 to $40,000.Motion by Watts,second by Peard to approve the job
description and salary range.Ayes:Watts,Peard,Johnson,Berger and
Gruber.Motion carried 5-0.
26.RESOLUTION:Approving Perpetual Easement Agreement with Storm and
Sanitary Sewer with Ms.Culver.The City needs a perpetual easement for
storm and sanitary sewer.This easement will facilitate economic growth in
that area.Paul Huscher requested that we delete the second sentence in
paragraph six,and make word changes to paragraph 8.Motion by Johnson,

27.REPORTS:
A.Director of Public Works:John reported on the status of the
"old"watertower demolition.He also stated that the city
portion of the entrance signs was completed.
B.Director of Community Development:Jody reported that
he has done extensive work on the Waukee Urban Renewal
area.Mayor Bailey asked him to keep in mind the comp
plan's idea of a highway circumferencing the city.
C.City Attomey:Paul Huscher had correspondence with the
attomey in Florida regarding the Park Ordinance.Paul was
going to review the Park Ordinance himself.
D.City Administrator:Mark reminded everyone that the next
council meeting would be held on 9/18/00.He also
reported that a draft of the Interstate Justification Study for
Alice's Road was completed.He also noted that City
Planner Marty Shukert will be in town on Monday,
9/18/00.

E.City Council:Nick,Bill and Marvin reminded people to
vote at the School Board election.Wayne said the Park
Board was sending out surveys to the vendors from the
Farmer's Market and also a thank you for participating.He
also noted he would be meeting with Regency Builders in
regards to the Laurel Street Park.
F.Mayor:Mayor Bailey discussed future town hall meetings
he would like to have held.He would like the city divided
into four (4)quadrants.Mayor Bailey would like these
held in OctoberlNovember.He wants all citizens to have a
forum to discuss questions/concerns,and he has asked city
staff for their support,
