SEPTEMBER 18,2000
1.CALL TO ORDER:Mayor Pro Tern Wayne Johnson called the September 18,
2000 Waukee City Council meeting to order at 7:02 p.rn.
2.ROLLCALL:
3.OPEN FORUM:
Mayor Pro Tern Johnson asked for roll call.Present were
Gruber,Berger,Johnson,Watts and Peard.MayorBailey
was absent.
Mayor Pro Tern Johnson announced this open forum was
for citizens to address concerns with the City Council over
items that are not on the agenda.Bob Ellis,250 Southview
Drive,had concerns over children on bikes using sidewalks
and not following street rules.Mr.Ellis said bicycle users
should follow the same rules that motorized vehicles use.
City Administrator Mark Arentsen will mention this issue
to Chief Phillips at the Tuesday,September 19,2000
Department Head meeting.Mayor Pro Tern asked for
Chief Phillips to write a summary of what Waukee's
current ordinance(s)are regarding sidewalk and bicycle
usage.
4.AGENDA ADDITION/AGENDA APPROVAL:
5.CONSENT AGENDA:
Director of Community Development Jody Gunderson
asked that item #12,Resolution Approving an Urban
Renewal Plan,be removed from the agenda.Gunderson
stated that the Urban Renewal Plan could be approved at
the same time individual Tax Increment Financing (TIP)
agreements are approved.Rick Ross asked that we have a
discussion on monument signs after agenda item #13.
Councilman Peard stated that we can discuss monument
signs but take no official action on anything that is
discussed.Motion by Gruber,second by Watts to approve
Agenda Addition/Agenda Approval.Ayes:Gruber,Watts,
Peard,Berger,and Johnson.Motion carried 5-0.

Mayor Pro Tern Johnson stated there was a problem with
the Bill List.He stated city payroll was $47,322.77.City
Attorney Paul Huscher said the Bill List could be approved
by the Council with the understanding that a Bill List
would be provided for City Council review before the City
Council minutes are published.Any bills on the Bill List
that the Council had objections on could be delayed for
payment.Mike Watts moved to approve the City
Attorney's suggestion,with Bill Peard seconding the
motion.Mark stated the bill list should be available for
review on September 19,2000.Councilman Berger had
corrections for the September 11,2000 minutes that he
wanted changed.The motion was amended to include
Councilman Berger's corrections,Ayes:Watts,Peard,
Johnson,Berger and Gruber.The entire consent agenda
was approved.

6.MOTION:Appointing Mary Leonard to Library Board of
Trustees.Joe Schmitt,2806 X Avenue stated that Mrs.
Leonard has a background in BankinglFinance regulations.
Motion by Berger,second by Gruber to approve this
motion.Ayes:Berger,Gruber,Watts,Peard and Johnson.
Motion carried 5-0.
7.MOTION:"Authorizing"Dennis Dowell to Attend City Council
Meetings.Councilman Peard requested this agenda item
be placed because on the agenda because he felt it was
important that all department heads attend City Council
Meetings,especially our Code Compliance,due to the high
volume of development issues.Councilman Watts asked
why Dennis was needed at City Council meetings.Watts
stated that we have City Engineer and City Attorney
already present to answer questions.Jim Phillips,240
Belair asked if everyone (indicating City Staff)received
additional money for attending meetings.Councilman
Peard stated that every department head in attendance at
this meeting (Mark Arentsen,Joshua Smith,Jody
Gunderson and John Gibson)are salaried employees and do
not receive overtime benefits.Paul Huscher explained to
Jim Phillips the Fair Labor Standard Act (FLSA)and why
Dennis could not attend the Council meetings on "donated"
time.Councilman Peard and Councilman Watts debated
about the need for having Dennis attend meetings.
Councilman Watts stated that city boards (Utility,Planning
&Zoning,etc.)make recommendations and that the city
should use those recommendations,Councilman Watts
said that Dennis sat in the crowd for his first three (3)
months on City Council and never said a word,and if we
can save $80/month we should.Mark Arentsen said both
arguments had valid points.Rick Ross said that the
meeting tonight was an example of why Dennis should be
here,due to the questions on monument signs.Ed Butler
asked if future council agendas could have construction
items on the beginning of the agenda,and when those items
were finished,Dennis could leave.J ody and Joshua both
agreed that could be a good compromise.Councilman
Peard asked John Gibson his opinion since he worked
intimately with the Code Compliance Department.John
stated Ed's suggestion was a good one.Councilman Watt

asked staffs'recommendation.Jody and Mark reiterated
that Ed Butler's suggestion was an idea they could support.
Councilman Peard asked for a point of order.There was a
discussion of having more detailed Planning &Zoning
reports given to the council.Motion by Gruber,second by
Peard to approve having Dennis Dowell attend City
Council meetings.Ayes:Gruber,Peard,Johnson and
Berger.Nays:Watts.Motion approved 4-1.Steve
Blumenthal asked the council to address why all
department heads do not attend City Council meetings.
8.RECEIVE/FILE:Interchange Justification Report (IJR):
Rick Baumhover from Kirkham Michael was present and
explained that Greg Roth could not attend the meeting.
Baumhover indicated that the DR continued to get bogged
down by traffic numbers they need from the Des Moines
Metropolitan Planning Organization (MPO).Motion by
Berger,second by Watts to ReceivelFile this report.Ayes:
Berger,Watts,Johnson,Peard,and Gruber.
9.RECEIVE/FILE:Letters from the Iowa Finance Authority-RE:Tax
Credit Apartments.Included in the City Council packet
were three (3)letters from the Iowa Finance Authority
indicating they were considering three (3)tax credit
apartments for the City of Waukee.The three complexes
being considered are Sugar Creek Apartments (General
Grant Parkway),Windfield West Apartments (301 Warrior
Lane)and Florence Place Apartments (1310 Florence
Drive).Councilman Gruber asked if these apartments were
the same projects brought before the council before.
Joshua stated yes.Motion by Gruber,second by Berger to
receive/file this information.Ayes:Gruber,Berger,Watts,
Johnson and Peard.Motion carried 5-0.
10.RECEIVE/FILE:Discussion on Locking in Natural Gas Prices for Winter
Delivery.The City's natural gas consultant,U.S.Energy,
has been in regular contact with city staff over the last
several months regarding natural gas future prices.At the
current time winter delivery of natural gas remains high.
U.S.Energy representative Kurt Garst recommends the
City delay locking in winter delivery contracts at this time.
Their projections call for future prices to decline in the next
month or two.Futures prices at this time are over $5.00 per
MMBtu,their highest point in the last ten (10)years.
Councilman Watts inquired about the ability to lock in I

prices for long period of times.John Gibson said prices
could be locked in any time after April 1".Motion by
Berger,second by Gruber to recei ve/file this information.
Ayes:Berger,Gruber,Watts,Peard and Johnson.Motion
carried 5-0.
11.RESOLUTION:Approving Parkview Crossing Plat 2 Construction
Plans.
Veenstra &Kimm provided city staff with a "punch list"of
requirements to be addressed before the project proceeds.
Rick Ross was representing this project and went through
each item individually.Of particular concern was a storm
sewer issue/drainage issue with Lot 73 and ownership of an
adjacent retention pond.City Administrator stressed to
Rick that he would be solely responsible for continuing the
paving of General Grant Parkway.Mr.Ross agreed that he
would finance the road extension.Motion by Gruber,
second by Watts to pass Resolution Approving Parkview
Crossing Plat 2.Ayes:Gruber,Watts,Berger,Peard and
Johnson.Motion carried 5-0.
RESOLUTION 00-156
APPROVING PARKVIEW CROSSING PLAT 2 CONSTRUCTION PLANS
WHEREAS,the City has approved a Preliminary Plat for Parkview Crossing Plat 2 located south of
Rosenkranz Drive and east of General L.A.Grant Parkway,AND,
WHEREAS,the Developer,Jerry's Homes,has submitted construction plans for Parkview Crossing
Plat 2,AND,
WHEREAS,said construction plans have been reviewed by the Public Works Department and City
Engineer.AND,
WHEREAS,the Engineer's recommendations for modifications to said plans have been submitted to
the City and Developer in a letter dated September 14,2000,
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this IS"'day of
September,2000 that it hereby approves the construction plans for Parkview Crossing Plat 2 provided that
all of the recommendations submitted by the City Engineer in their September 14 letter are addressed and
constructed to the City Engineer's satisfaction.

12.RESOLUTION:CREATING AN URBAN RENEWAL AREA FOR
THE CITY OF WAUKEE.This item was tabled.
13.MOTION:AMENDING SIGN ORDINANCE ELIMINATING
PLANNING &ZONING APPROVAL/CITY
COUNCIL APPROVAL FOR MONUMENT SIGNS.
Pursuant to Waukee Municipal Code 301.8(5),any
monument sign must be approved by the City's Code
Compliance officer,Planning &Zoning Commission and
City Council.After reviewing this ordinance with the
City's Code Compliance Officer,the City Staff is
requesting that Dennis have unilateral authority on
approving monument signs.All Councilmembers
supported this agenda item,and a motion was made by
Peard and a second by Gruber to have Paul reword the
Ordinance to reflect the aforementioned change.Ayes:
Peard,Gruber,Watts,Johnson and Berger.Motion passed
5-0.
14.RESOLUTION:APPROVING CONTRACT BONDS AND
CERTIFICATE OF INSURANCE FOR HICKMAN
PUMPING STATION AND SEWER EXTENSION.
KRI Company of Ames,the recommended contractor for
the Hickman Road Sewer Project,has submitted the
required Contract Bonds and Certificates of Insurance.
Paul has reviewed the documents and found them to be in
the form required by the contract specifications and
recommends approval of said contract bonds and certificate
of insurance.Motion by Berger,second by Gruber to
approve resolution.Ayes:Berger,Gruber,Johnson,Watts
and Peard.Motion passed 5-0

free standing,or post signs,by deleting said section,and inserting in lieu thereof the following:
4.One freestanding monument identification sign referring only to a use or uses
conducted on the premises is permitted for each frontage lot,or one sign for each 300 feet of
street,whichever is greater,subject to the following provisions:
A.Such a sign may be attached to the building if it is in compliance with
section 301.18B(3)and each subparagraph thereof;or such sign may be located
within any required yard on a directory sign.
B,The sign may be two-sided,Such sign shall not have a total
surface in excess of one hundred eighty (180)square feet on any side,and not more
than two sides of said sign shall be used for advertising purposes.The maximum
height shall be fifteen (15)feet,and the maximum width shall be twelve (12)feet.
C.The sign must have a brick or stone base that measures at least
15%of the total height.The sign can be entirely or partially surrounded by brick or
stone.The sign portion must not exceed 70%of the total area.The sign portion
must not exceed fifty-four (54)square feet in any case.
D.The sign portion may be constructed of any material,but must
consist only of the name and/or identifying logo of the individual business,building
or complex,and product and/or services being offered.The entire monument may
be in stone or brick with engraved,painted or attached lettering,however,that
portion is still bound by the sign portion size restrictions.
E.Lighting.Signs may be lit internally or externally,but must void
glare or reflection into adjacent property or onto a street or alley creating a traffic
hazard.No exposed neon tube lighting or open light bulbs shall be permitted.
5,Entry Monuments
A commercial development such as an office park or shopping center may erect one (1)
monument with the name of the building,complex or center.To qualify for use of this sign,the
development must be at least forty (40)acres (otherwise the monument identification sign
requirements still apply).The allowable sizes are as follows:

*In areas so designated,the placement and erection of monument SIgns IS restricted to entry
signs placed in the first lot upon entry into a new development,no other exceptions will be
allowed or allowances made.Monument signs within developments are restricted in content
to only allow for the name of the development and such artwork as may be in keeping with
the residential nature of the area in question.The maximum begins at road grade;thus,if the
sign is placed 3'below road grade,then the sign can technically be 18'v.15'in height.

6th STREET INTERSECTION APPROACH TO
HIGHWAY 6.
The City of Waukee had not acquired land for the North 6th
Street approach when Highway 6 was paved.The City has
now purchased land for the approach and would like the
installation of the approach to begin as soon as possible.
The City and Iowa Department of Transportation are
working on an agreement where the City will pay for the
installation of the approach and then deduct that amount
from the money owed to the DOT for the storm sewer
installation on Highway 6.Motion by Berger,second by
Watts to approve the proposal.Ayes:Berger,Watts,

RESOLUTION ACCEPTING THE PROPOSAL FOR PAVING THE NORTH 6TH STREET
INTERSECTION APPROACH TO HIGHWAY 6
WHEREAS,during the construction of Highway 6 the City had not acquired the land for the North 6th
Street intersection;AND
WHEREAS,the City now having purchased the land for the North 6th Street intersection;AND
WHEREAS,Eco-Tech Construction having submitted a proposal of $15,632 to furnish all material,labor,
equipment and supervision required to construct the North 6th Street improvements in accordance with
Iowa Department of Transportation Standard Specifications;

NOW,THEREFORE BE IT RESOLVED,that the City council of Waukee,Iowa do hereby accept the
proposal for the paving of the North 6th Street intersection approach to Highway 6 in the amount of $15,632
on this 18th day of September 2000.

22.REPORTS:
A.Director of Public Works:John discussed
the sidewalk situation on the west of
Warrior Lane,adjacent to Waukee State
Bank.John informed the Council the
sidewalks would be installed soon.
B.Director of Community Development Jody
Gunderson reported he has finished creating
the Urban Renewal area for Waukee and
was looking for feedback from the Council.
C.City Attorney Paul Huscher had no report.
D.Deputy City Administrator reported the
Rube's annexation had been filed with the
Secretary of State in Iowa,and the Senior's
do not want the organ at the Community
Center.
E.City Adtninistrator Mark Arentsen reported
an advertisement for the Treasurer position
was in the Des Moines Register,that checks
were mailed to vendors last week,he wrote
a letter to the IDOT regarding the Alice's
RoadlHighway 6 intersection,and funding
request letters were sent to the Des Moines I

Metropolitan Planning Organization for "V"
Avenue,University Avenue,and Alice's
Road.
F.The City Council had no reports.
G.Mayor Pro Tem Johnson reported that
AT&T Cable had sent a letter to Mayor
Bailey regarding their commitment in
having an 860 mhz broadband cable system
installed by December 2000.
