OCTOBER 2,2000
1)CALL TO ORDER:Mayor Bailey called the October 2,2000 Council Meeting to
order at7:00p.m.
2)ROLL CALL:Mayor Bailey asked for a roll call.Councilmen Nick Gruber,
Marvin Bel](ger,Michael Watts,Bill Peard and Wayne Johnson
were present,as was Mayor Bailey.
3)OPEN FORUM:Mayor Bailey asked for any for any comments not pertaining to
any item on the agenda.Jay Oxenford (No address given)asked
about sidewalks connecting sidewalks on the east side of N.
Warrior Lane and Warrior Lane.Oxenford said that installing
connecting sidewalks will help the Iowa Department of
Transportation install painted crosswalks between the north and
south side of Highway 6.John Gibson will investigate cost
involved for installing sidewalks.Mark said this item will be on
the next City Council agenda.Joe Schmitt (No address given)
said the Waukee entrance signs looked nice.
4)AGENDA ADDITION/AGENDA APPROVAL:
Mayor Bailey asked if there were any agenda additions/agenda
approval.City Staff indicated there were no changes.Motion by
Watts,second by Johnson to approve the agenda as presented.
Ayes:Gruber,Johnson,Berger,Watts and Peard.Motion carried
5-0.
5)CONSENT AGENDA:The Consent Agenda was approved minus the bill list.Motion by
Watts second by Johnson to approve consent agenda minus the bill
list.Ayes:Watts,Johnson,Gruber,Berger,and Peard.The Mayor
requested the bill list not be approved because he had concerns
over the City Hall payment being increased.The rent for City Hall
was $4545.80/month until this month.Greg Judas,the owner of
the building,said a property tax increase increased the City Hall
bill to $5272.17month.Geoff Wearmouth,120 Kaylin Drive
stated that he was present when this lease was approved.
Wearmouth said that he remembered the lease being a Triple-Net
Lease and that taxes would be passed on to City Hall.The Mayor
inquired what a Triple-Net Lease was.Geoff explained that a
Triple-Net Lease requires tenants to pay all utilities,taxes,
insurance,and upkeep of the property.Bill Peard made a motion
to have a special council meeting designated to deal with the City
Hall issue.The motion died with a lack of a second.The Mayor
had questions on several other bills and requested several cell
phone bills to review.Nick Gruber requested that City Staff
review other cell phone packages.

WHEREAS,the City of Waukee Planning &Zoning Commission on September 26,2000
approved the rezoning of said property from A-I to R-2;AND
WHEREAS,the City of Waukee has a need for more residential construction;AND
WHEREAS,the City of Waukee would like to set a Public Hearing Date to consider said
rezoning for November 6,2000.
NOW,THEREFORE BE IT RESOLVED,that the City Council of Waukee,Iowa do hereby
approve setting November 6,2000 as the date for a Public Hearing regarding the rezoning of
Sunrise Meadows Plat 2.

Report on How Many Citizens Receive Minimum Gas Charge if
they Do Not Use Any Natural Gas.Mayor Bailey said he asked
for this agenda item to be placed on the agenda.Mayor Bailey said
he asked for this information two (2)months ago.The Mayor said
he still did not have this report.John Gibson stated that he put a
memo in the Mayor's box on August 21,2000.John went through
the report that he provided the Mayor and City Council on October
2,2000.John said that a minimum charge is needed to cover
administrative costs.There was no motion,thus no action taken on
Agenda Item #9.
Report By Mayor Bailey on Status of Hickman Road/Alice's Road
Intersection:Mayor B ailey read a letter that he wrote Governor
Vilsack and he also read the response that Govemor Vilsack sent
back to him.Mayor Bailey indicated that he has also discussed
this issue with Senator JoAnn Johnson.Motion by Berger,second

Library Fund Raising Report:Joe Schmitt of the Library Board
presented a brief overview of the library fundraising,He
announced that the Library Family will be having a meeting on

Permission to Negotiate With Phil Broderick on Purchasing
Property for the City:The City Council asked the City
Administrator to begin negotiating with Phil Broderick.Several
residents noted that buying property now for municipal projects
will save the City money in the future.Jerry Crow (no address
given)wanted to know how many acres the City was interested in.
The Council did not indicated a specific amount of acreage.
Motion by Peard,second by Gruber to receive/file this report.

Report by Jon Burmeister of Public Financial Management on City
Finances:Mayor Bailey read a letter from Ruan Securities
thanking the city for many years of business.Jon Burmeister of
Public Financial Management,the city's new financial advisor,
gave an in-depth overview of the City's valuations,projected
valuations,and potential tax increases related to bonding for a
library.Motion by Watts,second by Peard to receive/file this
report.Ayes:Watts,Peard,Gruber,Berger and Johnson.
Amending By-Laws for Volunteer Fire/EMS Department:The
Mayor read the amendments for the By-Laws for Volunteer
Fire/EMS Department.The amendments were voted on at the last
Volunteer FirelEMS Department meeting.Mayor Bailey and
Councilman Watts had reservations about the Fire Chief being able
to live outside of the City's corporate limits.Motion by Gruber,
second by Berger to approve this
motion.Ayes:Gruber,Berger,Johnson and Peard.Nay:Watts.
Motion carried 4-1.
Confirming Appointment of Fire Chief The City Council was
asked to confirm the appointment of the Fire Chief.Motion by
Gruber,second by Peard to confirm this motion.Ayes:Gruber,
Peard,Berger,Watts and Johnson.Motion carried 5-0.
Adjusting Date for Second Council Meeting in
November forNovember 27:
City Staff requested the City Council adjust the second City
Council date in November from November 20 to November 27.
Motion by Gruber,second by Johnson.Ayes:Gruber,Johnson,
Berger,Watts and Peard.Motion carried 5-0.
Awarding Contract for 500,000 Gallon Storage Tank Modification
and Coating.Mayor Bailey asked why the City didn't build
another water tower,instead of raising the current water tower.
Engineer Mik Briedis said it was cost prohibitive,and the objective
of raising the current water tower was to increase the water
pressure for all Waukee residents.Motion by Watts,second by
Gruber.Ayes:Watts,Gruber,Johnson,Peard and Berger.

ELEVATED STORAGE TANK MODIFICATION AND COATING TO DIVERSIFIED
COATING LTD
WHEREAS,the City of Waukee desiring to raise the water pressure in certain parts of the City
has let bids for the modifications and coating of the 500,000 gallon elevated storage tank;AND
WHEREAS,Diversified Coating Ltd.of O'Fallon,Illinois was the apparent low bidder with a
bid of $491,350 for modifications and coatings;
NOW,THEREFORE BE IT RESOLVED,that the City Council of Waukee,Iowa do hereby
award the contract for the modifications and coating of the 500,000 gallon storage tank to
Diversified Coating Ltd.,in the amount of $491,350.

Mayor Bailey indicated that it was the City Council's policy not to
exceed three hours for City Council meetings.Motion by Gruber,
second by Johnson to extend the City Council meeting not to
exceed 11 p.m.
18)RESOLUTION:Approving City of Waukee 's Road Use Report and Directing the
City Clerk of the City of Waukee to File the Report with the
Department of Transportation.Mark Arentsen completed the
Road Use Report and gave it to the City CouncillMayor.Mayor
Bailey asked City Staff to certify recent annexations so they would
be included in obtaining road use tax dollars.Motion by Gruber,

RESOLUTION OF THE CITY OF WAUKEE'S ANNUAL ROAD USE REPORT,AND
DIRECTING THE CITY CLERK OF THE CITY OF WAUKEE TO FILE THE REPORT
WITH THE DEPARTMENT OF TRANSPORTATION
WHEREAS,The Waukee City clerk having submitted to the City Council of the City of
Waukee the 2000 Street Finance Report for the City of Waukee,Iowa;AND
WHEREAS,the report shows total Road Use Funds available in the amount of $484,027 and
total expenditures of $337,091 in the Road Use Fund,with an ending Road Use Fund Balance of
$146,936;AND
WHEREAS,the report shows total road use related Funds available from all funds in the
amount of $972,688 and total expenditures in the amount of $824,760;AND
WHEREAS,the City council finds that the funds for road use purposes have been used for their
intended purpose;
NOW,THEREFORE,BE IT ROSOL VED that the City of Waukee hereby approves the Road
Use Report and directs the City clerk to file the same with the Department of Transportation on
this 2"d day of October 2000.

RESOLUTION TO EXTEND TRAFFIC LAWS AND ORDINANCES TO THE PROPERTY OF

WHEREAS,the owner of Midwest Country Estates,Midwest Mobile Home Development Corporation,
Inc.,has requested that the traffic laws and ordinances applicable to Waukee,Dallas County,Iowa,be
extended to its property known as Midwest country Estates,and legally described as:
The Southeast One Quarter (SE '4 )of the Northwest one Quarter (NW '4)of
Section Thirty-four (34)in Township Seventy-nine (79)North,Range Twenty-six
(26)West of the 5th P.M.,and the Northeast One Quarter (NE '4 )of the
Northwest Quarter (NW '4)of Section Thirty-four (34)in Township Seventy-nine

laws,ordinances,rules and regulations to the above-described territory and any persons located on the
real property;and the authority is hereby granted to any peace officer to enforce the vehicular traffic
provisions of Chapter 321,Code of Iowa,or the ordinances,rules,or regulations of the City of Waukee,
as well as any regulations or conditions imposed on the real property pursuant to §321.25l(1),Code of
Iowa.The election made herein shall not create a higher priority for the enforcement of traffic laws on

WHEREAS,during the construction of the Waukee Waste Treatment Plant the chain link fence
was deleted due to cutting cost;AND
WHEREAS,the City of Waukee understanding the danger of people being injured and the
possibility of infectious diseases without a chain link fence around the reed beds;AND
WHEREAS,American Fence Co.having the low proposal to install the chain link fence;
NOW,THEREFORE BE IT RESOLVED,that the City Council of Waukee,Iowa do hereby
approve the installation of a chain link fence surrounding the reed beds at the Waukee Waste
Treatment Plant by the American Fence Co.in the amount of $5,760 on this 2nd day of October
2000.

PrincipalAmount Not to Exceed $475,000.Jon Burmeister discussed the
loan agreement needed to have the Hickman Trunk Sewer installed.
Recommendation was to use Commercial Federal to acquire sewer
revenue bonds.Mayor Bailey requested to see a map of who is being
served with this sewer,and who is paying for the project.Motion by

WHEREAS,the City of Waukee having entered into a contract with M.E.D.A.for the demolition and
disposal of the 50,000 gallon elevated storage tank and 200,000 gallon storage tank on August 7,2000 in
the amount of $46,060;AND
WHEREAS,M.D.E.A.having completed part of the contracted work and requesting partial pay for that
work;AND
WHEREAS,Veenstra &Kimm have reviewed the partial pay estimate and recommend payment in the
amount of $32,547;
NOW,THEREFORE BE IT RESOLVED,that the City Council of Waukee,Iowa do hereby approve
the Partial Pay Estimate No.I to M.E.D.A.for the demolition and disposal of the 50,000 gallon elevated
storage tank and 200,000 gallon ground storage tank in the amount of #32,547 on this 2nd day of
October,2000.

25)REPORTS:
City Department Heads:Jody Gunderson discussed the Urban Renewal area for Waukee.John
Gibson had no report.Joshua Smith talked about having the Waukee
community center cleaned more thoroughly.He was going to talk with
the cleaning company that cleans the center.
City Administrator:Mark Arentsen discussed giving a presentation to the Metropolitan
Business Club on October 3,2000,and talked about an upcoming meeting
with the WRA.
City Council (Committee Reports):There were no reports given by the Waukee City Council,except
for Wayne Johnson discussed about putting the 4th Street area on the
agenda to make it a park,and Bill Peard thanked Geoff Wearmouth for the
entrance signs for the City of Waukee.
Mayor:The Mayor indicated that Police Chief Phillips had distributed his annual
report.Geoff Wearmouth remarked about Crimestoppers doing a good
job.The Mayor did not finish his report due to the late time.
