1.Call to Order:Mayor Pro-Tern Wayne Johnson called the October 23,2000 Special
Council meeting to order at 7:01 p.m.
2.Roll Call:Mayor Pro-Tern Johnson asked for a roll call.Present:Gruber,Johnson,
and Watts.Absent:Berger,Peard.(peard arrived at 7:04 p.m.)
3.Open Forums:No items were presented for Open Forum.
4.Agenda Addition I Agenda Approval:The Agenda Addition I Agenda Approval
was approved with one modification on the City Council Agenda.Item 5 A.was
changed from "Approve Bill List"to "Approve Payroll List".Motion by Gruber,
second by Watts.Ayes:Gruber,Watts,Johnson.Nays:None.Motion carried 3-0.
5.Consent Agenda:Motion by Gruber,second by Watts to approve consent agenda.
6.Mayor's Report:Mayor Pro-Tern Johnson had no report from Mayor Bailey or
himself.
7.Motion:Allowing Waukee Residents to Burn within the City of Waukee.
According to Deputy City Administrator Joshua Smith,the only person that can
unilaterally lift the "bum ban"within the City of Waukee is either the State Fire
Marshall.The City Fire Chief is allowed to issue individual burning permits at his
discretion.Councilman Mike Watts spoke to Fire Chief Mark Schmitt and Chief
Schmitt indicated that he was not willing to issue permits until conditions improved.
There was no action taken on this item.

8.Motion:Distributing Developers'Gas Reimbursements.The City is required by
Ordinance to reimburse developers for gas main installation in subdivisions.Motion
by Watts,second by Gruber to approve motion.Ayes:Watts,Gruber,Johnson and
Peard.Motion carried 4-0.
9.Resolution:Setting Public Hearing for Westgate Business Park Rezoning.Jim
CarnpneylMike Myers requested the City set a Public Hearing date to consider a
rezoning of their Westgate Business Park from A-I to M-l.Jeff Downing,President
of Downing Development,requested why we were willing to do this for Westgate
Business Park,but not his development.Specifically,Downing was referring to a
request made by him on October 6,2000 to have a preliminary plat approved.There
was some confusion at the October 6,2000 meeting over the timing of certain
requests.Motion by Gruber,second by Peard to approve this resolution.Ayes:
Gruber,Peard,Johnson &Watts.Motion carried 4-0.

SETTING PUBLIC HEARING DATE FOR REZONING OF WESTGATE
BUSINESS PARK
WHEREAS,the owner's of Westgate Business Park have reqnested to set a date for a Public Hearing to
consider rezoning of their property;AND
WHEREAS,the City of Waukee has a need for more commercial construction;AND
WHEREAS,the City of Waukee would like to set a Public Hearing Date to consider said rezoning the
Westgate Business Park from A-I to M-IA for November 6,2000.
NOW,THEREFORE BE IT RESOLVED,that the City Council of Waukee,Iowa do hereby approve
setting November 6,2000 as the date for a Public Hearing regarding the rezoning of Westgate Business
Park.
