March 19,2001
Call to Order -The March 19,2001 meeting of the Waukee City Council was called to
order by Mayor Bailey at 7:00PM.The Mayor asked for roll call.
Roll Call -The following members were present;Mayor Donald L.Bailey,JI.and
Council members Nicholas Gruber,Marvin Berger,Mike Walts,Bill Peard and Wayne
Johnson.
Agenda Additions!Approval -A motion was made by Gruber seconded by Berger to
approve the agenda as presented,except to move item 21 to 15A.
Open FOlUm -Mark Currie with Insurance Associates addressed the City Council
regarding the City's insurance package.This report was for information only.The City
Council will have this item to act upon on the APIil 2,2001 meeting.
Mayor Bailey presented Joshua Smith with a Key to the City of Waukee affixed to a
plaque thanking him for his service.

Mayor Bailey called for a roll call vote on the motion to approve the consent agenda.
Ayes;Gruber,Berger,Watts,Johnson,Peard.Nays;none.
Mayor's Report
Mayor Bailey said he attended the Library Foundation Meeting on March io".The
Mayor said that Gene Dluhos passed away this past week.Gene served on the City
Council and will be greatly missed by our community.The Mayor reported that he went
to the Public Hearing at the State Capitol regarding teacher pay and stated that,
"everybody should be aware that I believe we start maintenance employees out at a
higher wage than teachers start at and it's really a sad situation."The Mayor also
reported that he attended the last school board meeting and watched their budget being
developed.The Mayor indicated he attended a lecture on e-govemment.The Mayor also
said that he had a chance to speak with Ed Fallon.
Report on Sidewalk Improvements
After much discussion on sidewalk improvements,there were several ideas presented:
1.Councilman Watts suggested that the City could pay for 75%of the cost of the
installation,and the residents could have the additional 25%waived by providing the
backfill,seed and water.

2.Have a straight 75/25 assessment on all sidewalk installation.
A motion was made by Berger,seconded by Gruber to receive/file this report.The
motion passed unanimously.
Report on Future Capital Improvement Projects
Mark Arentsen presented a list of future capital improvement projects for the City
Council to consider.Mark also presented various financing options for these projects.
Motion by Peard,seconded by Watts to approve the report on future capital improvement
projects.
Report Considering Replacement of 1977 &1980 Fire Trucks
Fire Chief Mark Schmitt was present to discuss the situation he had with two fire trucks
in disrepair.Both trucks are cost prohibitive to fix and maintain he said.Schmitt was
advocating purchasing one truck to replace the other fire trucks,There were several
questions regarding where the money was coming from to replace the trucks and if the
other trucks could be fixed.Motion by Berger,seconded by Peard to approve Chief l

Schmitt to begin looking for another fire truck in the $90,000 range.Motion carried
unanimously.
Report on Commercial Planned Unit Development Along US Highway 6
J ody Gunderson presented a report about potentially creating a Commercial PUD along

Indicating Properties to be Included in the Amended Urban Renewal Area
Jody Gunderson presented a map for the City Council to review regarding additional
properties to be included.The properties to be included include Centennial and Fourth
Street Park,streets on the western side of town and the Greenview Corporate Building.
Mayor Bailey expressed concern about TIP in general and how it would be a problem to
say no to developers who want TIP funding.Motion by Watts,seconded by Gruber to
approve adding the aforementioned properties into the urban renewal area.The motion
passed unanimously.
Approving Letter of Support for the Library Yes Committee
Motion by Gruber,second by Peard to approve letter of support for the Library Yes

Approving Banner Sign on Westwoods Drive for American Fence
American Fence requested that the City allow them to hang a banner sign on a fence
along Westwoods Drive.After much discussion,the City Council believed that it would

this motion.All Councilmen voted nay and the motion was unanimously defeated.

TO FIX A DATE FOR A PUBLICH HEARING ON A LOAN AGREEMENT IN
THE PRINCIPAL AMOUNT OF $700,000
WHEREAS,the City of Waukee,in the County of Dallas,State of Iowa (the "City"),
proposes to enter into a loan agreement (the "Loan Agreement")in the principal amount
of $700,000 pursuant to the provisions of Section 384.24A of the Code oflowa for the
general corporate purpose of paying the cost,to that extent,of acquisition of an office
building for use as a city hall,and the City,being a city having a population of more than
five thousand,desires to institute proceedings to enter into the Loan Agreement for such
general corporate purpose by causing a notice of such proposal to be published,including
notice of the right to petition for an election,under the provisions of Section
384.26(5)(a)(2)of the Code oflowa;
NOW,THEREFORE,Be It Resolved by the City Council of the City of Waukee,Iowa,
as follows:
Section 1.This council shall meet on the 2nd day of April,2001,at the City
Hall,in the City,at 7:00 o'clock PM,at which time and place a hearing will be held and
proceedings will be instituted and action taken to enter into the Loan Agreement.
Section 2.The City Clerk is hereby directed to give notice of the proposed
action on the Loan Agreement setting forth the amount and purpose thereof,the time
when and place where the said meeting will be held by publication at least once not less
than 10 and not more than 20 days before the meeting,in a legal newspaper which has a
general circulation in the City.The notice shall be in substantially the following form:

borrow money in the principal amount of $700,000 for the purpose of paying the cost,to

The Loan Agreement is proposed to be entered into pursuant to authority

Providing for Appropriation of all Funds Acquired for Connections to Sanitary
Sewer Facilities and Water System Facilities in Connection Fee Districts under
Provisions of Chapter 224,Waukee Municipal Code
Paul Huscher created a resolution that appropriated all revenues for connections to sewer
and water facilities to be used exclusively for debt service andlor maintenance of specific
facilities.Mayor Bailey advocated putting additional revenues back into the General
Fund.The Mayor said that taxpayers paid the expenses initially and are due a
reimbursement.Motion by Gruber,second by Peard to table this item until a further
meeting.The motion passed unanimously to tabie this item until a later meeting.

The City Attorney and staff had a few more questions regarding this agreement so the

The City Administrator reported that the Comp Plan meeting was scheduled for March
