MARCH 29,2001
1.Call to OrderlRoll Call-The March 29,2001 meeting of the Waukee City Council
was called to order by Mayor Bailey at 5:00PM.Roll call was taken.Mayor Bailey and
Council members Marvin Berger,Mike Watts and Wayne Johnson were present.Council
members Nicholas Gruber and Bill Peard were absent.Also present were City
Administrator Mark Arentsen,Librarian Linda Mack and Library Board member Joe
Schmidt.
2.Agenda Addition/Agenda Approval-A motion was made by Berger,seconded by
Johnson to approve the agenda as submitted.Motion passed unanimously.
3.Open Forum -Mayor Bailey inquired as to whether anyone present wished to
comment on items not on the agenda.There was no response.
4.RESOLUTION -The Council discussed the proposed Resolution establishing the date
and ballot wording for a $2,000,000 library bond referendum.Linda Mack and Joe
Schmidt asked the Council to eliminate the words and furnishing from the proposed
ballot wording.Library supporters are planning to use the bond proceeds to construct as
much building area as possible.They stated that a separate campaign was being planned
for furnishing the building.Including any reference to furnishing the library as part of
the referendum could lead people to believe that all necessary furnishings were being
provided in the $2,000,000 bond.This could hurt efforts to raise funds for furnishings at
a later date.A motion was made by Watts,seconded by Johnson to approve the proposed
Resolution with the words and furnishing deleted from the referendum ballot wording.
Mayor Bailey called for a roll call vote.Ayes;Watts,Johnson,Berger.Nays;none.
Motion passed.
RESOLUTION NO.01-35
Resolution calling an election on the proposition of issuing general obligation bonds
for construction of a library
WHEREAS,the city of Waukee (the "City")intends to contract indebtedness and
issue general obligation bonds in an amount not exceeding $2,000,000 for the purpose of
constructing,equipping and fumishing a new municipal library (hereinafter referred to as
the "Project")in accordance with the provisions of Chapter 384 of the Code of Iowa;and
WHEREAS,pursuant to Section 384.26 of the Code of Iowa,before the City may
institute proceedings for the issuance of general obligation bonds for the Project,the City
must hold a special election upon the proposition of issuing such bonds and receive a
favorable vote from at least sixty percent of the total votes cast at such special election;
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of
Waukee,Iowa,as follows:
Section 1.A special municipal election is hereby called and ordered to be held
in and for the City,on Tuesday,the 1st day of May,2001,at which there will be submitted
to the voters of the City the following proposition to wit:I
Shall the City of Waukee,in Dallas County,Iowa,issue its bonds in an amount not
exceeding the amount of $2,000,000 for the purpose of paying the cost,to that
extent,of constructing and equipping a new municipal library ?
Section 2,The polls for the said election shall be kept open form 7:00 o'clock
a.m.until 8:00 oclock p.m.
Section 3.The county Commissioner of Elections is hereby authorized and
requested to issue a proclamation and notice of the election on the aforementioned
proposition and of the time and place thereof and to take all other actions necessary
pursuant to state law to conduct the election.
Section 4.All of the foregoing matters are adopted and resolved by this
Council,and the City Clerk is hereby directed to give written notice thereof by submitting
a copy of this resolution at least thirty-two (32)days before the date of the election to the
Dallas County Commissioner of Elections,who has the duty to conduct this election,for
approval,ratification and confirmation to the extent required by Iowa law,and such
County Commissioner of Elections shall signify such approval,ratification and
confirmation and shall order the election to be conducted in the manner set forth herein by
signing the order attached to this resolution.1
Section 5.All resolutions or parts of resolutions in conflict herewith be and
the same are hereby repealed,to the extent of such conflict.

5.Adjournment -A motion was made by Berger,seconded by Watts to adjourn.Motion
passed unanimously.Mayor Bailey declared the meeting adjourned at 5:06PM.
